West Bengal
Electrical Licensing Rules, 2017
In exercise of the power conferred by sub-section (1) of Section 180 of
the Electricity Act, 2003 (36 of 2003) read with regulation 29 of the Central
Electricity Authority (Measures Relating to Safety and Electric Supply)
Regulations, 2010 and in supersession of the Commerce and Industries Department
Notification No. 3560 MP/IR-4/56,dated the 25th October, 1956,
as subsequently amended by Notification No. 2588 MP, dated the 29th July,
1959, the Governor is pleased hereby to make, with immediate effect, the
following rules, namely:-
Part I
Preliminary
Rule - 1. Title, extent and commencement.
(1)
These
rules may be called the West Bengal Electrical Licensing Rules, 2017.
(2)
They
shall extend to the whole of the State of West Bengal.
(3)
They
shall come into force from the date of publication in the Official
Gazette.
Rule - 2. Definitions.
(1)
In
these rules, unless the context otherwise requires,-
(a)
"Act" means
the Electricity Act, 2003 (36 of 2003);
(b)
"Board" means
the West Bengal Licensing Board (Electrical) constituted under rule 3 for
carrying out the functions mentioned in Rule 6;
(c)
"Chartered
Electrical Safety Engineer" means a person authorized by the
Government of West Bengal in terms of regulation 5A of the Central Electricity
Authority (Measures Relating to Safety and Electric Supply) (Amendment)
Regulations, 2015;
(d)
"Contractor" means
an Electrical Contractor licenced under these rules;
(e)
"Form" means
form appended to these rules;
(f)
"Licence" means
a licence granted to the contractor under these rules;
(g)
"Part" or "Class" means
a subject or field to be qualified for obtaining the Workman's Permit or the
Supervisor Certificate of Competency or the National Supervisor Certificate of
Competency;
(h)
"Permit" means
the permit granted under these rules to the Electrical Supervisors including
the National Certificate of Supervisor and Electrical Workmen;
(i)
"Regulations" means
the Central Electricity Authority (Measures Relating to Safety and Electric
Supply) Regulations, 2010 and the Central Electricity Authority (Measures
Relating to Safety and Electric Supply) (Amendment) Regulations, 2015;
(j)
"Supervisor" means
a person holding either the Electrical Supervisor's Certificate of Competency
or the National Certificate of Supervisor issued under these rules;
(k)
"Workman" means
a person holding an Electrical Workman's Permit issued under these rules.
(2)
Words
and expressions used and not defined in these rules but defined in the Act,
shall have the same meanings as respectively assigned to them in the Act and
the rules and the regulations made thereunder.
Part
II Constitution of Board and its meeting
Rule - 3. Constitution of the Board.
(1)
For the
purposes of granting of licences to Electrical Contractors, Electrical
Supervisor's Certificate of Competency, authorizing Chartered Electrical Safety
Engineer and permitting to National Certificate of Supervisor and Electrical
Workmen, the Board shall be constituted by the Government of West Bengal
consisting of the following members, namely:-
(a)
Officer nominated by the Additional Chief Secretary Secretary/Principal
Secretary to the Government of West Bengal (ex officio), Department of Power
& NES, not below the rank of Joint Secretary. |

Electrical Inspector to the Government of West Bengal. |

(c) A
Deputy Chief Electrical Inspector/Joint Chief Electrical Inspector to the
Government of West ex-officio Bengal to be appointed by the State Government. |

Government of India or his representative who shall be a graduate in

(2)
The
Committee may seek assistance from the Chambers of Commerce, academics, legal
professionals while accomplishing the works assigned to it.
(3)
A
Committee consisting of all the Board Members for taking any decision or policy
of the Board shall be regarded as the Full Board Committee of the Board.
(4)
A
Committee consisting of 1Ard of total Board Members selected by the President
for looking after the works of the Board including examination, granting of
licence or any other works of the Board, shall be regarded as the Working
Committee of the Board.
Rule - 4. Term of office.
The term of office of members other than ex officio members of the Board, shall
be for a period of three years.
Rule - 5. Filling up of casual vacancies.
(1)
If a
member of the Board, leaves the State or is absent for a period of more than
six months, another person may be appointed in his place for the unexpired
portion of his term of office.
(2)
The
Board shall have power to act notwithstanding of any vacancy in its membership.
Rule - 6. Functions of the Board.
The functions of the Board shall be as follows, namely:-
(a)
to grant licences to
approved Electrical Contractors as per rule 36;
(b)
to conduct examinations
for Supervisors and Chartered Electrical Safety Engineer, Electrical Workmen
and National Certificate of Supervisors;
(c)
to grant Certificates of
Competency to Supervisors and permits to Electrical Workman;
(d)
to grant the National
Certificate of Supervisors:
(e)
to authorise the
Chartered Electrical Safety Engineer in terms of regulation 5A of the Central
Electricity Authority (Measures Relating to Safety and Electric Supply)
(Amendment) Regulations, 2015;
(f)
to enquire into
allegations of incompetence, negligence, breach of the provisions of the
Central Electricity Authority (Measures Relating to Safety and Electric Supply)
Regulations, 2010, or malpractice on the part of a Workman, Supervisor,
Contractor or Chartered Electrical Safety Engineer holding a permit, certificate,
licence or Certificate of Authorisation granted by the Board or breach of a
condition of a licence or Certificate of Authorisation on the part of a
Contractor or Chartered Electrical Safety Engineer holding a licence or
Certificate of Authorisation granted by the Board and take such action in
respect of such permit, certificate, license, or Certificate of Authorisation
as may be considered necessary; and
(g)
to maintain a Register
(electronically and manually) of licensed contractors, authorized Chartered
Electrical Safety Engineer and all persons holding Supervisor Certificates of
Competency or Workman's permits and
(h)
to carry out the
provisions of these rules.
Rule - 7. Meetings of the Board.
(1)
The
Board shall meet once in three months and at such other time as may in the
opinion of the President be necessary for transacting business, which cannot be
disposed of by circulation of papers. At least seven days' notice in advance of
all meetings shall be sent to each member.
(2)
Each
non-Government member of the Board is entitled to an honorarium, in terms of
G.O. No. 94-PO/O/IV/1E-64/2012 dated 14.02.2014, as mentioned in Annexure-VI.
Rule - 8. Quorum.
The President and or the Secretary together with 1Ard members shall form a
quorum at any meeting of the Board.
Rule - 9. Chairman of the meeting.
The President or, in his absence, such one of the members present and elected
at the meeting, shall be the Chairman of the meeting.
Rule - 10. Duties of the President.
(1)
The
President shall have the following duties, namely:-
(a)
to preside over all the
meetings of the Board;
(b)
to authorize Chief
Electrical Inspector of the Directorate of Electricity, West Bengal to
accomplish the procedures to grant/or renew licences, permits and
authorizations of Chartered Electrical Safety Engineers;
(c)
to ensure functioning of
the Board as per Act, Rules and Regulations and policies framed by the
Authority.
(2)
The
President may direct the Member-Secretary or any of the officials of
Directorate of Electricity to act for or on behalf of him for the necessities
as required for the Board.
Rule - 11. Duties of the Member Secretary.
(1)
The
Member-Secretary shall have the following duties, namely:
(a)
to oversee the functions
of the designated officers or officials mentioned in rule 6 to verify the
entries and enclosures, submitted by the candidates or applicants or examiners
before placing the same to the Board;
(b)
to place before the
Board all applications received for grant or renewal of licences and other
permits and certificates of Authorisation;
(c)
to place before the
Board all applications received for admission to the examination for
Supervisor, Workman and Chartered Electrical Safety Engineer;
(d)
to carry-out all the
official functions incidental to these rules as directed by the President from
time to time.
(e)
to grant or renew the
licences of the applicants duly cleared by the Board.
(f)
to grant or arrange to
grant Electrical Supervisory Certificate of Competency and Certificate to
Workmen, and to grant or renew, or arrange to grant or renew permits to
applicants duly cleared by the Board;
(g)
to conduct examination
for grant of Certificate of Competency and other certificates;
(h)
to enquire into
violation of any of the provision of these rules on the part of Electrical
Contractors, Supervisors and Workmen and to initiate appropriate action as
decided by the Board.
Part
III Examination conducted by Board
Rule - 12. Examinations, qualification of examiners for Workmen's Permit (W.P) or Certificate of Competency of Supervisors (S.C.C). or National Certificate of Supervisors (N.C.S.) examination and honorarium or remuneration of examiners.
(1)
Examinations
either conventional or on-line shall be held by the Board at such places and on
such dates as may be notified from time to time in the Kolkata Gazette or in
leading newspapers or website of the Department www.wbpower.gov.in.
(2)
Every
examination shall be of such a nature as to test the skill and practical
knowledge of the candidate for ascertaining his competency and the adequacy of
his practical experience to the satisfaction of the Board with the purpose of
granting certificates of competency and permits under the regulations.
(3)
Every
examination shall be conducted in a place having infrastructure where the
candidate's knowledge may be practically tested for skills. Each candidate
shall be tested through viva voce also. Also, online method of
examination may be adopted once it is implemented by the State Government.
(4)
A Board
of Examiners shall be constituted by the Secretary of the Board with
concurrence of the President.
(5)
Every
examiner for the Workman's Permit, Supervisory Certificate of Competency and
National Certificate of Supervisors shall possess a degree in Electrical
Engineering from a recognized University or its equivalent examination from the
institution recognized by the State or Central Government or a Diploma in
Electrical Engineering from the institution recognized by the State Government
and/or have passed National Certificate of Supervisor's Examination in Part I
and II for general or in Part I and III for Mine Installation.
(6)
The
Board shall pay honorarium or remuneration to the examiners for oral and
practical tests for the examination of Supervisor Certificate of Competency and
Electrical Workman's Permit as per the rate as mentioned in Annexure V.
Rule - 13. Application for admission to the examination.
(1)
Every
candidate, for admission to examination for Workman's Permit (W.P.) or
Supervisor Certificate of Competency (S.C.C.), shall make an application in
Form A and shall forward the application duly filled in/on-line ( wherever
applicable) to the Secretary within ten working days after making payment of
fees as prescribed in Annexure-IV through GRIPS (Government Receipt Portal
System), Collection under the Indian Electricity Rules and Electrical
Inspection of Cinemas/Collection under the Central Electricity Authority, CEA
(Measures relating to Safety and Electric Supply), Regulations 2010 along with
Head of Account 0043-00-103-001 -16.
(2)
The
candidate shall submit the following documents with Form A, namely:-
(a)
a self-declaration in
own hand writing certifying ability to read and write in Bengali or Hindi or
Urdu or Nepali;
(b)
testimonials of
practical experience as an Electrical Workman from any Licensed Contractor or
Registered Company;
(c)
electrical workmen's
Permit, if any;
(d)
a BRN receipt in support
of payment of the fee (Annexure-IV); and
(e)
three copies of a recent
photograph (size 50.80 mm X 63.50 mm) all of which shall bear his signature on
the back.
(3)
The
fees paid by a candidate, whose application for admission to an examination has
been accepted, shall not be refunded to him on any account; Amount paid in
excess of prescribed fees shall not be refunded.
(4)
The
Board may allow a candidate, who was prevented from appearing at the
examination to appear at the next examination without further payment. In the
event of a candidate not appearing at the next examination the application will
lapse and the fees will be forfeited.
(5)
The
applications of the candidates who have paid less than prescribed fees shall
not be considered.
(6)
No
application for new or further Workman's Permit will henceforth be entertained
from the candidates attaining the age of 60 years and above. In cases for 60
years and above, production/submission of medical fitness certificate is
mandatory for renewal of Workman's Permit or Licence. However, any Workman's
Permit or Licence of a person is liable to be ceased/canceled upon attaining
his age of 65 years.
Part
IV Permits to Electrical Workmen
Rule - 14. Examination for permits to electrical workmen.
The examination for permits to Electrical Workmen is intended for operative
electrical workmen as distinct from Supervising Electrical Workmen.
Rule - 15. Qualifications.
(1)
Candidates
intending to appear in the examination for permits to Electrical Workmen, shall
possess the following qualifications:-
(a)
in respect of
description mentioned in Parts i(a), i(b) and (ii) of Annexure I,
self-certification regarding working experience for a period of two years;
(b)
in respect of
description mentioned in Parts (vii) and (viii) of Annexure I, permit relating
to high pressure installation work and a valid permit in the corresponding
class or classes (iv) and (v), respectively, pertaining to medium-pressure work
as mentioned in clause (g) of Annexure I;
(c)
in respect of
description mentioned in any other Part of Annexure I, documents or
certificates indicating working experience in operation and maintenance for a
minimum period of two years in Generation, transmission and distribution
companies or electrical installations including factory registered under the
Factories Act, 1948 (63 of 1948) and mines and oil field as defined in the
Mines Act, 1952 (35 of 1952), where more than 250 Kilo Watt (KW) electrical
load is connected/under an electrical contractor licensed under these rules, or
received other electrical training as a workman for a minimum period of two
years which is considered satisfactory by the Board;
(2)
A
candidate for a Workman's Permit shall attain the age not below 20 years as on
date of application.
Rule - 16. Syllabus for examination for permits to electrical workmen.
(1)
Candidates
for examination for permits to Electrical Workman shall comply with the
provisions of rule 13 and shall be examined practically in installation work or
practical test on the subjects mentioned in Annexure I along with an oral test.
(2)
No
applicant shall be entitled to sit in the subsequent examination until and
unless the result of the previous examination is published.
Rule - 17. Grant of Permits to Electrical Workman.
(1)
Every
candidate who qualifies the examination for permits to electrical workmen shall
be granted a permit in Form C in compliance of the provisions of Right To
Public Commission (RTPS) Act, 2013.
(2)
The
Board may, after satisfaction of the fact that the qualifications and practical
experience of any candidate are such as to justify the grant of a Workman's
Permit (W.P) and without requiring any candidate to sit for examination, grant
a permit in Form C to the candidate who has fulfilled the requirements mentioned
in rule 13.
(3)
The
permit granted under sub-rule (2) shall be renewed in every ten years and where
the same is not revalidated at all even within six months from the date of its
expiry, the said license shall be treated as cancelled. The fee for renewal
shall be as mentioned in Annexure IV and shall not be refunded on any account.
(4)
Size
and Format of Form C may be varied in case of Computer printing or in the form
of displayable ID card as decided by the Board.
Rule - 18. Production of Workmen's Permits (W.P.) for inspection and verification.
The Secretary may require production of permits for inspection and verification
and in case of mutilation and/or defacement of or un-authorised entry therein,
the same may be placed before the Board with a report for action as the Board
may deem fit.
Rule - 19. Renewal.
Certificates of Workman Permit (W.P.) shall be renewed after every ten years.
The fee for renewal shall be such as mentioned in Annexure IV and shall not be
refunded in any case:
Provided that when the application for renewal together with the certificate
and the prescribed fee is not received before the date of expiry of the
certificate, a penalty as mentioned in Annexure IV shall be charged for
renewal. Renewal of certificates shall be done online once notified by the
Board.
Rule - 20. Grant of duplicate Certificate or Permit.
(1)
Where
an original Certificate or Permit granted under these rules has been lost or
destroyed; the Secretary may, on application, grant a duplicate in compliance
of relevant provision of Right to Public Services (RTPS) Act, 2013.
(2)
The
grant of duplicate Certificate or Permit shall be done online once notified by
the Board. The charge for such duplicate shall be such as mentioned in Annexure
IV and shall not be refunded in any case.
Part V
Certificate of Competency of Supervisors
Rule - 21. Certificate of Competency of Supervisors.
The examination for certificates of competency of supervisors is intended for
electrical workman who will directly supervise installation work.
Rule - 22. Qualifications for Certificate of Competency of Supervisors.
(1)
Candidates
for the examination for Certificates of Competency of Supervisors shall comply
with rule 13 and such candidate shall have-
(a)
passed Madhyamik
Pariksha or its equivalent examination from any recognised board or council;
(b)
passed the examination
for electrical workman in the corresponding class;
(c)
minimum of 8 (eight)
years of practical experience out of which 2 years as workmen and remaining 6
years in supervising nature of job which is regarded as satisfactory by the
Board; and
(d)
attained minimum age of
26 years of age as on the date of application:
Provided that notwithstanding anything contained in sub-rule (1), the
Board may permit any person for appearing in the examination for Certificates
of Competency of Supervisors:
Provided further that for the purpose of this rule, every candidate who
produces a full technical certificate acceptable to the Board from a school or
college or institution to the effect that he has satisfactorily completed a
course of theoretical and practical electrical installation work or electrical
engineering and who, subsequent to the course of practical work, has completed
two years practical experience in actual electrical installation work, may be
exempted from appearing at the examination:
Provided also that for the purpose of this rule, every candidate who produces a
full Degree or Diploma Certificate in Electrical Engineering acceptable to the
Board from a college or institution and who subsequent to the Degree or Diploma
course has completed one year experience or three years of experience
respectively in the field of domestic wiring upto 250 Volt and industrial
wiring upto 650 Volt, may be exempted from appearing at Supervisor Certificate
of Competency (S.C.C) in Parts 1,2 and 11.
(2)
Degree
or Diploma holders shall have to sit for the oral examination and practical
test for grant of Supervisor Certificate of Competency on application and
payment of requisite fee subject to the condition that the candidates shall
have undergone one year experience corresponding to each additional Supervisor
Certificate of Competency (SCC) Part.
(3)
Any
candidate of advanced age not less than 40 years who has passed any one of-
(a)
Madhyamik pariksha or
its equivalent examination; or
(b)
relevant Part of
Electrical Workman's Permit examination having at least 10 (ten) years of
practical experience which is regarded as satisfactory by the Board, may be
allowed to sit for the oral examination and practical test for grant of
Supervisor Certificate of Competency on application and payment of necessary
fee as mentioned in Annexure IV.
(4)
Relevant
working supervisory experience in generation, transmission and distribution
companies or electrical installations including factory registered under the
Factories Act, 1948 (63 of 1948) and mines and oil field as defined in the
Mines Act, 1952 (35 of 1952), where more than 250 Kilo Watt (KW) of electrical
load is connected or under a licensed electrical contractor, who has sufficient
credentials on execution of related electrical jobs (copies of Work Orders on
execution of relevant electrical jobs shall be produced).
Rule - 23. Examination for Certificate of Competency of Supervisors.
(1)
(a)
Candidates intending to appear in the examination for Certificate of
Competency, shall be examined by oral and practical tests and examination shall
normally be conducted through the medium of the
English/Bengali/Hindi/Urdu/Nepali, as the case may be.
(b) A
candidate may appear or apply for maximum 3 (three) parts at a time.
(c)
After coming into force of these rules, no application for new or further Parts
for Supervisor Certificate of Competency, shall be entertained from the
candidate attaining the age of 65 years. In respect of renewal of such
Certificate, candidate of 65 years shall produce a medical fitness certificate.
However, in any case Supervisor Certificate of Competency of a person is liable
to be ceased/cancelled upon attaining his age of 70 years.
(d)
All the candidates applying for Supervisor Certificate of Competency
(Degree/Diploma) examination including exempted category shall possess the
requisite Degree/Diploma in Electrical Engineering or equivalent from the
institutes or colleges recognized by MHRD or UGC or AICTE.
(2)
For the
purpose of these rules, all electrical installation work shall be divided as
shown under the sub-clause (3). Successful candidates shall be granted a
Certificate of Competency for the installation work and such Certificate as
granted by the Board shall be conclusive proof that they are competent to
supervise.
(3)
The
syllabus of the several Parts of the examination to be passed to qualify for a
Certificate shall be such as set out below and any candidate may appear for
examination for any class of certificate:-

Note
1. - Part 1 is compulsory to all candidates. The
passing of the parts stated above are cumulative and progressive. That is the
candidate must pass in all the-parts and in the sequence shown.
Note
2. - Certificates endorsed for underground cable
work and for work for overhead lines exceeding 250 Volts will be divided into
sections A, B and C which are progressive and cumulative. Certificates granted
to successful candidates will be endorsed to denote the section or sections in
which the candidate has qualified.
(4)
A Board
of examiners shall be constituted by the Secretary of the Board upon
concurrence of the President for the examination of Supervisor Competency
Certificate.
Rule - 24. Syllabus for examination for Certificate of Competency of Supervisors.
(1)
Syllabus
for examination for Electrical Supervisor's Certificate shall be by way of
written/oral test as decided by the Board, covering subjects of relevant Part
as mentioned in Annexure II.
(2)
No applicant
shall be entitled to sit in the subsequent examination until and unless the
result of the previous examination is published. Failure of the same shall not
entitle the candidate to retain necessary Supervisor's Certificate of
Competency (SCC) Part.
Rule - 25. Grant of Certificates of Competency to Supervisors.
(1)
Every
candidate who qualifies the examination as mentioned in rule 23, shall be
granted a Certificate of Competency in Form B:
Provided further that the Board may, without requiring a candidate to
sit for the oral examinations and practical tests, grant a Certificate of
Competency in Parts 1, 2 and 11 in Form B to a candidate who holds a degree or
diploma in Electrical Engineering issued or recognized by the State Government
and has a minimum of one year or three years of requisite practical experience
respectively.
(2)
Size
and Format of Form-B may be varied in case of Computer printing or in the form
of displayable Identity (ID) card as decided by the Board.
Rule - 26. Production of Supervisor's Certificates of Competency for inspection and verification.
The Secretary may require production of certificates for inspection and
verification in case of mutilation and defacement of or unauthorized entry
therein and in such case the same may be placed before the Board with a report
for action as may be deemed fit.
Rule - 27. Renewal of Certificate of Competency of Supervisors.
Certificates of Competency shall be renewed in every ten years and where the
same is not revalidated at all even within six months from the date of its
expiry, the said license shall be treated as cancelled. The licence shall be
deemed to be in suspension from the date of expiry till revalidation and the
same will be treated as invalid on expiry. The fees for renewal shall be such
as mentioned in Annexure IV and shall not be refunded on any account:
Provided that where the application for renewal together with the
certificate and the prescribed fees has not been received before the date of
expiry of such Certificate, a penalty as mentioned in Annexure IV shall be
charged for renewal/revalidation.
Rule - 28. Grant of duplicate for Certificate of Competency of Supervisors.
On being satisfied that an original certificate or permit granted under the
regulations has been lost or destroyed; the Secretary may on application grant
a duplicate. The charge for such duplicate shall be as in Annexure-IV. and
shall not be refunded on any account.
Part
VI National Certificate of Supervisors
Rule - 29. Application for admission to or exemption from examination for National Certificate of Supervisors (N.C.S.).
(1)
Every
candidate for admission to or exemption from the examination for the National
Certificate of Supervisors shall make an application in Form P and forward the
application duly filled in to the Secretary, West Bengal Licensing Board
(Electrical), together with the following documents:
(a)
testimonials of
practical experience in Electrical installation work;
(b)
a true copy of
Electrical Supervisor's Certificate of Competent (S.C.C.) or Electrical
Workman's Permit (W.P.) if any;
(c)
a challan or receipt in
support of payment of the requisite fee (Annexure-IV); and
(d)
three copies of a recent
photograph (size 50.80 mm X 63.50 mm) bearing self-signature or thumb
impression on their back.
(2)
The fee
paid by a candidate as mentioned in Annexure IV, whose application for
admission to the examination has been accepted, shall not be refunded to him on
any case.
Rule - 30. Qualifications for National Certificate of Supervisors.
(1)
Candidates
for the examination for National Certificate of Supervisors shall-
(a)
submit testimonials
relating to Higher Secondary or Diploma in Engineering Disciplines or National
Council for Training in Vocational Trades (NCTVT) or its equivalent from any
recognised board or council; and
(b)
possess approved
practical experience of not less than ten years in electrical installation
work:
(2)
Notwithstanding
anything contained in sub-rule (1) the Board may permit any person for
appearing in the examination for National Certificate of Supervisors.
Rule - 31. Examination for National Certificate of Supervisors.
(1)
The
examination for the National Certificate of Supervisor shall consist of an oral
and practical test carrying 100 marks on following papers:-
(a)
Paper (I) Compulsory:
Electricity-Theory(Elementary knowledge);
(b)
Paper (II) Optional:
Electricity Utilisation-to be taken by the candidates desiring to qualify for
domestic, industrial and other installations;
(c)
Paper(lll)-Optional:
Mines installations-to be taken up by the candidates desiring to qualify for
electrical installations in mines.
(2)
To pass
the examination under the rule, a candidate shall have to secure overall 40%
marks in the oral and practical test combined.
(3)
No
certificate shall be granted unless a candidate passes in Papers (I) and (II),
or Papers (I) and (III) of the common Syllabus. Candidates who have passed in
Papers I and III and desire to qualify for mines installations, shall be
exempted from reappearing in Paper II.
(4)
The
syllabus for the examination for the National Certificate of Supervisor shall
be called the common Syllabus for National Certificate of Supervisor and shall
be as mentioned in Annexure III.
(5)
After
coming into force of these rules, no application for new or further Parts for National
Certificate of Supervisor, shall be entertained from the candidate attaining
the age of 65 years. In respect of renewal of such Certificate, candidate of 65
years shall produce a medical fitness certificate for renewal of National
Certificate of Supervisor (N.C.S). However, in any case National Certificate of
Supervisor's Licence of a person is liable to be ceased/cancelled upon
attaining his age of 70 years.
Rule - 32. Exemptions.
(1)
(a) If
a person has qualified in all the Parts of the Syllabus as mentioned in
Annexure II for Electrical Supervisor except Part 12 thereof and has been
granted Certificate in that behalf, it shall not be necessary for him to sit
for the examination but shall have to satisfy the Board by an interview before
the Working Committee (WC) of the Board. If the Working Committee is satisfied
with the overall knowledge, experience and awareness etc. of the candidate,
such candidate may be granted a National Certificate of Supervisor in Parts I,
II and III of the common Syllabus (National Certificate of Supervisor as
mentioned in Annexure III) on application and payment of necessary fee.
(b) If
a person has qualified in all the Parts of the syllabus as mentioned in
Annexure II for electrical supervisors except Parts 8 and 12 and has been
granted Certificate in that behalf, it shall not be necessary for such
candidate to sit for the examination but shall have to satisfy the Board by an
interview before the Working Committee (WC) of the Board. If the Working
Committee is satisfied with the overall knowledge, experience and awareness
etc. of the candidates, such candidate may be granted a National Certificate of
Supervisor in Parts I and II of the common Syllabus (National Certificate of
Supervisor as mentioned in Annexure III) without any examination, on
application and payment of necessary fee.
(c) if
a person has qualified in all the Parts of the Syllabus as mentioned in
Annexure II for electrical supervisors except Parts 7(c), 9,10 and 12 and has
been granted Certificate in that behalf, it shall not he necessary for such
candidate to sit for the examination but shall have to satisfy the Board by an
interview before the Working Committee (WC) of the Board. If the Working
Committee is satisfied of the overall knowledge, experience and awareness etc.
with the candidates, the candidates may be granted a National Certificate of
Supervisor in Parts I and III of the common Syllabus (National Certificate of
Supervisor as mentioned in Annexure III) without examination, on application
and payment of necessary fee.
(d)
Any candidate holding a Degree in Electrical Engineering from a recognised
University and possessing a minimum experience of 10(ten) years or holding a
Diploma in Electrical Engineering from institution recognised by the State
Government and possessing a minimum experience of 15 (fifteen) years in the
practice of Electrical Engineering approved by the Board, may be exempted from
passing examinations under these rules but shall have to satisfy the Board in
an interview regarding his eligibility for the grant of a National Certificate
of Supervisor on application and payment of necessary fee.
(e)
Any candidate of advanced age not less than 40 years holding a responsible
position in the profession of Electrical Engineering for more than 20 (twenty)
years but without holding any Degree or Diploma from a University or an
institution recognised by the State Government, may be exempted from passing
examination under these rules but shall have to satisfy the Board, in an
interview regarding his eligibility for grant of a National Certificate of
Supervisor, on application and payment of necessary fee.
(f)
Any candidate holding a Supervisor's Certificate of Competency issued by any
other State Government not under the common Syllabus (National Certificate of
Supervisor as mentioned in Annexure III) may be exempted from passing
examination under these rules and such candidate may be granted a National
Certificate of Supervisor after an interview regarding his eligibility, on
application and payment of necessary fee.
(g)
Any candidate holding a Supervisor's Certificate of Competency on common
Syllabus (National Certificate of Supervisor as mentioned in Annexure III)
granted by any other State may be exempted from passing examination under these
rules and may be granted a National Certificate of Supervisor by the Board, on
application and payment of necessary fee for work to be executed within the
State of West Bengal.
(2)
For
supervision of electrical installations below ground in gassy mines, persons
who hold National Certificate of Supervisor in Parts I and III of the common
Syllabus (National Certificate of Supervisor as mentioned in Annexure III)
shall have their certificates endorsed for supervising such installation work
in gassy mines if they can produce evidence to the satisfaction of the Board,
subject to the condition that they have a minimum of six months approved
practical experience of electrical installation work in gassy mines below
ground.
(3)
Any
candidate claiming exemption under this regulation shall be interviewed by the
Board and the said Board shall determine if he shall be fully exempted from appearing
in oral and practical test only.
Rule - 33. Grant of National Certificate of Supervisors.
(1)
Every
candidate who qualifies as required under rule 30, shall be granted a National
Certificate of Supervisor in Form Q.
(2)
The
Board may, after satisfaction of the fact that technical qualifications and
practical experience of the candidate are such as to justify the grant of a
National Certificate of Supervisor without requiring him to sit for
examination, grant a National Certificate of Supervisor in Form Q to any person
who has fulfilled the requirements of rule 29.
(3)
The
Board may, without requiring him to appear in an interview or practical test,
grant a National Certificate of Supervisor in From Q to a person holding a
Degree or Diploma in Electrical Engineering or equivalent qualifications
recognized by the State Government and possessing wide range of experience in
the practice of Electrical Engineering for over 15 years and holding high
technical and managerial position.
(4)
Size
and Format of Form Q may be varied in case of Computer printing or in the form
of displayable ID card as decided by the Board.
Rule - 34. Renewal.
National Certificate of Supervisor shall be renewed after every ten years. The
fee for renewal shall be such as mentioned in Annexure IV and shall not be
refunded on any case and when the application for renewal together with the
certificate and the prescribed fee is not received before the date of expiry of
the certificate, a penalty as mentioned in Annexure IV shall be charged for renewal.
Rule - 35. Grant of duplicate National Certificate of Supervisor.
Where an original certificate has
been lost or destroyed, the Secretary may, on application, grant a duplicate
certificate. The charge for such duplicate shall be such as mentioned in
Annexure IV and shall not be refunded on any case.
Part
VII Licence to Electrical Contractors
Rule - 36. Grant and issue of licence to Electrical Contractors.
(1)
The
Board shall grant the licenses to undertake electrical installation works
initially for a maximum of period of five years to the applicants on fulfilling
the conditions as mentioned in sub-rule (3).
(2)
The
licence shall be effective from the first day of the succeeding month-after the
month in which the application is approved by the Board for granting of such
licence.
(3)
A
licence to the Electrical Contractor shall be granted by the Board-
(a)
to a person or firm who
has in his possession the instrument necessary for carrying out the test for
class or classes of work for which he is engaged under such conditions,
financial stability and instruments as may be mentioned by the board;
and
(b)
to a person or firm
holding a Supervisor's Certificate of Competency for executing or supervising
all works undertaken by such person or firm under such conditions, financial
stability and instruments as may be mentioned by the Board;
or
to a
person or firm employing a Supervisor having a Certificate of Competency and
under whose supervision all works are undertaken by such persons or firm under
such conditions, financial stability and instruments as may be mentioned by the
Board;
(4)
The
Board may, after giving opportunity of being heard, refuse to grant such
license to any person or firm who in the opinion of the Board is not fit to
hold such licence, or has been found guilty of malpractice or negligence in the
business of an electrical contractor.
(5)
A
Licence shall not be granted to the Supervisor so long as he is employed by a
licensed Contractor or as an Electrical Supervisor for carrying out or
supervising electrical installation work under regulation 29 (1) of the Central
Electricity Authority (Measures Relating to Safety and Electric Supply)
Regulations, 2010.
(6)
If the
holder of this license ceases to be in possession of a valid supervisor's
certificate of competency, or ceases to retain in his sole employ at least one
supervisor holding a valid certificate of competency, this license shall be
invalid and if within one month of the license becoming so invalid the
certificate of competency concerned is not revalidated or at least one
supervisor holding a valid certificate of competency is not engaged, the
license shall be deemed to have been cancelled and the holder shall return the
same to the Secretary for cancellation.
Rule - 37. Production of Electrical Contractor's Licenses for inspection and verification.
The Secretary may require production of certificates for inspection and
verification in case of mutilation and defacement of or unauthorized entry
therein and in such case the same may be placed before the Board with a report
for action as may be deemed fit.
Rule - 38. Application for Contractor's License.
(1)
An
application for a Contractor's Licence shall be made to Secretary in Form D.
(2)
Fees
received as mentioned in Annexure-IV along with such applications shall not be
refunded to applicants under any circumstances.
Rule - 39. Form of Contractor's License.
(1)
The
Electrical Contractor's License shall be in Form E and the grant of License is
subject to the conditions as set out therein.
(2)
Size
and Format of Form-E may be varied in case of Computer printing or in the form
of displayable identity (ID) card as decided by the Licensing Board.
Rule - 40. Register of Contractors.
(1)
A
register of all electrical Contractors Licensed under the rules shall be
maintained by the Secretary.
(2)
At the
time of submission of application for New Contractor Licence in Form `D' and
also renewal of the same both Contractor and Supervisor(s) are required to be
present personally in the office of the West Bengal Licensing Board (Electrical)
or at their camp offices, if any and to produce the relevant Supervisor's
Certificate of Competency (S.C.C) Book(s) concerned.
(3)
While
recording his joining in any Contractor's firm the concerned Supervisor(s) are
to be present personally along with Supervisor's Certificate of Competency
(S.C.C) Book in the office of West Bengal Licensing Board (Electrical) or at
their camp office, if any, with the respective Contractor.
(4)
For
making contractor licence more informative, one photograph (official passport
size-colour) of Director or Proprietor or Partner or Secretary or Chairman (of
co-operative) or Power-of-Attorney holder etc. shall be attached duly signed in
back side with every Contractor license in case of new as well as old (old, in
case of renewal).
(5)
For the
betterment of service to the society, the new Contractor's license shall be
checked and at the time of passing or approval of new Contractor licence or new
assignment as the case may be, personal appearance of Contractor and his
Supervisor shall be mandatory before the Working Committee or Full Board of the
Board.
(6)
In case
of Limited companies applying for new Contractor license or modification of
earlier Contractor license to the Board, the concerned Managing Director or
Chairman or Appropriate authority including Companies Secretaries of that
particular company may appear or authorize a person for physical appearance
before the Board. If Managing Director or Chairman or Appropriate authority
including Companies Secretaries appears personally before the Board and the
other directors of that company remain absent, the licence of the concerned
limited company may be issued considering the presence of their Managing
Director or Chairman or Appropriate authority before the Board. Company
Secretaries having accreditation from the Institute of Company Secretaries of
India constituted under the Company Secretaries Act, 1980, may personally
receive the licence on behalf of the company after producing relevant papers.
Note. -
The expression "authorize or authorization", with its grammatical
variation, may include providing authority or authorization by way of
registered Power-of-Attorney to someone of own choice within the jurisdiction
where the concerned notified person resides or works or by way of affirmation
made before the 1st class Judicial Magistrate after affixing photograph of all
the persons concerned.
(7)
In case
of private limited companies applying for new or modified Contractor licence to
the Board and all the Directors cannot manage themselves to appear before the
Board, the licencing Board shall condone such actions on productions of a
resolution of Board of Directors (BOD) of the company authorizing an officer of
the company not below the Company Secretary to appear before the licencing
Board.
Rule - 41. Renewal of Contractor's License.
(1)
Every
Electrical Contractor's license granted under these rules shall be renewed in
every five years'. Applications for renewal together with the license following
documents and prescribed fees as mentioned in Annexure IV, shall be submitted
to the Secretary before the date of expiry of the license. In the event of
failure on the part of a licensed Contractor to renew a licence before the date
of expiry, the licence shall become invalid but may be revalidated with
original registration number on payment of penalty fees as mentioned in
Annexure IV along with an application in Form D. The date of revalidation shall
be the date of last renewal:
Provided that submission of an affidavit before Notary Public as to Supervisors'
sole employment with the Contractor may be considered as an option for the
purpose of renewing of Contractors' licence:
Provided further that applications for renewal of licenses after every five
years shall be made along with the following documents:-
(a)
affirmation of
Supervisor before 1st class Judicial Magistrate or Notary
Public as to their sole engagement or employment with the contractors during
the interim period of five years or period applicable. In case a Company does
not engage supervisor before releasing their registered supervisor, the license
of the said company/Firm will be treated as cancelled and in that case, the
contractor may have to revalidate his license after engaging new supervisor
upon payment of full license fee;
(b)
valid Trade license from
time to time during the interim period of five years;
(c)
test report of the
Directorate of Electricity laboratory or any other appropriate National
Accreditation Board for Testing and Calibration Laboratories (NABL) accredited
laboratory for the Megger, ohm meter, earth tester or insulation tester at the
lime of renewal;
(d)
document evidencing
payment of testing fee as mentioned in Annexure IV for testing of each
instrument (i.e. Megger, earth tester) in Directorate of Electricity
Laboratory.
(2)
Applicants
for new contractor license and its renewal having supervisor's certificate with
Parts for H.V. installation shall possess both 2.5 KV and 1000V or 500 V Meggar
and invariably one earth tester as per Central Electricity Authority, CEA
(Measures relating to Safety and Electric Supply) Regulations, 2010 as
subsequently amended. The Megger or the Earth tester shall be tested by
Directorate of Electricity Laboratory or any other National Accreditation Board
for Testing and Calibration Laboratories (NABL) accredited laboratory at the
time of renewal.
Rule - 42. Grant of duplicate Contractor's License.
A duplicate Licence of an Electrical Contractor granted under this rule shall
be issued only upon payment of fees as mentioned in Annexure IV on
certification of the loss of the original license by the applicant to the
satisfaction of the Secretary of the Board.
Part
VIII Miscellaneous
Rule - 43. On-line Services of West Bengal Electrical Licencing Board.
All Applications related to any Service(s) of the West Bengal Electrical
Licencing Board are to be submitted through on-line system, once it is notified
by the Govt, of West Bengal.
Rule - 44. Procedure for authorization of Chartered Electrical Safety Engineers (CESE).
Procedure for authorization of Chartered Electrical Safety Engineers will be
detailed in the subsequent Rules soon after the Guidelines along with the
eligibility conditions for authorizing the Chartered Electrical Safety Engineer
is framed and issued by the Central Electricity Authority (CEA), Government of
India.
Rule - 45. Report of negligence.
(1)
When in
the opinion of a person licensed under Part II of the Electricity Act 2003, any
work carried out by a contractor licensed under the rules is not in accordance
with the Central Electricity Authority (CEA) Regulations, 2010, as amended, and
such licensed person desires to bring the facts to the notice of the Board, he
shall make a report in writing to the Secretary.
(2)
Further
when in the opinion of a person for whom any electrical installation work is
being or has been carried out and such work is not carried out by a contractor
licensed under the rules is not in accordance with the Central Electricity
Authority (CEA) Regulations 2010 as amended, and such person desires to bring
the facts to the notice of the Board, he shall make a report in writing to the
Secretary.
Rule - 46. Malpractice or infringement of Rules to be reported.
If any person holding an electrical workman's permit or a supervisor's
certificate of competency or National Certificate of Supervisor or Certificate
of Authorization of Chartered Electrical Safety Engineer or an electrical
contractor's license is found by the Board to be guilty of negligence,
misrepresentation or deliberate suppression of facts, incompetence or a breach
of these rules or of the conditions of his license, the Board may suspend or
cancel such permit, certificate, authorization or license. The decision of the
Board shall be final.
Rule - 47. Unauthorized entries, mutilations or defacements of Workmen's permits. Supervisor's certificates of Competency and Electrical Contractor's Licenses.
Any mutilation or defacement of any unauthorized entry in, any workman's pemrit
or Supervisor's Certificate of competency or National Certificate of
Supervisors or Certificate of Authorization of Chartered Electrical Safety
Engineer electrical Contractor's license shall make the permit, certificate,
authorization or license as the case may be, liable to cancellation by the
Board. The decision of the Board in this regard shall be final.
Rule - 48. Electric License to obtain contractor's license.
No electrical installation work shall be carried out by a person licensed under
Part II of the Electricity Act, 2003 on a consumer's premises beyond the point
of commencement of supply unless he has obtained an electrical contractor's
license and employs a staff of supervisors and electrical workmen in compliance
with these rules.
Rule - 49. Release of Contractor or Supervisor or Workman.
A Contractor or Supervisor or Workman's Permit holder may disengage himself or
herself from any company on the fulfillment of the following steps:-
(a)
he or she shall serve a
notice with registered acknowledgement due and the proof thereof shall be
submitted to the Board;
(b)
he or she shall affirm
before the 1st class Judicial Magistrate Affidavit declaring
such disengagement which is to be published in daily newspaper.
Rule - 50. Appeal.
(1)
Any
person aggrieved by the order of the Board, may prefer an appeal within a period
of thirty days from the date of receipt of the order by him before such person
as may be authorized/notified by the State Government.
(2)
The
order of the Appellate Authority in this regard shall be final.
Rule - 51. Savings.
Notwithstanding the supersession of the regulations made by the Government of
West Bengal under Commerce and Industries Department notification No. 3560
MP/IR-4/56 dated the 25th October,1956 and notification No.
2588 MP, dated the 29th July, 1959,-
(a)
all licences or permits granted
under the repealed regulations shall be deemed to be valid till the date of
Expiry, the renewal of which is subject to fulfilling of the conditions of
licenses under these rules;
(b)
all the candidates
declared to have been passed the examination conducted by the Board under the
repealed regulations shall be deemed to have passed the examination under these
rule.
Annexure-I
Syllabus For Workman Permit (W.P)
(See rule 16)
Candidates for examination for permits to electrical workmen shall
comply with Rule 13 and be examined practically in installation work and by an
oral & practical test covering any or all of the following subject and the
permits of successful candidates will contain a reference to one or more of the
classes of wiring referred to in clause (a) to (g) below:-
(a)
Ascertaining the sizes
of wires of solid and stranded conductors.
(b)
Use of test lamps.
(c)
Use of bell and battery
for sorting out circuits.
(d)
Methods of testing polarity
and phasing out circuits.
(e)
Connections and diagrams
for distribution boards, ceiling roses, plugs and sockets, lamp holders,
Alternating (A.C) and Direct Current (D.C) fans with regulators, and switches
(including two-way).
(f)

other domestic consuming devices.

Installation work of the
classes and with the kinds of cables and wires set out below :-

volts. Permits granted to successful candidates shall be endorsed to denote the
section or sections in which the candidate has qualified".
(ii)
The syllabus may be altered, modified or amended from time to time as
considered necessary by the Board.

(1)
The Board reserves the
right to amend, alter, or add to, the undermentioned Syllabuses at any time,
and without notice.
(2)
Candidates are not
expected to have a memorized knowledge of the Central Electricity Authority
(Measures relating to Safety and Electric supply) Regulation, 2010, but they
are expected to be able to apply them and give a reasoned explanation of their
meaning in any particular case, so far as electrical installation work is
concerned. In the examinations they will be permitted to use a copy of the
Regulations.

A candidate must pass ip parts 1, 2, 4, 6A & 7 A before appearing in an
examination for part 8.
Note : (1) Those candidates who desire a certificate for supervising high
pressure work below ground must also qualify in part 5.
Note : (2) Any person who holds a certificate for Mining Installations (Below
ground) shall also be entitled to supervise surface installations of the nature
covered by the syllabus for the parts in which he was qualified.
Note : (3) For the supervision of Electrical installation below ground in gassy
mines, persons who hold certificates for supervising electrical installations
in mines below ground shall have their certificates endorsed for supervising
such installations in "gassy mines" if they can produce satisfactory
evidence that they have a minimum of six months' practical experience of

case any license is not at all renewed beyond six months from the date of its
expiry, then the licence will be treated as cancelled.

a passed candidate desire to qualify, subsequently fora class other than that
for which a certificate or permit has been granted, he will be permitted to
appear in the examination for the parts concerned and will be charged the
additional fee or fees.
Similarly,
those who apply for exemption from the Supervisors' examination and who have
been granted a certificate for one class, or more classes may apply with the
requisite fee for examination in any other additional class or classes.
(ii)
Candidates will be supplied with a copy of the pass list as soon as it is available.
No reply will be issued to applications made before hand, as the information
will be available in the website of the Department www.wbpower.gov.in.
(iii)
Apart from the issue of the pass list no correspondence will be entered into in
respect of the results of the examination
(iv)
All fees for examinations, permits, certificates, contractors' licenses and the
annual renewal thereof, and any other fees leviable under these regulations
shall be paid through GRIPS into a Government Treasury in the State of West
Bengal.

Notes: - (1) The examination fee must be paid through
GRIPS (Government Receipt Portal System) in the State of West Bengal. The fee
for the examination for supervisors is Rs. 800/- (eight hundred) only for only
two parts at a time and Rs. 400/- (four hundred) only for each additional part
thereof and that for the electrical workmen is Rs. 200/-(two hundred) only per
class as set out in clause (1) of Rule 13.
Every application must be accompanied by a Bank Receipt Number (BRN) receipt of
the fee payment.
(2) Three copies o fa recent photograph of the applicant (Size 50.80 mm X 63.50
nun)must accompany the application with the applicant's signature or thumb
impression on the back of each photograph.
(3) Any person making false statements for the purpose of admission to the
examination renders himself liable for prosecution.
(4) Incomplete applications are liable to be rejected.

Conditions
(1)
All
electrical installation work coming within the purview of Regulation 29( I)
& 3(3) of the Central Electricity Authority (Measures relating to Safety
and Electric supply) Regulations, 2010 as amended undertaken by the holder of
this license shall be carried out under the direct super-vision of a person
holding a valid certificate of competency and at least 50 percent of the
electrical workmen employed on any such work shall be in possession of valid
permits issued under Rules 25 & 17 of these Rules.
(2)
The
holder of this license shall maintain a register of supervisors and workmen in
the form below and shall produce the register for inspection on demand by an
Electric Inspector or other person authorised in this behalf by the Licensing
Board.
(3)
Every
contract for electrical installation work coming within the purview of
Regulation 29 (1) of the Central Electricity Authority (Measures relating to
Safety and Electric supply) Regulations, 2010 as amended undertaken by the
holder of this license shall be in writing and he shall be held responsible for
the suitability of materials used. Before commencing any work the value of
which exceeds Rs. 20000/- inclusive of cost of materials and labour charges, he
shall notify the Secretary.
(4)
On the
completion of any electrical install work coming within the purview of
Regulation 29 (1) of the Central Electricity Authority (Measures relating to
Safety and Electric supply) Regulations, 2010 as amended a test report in the
form prescribed by the Board shall be submitted by the holder of this license
to the Secretary. The report shall be signed by the supervisor under whose
supervision the work has been carried out, and countersigned by the holder of
this license who shall be wholly responsible for the due execution of the work.
(5)
If the
holder of this license ceases to be in possession of a valid supervisor's
certificate of competency, or ceases to retain in his sole employ at least on
supervisor holding a valid certificate of competency, this license shall be
invalid and if within one month of the license becoming so invalid the
certificate of competency concerned is not revalidated or at least one
supervisor holding a valid certificate of competency is not engaged, the
license shall be deemed to have been cancelled and the holder shall return the
same to the Secretary for cancellation.
(6)
If the
holder of this license accepts an employment under any other firm or person for
the purpose of carrying out or supervising any electrical installation work
coming within the purview of Regulation 29(1) of the Central Electricity
Authority (Measures relating to Safety and Electric supply) Regulations, 2010
as amended this license shall be invalid and the holder shall return the same
to the Secretary for cancellation.
(7)
This
license shall be invalid if the holder thereof ceases to have in his possession
the instruments necessary for carrying out the tests prescribed for the class
or classes of work upon which he is engaged.
(8)
The
holder of this license shall send intimation to the Secretary of the Licensing
Board in writing within the periods specified below as to every change of- (1)
address of the place of business within two months of such change; (2)
proprietor within seven days of such change; or (3) agent or manager (in case
of a limited company) within seven days of such change and shall also send
similar intimation as to dissolution of partnership within seven days of the
date of such dissolution.
