THE WORKING JOURNALISTS (INDUSTRIAL DISPUTES) ACT, 1955

PREAMBLE

An Act to apply the Industrial Disputes Act, 1947 to working journalists.

BE it enacted by Parliament in the Sixth Year of the Republic of India as follows:--

 

Section 1 - Short title

This Act may be called the Working Journalists (Industrial Disputes) Act, 1955.

Section 2 - Definitions

In this Act--

(a)      "newspaper" has the meaning assigned to it in the Press and Registration of Books Act, 1867 (25 of 1867);

 

(b)      "working journalist" means a person whose principal avocation is that of a journalist and who is employed as such in, or in relation to, any establishment for the production or publication of a newspaper or in, or in relation to, any news agency or syndicate supplying material for publication in any newspaper, and includes an editor, a leader-writer, news editor, sub-editor, feature-writer, copy-taster, reporter, correspondent, cartoonist, news-photographer and proof- reader, but does not include any such person who?

 

(i)       is employed mainly in a managerial or administrative capacity, or

 

(ii)      being employed in a supervisory capacity, exercises, either by the nature of the duties attached to the office or by reason of the powers vested in him functions mainly of a managerial nature.

Section 3 - Act 14 of 1947 to apply to working journalists

The provisions of the Industrial Disputes Act, 1947 (14 of 1947), shall apply to, or in relation to, working journalists as they apply to, or in relation to, workmen within the meaning of that Act.
