PREAMBLE
In
exercise of the powers under clause (c) of sub-section (2) of Section 46 read
with sub-sections (3) of the said section and Section 2 of the Police Act, 1861
(Act No. 5 of 1861) and all other powers enabling him in this behalf and in
supersession of all existing rules or orders issued, in this behalf, the
Governor is pleased to make the following rules with a view to regulating the
selection, promotion, training, appointment, determination of seniority and
confirmation etc. of sub-inspectors and inspectors of the Civil Police in Uttar
Pradesh Police Force.
PART I GENERAL
Rule - 1. Short title and commencement.
(1)
These rules may be called the Uttar Pradesh Sub-Inspector and
Inspector (Civil Police) Services Rules, 2015.
(2)
They shall come into force with effect from the date of their
publication in the Gazette.
Rule - 2. Status of the Service.
The Uttar Pradesh Sub-Inspector
and Inspector (Civil Police) service comprises group 'C' posts.
Rule - 3. Definitions.
In these rules unless there is
anything repugnant in the subject or context,
(a)
'Act' means the Uttar Pradesh Public Services (Reservation for
Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act, 1994 (U.P.
Act No. 4 of 1994) as amended from time to time.
(b)
'appointing authority' means the Deputy Inspector General of
Police;
(c)
'Board' means the Uttar Pradesh Police Service Recruitment and
Promotion Board, established in accordance with Government orders issued from
time to time in this regard;
(d)
'Constitution' means the Constitution of India;
(e)
'Citizen of India' means a person who is or is deemed to be a
citizen of India under Part II of the Constitution of India;
(f)
'Government' means the State Government of Uttar Pradesh;
(g)
'Governor' means the Governor of Uttar Pradesh;
(h)
'Head of the Department' means the Director General of Police,
Uttar Pradesh;
(i)
'Member of Services' means a person appointed to a post in service
under these rules or any previous rules before the commencement of these rules.
(j)
'Other Backward Classes of citizen' means the backward classes of
citizens specified in Scheduled I of the Act;
(k)
'Police Headquarters' means the Headquarters of the Director
General of Police, Uttar Pradesh at Lucknow and Uttar Pradesh Police
Headquarters at Allahabad;
(l)
'Selection Committee' means the Committee duly constituted in
accordance with the provisions of these rules to select candidates for
appointment to the posts in the Services;
(m)
'Service' means the Uttar Pradesh Sub-Inspector and Inspector
(Civil Police) Service;
(n)
'Substantive appointment' means an appointment, not being an ad
hoc appointment, on a post in the cadre of the service, made after selection in
accordance with the rules and, if there were no rules, in accordance with the
procedure prescribed for the time being by executive instructions issued by the
Government;
(o)
'Year of recruitment' means a period of twelve months commencing
on the first day of July of a calendar year.
PART II CADRE
Rule - 4. Cadre of service.
(1)
The strength of the service and of each category of posts therein
shall be such as may be determined by the Government from time to time.
(2)
The strength of the service and of each category of posts therein
shall, until orders varying the same are passed under sub-rule (1), be as given
below:

Provided that;
(i)
the Head of the Department may re-determine the number of posts of
various units within the overall sanctioned allocation.
(ii)
the appointing authority may leave unfilled or the Governor may
hold in abeyance any vacant post, without thereby entitling any person to claim
compensation, or
(iii)
the Governor may create such additional permanent or temporary
posts as he may consider proper.
PART III RECRUITMENT
Rule - 5. Source of recruitment.
Recruitment to the various
categories of posts in the service shall be made from the following sources:
(1)
Sub-Inspector
(i)
Fifty per cent by direct recruitment through the Board.
Note.Dependants of personnel of
police department deceased during service who apply for the post of
Sub-Inspector of Police in the dependant of deceased category shall recruited
by the Board as per the policy decided by the Government. Restriction being
that every year such posts shall not be more than 5 per cent of the posts to be
filled by direct recruitment as against the vacancies arising in the previously
sanctioned posts of Sub-Inspector of Police.
(ii)
Fifty per cent by promotion through the Board on the basis of
seniority subject to the rejection of the unfit from amongst the substantively
appointed Head Constables of Civil Police who have been found successful in
physical efficiency test of qualifying nature and have completed three years of
service as such on the first day of the year of recruitment.
(iii)
Head Constables Civil Police promoted on the ex-cadre posts of
Sub-Inspectors Civil Police who fulfil the requirement mentioned in clause (ii)
shall also be eligible for promotion to the post of Sub-Inspector.
(2)
Inspector
(a)
Hundred per cent of the total number of sanctioned posts of
Inspector civil police shall be filled by promotion by the Board on the basis
of seniority subject to rejection of unfit, from amongst substantively
appointed Sub-Inspectors Civil Police who have completed seven years of service
as such on the first day of the year of recruitment, including the probation
period.
(b)
Sub-Inspectors Civil Police promoted on ex-cadre posts of
Inspector Civil Police who fulfil the requirement mentioned in sub-clause (a)
shall also be eligible for promotion to the post of Inspector Civil Police.
Rule - 6. Reservation.
Reservation for the candidates
belonging to the Scheduled Castes, Scheduled Tribes and other categories shall
be in accordance with the provisions of the Act and the Uttar Pradesh Public
Services (Reservation for Physically Handicapped, Dependents of Freedom
Fighters and Ex-Servicemen) Act, 1993 as amended from time to time and the
orders of the Government in force at the time of the recruitment. The
reservation of the National/State level sportsmen shall be in accordance with
the Government Orders in force at the time of recruitment. It is also provided
that physically handicapped person will not be eligible for police services.
PART IV QUALIFICATIONS
Rule - 7. Nationality.
A candidate for direct
recruitment to a post in the service must be;
(a)
a citizen of India; or
(b)
a Tibetan refugee who came over to India before the 1st January,
1962, with the intention of permanently settling in India; or
(c)
a person of Indian origin who has migrated from Pakistan, Burma,
Sri Lanka or any of the East African Countries of Kenya, Uganda and the United
Republic of Tanzania (formerly Tanganyika and Zanzibar) with the intention of
permanently settling in India:
Provided that a candidate
belonging to category (b) or (c) above must be a person in whose favour a
certificate of eligibility has been issued by the Government:
Provided further that a candidate
belonging to the category (b) will also be required to obtain a certificate of
eligibility granted by the Deputy Inspector General of Police, Intelligence
Branch, Uttar Pradesh:
Provided also that if a candidate
belongs to category (c) above, no certificate of eligibility will be issued for
a period of more than one year and the retention of such a candidate in service
beyond the period of one year shall be subject to his acquiring Indian
Citizenship.
Note.A candidate in whose case a
certificate of eligibility is necessary but the same has neither been issued
nor refused, may be admitted to an examination or interview and he may also be
provisionally appointed subject to the necessary certificate being obtained by
him or issued in his favour.
Rule - 8. Academic Qualification.
A candidate for direct
recruitment to the post of Sub-Inspector must possess a Bachelor's degree from
a University established by law in India or a qualification recognized by the
Government as equivalent thereto. It is also provided that only those
candidates shall be eligible for direct recruitment, who have obtained fifty
per cent or more marks in the above mentioned Bachelor's Degree or
qualification recognized by Government as equivalent thereto.
Rule - 9. Preferential Qualification.
Other things being equal a
candidate for direct recruitment shall be given preference who has;
(i)
obtained "O" Level Certificate in Computer from
DOEACC/NIELIT Society;
(ii)
Has served for minimum of two years in Territorial Army; or
(iii)
Has obtained a 'B' Level Certificate of National Cadet Corps;
Note.Above noted preferential
qualification shall carry no marks, but in the event of two or more candidates
having equal marks, candidates with preferential qualifications shall be given
preference in final selection list under Rule 15(g).
Rule - 10. Age.
A candidate for direct
recruitment must have attained the age of 21 years and must not have attained
the age of more than 28 years on the first day of July of a calendar year in
which vacancies for direct recruitment are advertised:
Provided that the upper age limit
in the case of candidate belonging to the Scheduled Castes, Scheduled Tribes
and such other categories may be greater by such number of years as may be
specified in the Act and prevalent Government Orders applicable at the time of
the notification of the vacancies by the Board.
Rule - 11. Character.
The character of a candidate for
direct recruitment to a post in the service must be such as to render him
suitable in all respect for employment in Government Service. The appointing
authority shall satisfy itself on this point.
Note.Persons dismissed by the
Union Government or any State Government or by a Local Authority or by a
Corporation or Body owned or controlled by the Union Government or any State
Government shall be ineligible for appointment to the service. Persons
convicted of an offence involving moral turpitude shall also be ineligible.
Rule - 12. Marital Status.
A male/female candidate who has
more than one wife/husband living or a female candidate who has married a man
already having a wife living shall not be eligible for appointment to a post in
the service:
Provided that the Government may,
if satisfied that there exist special grounds for doing so, exempt any person
from the operation of this rule.
Rule - 13. Physical fitness.
No candidate shall be appointed
to a post in the service unless he is in good mental and bodily health and free
from any physical defect likely to interfere with the efficient performance of
his duties. Before a candidate is finally approved for appointment, he shall be
required to pass an examination by a Medical Board.
Note.The Medical Board shall
examine the candidates for any physical standards prescribed for height, chest
and weight measurement as the case may be and deficiencies such as Knock Knee,
bow-legs, flat feet, varicose veins, distant and near vision, colour blindness
(total or partial), hearing test comprising of Rinne' Test, Webber's Test and
tests for vertigo, speech defects etc., and such other deficiencies as may be
notified by the Government from time to time.
PART V PROCEDURE
FOR RECRUITMENT
Rule - 14. Determination of vacancies.
The appointing authority shall
determine and intimate to the Head of the Department the number of vacancies to
be filled during the course of the year of recruitment as also the number of
vacancies reserved for candidates belonging to Scheduled Castes, Scheduled
Tribes and other categories under Rule 6. The Head of the Department shall
intimate the number of vacancies for both male and female candidates
separately, to the Board and also to the Government. Subsequently the Board
shall notify the vacancies for both male and female candidates separately in
the following manner
(i)
by issuing advertisement in daily Hindi and English newspapers
having wide circulation;
(ii)
by pasting the notice on the notice board of the office or by
advertising through Radio/Television and other Employment newspapers;
(iii)
by notifying vacancies to the Employment Exchange; and
(iv)
by other means of mass communication.
Rule - 15. Procedure for Direct Recruitment to the post of Sub-Inspector.
(a)
Application Form
(i)
A candidate shall fill only one application Form. The Board will
accept only online applications. The application of candidates, who fill more
than one forms, may be rejected by the Board.
(ii)
The details of the information regarding educational
qualification, age, minimum qualifying standards for each category of
examination, including physical, written, medical examination etc., minimum
qualifying marks for written examination subject wise and other important
guidelines as determined by the Board from time to time shall be made available
by the Board on its own website and or by other means as it deems necessary.
(iii)
The applications shall be invited by the Board giving the
applicants adequate time for making application, the candidate shall be
personally and solely responsible for its accuracy and completeness, if the
Form of any candidate is found incomplete, wrong or having inaccurate
information, it may be cancelled and the decision of the Board in this regard
shall be final.
(iv)
An applicant shall certify himself his certificates and documents
and be responsible for their genuineness and correctness.
(v)
In the application form the detail of the identity, specific
identity card number, thumb and finger impression, photographs or bio-metric
details will be so included as may be determine by the Board from time to time.
(vi)
The Head of the Department, in consultation with the Board, may
fix an application fee for any recruitment.
(vii)
The Board shall have the right to summarily reject the candidature
of an applicant for any incompleteness or inaccuracy or variation or conflict
with any previous or subsequent information submitted by the candidate.
(viii) The
Government may change the number of vacancies for any recruitment at any time
before the first examination and may also cancel any recruitment at any time or
stage of recruitment without assigning any reason thereof.
(b)
Call Letters Call letter for candidates shall be uploaded by the
Board on its website at least 7 days before the examination the applicant will
download it and carry it for subsequent examinations.
(c)
Scrutiny of Documents and Medical Examination Candidates whose
applications are found correct, shall be required to appear for scrutiny of
documents and Physical Standard Test. This test will be conducted as per
Annexure 1. In case any document is found to be manipulated, inaccurate or
forged during the scrutiny or at any time after the scrutiny, the candidature
of the applicant will be cancelled at the discretion of the Board or the
Appointing authority as the case may be.
(d)
Physical Efficiency Test Candidates found successful in Scrutiny
of Documents and Medical Examination as per clause (c) will be required to
appear in Physical Efficiency Test, which will be of qualifying nature. As far
as possible, the Board will try to conduct Physical Efficiency Test of
candidates on the next day of their Scrutiny of Documents and Medical
Examination Test. The procedure for conducting the Physical Efficiency Test
shall be as prescribed in Appendix 2.
(e)
Written Examination The candidates who are declared successful in
the Physical Efficiency Test under clause (d) shall be required to appear in
the written examination which shall carry 400 marks in the following subjects

Note.The detailed syllabus for
the examination will be notified by the Board. The procedure for the conducting
the written examination shall be such as is prescribed in Appendix 3.
Candidates failing to obtain 50% marks in each subject shall not be eligible
for recruitment.
(f)
Selection and Final Merit List From amongst the candidates found
successful in written test, Board shall prepare, as per the vacancies, a select
list of each category of candidates, on the basis of marks obtained by each
candidate in written examination under clause (e), keeping in view the
reservation policy and send it with recommendation to the Head of the
Department subject to Medical test/character verification. No waiting list
shall be prepared by the Board. List of all candidates with marks obtained by
each candidate shall be uploaded on its website by the Board. The Head of the
Department shall after his approval forward the list sent by the Board to the
Appointing Authority for further action.
Note.If two or more than two
candidates obtain equal marks then their seniority shall be decided by the
procedure laid in following order
(1)
If two or more candidates obtain equal marks than such candidate
will be given preference who possesses preferential qualification, if any (in
the same order as stated in Rule 9). Candidate having more than one
preferential qualification shall get the benefit of only one preferential
qualification.
(2)
Even then if two or more candidates have equal marks then
candidate older in age shall be given preference.
(3)
If despite the aforementioned more than one candidates are equal,
then preference to such candidate shall be determined according to the order in
English Alphabets of their names mentioned in High School Certificate.
(g)
Medical Test The candidates whose name are in the list sent as per
clause (f), will be required to appear for Medical Examination by the
Appointing authority. Medical Examination will be conducted in the Police Line
of the concerned District or at the place mentioned by the Appointing
authority. Medical Examination will be conducted as per Appendix 4. The
candidates found unsuccessful in Medical Examination shall be declared unfit by
the Appointing authority and such vacancies shall be carried forward for next
selection.
Rule - 16. Character verification.
Character Verification shall be
completed under the supervision of appointing authority before issuing of
appointment letter and before sending the candidates for training. Ordinarily
character verification shall be completed within a month. On adverse fact
coming to light during character verification of any candidate, he shall be
declared unfit by the appointing authority and such vacancies shall be carried
forward for next selection.
Rule - 17. Procedure for recruitment by promotion.
(1)
Promotion on the post of Sub-Inspector
The appointment to the post of
the Sub-Inspector shall be made from amongst the eligible personnel
substantively appointed as Head Constable Civil Police according to the
following policy
(a)
Fifty per cent of the total sanctioned posts of the Sub-Inspector
Civil Police shall be filled by recruitment through promotion by the Board on
the basis of seniority subject to rejection of unfit from amongst such
substantively appointed Head Constables who have completed three years of
service including probation period on the first day of the year of recruitment
and are found successful in qualifying physical efficiency test according to
Appendix 5.
(b)
Such Head Constables Civil Police promoted to ex-cadre post of
Sub-Inspector Civil Police shall also be eligible for promotion to the posts of
Sub-Inspector Civil Police under clause (a) who fulfil the qualifications.
(2)
Promotion on the post of Inspector Civil Police.
The appointment to the post of
the Inspector Civil Police shall be made from amongst the eligible personnel
substantively appointed as Sub-Inspector Civil Police according to the
following policy
(a)
Hundred per cent of the total number of sanctioned posts of
Inspector Civil Police shall be filled by recruitment through promotion by the
Board on the basis of seniority subject to rejection of unfit from amongst
those substantively appointed Sub-Inspector Civil Police who have completed
seven years of service including probation period on the first day of the year
of recruitment.
(b)
Such Sub-Inspector Civil Police, promoted to ex-cadre post of Inspector
Civil Police, shall also be eligible for promotion to the posts of Inspector
Civil Police under clause (a), who fulfil the qualifications.
(3)
Selection Committee for Promotion
(a)
The Selection Committee for promotion shall be constituted by the
Board.
(b)
The Chairman of the Committee shall be nominated by the Board and
shall not be junior in rank than the Appointing Authority for the promotional
post for which the selection committee is constituted. One member of
appropriate rank shall be nominated by the Head of the Department in the
Committee and remaining members of the Committee shall be nominated by the
Board according to Government Orders for the time being in force.
(c)
Undisputed seniority list for promotion shall be made available by
the Police Head Quarters to the Board.
(d)
Selection Committee shall submit the result of successful
candidates along with its recommendations to the Board. The Board shall submit
the list of selected candidates along with its recommendations to the Head of
the Department. The list shall not contain candidates more than the notified
vacancies.
(e)
The Head of the Department shall after his approval send the List
to Appointing Authority who will issue final orders for promotion.
(f)
After approval by the Head of Department, final list of candidates
selected for promotion shall be displayed by the Board on its website and U.P.
Police website.
PART VI TRAINING, APPOINTMENT, PROBATION, CONFIRMATION AND SENIORITY
Rule - 18. Appointment.
(1)
Subject to the provisions of Rules 15 and 16 the appointing authority
shall make appointment by taking the names of candidates in the same order in
which they stand in the list prepared under clause (f) of Rule 15. The
appointing authority shall issue the appointment letter to the candidates with
the direction that they should report for service/training within one month of
the date of issue of the letter or any date specified for this purpose in the
appointment letter. If a candidate does not do so his selection/appointment
shall be cancelled:
Provided that any person
appointed to a post in the service prior to the commencement of these rules and
is working on the post, shall be deemed to have been substantively appointed
under these rules.
(2)
If more than one order of appointments are issued in respect of
any one selection under Rule 17, then a combined order shall also be issued,
mentioning the names of the persons in order of seniority as determined in the
selection or, as the case may be, as it stood in the cadre from which they are
promoted.
Provided that any person
appointed before the commencement of these rules to a post under the service
and working on that post shall be deemed to have been substantively appointed
under these rules and such substantive appointment shall be deemed to have been
made under these rules.
Rule - 19. Training.
(1)
(a) The candidates finally selected to the post of sub-inspector
under Rules 15 and 16 shall be required to pass the training prescribed by the
Head of the Department. Provisions of Police Training College Manual shall be
effective on the cadets during the basic training. If the candidate finally
selected for basic training does not report for training within the stipulated
time limit then his selection/candidature shall be cancelled.
(b) Re-examination of the cadets
failing in basic training shall be organized by the Head of the Department
after their supplementary training. The proceeding for termination of service
of candidates failing in examination of training after supplementary training
shall be done by the Appointing Authority.
(2)
The candidates appointed by promotion under Rule 17 shall be
required to complete the training prescribed by the Head of the Department.
Rule - 20. Probation.
(1)
A person on substantive appointment to a post in the service shall
be placed on probation for a period of two years.
(2)
During the probation period a probationer shall be required to
undergo such training as may be prescribed by the Head of the Department.
(3)
The appointing authority may, for reasons to be recorded, extend
the period of probation in individual cases specifying the date up to which
extension is granted:
Provided that, except in
exceptional circumstances, the period of probation shall not be extended beyond
one year and in no circumstances, beyond two years.
(4)
If it appears to appointing authority at any time during or at the
end of the period of probation or extended period of probation that a
probationer has not made sufficient use of his opportunities or has otherwise
failed to give satisfaction, he may be reverted to his substantive post, if
any, and if he does not hold a lien on any post, his services may be dispensed
with.
(5)
A probationer who is reverted or whose services are dispensed with
under sub-rule (4) shall not be entitled to any compensation.
(6)
The appointing authority may allow continuous service, rendered in
officiating or temporary capacity in a post included in the cadre or any other
equivalent or higher post to be taken into account for the purpose of computing
the period of probation.
Rule - 21. Confirmation.
(1)
Subject to the provisions of Rule 20, a probationer shall be
confirmed in his appointment at the end of the period of probation or the
extended period of probation if;
(a)
he has successfully undergone the prescribed training;
(b)
his work and conduct is reported to be satisfactory; and
(c)
his integrity is certified.
(2)
Where, in accordance with the provisions of the Uttar Pradesh
State Government Servants Confirmation Rules, 1991, confirmation is not
necessary, the order under sub-rule (3) of Rule 5 of those rules declaring that
the person concerned has successfully completed the probation shall be deemed
to be the order of confirmation.
Rule - 22. Seniority.
Seniority of persons
substantively appointed to any posts in the service shall be determined as
follows
(1)
Determination of seniority of sub-inspectors recruited before
2-12-2008
(a)
Seniority of sub-inspectors recruited by any means who have
undergone training at one time shall be determined on the basis of the
percentage of marks obtained by them in training after selection in training
institutions.
(b)
Sub-inspectors trained in one training session shall be junior to
all sub-inspector trained in previous training session and shall be senior to
all sub-inspectors trained in subsequent training sessions. Restriction being
that if sub-inspectors appointed by direct recruitment and by promotion undergo
training in one training session then in that case the seniority of promotes
vis a vis direct recruits shall be determined in a cyclic order (the first
being a promotee) so far as may be, in accordance with the quota prescribed for
two sources.
(2)
Determination of seniority of sub-inspectors recruited after
2-12-2008
(a)
seniority of sub-inspectors appointed by any type of selection
shall be determined from their date of selection. Here date of selection means
the date on which the Head of the Department approves the select list sent by
the Board or the selection committee after the completion of recruitment
process;
(b)
selection of sub-inspectors by the Board by means of direct
recruitment shall be considered a separate selection. Inter se seniority of
sub-inspectors recruited in a single selection under direct recruitment shall
be according to the order of the final select list issued by the Board.
(c)
sub-inspectors recruited under the dependants of deceased category
and sub-inspectors recruited under the Skilled Sportsmen Rules, 2011 shall be
considered a separate selection of direct recruitment. The inter se seniority
of sub-inspectors so recruited shall be determined according to the percentage
of marks obtained by them in training after selection in training institutions.
In one training session if percentage of marks obtained in training
institutions are same for more than one candidate then date of birth shall be
made the basis of determination of inter se seniority. In case of percentage of
marks and date of birth being same the seniority shall be determined according
to the alphabetical order of the names in High School Certificates in English.
(d)
Sub-inspectors appointed through promotion shall be considered a
separate selection. If promotion to the post of sub-inspector is through an
examination then inter se seniority of sub-inspectors appointed after promotion
shall be according to the final select list issued by the Board. If promotion
to the post of sub-inspector is done on the basis of seniority then the inter
se seniority of sub-inspectors appointed having same date of selection shall be
according to their seniority in the feeder cadre and sub-inspector selected in
previous year shall be senior to sub-inspector selected in subsequent year.
(3)
Determination of seniority of Inspectors.
Seniority of inspectors appointed
on the basis of promotion shall be determined from their date of selection.
Inter se seniority of inspectors appointed on same date of selection shall be
according to their seniority in their feeder cadre and inspectors selected in
previous year shall be senior to inspectors selected in subsequent year. Here
date of selection means the date on which the Head of the Department approves the
select list sent by the Board or the selection committee after the completion
of recruitment process.
(4)
The seniority in some special case determined according to a
previously determined policy shall remain unchanged.
(5)
Despite the aforesaid if new facts come to light about seniority
determination or in case some dispute arises then it shall be resolved by the
Head of the Department according to policy of the Government.
PART VII PAY ETC.
Rule - 23. Scales of pay.
(1)
The scales of pay admissible to persons appointed to the various
categories of posts in the Service be such as may be determined by the
Government from time to time.
(2)
The scales of pay at the time of the commencement of these rules
are given as follows:

Rule - 24. Pay during probation.
(1)
Notwithstanding any provision in the Fundamental Rules to the
contrary, a person on probation, if he is not already in permanent Government
Service shall be allowed his first increment in the time scale when he has
completed one year of satisfactory service, has passed departmental examination
and undergone training where prescribed and second increment after two years of
service when he has completed the probationary period and is also confirmed:
Provided that if the period of
probation is extended on account of failure to give satisfaction, such
extension shall not count for increment unless the appointing authority directs
otherwise.
(2)
The pay during probation of a person who was already holding a
post under the Government shall be regulated by the relevant fundamental rules:
Provided that if period of
probation is extended on account of failure to give satisfaction such extension
shall not count for increment unless the appointing authority directs
otherwise.
(3)
The pay during probation of a person already in permanent
Government Service shall be regulated by the relevant rules, applicable
generally to Government Servants serving in connection with the affairs of the
State.
PART VIII OTHER
PROVISIONS
Rule - 25. Canvassing.
No recommendations, either
written or oral, other than those required under the rules applicable to the
post in the service will be taken into consideration. Any attempt on the part
of a candidate to enlist support directly or indirectly for his candidature
will disqualify him for appointment.
Rule - 26. Regulation of other matters.
In regard to the matters not
specifically covered by these rules or special orders persons appointed to the
service shall be governed by the rules, regulations and orders made under the
Police Act.
Rule - 27. Relaxation for the conditions of service.
Where the State Government is
satisfied that the operation of any rule, regulating the conditions of service
of persons appointed to the service causes undue hardship in any particular
case, it may, notwithstanding anything contained in the rules applicable to the
case, by order, dispense with or relax the requirements of that rule to such
extent and subject to such conditions as it may consider necessary for dealing
with the cases in just and equitable manner.
Rule - 28. Savings.
Nothing in these rules shall
affect reservations and other concessions required to be provided for the
candidates belonging to the Scheduled Castes, Scheduled Tribes and other
special categories of persons in accordance with the orders of the Government
issued from time to time in this regard.
APPENDIX 1
[See Rule
15(c)]
Scrutiny
of Documents and Physical Standard Test
Scrutiny
of the Documents
(1)
Candidates will be summoned with relevant documents with regard to
eligibility, relaxation, preferential qualifications, etc., for scrutiny
thereof to be carried out by a committee which will consist of following
members
(a)
a Deputy Collector nominated by the District Magistrate of the
District will be the Chairman;
(b)
a Deputy Superintendent of Police nominated by the Senior
Superintendent of Police/Superintendent of Police of the district;
(c)
District Inspector of Schools (DIOS) or Basic Siksha Adhikari
(BSA) or any other Gazetted Officer of the education department nominated by
the District Magistrate.
Where according to the prevalent
Government Orders representation of Scheduled Castes/Scheduled Tribes, Other
Backward Classes, Minority or any other category whose representation is
necessary in the said committee, the Board shall keep additional officers
nominated by the District Superintendent of Police to ensure their
representation. Such nominated officers shall not be below the ranks of
Inspector in police department.
(2)
Original documents shall be checked as per the information
provided in the application form.
(3)
During scrutiny of documents on being referred by any committee
because of any doubt or on being brought directly in its notice, the Board can
issue directions in this regard. The directions issued by Board, shall be
final.
Physical
Standard Test
The abovementioned committee can
take help of any Government employee for conducting Physical Standard Test
(1)
Minimum Physical Standards for male candidates arc as follows
(a)
Height
(one) for General/Other Backward
Classes and Scheduled Castes male candidates minimum height should be 168
centimetre.
(two) for Scheduled Tribe male
candidates minimum height should be 160 centimetre.
(b)
Chest
For the candidates belonging to
General/Other Backward Classes and Scheduled Castes minimum chest measurement
should be 79 centimetres without expansion and at least 84 centimetres with
expansion; and for the Scheduled Tribes 77 centimetres without expansion and
not less than 82 centimetres on expansion.
Note: Minimum 5 centimetres chest
expansion is essential.
(2)
Minimum Physical Standards for female candidates are as follows
(a)
Height
(one) for General/Other Backward
Classes and Scheduled Castes female candidates minimum height should be 152
centimetre.
(two) for Scheduled Tribes female
candidates minimum height should be 147 centimetre.
(b)
Weight
Minimum 40 Kg. for female
candidates.
(3)
The minimum physical standards for qualifying for each test shall
be displayed very prominently on Notice Boards in the venue of examination
before conducting the examination.
(4)
Only standardized equipments having Bureau of Indian Standards
certification or duly certified by the Director of Weights and Measures are to
be used for physical standards test examination.
(5)
If any candidate is not satisfied with his Physical Standard Test,
he may file an objection on the same day after the test. For clearing all such
objection; the Board shall nominate one Additional Superintendent of Police at
every place and Physical Standard Test of all such candidates will be conducted
again by the committee in the presence of above nominated Additional
Superintendent of Police. All those candidates who are again found unsuccessful
in the Physical Standard Test, will be declared unfit and no further appeal
will be entertained in this regard.
General
Instructions
(1)
Candidates will be expected to appear on the date and time
assigned to them. For reasons beyond their control and to be recorded in
writing, the date and time of the test may be changed by the Board for a group
of candidates to be tested at a particular time.
(2)
If a candidate fails to appear in the examination on the scheduled
date and time, then he can give application to the committee formed for
conducting the test in concerned district, giving reasons in detail for absence
and requesting to appear in the examination on some other date. The committee,
after considering his application, can decide and may allow him to appear for
test on some other date. The candidate will be given only one chance in this
regard and if he fails to appear in the examination on rescheduled date and
time, he shall be considered unsuccessful. The candidates may give application,
before the last date fixed for this test, by the Board. No application will be
accepted after the last day. The committee shall inform the Board about all
such cases where the date and time of the test has been rescheduled.
(3)
A candidate who fails for not achieving the prescribed standards
in the examination, shall not be given another chance and no appeal shall lie
for a retest for reasons of health and any other ground whatsoever.
(4)
The candidates will be informed about result of Scrutiny of
Documents and Physical Standard Test on the same day.
APPENDIX 2

15(d)]
Physical
Efficiency Test for direct recruitment
(1)
The Physical Efficiency Test will be conducted by a team formed by
the Board which shall have the following members
(i)
Sub-Divisional Magistrate nominated by the District Magistrate of
the District concerned;
(ii)
Medical Officer nominated by the Chief Medical Officer of the
District concerned.
(iii)
Deputy Superintendent of Police nominated by Senior Superintendent
of Police/Superintendent of Police.
Where according to the prevalent
Government Orders representation of Scheduled Castes/Scheduled Tribes, Other
Backward Classes, Minority or any other category whose representation is
necessary in the above team, the Board shall keep additional officers nominated
by the District Superintendent of Police to ensure their representation. Such
nominated officers shall not be below the ranks of Inspector in police
department.
The said team may take the help
of any other expert for conducting the examination.
(2)
The physical efficiency test shall only be of qualifying nature
and it will have no effect on the merit list. To become successful in physical
efficiency test it shall be necessary to complete 4.8 km. run in 28 minutes for
male candidates and 2.4 km. run in 16 minutes for female candidates. Those
candidates who do not complete the run within prescribed time shall not be
eligible for next stage of examination.
(3)
Manual timing shall not be permitted to be used by the team.
Standardised Electronic Timing Equipment along with CCTV coverage and
biometrics and adequate backup will be used to ensure accuracy, transparency
and avoid impersonations.
(4)
The team shall follow the process laid down as under
(i)
The number of candidates to be tested per day shall be determined
by the Board and decided by it depending on the total numbers to be tested and
prevailing conditions.
(ii)
The information of minimum physical standards for qualification as
given in Clause 2 of this appendix shall be displayed on the notice board at
the venue of the test.
(iii) The
result of this test will be displayed on the notice board at the end of the
day, at the venue of the Test and will be uploaded on the Board's website as
soon as possible.
(iv) The
members of the organisational team including testing agency if any who will
fully commit an act which is wrong or omit to perform an act and which causes
an unfair advantage or disadvantage to any candidate may be liable to Criminal
proceedings or Departmental proceedings.
(v)
The list of successful and unsuccessful candidates shall be
declared by the collective signatures of members of the team.
(vi) The
outdoor test shall be such that the results arc capable of being measured and
recorded mechanically without manual intervention. Only standardised equipments
preferably having Bureau of Indian Standards certificate shall be used for
Physical Efficiency Test.
(vii) Candidates
will be expected to appear on the date and time assigned to them. For reasons
beyond their control and to be recorded in writing, the date and time of the
test may be changed by the board for a group of candidates to be tested at a
particular time.
(viii) If a
candidate fails to appear in the examination on the scheduled date and time,
then he can give application to the committee formed for conducting the test in
concerned district, giving reasons in detail for absence and requesting to
appear in the examination on some other date. The committee, after considering
his application, may decide and allow him to appear for test on some other
date. The candidate will be given only one chance in this regard and if he
fails to appear in the examination on rescheduled date and time, he shall be

respected in all video records and the record will be kept in safe custody and
will be made available to a court of law when summoned by it, or to an enquiry
officer with the permission of the Board.
APPENDIX 3
[See Rule 15(e)]
Procedure for Written Examination
(1) In the
written examination a candidate shall write in his own handwriting. Scribe or assistant
shall not be permitted for any reason whatsoever.
(2) If call
letter is not received 7 days before the examination, then the Board shall
ensure arrangements for the candidates to contact the board on
helpline/landline/mobile phone or download the call letter from the Board's
website.
(3) Written
Examination shall be conducted on the same day at the same time throughout the
State.
(4) For the
purpose of the written examination O.M.R. answer sheet shall be in 3 copies,
the original copy will be used for scanning, first carbon copy shall be kept
for Board's record and second carbon copy shall be for candidate. Candidates
will be permitted to take the second carbon copy of O.M.R. answer sheet with
them.
(5) After the
written examination is over answer sheets will be dispatched to the Board,
centre-wise in sealed covers through the safe custody provided by the District
Senior Superintendent of Police/Superintendent of Police.
(6) Answers
of the questions asked in the examination shall be uploaded on Board's website.
(7) The
question papers provided to the candidates shall be such that the sequence of
the questions and also the answer to particular questions is randomised. Each
question paper shall have a unique identification number or series and, where
so instructed, the candidates will be expected to record this on the answer
sheet as per the instructions issued by the Board. When instructed to do so,
and where the candidates have failed to record the same, the answer sheets will
not be evaluated and no marks will accrue to such candidates.
(8) All
precautions shall be taken to ensure the correctness of all the questions and
answers. However in case of question being wrong in one or more question
papers, or in the opinion of the Board, option for answer is not unique or for
any other reason which shall be recorded, Board may annul any question. In case
of a question being annulled by the Board for any reason the allotted marks for
the question shall be awarded to all those candidates who have attempted the
question by marking any of the given answer choices.
(9) Board
shall specify detailed syllabus for the examination. However the syllabus will
be indicative in nature and after the completion of the examination no appeal
or objection will be entertained on the issue of any question being out of
syllabus.
(10) The Board
may divide the question paper in parts and can put two or more than two
subjects or two or more than two question papers serially in one question
paper.
(11) The Board
can prescribe minimum passing percentage for any examination, which shall be
clearly mentioned in the notification of the examination, and until the Board
is satisfied otherwise, the Board will not further examine any candidate who
are unsuccessful in previous stage.
(12) As a
result of any signature, writing a name or improper sign by a candidate on the
answer sheet, except as per the instructions given to the candidates, the
candidature of the candidate can be cancelled by the Board.
(13) If a
candidate is found copying in the exam or is found using unfair means, then the
Board can cancel the candidature of such candidate and the decision of Board in
this regard shall be final.
APPENDIX 4

15(g)]
Medical
Examination for direct recruitment
The Appointing Authority will
request the Chief Medical Officer of the concerned District to constitute
medical board for conducting Medical Examination. The Medical Board will
consist of three Doctors, who will conduct Medical Examination as per
"Police Recruitment Medical Examination Forms" as prescribed and codified
by Head of the Department in consultation with Director General of Medical
Health. This form will be available on U.P. Police website and also displayed
at the place of Medical Examination. Medical Board may take services of any
expert as per requirements.
(1)
The doctors will examine the candidates in accordance with the
Medical Manual, if any, and announce the result on the day of the Medical
Examination.
(2)
The result of the Medical Examination will be displayed on the
notice board outside the premises at the end of the day.
(3)
Any candidate not satisfied by his Medical Examination, may file
an appeal on the day of examination itself. Any appeal in regard to Medical
Examination will not be considered if the candidate fails to file appeal on the
date of Medical Examination and declaration of its result itself. The appeal
should be disposed of by the Medical Board, constituted for the same purpose
within two weeks of the appeal being filed. The Medical Board constituted for
appeal shall have expert regarding Medical deficiency of the applicant.
(4)
The members of the Medical Board who are found to give wrong
report wilfully will be liable for clinical proceedings.
(5)
The Medical Examination is only qualifying in nature and it has no
effect on the merit list.
Note: The Medical Board will
examine the candidates and their deficiencies such as knock knee, bow legs,
flat feet, varicose veins, distant and near vision, colour blindness, hearing
test comprising of Rinne's Test, Webber's Test and tests for vertigo etc. as
notified by the government from time to time. The Medical Board may get
conducted other examinations after obtaining opinion of experts.
APPENDIX 5
[See Rule 17(1)(a)]
Physical Efficiency Test for Promotion on the Post of
Sub-Inspector Civil Police
(1) The
Physical Efficiency Test shall be conducted by a Committee constituted by the
Board with following members
(i)
An Additional Superintendent of Police nominated by name by the
Board.
(ii)
A Medical Officer nominated by name by the Chief Medical Officer
of the District.
Where
according to the prevalent Government Orders representation of Scheduled
Castes/Scheduled Tribes, Other Backward Classes, Minority or any other category
whose representation is necessary in the said committee, such additional
members of suitable rank shall be nominated by the Board to ensure their
representation.
This team
may take the help of any other expert for conducting the examination.
(2) The
physical efficiency test shall only be of qualifying nature. To become
successful in physical efficiency test it shall be necessary to complete 3.2
km. walk in 35 minutes for male candidates and 2.4 km. walk in 28 minutes for
female candidates.
(3) Manual
timing shall not be permitted to be used by the team. Standardised Electronic
Timing Equipment along with CCTV coverage and biometric with adequate backup
will be used to ensure accuracy, transparency and avoid impersonation.
