UTTAR PRADESH SUBORDINATE SERVICES
SELECTION COMMISSION (PROCEDURE AND CONDUCT OF BUSINESS) REGULATIONS, 2015
In exercise of the powers conferred by Sections 16
and 23 of the Uttar Pradesh Subordinate Services Selection Commission Act, 2014
(U.P. Act No. 20 of 2014), the Uttar Pradesh Subordinate Services Selection
Commission, with the prior approval of the State Government, hereby makes the
following regulations.
Regulation - 1. Short title and commencement.
(1) These regulations may be called the Uttar Pradesh Subordinate Services
Selection Commission (Procedure and Conduct of Business) Regulations, 2015.
(2) They shall come into force with effect from the date of their
publication in the Gazette.
Regulation - 2. Definitions.
(1) In these regulations, unless there is anything repugnant in the subject
or the context,
(a) 'Act' means the Uttar Pradesh Subordinate Services Selection Commission
Act, 2014;
(b) 'Allocation' means allocation of business of the Commission among the
Members including the Chairperson according to these regulations;
(c) 'Board' means a board constituted by the Chairperson for the purposes of
holding viva voce test or interview of candidates;
(d) 'Chairperson' means the Chairperson of the Commission;
(e) 'Commission' means the Uttar Pradesh Subordinate Services Selection
Commission constituted under Section 5 of the Act;
(f) 'Committee or sub-committee' means a committee constituted by the
Commission or the Chairperson under Section 8 of the Act;
(g) 'Government' means the Government of Uttar Pradesh;
(h) 'Initiating Member' means the member who proposes a discussion on any
matter or to whom the file is first sent for the opinion or orders in
accordance with the allocation of business;
(i) 'Interview' includes viva-voce or personality test;
(j) 'Member' means a Member of the Commission and includes the Chairperson;
(k) 'Multiple Member Board' means an Interview Board in which more than one
Member is nominated by the Chairperson;
(l) 'Multiple Board' means more than one Board constituted by the
Chairperson for holding interview of candidate for selection of candidates for
appointment to a post;
(m) 'Office' means the Office of the Commission;
(n) 'Officer' means the Officers of the Commission appointed by the State
Government or by the Chairperson;
(o) 'Online Form Submission' means submission of application form by the
candidate to the Commission through the Internet/Computer in the manner
prescribed and publicised by the Commission on its website and/or through
print/electronic media;
(p) 'Secretary' means the secretary of the Commission and includes any other
officer of the Commission authorised by the Chairperson to perform all or any
of functions of the Secretary;
(q) 'Senior Member' in relation to other Member or Members means a Member in
respect of whom the order of appointment by the Governor was issued at an
earlier date and if the date of the order is same, the Member whose name stands
higher in the order of appointment and 'Senior Most Member' means the senior
most member in relation to all other Members generally or among Members present
in a meeting of the Commission or of a Committee or an Interview Board;
(r) 'Single Member Board' means an Interview Board in which only one Member
is nominated by the Chairperson;
(s) 'Staff' means Section Officers and other Officers or officials of the
Commission;
(t) 'Use of Unfair' means copying or receiving or giving assistance during
an Examination or Interview.
(2) Words or expressions used in these regulations not defined but defined
in the Act shall have the meanings respectively assigned to them.
Business to be transacted by Chairperson and Member
Regulation - 3.
(1) The business of the Commission specified in the Schedule shall be
transacted by the Chairperson or the Member, as the case may be.
(2) Notwithstanding any allocation of work made in the Schedule appended to
these regulation, the Chairperson may, if he considers necessary to do so,
direct that any particular matter or business specified in the Schedule be
placed before the Commission for decision.
The Chairperson may refer any matter in respect of
business allocated to him to an individual Member or to a committee as he may
deem fit, for consideration and report to the Commission.
Business before the Commission
Regulation - 4. Meetings.
(1) An ordinary meeting of the Commission shall he held twice in a month:
Provided that if it is not possible to hold two
meetings in any month for unavoidable reasons the Commission may hold one
meeting.
(2) An extraordinary meeting of the Commission may be called by the
Chairperson, in connection with the work allocated to the Commission on any day
at any time, if exigency arises or it in writing.
(3) The Secretary shall prepare the agenda of the meeting and get it
approved by the Chairperson.
(4) The date and time of every meeting shall be fixed by the Secretary after
obtaining prior approval of the Chairperson.
(5) Ordinarily a notice of five days shall be given to the members for the
meeting:
Provided that in the case of an emergent meeting,
notice may be given at any time.
(6) Notices of the meetings shall be issued by the Secretary. The notice of
the meeting shall, as far as possible, be accompanied by a short note
(synopsis) relating to each item on the agenda of the meeting.
(7) The quorum for a meeting shall be one-half of the total number of
members present and voting:
Provided that no quorum shall be necessary for a
meeting adjourned for want of quorum.
(8) The Chairperson may postpone consideration of any business at any
meeting of the Commission, if he considers necessary or expedient to do so.
(9) (i) All decisions of the Commission shall be recorded in a Minutes-Book
which shall be in the personal custody of the Secretary. Members present shall
put their signatures in token of their presence at the top of the record of
proceedings;
(ii) Any Member does not agree on any point of the
decision he may give his dissent or disagreement after all the proceeding have
been recorded specifying the agenda number and the point on which he disagree;
(iii) If a Member abstains from voting or does not
put on his signature the fact shall be recorded in the Minute-Book;
(iv) A copy of each decision shall be placed on the
relevant file or files as case may be;
(v) Copies of all the decision shall be sent to all
the Members and Officers concerned by the Secretary.
Regulation - 5. General procedure.
(1) No proceedings of the Commission shall be invalid only by reason of a
vacancy in the office of a Member or Chairperson or on the ground that a Member
or the Chairperson was absent from the meeting of the Commission.
(2) For convenient transaction of its business, the allocation of work among
the Members shall from time to time be made by the Chairperson.
(3) For convenient and expeditious transaction of its business the
Commission or the Chairperson may constitute a committee or committees from
amongst the Members of the Commission.
(4) The allocation made under the foregoing sub-regulation may be amended or
altered or modified by the Chairperson as and when deemed necessary by him/her.
(5) If the committees are formed the senior most Member shall be the
convener of the committee.
(6) Decision of the commission shall, except in matters in respect of which
the Commission has otherwise directed, be reported promptly to the Commission
for consideration and approval.
Regulation - 6. Procedure for selection of candidates.
(1) The Commission shall make selection of candidates by competitive
examination or by interview or by both through objective or other form of test
in accordance with the provisions of the relevant service rules/regulations.
(2) The Commission may with the prior approval of the Government, hold a
combined competitive examination for a group of posts and may also take a
preliminary test or examination for screening of candidates.
(3) The Commission shall advertise the vacancies through the Print media or
Electronic media or both and invite applications from eligible candidates.
Manner of inviting application forms includes online submission of application
forms through Internet as prescribed by the Commission. Applications received
in response to advertisement shall be scrutinised by the office in the manner
determined from time to time.
(4) In making selection by competitive examination or interview including
preliminary examination or test, the Commission may take recourse to modern
testing aids including the use of computers at one or more stages of selection
viz. the stages of receipt and processing of applications, issue of call
letters, evaluation of answer books, issue of interview letters and processing
of results under the close supervision of one or more officers of the
Commission to be nominated by the Chairperson.
(5) Notwithstanding anything to the contrary contained in relevant Service
Rules or Government orders regarding recruitment, the Commission may hold
preliminary examination/screening test for finding out suitable candidates for
admission to main examination or interview, as the case may be.
(6) Preliminary examination shall mean screening test to be conducted by the
Commission with the purpose of finding out suitable candidates in required
proportion as fixed by the Commission in each category, reserved and unreserved
for admission to the main examination or interview, as the case may be.
(7) Preliminary examination shall be conducted in the manner prescribed in
the Uttar Pradesh Direct Recruitment through Public Service Commission
Preliminary Examination Rules, 1986 as amended from time to time, which is
deemed to be adopted for the said purpose. The marks obtained by the candidates
in the preliminary examination/screening test shall not be counted for
determining final order of merit.
(8) The Commission shall fix the place, dates and time of examination which
includes preliminary examination/screening test and main examination, as the
case may be.
(9) The centres of examinations shall be fixed with prior approval of the
Commission.
(10) All arrangements for such examinations shall be made by the Controller
of Examination cum Joint Secretary in consultation with the Secretary and in
accordance with such directions as may be issued by the Commission in that
behalf.
Regulation - 7. Objective type testing system.
(1) To facilitate the use of computer technique for conducting the
examination, preliminary examination or screening test, the Commission may get
the objective type of question paper-cum-answer sheets prepared by drawing upon
its own Question Bank or through the organisation working in the field of
recruitment or eminent and reliable psychometric institutes, expert bodies or
expert in the field of psychometric education and objective type of question
papers-cum-answer sheets prepared according to the syllabus of different
examinations to be conducted by the Commission.
(2) The Secretary or the Controller of Examination cum Joint Secretary as
nominated by the Chairperson shall draw a list of the reputed and reliable
psychometric institutes, expert bodies and experts of relevant fields including
computer agencies and organisations functional in the field of recruitment, for
the approval of the Commission. Computer agencies shall be required for the
evaluation of answer sheets and compilation of examination results.
(3) The Chairperson may select any one or more among psychometric
institutes, expert bodies and organisations functional in the field of
recruitment or one or more experts as per the requirement of the case from the
list prepared under sub-rule (2) to prepare question paper-cum-answer sheets.
He is free to select any computer agency for the evaluation of answer sheets
and compilation of examination results.
(4) (a) If a particular institute or expert body is selected for preparing
of question papers-cum-answer sheets for a particular examination, the
Secretary or the Controller of the Examination cum Joint Secretary nominated by
the Chairperson shall get prepared three sets of every question paper and
having received them in separate sealed envelopes keep them in his custody.
(b) The Secretary or the Controller of the
Examination cum Joint Secretary nominated by the Chairperson shall submit to
the Chairperson three sealed envelopes in separate identical envelopes
specifically designed for this purpose without making any mark of
identification on the envelopes after having appended his signature thereon at
the place therefor.
(c) The Chairperson may choose any one of the three
sealed and signed envelopes without opening it and handover it to the Secretary
or the Controller of the Examination cum Joint Secretary and keep last two
envelopes in his safe custody till the examination is over.
(d) The Secretary or the Controller of the
Examination cum Joint Secretary nominated by the Chairperson shall send the
sealed envelope so chosen by the Chairperson to the particular institute,
expert body or press, as the case may be, for printing question
paper-cum-answer sheets. Particular institute, expert body or press, as the
case may be, shall be responsible for printing, proof reading and preparation
of their packets for different examination centres as also for Commission's
reserve under its seal in accordance with the direction furnished to it by the
Secretary or the Controller of the Examination cum Joint Secretary.
(5) (i) In case the Chairperson decides to utilise the Question Bank of the
Commission wholly or partly for preparing the question paper, every such paper
or part thereof, as the case may be, shall be prepared by three different
experts.
(ii) In case, the three question papers are wholly
prepared by drawing on the Question Bank of the Commission, the question papers
so prepared shall be sealed in three different identical envelopes which shall
be kept by the Secretary or the Controller of the Examination cum Joint
Secretary nominated by the Chairperson in his safe custody. In case, the three
question papers cannot be prepared wholly by drawing on Question Bank of the
Commission, service of one or more experts will be utilised to prepare three
different sets of part question papers. One set prepared by drawing on Question
Bank and the other two sets prepared otherwise out of Question Bank. These sets
of part question papers shall be handed over to the Secretary or the Controller
of the Examination cum Joint Secretary against signed receipt in sealed
envelopes for safe custody, clearly indicating the part of the syllabus covered
in each set of the part question papers.
(iii) The two sets of question papers so prepared
under clause (ii) shall thereafter be entrusted to different experts or set of
experts, as the case may be, for moderation, after merging the two sets of part
question papers so as to cover the syllabus fully. The expert shall place them
in three separate envelopes under his seal without making any mark of
identification on the envelope and hand them over to the Secretary or the
Controller of the Examination cum Joint Secretary as the case may be.
(iv) The Secretary or the Controller of the
Examination cum Joint Secretary nominated by the Chairperson shall keep each of
the three sealed envelopes in two separate but identical envelopes specifically
designed for this purpose without making any mark of identification on the
envelopes and convey his signatures thereon at the place reserved therefor and
submit the same to the Chairperson.
(v) The Chairperson may choose any one of the three
sealed and signed envelopes without opening it shall hand over the same to the
Secretary or the Controller of the Examination cum Joint Secretary and retain
the other two envelopes in his safe custody till the examinations are over.
(6) (i) In case the Chairperson decides to take the services of an expert
for preparing the question papers, every paper shall be prepared by three
different expert or set of experts and handed over to the Secretary or the
Controller of the Examination cum Joint Secretary as nominated by the
Chairperson.
(ii) Sealed envelopes so received from the experts
shall be handed over by the Secretary or the Controller of the Examination cum
Joint Secretary nominated by the Chairperson to one or more different experts,
as per specific requirement in each case, approved by the Chairperson out of
the list prepared under sub-regulation (2) against their signed and dated
receipt, for moderation.
(iii) The experts shall moderate all the two sets
of question papers, place them in separate envelopes under their seal without
making any mark of identification on the envelopes and hand them over to the
Secretary or the Controller of the Examination cum Joint Secretary as nominated.
(iv) The Secretary or the Controller of the
Examination cum Joint Secretary nominated by the Chairperson shall keep each of
the three sealed envelopes specifically designed for this purpose without
making any mark of identification on the envelopes and append his signatures
thereon at the place reserved therefor and submit the same to the Chairperson.
(v) The Chairperson may choose any one of the three
sealed and signed envelopes without opening it, shall hand over the same to the
Secretary or the Controller of the Examination cum Joint Secretary and retain
the other two envelopes in his safe custody till the examinations are over.
(7) The Secretary or the Controller of the Examination cum Joint Secretary
shall send the envelope so chosen by the Chairperson under clause (v) of
sub-regulation (5) or under clause (v) of sub-regulation (6) to an approved
press which shall be responsible for printing of question paper-cum-answer
sheets including proof reading and for preparing their packet for different
examination centres as also towards Commission's reserves under its seal in
accordance with the information furnished and directions given to it by the
Secretary or the Controller of the Examination cum Joint Secretary.
(8) (i) As per the direction of the Chairperson, Secretary or the Controller
of the Examination cum Joint Secretary shall prepare a list of reliable presses
for printing question paper-cum-answer sheets for the approval of the
Chairperson.
(ii) The Secretary shall choose any one of the
presses approved by the Chairperson under sub-regulation (i) for printing
question paper-cum-answer sheets for any particular examination.
(iii) The officer nominated by the Chairperson
shall have access to the computer agency with a view to ensuring that there is
no mistake in the evaluation of answer sheets and the preparation of results.
(iv) The Chairperson or his nominee will be
associated with the moderation of question.
(v) The institute expert body or the press, as the
case may be, shall be responsible for maintaining the secrecy of the question
papers and the Secretary or the Controller of the Examination cum Joint
Secretary shall issue necessary directions and take necessary precautions to
ensure such secrecy.
Regulation - 8. Subjective type testing system.
Where the Commission decides to conduct competitive
examination or preliminary examination or test on the basis of subjective type
testing system, the procedure for setting of question papers and their
moderation shall be such as mentioned in these regulations.
Regulation - 9.
(1) Every question paper shall be set by three different paper setters, who
do not belong to one and the same place.
(2) Sealed question papers received from the paper setters shall be kept in
the custody of the Secretary or the Controller of the Examination cum Joint
Secretary as per the direction of the Chairperson.
(3) The sealed envelopes, containing question papers received from the three
paper setters, shall be handed over to three different moderators against their
signed and dated receipts.
(4) Each moderator shall moderate the question paper, place it in an
envelope under his seal and hand it over to the Secretary or Controller of the
Examination cum Joint Secretary as may be nominated by the Chairperson.
(5) The Secretary or Controller of the Examination cum Joint Secretary shall
as may be directed by the Chairperson, keep each of the three sealed envelopes
in separate identical envelopes specifically designed for this purpose without
making any mark of identification on the envelopes and append his signature
there on at the place reserved therefor.
(6) The Chairperson may choose any one of the sealed and signed envelope
without opening it and send it as such to the press, which shall be responsible
for printing the question papers including its proof reading and for
preparation their packets for different examination centres under its seal in
accordance with the information furnished and directions given to it by the
Secretary or his nominee.
(7) The press shall be responsible for maintaining the secrecy of the
question papers. The Secretary or Controller of the Examination cum Joint
Secretary shall as nominated, issue necessary direction and take all necessary
precautions to ensure such secrecy.
Regulation - 10. Examination.
No candidate shall be admitted to the examination
unless he has duly applied on the prescribed form in the prescribed manner and
has deposited the prescribed application/examination fee within the prescribed
time.
Conduct of Competitive Examinations
Regulation - 11. Controller of the Examination cum Joint Secretary.
(1) To conduct the examinations of the Commission there shall be a
Controller of the Examination cum Joint Secretary nominated by the Chairperson.
(2) The Controller of the Examination cum Joint Secretary shall, subject to
the provisions of this regulation, exercise such duties and perform such
functions as may be assigned to him under rules and orders related with the
competitive examination conducted by the Commission.
(3) The Controller of the Examination cum Joint Secretary shall be
responsible for proper and timely conduct of such competitive examinations,
including preliminary examinations or tests and for maintaining and ensuing
their reality and secrecy.
(4) Unless otherwise prescribed, all the contracts relating with such examination
shall be in writing and all the documents and records regarding examination
shall be attested by the Controller of the Examination cum Joint Secretary on
behalf of the Commission. All such records shall be put in personal custody of
the Controller of the Examination cum Joint Secretary.
(5) All the arrangements for conducting such examinations shall be made by
the Controller of the Examination cum Joint Secretary in accordance with the
directions issued by the Chairperson.
Regulation - 12. Centre In-charge.
(1) The Commission shall lay down guidelines for the appointment of Centre
In-charge.
(2) The Controller of the Examination cum Joint Secretary shall prepare a
list of persons suitable to be appointed as Centre In-charge in accordance with
guidelines laid down by the Commission and get the approval of the Chairperson
thereon.
(3) The Controller of the Examination cum Joint Secretary shall appoint
Centre In-charge from amongst the persons included in the approved list.
Regulation - 13. Invigilator.
(1) The Commission shall lay down guidelines for appointment of Invigilators
at examination centres.
(2) The Centre In-charge shall prepare a list of the persons suitable to be
appointed as invigilators in accordance with the guidelines laid down by the
Commission. The Centre In-charge shall be responsible for proper arrangements
of invigilation to ensure fair conduct of examination at the centre.
(3) Guidelines for Centre In-charge and the invigilators shall be prepared
and sent by the Controller of the Examination cum Joint Secretary with approval
of the Secretary.
(4) The Commission may formulate guidelines for appointments of invigilator
at centres of examination.
(5) If an invigilator is absent from his duties as such, the matter shall be
reported to the Controller of the Examination cum Joint Secretary, who shall
take steps for exclusion of such invigilator's name from the list and shall
take such other actions as he deems fit.
(6) As soon as the examination with regard to a paper is over and the answer
book has been received, the Controller of the Examination cum Joint Secretary
shall submit a report to the Commission through the Secretary indicating the
number of candidates who have appeared in the examination. The term answer book
shall mean answer sheets also in case of preliminary examination or screening
test.
Regulation - 14. Appointment of paper setters and moderators.
(1) The Secretary or Controller of the Examination cum Joint Secretary as
referred shall with the prior approval of the Chairperson, prepare for every
subject separate lists of persons qualified for appointment as paper setters,
moderators and examiners. The Chairperson may seek assistance of any member.
Such lists shall be revised once in every year:
Provided that a person included in the previous
list shall be eligible for inclusion in the revised list.
(2) The list referred to in sub-regulation (1) shall contain, as far as
possible, information about such persons included therein with regard to their
academic, technical or professional qualifications and research or other experience
and the particulars of the earlier examination conducted by the Public Service
Commission or any other Commission in which they acted as paper setters,
moderators or examiners.
(3) The Secretary or the Controller of the Examination cum Joint Secretary
nominated by the Chairperson shall with the prior approval of the Chairperson,
appoint paper setters, moderators and examiners from amongst the persons
included in the list referred to in sub-regulation (1).
(4) In making such appointment every care shall be taken to ensure that no
person is appointed who has been found guilty of misconduct by the Public
Service Commission, any other Commission, University, State Government or
Government body or against whom any formal disciplinary enquiry or
investigation is pending or whose integrity is in doubt.
(5) Any person whose work as paper setter, moderator or examiner is found to
be unsatisfactory by the Commission shall not be reappointed in any capacity
for that or any other purpose.
Regulation - 15. Interview Board.
(1) The Chairperson shall constitute separate interview boards for different
posts or group of posts for which interview may be held and may constitute more
than one interview board for making selection for one post or group of posts,
where the number of candidates is large.
(2) There shall be at least one member and one expert in an Interview Board
but the Chairperson may, if he thinks fit, include more than one member or more
than one expert in an Interview Board or constitute an Interview Board without
an expert.
(3) The Chairperson may change the constitution of the Interview Board.
(4) The programme of interviews shall be fixed by the Chairperson.
(5) The information for interview shall ordinarily be sent before 21 days to
a candidate by post at the address furnished by him in the application form.
(6) If a Member of an Interview Board is unable to be present the
Chairperson may authorise any other such member to hold the interview in his
place and this fact shall not invalidate the proceedings of such selection.
(7) If a Member of Multiple Member Interview Board is unable to attend or
has to leave the Interview Board during the course of its sitting and an
alternative arrangement is not made then the other remaining Member or Members,
as the case may be the proceedings of the Interview Board shall continue and
the selection made by it shall not be vitiated on the ground that the Member
was absent from the sitting of the board.
(8) In a Multiple Member Interview Board the senior most Member shall
preside.
Regulation - 16. Result of Selection.
The result of the selection shall be pasted on the
notice board of the Commission and also on the website of the Commission. The
result shall also be published in at least two daily Hindi newspapers having
wide circulation in the State of Uttar Pradesh and shall also be commutated in
writing to the Appointing Authority.
Regulation - 17. Selection and appointment of experts.
A panel of experts for different subjects shall be
prepared for assisting the Commission in selection of candidates to different
services or posts within the purview of the Commission with the approval of the
Chairperson by the Secretary or the Controller of the Examination cum Joint
Secretary as the case may be. The panel of experts shall be a confidential
document and shall be kept in safe custody by the Secretary or under his
specific order or direction with the prior approval of the Chairperson by any
officer of the Commission. The panel of experts shall ordinarily remain valid
for a period of one year unless revised/reviewed earlier by the Commission.
Regulation - 18. Payment of remuneration to experts.
Every associate expert attending a selection or
assisting an Interview Board under Section 11 of the Act shall be paid
remuneration and travelling allowance at such rates as may be determined by the
Commission.
Regulation - 19. Penalty.
The Commission may debar any candidate who is found
guilty of using unfair means from appearing in a particular or such subsequent
examinations or tests or interviews. The Commission may also bring the fact of
such penalty to the notice of the requisitioning or appointing authority or
recruiting agency or the State Government.
Regulation - 20. Powers and duties of the Secretary.
(1) The Secretary shall be the head of the office of the Commission and
shall exercise powers and carry out duties thereof in accordance with the
provisions of the Act, the rules, the regulations and the orders and directions
of the Chairperson issued from time to time in connection with the business of
the Commission and for performance of the work of the Commission.
(2) The Secretary shall be the appointing authority of group 'C' and 'D'
employees of the Commission and shall assign duties to and exercise control
over them.
(3) The Secretary shall be responsible for
(i) preparing the annual report of the activities of the Commission for its
approval after obtaining the sanction of the Chairperson. The annual report
approved by the Commission shall be submitted to the Government.
(ii) any other duty entrusted by the Chairperson.
Regulation - 21. Role of the District Administration in conducting Examination.
(1) The Commission shall take the co-operation of the District
Administration as required for the proper conduct of its Written Examination
and Interview to be organised in different Districts of the State and the
District Magistrate, the Superintendent of Police and the Commission, jointly
take necessary measures for the peaceful, free and fair conduct of the
examinations and shall, when required, also make physical inspection of the
examinations and survey of the arrangements.
(2) The Commission shall require the District Magistrate and Superintendent
of Police concerned to ensure that before the examination, the examination materials
of the Commission such as question papers and answer books etc. are kept in the
safe custody of police in the Treasury's strong room under Double Lock and on
the day of examination, they are taken out safely from the Double Lock and
carried to the respective centres and after the examination is over, the answer
books of the candidates are carried in the safe custody of police to the office
of the Commission. Thereafter the Magistrate of the District concerned shall
ensure necessary action and after the completion of the examination, he shall
inform the Commission through fax about the successful completion of
examination.
(3) At least two days before the date of holding the examination, the
concerned District Magistrate shall, through his subordinate Divisional
Officer, survey the arrangement of the examination and on the date of
examination and before it, shall ensure surprise visit/supervision of
examinations are held in a peaceful, free and fair manner and the custody and
safety of question papers and answer books are ensured.
(4) The Commission shall make payments of the rent of schools and buildings
occupied for the examination and of the remuneration to the officers and
employees of the concerned District Administration at the rates fixed by the
Government.
Regulation - 22. Working Hours.
The working hours of the Commission shall be such
as are in the Secretariat but if the official work of the Commission so
warrants, the officers and other employees of the Commission may be called upon
to work before or after office hours without any extra or additional
remuneration.
Regulation - 23. Holidays.
The Commission shall generally observe such
holidays as are observed in the Uttar Pradesh Secretariat subject to the
exigencies of the work of the Commission, the Commission shall also observe
such local holidays as may be determined by the State Government:
Provided that if the work of the Commission so
warrants, the officers and other employees of the Commission may be called upon
to work on one or more of such holidays.
Regulation - 24. Fees.
Every candidate shall be liable to pay to the
Commission such fees for holding an examination, test or interviews as may be
determined by the Commission from time to time with the prior approval of the
State Government.
Regulation - 25. Miscellaneous Provisions.
(1) All decisions and proceedings of the Commission shall, unless otherwise
directed, be kept secret.
(2) Any Member may call for any file, papers or information from the office
through the Secretary:
Provided that examination paper, information
regarding marks obtained by candidates, shall not in any way be called.
(3) The Commission may deal in such manner as they deem fit with any matter
not specifically provided for in these regulations.
(4) If any doubt arises as to the interpretation of these regulations, the
interpretation made by the Commission shall be final.
