UTTAR PRADESH SPECIAL SECURITY FORCE RULES,
2021
PREAMBLE
In exercise
of the powers conferred by Section 17 of the Uttar Pradesh Special Security
Force Act, 2020 (U.P. Act 27 of 2020), the Governor is pleased to make the
following rules for the purpose of regulating the constitution, appointments,
recruitments, superintendence, administration, deployment, powers of the
members, etc. of the Uttar Pradesh Special Security Force, namely:
Rule - 1. Short title, extent and commencement.
(1)
These rules may be called the Uttar
Pradesh Special Security Force Rules, 2021.
(2)
They shall be extend in whole of the
State of Uttar Pradesh.
(3)
They shall come into force on the date
of their publication in the Gazette.
Rule - 2. Definitions.
In these
rules, unless the context otherwise requires.-
(1)
(a) "Act" means the Uttar
Pradesh Special Security Force Act, 2020;
(b)
"Additional Director General of Police", "Inspector General of
Police", "Deputy Inspector General of Police",
"Superintendent of Police", "Commandant", "Additional
Superintendent of Police"/"Deputy Commandant", "Deputy
Superintendent of Police"/"Assistant Commandant" means police
officers appointed by the Government to Headquarters, Sector offices and
Battalions of Uttar Pradesh Special Security Force;
(c)
"Appointing Authority" in matters of Inspectors and Sub-Inspectors
means the Deputy Inspector General of Police and in the matters of Head
Constables, Constables and Class Four(Group 'D') Superintendent of Police or
Commandant, as the case may be;
(d)
"Citizen of India" means a person who is or deemed to be citizen of
India under Part II of the Constitution of India;
(e)
"Director General of Police" means the person appointed as the
Director General of Police by the State Government as the head of the Uttar
Pradesh Police Force;
(f)
"Establishment" means building, premises or campus being used in
connection with the affairs of any organisation serving educational,
commercial, recreational purposes;
(g)
"Force" means the Uttar Pradesh Special Security Force constituted under
Section 3 of the Act;
(h)
"Government" means the Government of Uttar Pradesh;
(i)
"Governor" means the Governor of State of Uttar Pradesh;
(j)
"Head of the Department" means the officer appointed as the Head of
Uttar Pradesh Special Security Force by the Government;
(k)
"Headquarters of UP Special Security Force" means a headquarter
functioning under the Director General of Police or Additional Director General
of Police, Uttar Pradesh Special Security Force, as the case may be;
(i)
"Industrial Undertaking" means any undertaking as notified by the
State Government pertaining to a scheduled industry as defined in Section 3 of
the Industries (Development and Regulation Act, 1951) and includes an
undertaking engaged in any other industry, or in any trade, business or service
which may be regulated by Parliament or State Legislature by law;
(m)
"Installation" means any statue, monument, building, premises or
campus being used in connection with the affairs of any organisation including
offices, associated buildings, residential area and property of that
organisation in that premises or campus;
(n)
"Member of the Force" means a person appointed to the Force;
(o)
"Private" means an installation or establishment controlled or
managed by a person other than Central or State Government or their agencies;
(p)
"Selection Committee" means a selection committee appointed by U.P.
Recruitment and Promotion Board for selection of candidates for appointments to
any post in the service;
(q)
"Subordinate Officer" means a person appointed to the Force on the
rank of Inspector or a Sub-Inspector;
(r)
"Substantive Appointment" means appointment to any such post in the
cadre which is not ad hoc and is made pursuant to rules in force by selection;
and in the absence of any rules thereof, made under procedures established
pursuant to any executive orders of the Government for the time being in force;
(s)
"Supervisory Officer" in relation to an officer of the Force means
any officer of a rank which is prescribed as higher than that of such officer;
(r)
"Under Officer" means a Head Constable posted in the Force as
Orderly, Havildar, Line Police Havildar, Havildar Quartermaster or Team
Havildar Major;
(u)
"U.P. Police Recruitment and Promotion Board" means the Board
constituted for recruitment and promotion by the Government Order 1256/6-Pu-
IO-2008-27(7)/08;
(v)
"U.P. Pradeshik Armed Constabulary" means the force of the State of
Uttar Pradesh constituted under the United Provinces Pradeshik Armed
Constabulary Act, 1948;
(w)
"Uttar Pradesh Police" means the Force of the State of Uttar Pradesh
constituted under the Police Act, 1861;
(x)
"Year of Recruitment" means the period of 12 months commencing on 1st
of July of any calendar year;
(y) Words
and expressions used and not defined in these rules but defined in the Indian
Penal Code, 1860, Code of Criminal Procedure, 1973, Police Act, 1861, U.P.
Pradeshik Armed Constabulary Act, 1948 and Uttar Pradesh Pradeshik Armed
Constabulary (PAC) Manual, shall have the same meanings respectively assigned
to them therein.
Rule - 3. Constitution of the Force.
There shall
be constituted and maintained by the State Government a Force to be called the
Uttar Pradesh Special Security Force in accordance with the provision of
Section 3 of the Act.
Rule - 4. Composition of the Force.
(1)
The Force shall be constituted to have
a Headquarter of the Force, Sector offices and Battalions. The Constitution of
the Battalion shall be based on a primary unit called the "Team".
Apart from strength of persons in various posts to discharge essential
functions at the Battalion headquarters level, a Battalion shall consist of
General and Special Teams, Security Team, Personal Protection Team, Quick
Response Team, Training Reserve Team and Battalion Duty Team shall come under
General Teams while BDDS (Bomb Detection and Disposal Squad)/Dog Squad Teams,
AS (Anti Sabotage) check Teams, Snipers and MT (Motor Transport) Section shall
come under Specialised Teams.
(2)
At the commencement of these rules, 5
Battalions shall be raised in the " first phase and further such
Battalions shall be raised as may be notified by the State Government.
Constitution of the Headquarters of the Force shall be as prescribed in Rule 7.
(3)
Save as aforesaid
(a)
the strength of a Battalion consisting
of supervisory officers, subordinate officers and members and their strength on
each post in a Battalion of the Force, shall be such as the State Government
may, after consideration of proposal submitted by the Head of the Department
and recommended by Director General of Police, approve from time to time as per
requirements;
(b)
the Commandant/Head of Office, in view
of operational necessities may alter the posts and the strength thereof of
different Teams for the deployment purposes, on approval of the Head of the
Department;
(c)
the Appointing Authority may leave a
vacant post unfilled or the Governor may keep it in abeyance, on account of
which no person shall have any right to any kind of remedy or redress;
(d)
for the effective operation of the
Force, the State Government may create any permanent and/or temporary posts as
it deems fit.
Rule - 5. Structure of the Force.
Structure
of the Force and the hierarchical strength of the members shall be as
prescribed in Rule 4. The members of the Force shall be in different categories
in various ranks as mentioned below
(1)

Additional Director General of Police;
(b)
Inspector General of Police;
(c)
Deputy Inspector General of Police;
(d)
Superintendent of Police/Commandant;
(e)
Additional Superintendent of
Police/Deputy Commandant; and
(f)

Police/Assistant Commandant/Adjutant.
(2)
Non-Gazetted Officers.
(a)

(i)
Quartermaster, Special Security Force
(for Headquarter);
(ii)
Inspector, Special Security Force;
(iii)
Subedar Quartermaster, Subedar
Adjutant Special Security Force;
(iv)
Sub-Inspector, Special Security Force;
(v)
Head Constable, Special Security
Force; and
(vi)
Constable, Special Security Force.
(b)

Rule - 6. Pay.
The members
of the Force shall draw such salary and allowances as are prescribed from time
to time to the members, on equivalent ranks, of U.P. Pradeshik Armed
Constabulary or as payable in their parent department.
Rule - 7. Headquarters of the Force.
The
Headquarters of the Force shall be at Lucknow. In the first phase, 5 Battalions
of the Force shall be established at Gorakhpur, Prayagraj, Lucknow, Mathura and
Saharanpur. In future, as further Battalions are established, a Sector
Headquarter shall be established by the Government for a group of 3 to 5
Battalions. A Deputy Inspector General rank officer shall be in-charge of the
Sector Headquarters. A decision to appoint additional supervisory officers in
the Headquarter of the Force commensurate with the increased number of
Battalions shall be taken by Government at that time.
Rule - 8. Appointments and powers of Supervisory Officers.
(1)
For the supervision of the Force, the
State Government may appoint at the Force headquarters, an Additional Director
General of the Force who shall be the Head of the Department. In the first
phase, there shall be 1 Inspector General of Police, 1 Deputy Inspector General
of Police, 2 Superintendents of Police and 04 Deputy Superintendents of Police
to assist the Head of the Department at the Headquarters. In the future,
subject to the provisions prescribed under Rule 5, the State Government may,
after the constitution of additional Battalions and sector offices, appoint
additional Supervisory Officers for the Headquarters and the sector offices, at
that time.
(2)
The State Government may appoint for
the supervision of each Battalion of the Force, a Superintendent of
Police/Commandant at the Battalion Headquarters, who shall be the Head of the
Office; and to assist him in the form of a Supervisory Officer, may appoint 1
Additional Superintendent of Police/Deputy Commandant who shall be the
Second-in-command (2-I-C).
(3)
At the Battalion level, for each
Battalion, 5 Deputy Superintendents of Police/Assistant Commandants may be
appointed in the form of other Gazetted Supervisory Officers.
Rule - 9. Duties of Gazetted Supervisory Officers.
(A)
Additional Director General of the
Force:
(1)
The Additional Director General shall
be the Head of the Department and shall be responsible for maintaining it in a
state of high efficiency, training, discipline and morale and he shall for that
purpose take all such steps as he may consider necessary, by way of tours,
inspections, examination of records, calling for reports, framing procedures,
issuing instructions and giving directives on all matters pertaining to the
administration of the Force. He shall, in particular, guide and direct the
supervisory officers and it shall be his duty to ensure that each supervisory
officer maintains the Force in his charge at a high level of efficiency and
discipline.
(2)
The Additional Director General shall
ensure coordination with the authorities, key persons, etc. of all
institutions/installations mentioned in Section 3 of the Act, where the Force
has been deployed and in respect of the Force, he shall ensure resolution of
security issues and fulfillment of needs of every such undertaking,
establishment, person, etc. He shall maintain close liaison with the police and
other authorities of the State so as to secure effective coordination between
the State Police and the Force in regard to matters pertaining to the protection
and security of such undertaking, establishment, person, etc.
(3)
He shall issue standing
orders/pamphlets, circular orders, instructions, etc. to assign
responsibilities, not inconsistent with these rules, to the members of the
Force for the carrying out of duties enumerated under Section 8 of the Act.
(4)
He shall perform any other duty, which
the State Government or the Director General of Police may, from time to time,
entrust.
(5)
He shall keep the Director General of
Police and the State Government duly informed of all matters of importance.
(B)
Inspector General of the Force.
(1)
The Inspector General shall work as an
assistant to the Additional Director General of the Force.
(2)
He shall closely supervise the
locations of various deployments and take appropriate measures to promote their
efficiency and work proficiency.
(3)
He shall give instructions to the
sector Deputy Inspectors, General for the operation and control of the Force
deployed in various undertakings, persons, establishments, etc.
(4)
He shall assist the Head of the
Department in the discharge of the duties mentioned under Rule 9.
(5)
He shall carry out inspections of the
sector units as per the circulars issued by Force Headquarters.
(6)
He shall scrutinise the Inspection
Notes/Inspection Reports submitted by the sector Deputy Inspectors General of
all Battalions and monitor the compliance of shortfalls pointed out therein.
(7)
He shall scrutinise and approve the
tour programs, Inspection Notes/Inspection Reports and monthly diaries of
Deputy Inspectors General.
(8)
He shall ensure speedy disposal of
departmental enquiry cases and time-bound monitoring of court cases.
(9)
He shall perform any other duty, which
the Director General of Police or the Additional Director General of the Force
may, from time to time, entrust.
(C)
Deputy Inspector General of Police.
(1)
For proper supervision of the Force,
the State shall be divided into sectors. A Deputy Inspector General shall be
the in-charge of each sector.
(2)
He shall be responsible for
maintaining the Force in his charge in a state of high efficiency, training,
discipline and morale. For this purpose, he shall inspect the undertakings,
establishments, personal security, etc., in his sector where the Force is
deputed at least twice a year and send his Inspection Note/Inspection Reports
to the Inspector General, giving details of the state of the Force and its
administration.
(3)
The Deputy Inspector General shall be
readily available to the Commandants and shall aid, advise and control them. He
shall coordinate with the authorities of the undertakings, establishments,
personal security, etc., of his sector, where the Force has been deputed.
(4)
He shall perform any other duty, which
the Additional Director General of the Force and the Inspector General of the
Force may, from time to time, entrust.
(D)
Duties of the Commandant.
(1)
The Commandant shall be the Head of
the Battalion. He shall be responsible for the efficiency, discipline and
morale of the battalion and for the proper management of each branch of
the Force under him. He shall periodically inspect the battalion of the Force
under his command. All administrative and other orders to the Force under him
shall emanate from him and he shall ensure their compliance.
(2)
He shall ensure strict compliance of
all orders issued by the Director General of police, the Additional Director of
the Force and other senior Supervisory Officers.
(3)
The Commandant shall regularly inspect
the detachments of the Force posted outside the battalion and ensure that they
remain in a high state of efficiency.
(4)
He shall ensure that all members of
the Force under him attend parade and refresher courses in turn according to a
program. When at headquarters, he shall attend the parade every Tuesday and
Friday and hold the Orderly Room every Friday.
(5)
The Commandant shall be responsible
for the security of the undertaking, establishment and personal security in
which the detachment of his battalion is posted. For that purpose, he shall
remain in close touch/coordinate with the district police authorities as well
as the concerned authorities of the aforementioned undertaking, establishment
and personal security. He shall keep the Additional Director General of the
Force, the Inspector General and the Deputy Inspector General fully informed of
all the developments and send them regular fortnightly reports, as prescribed.
Matters of urgent nature, however, shall be brought to their notice by the
quickest possible means. He shall pay his personal attention to the working of
the Intelligence wing and ensure that intelligence is efficiently collected and
conveyed promptly to the concerned authorities and the Deputy Inspector
General.
(6)
He shall perform any other duty, which
the Head of the Department of the Force and other senior supervisory officers
may, from time to time, entrust.
(E)
Duties of the Deputy Commandant.
(1)
The Deputy Commandant shall be the
second-in-command (2-1-C) of the battalion.
(2)
He shall assist the Commandant in the
discharge of the Commandant's duties and responsibilities; and where he is
placed as head of the battalions; he shall discharge all the duties of a
Commandant and shall exercise only those financial powers that are delegated to
him under the relevant rules.
(3)
As the second-in-command, the Deputy
Commandant shall be responsible for discharge of all duties of the Commandant
of the battalion. He shall be responsible for the efficiency, discipline and
morale of the personnel under him and shall also be responsible for the
security of the undertaking or its part entrusted to him.
(4)
He shall perform any other duty, which
the Commandant and the Head of the Department of the Force and other senior
supervisory officers may, from time to time, entrust.
(F)
Duties of the Assistant Commandant.
(1)
The Assistant Commandant shall assist
the Commandant of the battalion and the Deputy Commandant; and unless
specifically directed to the contrary, he shall perform all the functions of
the Commandant when so required by the latter. He shall be responsible for the
efficiency, discipline and morale of the personnel under him and shall also be
responsible for the duties entrusted to him in relation to the security of the
undertaking, establishment and personal security.
(2)
He shall perform any other duty, which
the Commandant may, from time to time, entrust.
(G)
Duties of the Adjutant.
(1)
The Adjutant shall be the Commandant's
Staff Officer and as such all orders by him are to be obeyed as though given by
the Commandant himself.
(2)
As the administrative and operational
assistant to the Commandant, he shall be responsible for maintaining a high
level of discipline, turnout, compliance of rules and standing orders,
efficient and fair allotment of duties of subordinate officers and Under
Officers, in the Battalion.
(3)
He shall also perform all other such
duties which the Commandant may from time to time, entrust.
Rule - 10. Recruitment to the Force.
(1)
Deputation.
(a)
On constitution of the Force, for
initial 3 years, all posts in the Force shall be filled by deputation of
eligible personnel from Pradeshik Armed Constabulary and Civil Police on the
basis of qualifications/norms/standards prescribed by the Head of the
Department. The entire strength of women members of the Force shall be sourced
solely from deputation. The period of deputation shall ordinarily be three
years which may be further extended by a maximum of two years. The maximum
duration of deputation shall be five years.
(b)
On the first direct recruitment, the
ratio of members on deputation to members through direct recruitment shall be
brought down to around 70:30 level, after second recruitment it shall be
brought down to around 50:50 level, and after third recruitment to around 30:70
level, and the said ratio of 30:70 shall permanently remain effective
thenceforth until the State Government decides otherwise.
(c)
The members taken on deputation to
Special Security Force shall be repatriated to their parent departments:
i.
On attaining the below mentioned ages.
(a)

Or
ii.
On the satisfaction of the Head of the
Department that such repatriation is expedient on administrative grounds.
(d)
The standards and procedure for
deputation to the Force shall be determined by the Director General of Police
in accordance with the applicable rules.
(2)
Direct Recruitment.
(a)
Such male candidates, who are not
physically handicapped, shall be eligible for direct recruitment to the posts
of Constables and Sub-Inspectors. Save as provided under preferential
qualifications below, the direct recruitment to the above posts in Special
Security Force shall be governed by The Uttar Pradesh Pradeshik Armed
Constabulary Subordinate Officers Service Rules, 2015 (as amended) and all
other Rules applicable to Provincial Armed Constabulary for the time being in
force.
(b)
Preferential Qualifications:
All sought
criteria remaining same, such candidates for direct recruitment shall be given
preference, who have
(i)
"O" level certificate in
Computer from DOEACC/NIELT Society, or
(ii)
Minimum 2 years’ service with
Territorial Army, or
(iii)
"B" level certificate of
National Cadet Corps (NCC).
Note.-
Above mentioned preferential qualifications shall not bear any marks, but in
case two or more than two candidates secure equal marks, then in the selection
list a candidate possessing preferential qualification shall be given
preference.
Rule - 11. Appointment of Auxiliary Staff at the Force Headquarters/different offices.
(1)
The posts of Ministerial Branch,
Transport Branch, Armourer Branch and Police Radio Branch shall be tilled by
transfers from U.P. Police/Provincial Armed Constabulary from the common cadre
pool.
(2)
The posts of Class Four (Group 'D')
shall be filled by the Uttar Pradesh Police Recruitment and Promotion Board as
per prevailing rules/regulations for recruitment of Group 'D' in U.P.
Police/Provincial Armed Constabulary.
(3)
The posts of Medical Officers,
Pharmacists shall be filled by transfer/deputation from the Uttar Pradesh
Medical and Health Department.
Rule - 12. Promotion.
The rules
for promotion to different ranks in various posts in the Force shall be the
same as prevailing in the U.P. Police/Provincial Armed Constabulary for the
time being.
Rule - 13. Training.
(1)
Selected candidates shall be required
to pass the prescribed training. The duration of basic training shall be 9
months, of which the foundational training shall be of 6 months duration and
specialised training shall be of 3 months duration. The 3 months duration
specialised training shall comprise of Sniper, BDDS, AS Check and Commando
trainings, etc, as may be determined by the Training Headquarters on the
request of and in coordination with the Head of the Department. In case, any
selected candidate does not report for the training within the prescribed time
limit, his candidature shall stand cancelled.
(2)
The syllabus and place of basic
training of the selected candidates and refresher coursed for the members of
the force and other specialised training shall be determined by the Training
Headquarters on the request of and in coordination with the Head of the
Department.
(3)
For the cadets that fail in basic
training, the Head of the Department shall organise a re-examination after
imparting Supplementary Training. In the case of candidates that fail in
Supplementary Training, the Appointing Authority shall initiate proceedings to
terminate the services of such candidates.
(4)
Refresher Training
Post basic
training, a refresher training of 6 weeks duration shall be imparted every 5
years. There shall be an annual medical examination and annual firing practice.
Those who fail in tiring examination shall be given one more opportunity but
failing in the retest shall result in initiation of disciplinary proceedings
against him.
The
candidates appointed by promotion under Rule 12 shall have to successfully
complete the training prescribed by the Head of the Department.
Rule - 14. Superintendence and administration of the Force.
(1)
The Superintendence of the Force shall
vest in the Director General of Police, and the command, supervision and
administration of the Force shall vest in the Additional Director General of
the Force.
(2)
The administration of the Force within
such local limits as may be notified shall be carried on by the supervisory
officers in accordance with the provisions of these Rules, and every
supervisory officer placed in charge of the protection and security of body of
person(s) and/or his residential premises notified as such by the State Government
by name, nomenclature or category; the High Court of Judicature at Allahabad
and Lucknow, District Judgeships and any other court as notified by the State
Government; vital installations; industrial undertakings; shrines;
administrative premises, metro, airports, banks and other financial
institutions; and any other installations or establishments notified by the
State Government, as such, for this purpose subject to any direction that may
be given by the State Government or the Additional Director General in this
behalf.
(3)
The Superintendent of Police of the
district shall, in coordination with the Supervisory Officer of the Force, have
the power to oversee the functioning of the Force within his jurisdiction.
Rule - 15. Deployment of the Force for providing services to Private Establishments.
(1)
Under Section 7 of the Act, on the
request for services, received from Private Establishments, the Additional
Director General of the Force shall constitute a committee, which shall be
headed by an officer not below the rank of Deputy Inspector General who shall
get the said request examined. The Additional Director General of the Force
shall forward his clear opinion to the Director General of Police who shall
take a final decision on the report.
(2)
The estimated total cost to be
recovered from the private Industrial Establishments or Private Sector
Establishments for the Force to be deployed shall be determined on the basis of
the following.
(a)
Recurring Expenditure
(i)
Pay and allowances
(ii)
Annual expenditures towards uniform
and equipment’s
(iii)
Traveling allowances
(iv)
Contingency expenditures
(v)
Contribution towards pension
(vi)
Leave Pay
(vii)
Administrative or Supervisory charges
(viii)
Group Insurance
(ix)
Expenditures towards ammunitions for
annual firing practice
(x)
Other petty expenses
(xi)
Vehicle, fuel, oil, lubricants
(xii)
Office expenditures
(xiii)
Medical expenditures
(xiv) Any other payable approved by the State Government.
(b)
Non-Recurring Expenditure.
(i)
Training expenditures
(ii)
Expenditures towards uniform and
equipments
(iii)
Required Arms/ammunitions as per rank
and standards
(iv)
Residential/administrative buildings.
(c)
The expenditures to be charged shall
be calculated by the Finance Controller, Police Headquarters, Lucknow, for each
rank; and the Additional Director General of the Special Security Force shall,
after getting recommendation of the Director General of Police, shall seek the
approval of the State Government for the same.
The
calculation of expenditures to be charged shall be revised every year on the
1st of April. On the basis of charges as approved by the State Government, the
Private Establishments, to which the Force is to be provided under sub-rule (1)
and shall be charged the amount as determined.
(d)
It shall be lawful for the Additional
Director General of the Force to revise the reimbursement charges, as per the
requirements during any Financial Year, with the approval of the Director
General of Police. Approval of such revised expenditure reimbursements to be
charged shall be taken from the State Government.
Rule - 16. Duties of the members of the Force.
(1)
In addition to the duties mentioned in
Section 8 of the Act, the duties of subordinate officers and other members of
the Force shall be as given below:
(A)
Duties of the Subedar Adjutant,
Reserve Inspector, Inspector, Quartermaster, Subedar Quartermaster, Sub
Inspector, Havildar, Head Constable, Constable, Line Police etc. shall be as
follows:
(i)
They shall perform duties as shall be
laid out by the Head of the Department;
(ii)
'They shall ensure a high level of professional
capacity, competence, proactive readiness. SOP adherence, discipline,
knowledge, skills and attitudes in the Force in order to carry out the duties
enumerated under Section 8 of the Act;
(iii)
They shall carry out duties as per the
directions of the Supervisory Officers.
(2)
For other posts which have been
sanctioned or created or may be sanctioned or created from time to time by the
State Government, their duties shall be assigned by the Additional Director of
the Force by a separate order.
Rule - 17. Duties of Special Operational Teams.
(1)
In-charge Premises Security Team.
(a)
there will be an officer of
Inspector/Sub-Inspector rank who, with the cooperation of his/her subordinates,
will be responsible for the premises, security of any residential campus, the
High Court of Judicature at Allahabad and Lucknow, District Judgeships or any
other premises notified by State Government for protection and security
thereof;
(b)
he will prepare an SOP (Standard
Operating Procedure) according to Security Plan for the security of the defined
area and will ensure implementation of the SOP after getting it approved by the
competent authority;
(c)
he shall maintain a duty register at
duty point and a checking register for premises security; and shall peruse the
register himself daily;
(d)
he shall maintain an SOP designed for
every point in the premises and will ensure Standing Orders to be placed at all
Morcha duties and other appropriate duty points;
(e)
he shall ensure instant implementation
of the SOP in case of any contingency and shall ensure instant message to his
senior officials about the situation;
(f)
in case of any criminal offence taking
place in the premises secured by the Team, he shall, while informing, discharge
his constitutional duties as established by law and shall try his best to
control the situation and shall inform the local police station immediately;
(g)
he shall be responsible towards
maintaining high standards of discipline and professional competence in his
Team and shall ensure training, briefing and site mock drills and rehearsals of
his Team from time to time;
(h)
he shall ensure checking of the duties
of all the members of his Team from time to time and shall immediately report
about the personnel found careless in duty to the Gazetted Officer in-charge of
his Battalion.
(2)
In-charge Personal Security Team.
(a)
there shall be an officer of
Inspector/Sub-Inspector rank that shall ensure, through Personal Security
Officer under him that personal security is provided to persons notified as
dignitaries in categorised security or any other person to whom security is to
be provided as per directions of the State Government or Competent Court;
(b)
he shall ensure checking of the duties
of all the members of his Team from time to time and shall immediately report
about the personnel found careless in duty to the Gazetted Officer in-charge of
his Battalion;
(c)
he shall be responsible towards
maintaining high standards of discipline and professional competence in his
Team and shall ensure training, briefing and site mock drills and rehearsals of
his Team from time to time;
(d)
he shall keep his Team prepared
keeping in view the life threat perception of protected dignitaries and shall
develop competence among his Team members to act skillfully in all adverse
circumstances.
(3)
In-charge Quick Response Team (QRT)
(a)
there shall be an officer of
Inspector/Sub-Inspector rank who shall along with his Team, in case of any
contingency like terrorist attack/Law and Order problem or any other kind of
emergency, on orders to reach a specified place by Gazetted Officer of the
Battalion, shall reach such place and shall ensure immediate security and
further reactionary actions;
(b)
he shall ensure that during any
operation, all the members of his Team will remain in uniform and they should
be well equipped with all the equipments and weapons and, well prepared, they
should respond tactically in prescribed formations to face the conditions
arising due to any emergency;
(c)
he shall be responsible towards
maintaining high standards of discipline and professional competence in his
Team and shall ensure training, briefing and site mock drills and rehearsals of
his Team from time to time;
(d)
he will keep his Team ready according
to SOPs to respond to possible threats, and will act accordingly to develop
professional skills among his Team members to face all types of adverse
situations.
(4)
In-charge Bomb Detection and Disposal
Squad (BDDS) with Dog Squad
(a)
there shall be an officer of
Inspector/Sub-Inspector rank who shall ensure to get any specified place
checked by his Team as per standard procedure for the possibility of presence
of any explosive material as directed by the Gazetted Officer of the Battalion;
and in case any such explosive material is found there, he will take actions to
neutralise it;
(b)
he shall also be the in-charge of the
Dog Squad and shall ensure the standard checking of any specified place by the
trained dog/dogs;
(c)
the BDDS Team shall work under the
direction of its in-charge and the team shall follow all the directions and
instructions which are given by the Commandant or any of his subordinate
Gazetted Officers of the Battalion for any specific operational duty;
(d)
after checking of the specified place,
the in-charge of BDDS Team shall declare the place as secured place and hand
over the charge of the place to the in-charge security officer as per
prescribed procedure; and shall give a description of the checking to the duty
point in-charge Gazetted Officer on a prescribed format issued by Additional
Director General of the Force through a separate order;
(e)
he shall be responsible towards
maintaining high standards of discipline and professional competence in his
Team and shall ensure training, briefing and site mock drills and rehearsals of
his Team from time to time.
(5)
In-charge Anti-Sabotage (A.S.) Check
Team
(a)
there shall be an officer of
Inspector/Sub-Inspector/Head Constable rank who shall ensure to get advanced
security check of any specified place by his Team as per standard procedure for
the possibility of presence of any undesirable item/object as directed by the
Gazetted Officer of the Battalion;
(b)
the A.S. Check Team shall perform its
duties under the direction of its in-charge of the Battalion and the Team shall
comply with all such directions/instructions which are issued by Commandant or
his subordinate Gazetted Officers of the Battalion for specialised operational
duty;
(c)
after checking of the specified place,
the in-charge of the Team shall hand over the venue/location to concerned duty
officer after having declared the place as secure and shall give a description
of the checking to the duty point in-charge Gazetted Officer on a prescribed
format issued by Additional Director General of the Force through a separate
order;
(d)
he shall be responsible towards
maintaining high standards of discipline and professional competence in his
Team and shall ensure training, briefing and site mock drills and rehearsals of
his Team from time to time.
(6)
In-charge Sniper Team.
(a)
there shall be an officer of
Inspector/Sub-Inspector rank who shall immediately ensure to get the specified
duties performed by his Sniper Team as directed by the higher officials with
utmost professional efficiency;
(b)
his Team shall consist of snipers who
shall be well trained sharpshooters. The Team shall report to the concerned
Gazetted Officer in-charge of the duty place specified by the Commandant of the
Battalion and shall ensure discharge of all responsibilities related to
security aspects.
Rule - 18. Powers of the members of the Force.
Every
member of the Force having been so appointed and till such time he remains a
member of the Force, shall be considered a Police Officer and shall be
subjected to such conditions, restrictions and limits as may be determined; and
shall have all such powers, special powers, responsibilities, restraints,
punishments and protections; and be governed by them, as are applicable to
police officers appointed to Uttar Pradesh Police under the Police Act, 1861 or
any such other law for the time being in force or under any rules or
regulations framed thereunder, but such conditions, restrictions and limits
shall not be contrary to the orders under the Act.
Rule - 19. Procedure of arrest.
In making
an arrest, under Section 10 of the Act
(i)
the member of the Force shall actually
touch or confine the body of the person to be arrested.
(ii)
If such person forcibly resists the
endeavor to arrest him, or attempts to evade the arrest, the member of the
Force may use all means necessary to effect the arrest. In case of use of force
it should be minimum, required in that particular situation.
(iii)
The person arrested shall not be
subjected to more restraint than necessary to prevent his escape.
(iv)
The member of the Force making the
arrest, may search such person, and place in safe custody all articles
including weapons, if any other than necessary wearing apparels, found upon
him. An inventory of all such articles shall be prepared in the presence of at
least two respectable witnesses and in the presence of the arrested person and
a copy of the inventory duly signed by the witnesses and the person conducting
the search, shall be given to the person so arrested after obtaining duo
receipt.
(v)
Such arrested person as well as the
seized articles and its inventory shall be handed over to a local police
officer or at the nearest police station without avoidable delay along with a
brief note giving the time, date and reasons of arrest.
Rule - 20. Procedure of Search.
Whenever a
search of a person and of his belongings is conducted under Section 11 of the
Act an inventory shall be prepared in the presence of the two respectable
witnesses and a copy of the inventory duly signed by the witnesses and the
person who conducted the search, shall be given to the person concerned after obtaining
due receipt. The property so found on such search, shall also be sent to the
police along with the person. If nothing is found on such search, a nil
inventory statement duly signed shall be sent to the police along with the
person.
Rule - 21. Terms and Conditions of service.
(1)
The disciplinary action against
non-Gazetted Officers and personnel of the Force shall be taken in accordance
with the U.P. Police Officers of Subordinate Ranks (Punishment and Appeal)
Rules, 1991 (as amended) and U.P. Pradeshik Armed Constabulary Act, 1948.
(2)
The members of the Executive Force as
defined in clause (a) of sub-rule (2) of Rule 5 and directly recruited for
Force or promoted to non-gazetted ranks from such members shall form a separate
cadre known as The Uttar Pradesh Special Security Force Cadre. Members of this
cadre in the ranks of Inspectors, Sub-Inspectors, Head Constables, Constables
and the personnel posted on equal ranks may be transferred or posted from one
place to another, within the Force, by the orders of the Establishment Boards
at battalion, sector and Headquarters level in the Force, constituted by the
Government.
(3)
When the Government is of the opinion
that a difficulty has arisen in a particular matter in implementing a rule,
regulating the service conditions of the appointed personnel, in such cases,
without prejudice to the rules, and not inconsistent with the limits and
conditions of the rule, it may grant such waiver or relaxation as may be
required to proceed in a just and equitable manner.
Rule - 22. Power to issue standing orders etc.
Without
prejudice to the generality of the powers conferred by these rules, in view of
operational and tactical needs, administrative ease and enhancement of work
efficiency and efficacy, Additional Director General of the Force, on approval
of Director General of Police, may issue standing orders or pamphlets.
Rule - 23. Uniform, vehicles/carriages, arms and ammunitions, equipments of the force.
Without
prejudice to scope of aforesaid powers granted under these rules, requirement
of weapons, accoutrements, clothing and other necessary articles and vehicles,
equipments and other necessary resources shall be provided as under
(1)
Uniform
(a)
The general features of the uniform to
be adorned by members of the Force shall be as described in Appendix 1; whereas
general format of symbol/insignia of the Force shall be as given in Appendix 2;
and the formation sign to be worn on the right arm shall be as prescribed in
Appendix 3.
(b)
In relation to the uniform as above,
the Additional Director General of the Force, on approval by Director General
of Police, shall issue a comprehensive standing order/pamphlet giving details
of technical specifications of the cloth, the design of the uniform, the
tailoring instructions, manner of adornment, changes as per the seasons etc.,
and in relation to insignia and formation sign, giving details of dimension and
other measurements, colour combinations, designs, methods of making, base
materials, manners of wearing, etc.
(c)
The Director General of Police shall
be the competent authority to make amendment in the uniform to be adorned by
the members of the Force.
(d)
Apart from the decorations as
prescribed by the Government, Director General of Police shall determine
decorations to be worn by members of the Force like different ribbons (symbols)
on successful completion of specialised training, on completion of prescribed
refresher course etc., on discharge of special duties etc.; and identification
symbols of specialised Teams; and the member of the Force shall wear these
decorations/symbols on the uniform as prescribed.
(e)
The uniform to be worn by the Gazetted
Officers of the Force shall be as follows.
(i)
Prevailing working uniform in U.P.
Police;
(ii)
Prescribed uniform for Special
Security Force;
(f)
The uniform to be worn by the
Non-Gazetted Officers of the Force shall be as follows
(i)
All the members who are discharging
duties in Campus/Premises Security Teams, QR Teams, Training Reserve Teams,
Battalion duties, MT Sections, Snipers and Personal Security Teams shall wear
specially designed uniform made of khaki based Disruptive Pattern Material
(Desert Digital Camouflage). A sample of the pattern shall be securely
preserved by the Head of the Department. As part of this uniform, a black/DPM
coloured forage cap/beret cap with the embroidered UPSSF badge/insignia on it
shall be worn. The Unit Commander shall ensure that cap of the subordinate
force at any point of time shall be of identical type. The shirt and trousers
of the uniform, made of disruptive pattern material shall be worn in tucked-in
style and shall be held by a black web belt in tight fit. The lanyard of the
uniform shall be black in colour and it shall have a whistle, as prescribed.
The members of the Force shall wear black tactical shoes and black socks with
the aforesaid uniform. The prevailing Uttar Pradesh Police formation sign shall
be worn on the left arm of the shirt. A name plate shall be worn above the
right pocket of the shirt in a stitched manner such that the name is
embroidered in transparent against a black base. All members of the Special Security
Force shall wear the formation sign of the Force on the right arm in a stitched
manner and shall wear Team identification symbol on the right pocket also in
stitched manner. The members shall wear the Battalion identification sign, for
example "IIBN" in a stitched manner on both upper arms. In this
regard detailed standing order shall be issued by the Head of the Department.
Rank badges to be worn on the shoulders shall be embroidered; no metallic
badges/decorations shall be worn during field duties. The prevailing crest of
the U.P. Police shall be worn on the shoulders. For operational ease,' Velcro
Tapes' shall be provided along with the buttons on shirt and trousers of the
uniform.
Other
decorations like-medals, commendation discs, training medals/ribbons, posting
ribbons etc. shall be worn on left or right pocket as prescribed.
(ii)
The members of the BDDS Team along
with dog squad Teams and AS Check Teams posted in U.P. Special Security Force
shall wear half-sleeved grey-black coloured plain (Pantone 18-4005 TCX) safari
dress during summers and plain trousers and full-sleeved shirt of the same
colour and cloth; and a blazer shall be worn during winters.
(g)
The Head of Department shall determine
the flag of the Special Security Force with the approval of Director General of
Police and shall issue a standing order.
(2)
Vehicles/Carriages
The
Director General of Police or Additional Director General of the Force shall
determine, from time to time, the numbers and kinds of vehicles/carriages
needed commensurate with the requirements of the Force; and these shall be
included in the fleet upon the approval of the Government.
(3)
Arms and ammunitions
The
Director General of Police or Additional Director General of Special Security
Force shall determine, from time to time, the quantity and the kind of modern
and technologically superior weaponry, commensurate with developing security
challenges and the requirements of the Force; and these shall be inducted in
the Force upon the approval of the Government.
(4)
Equipment’s
The
Director General of Police or Additional Director General of Special Security
Force shall determine, from time to time, the type of the state-of-the-art equipment’s
and their numbers commensurate with the widening security challenges and the
requirements of the Force: and that these shall be included in the Force upon
the approval of the Government.
Rule - 24. Enhancement of Manpower of the force.
Under
Section 9 of the Act. during actual deployment of the force or otherwise, the
Director General of Police is satisfied that additional manpower needs to be
added to the strength of the force for the time being, he may approve such
strength to be deployed from Pradeshik Armed Constabulary and/or Civil Police
to enhance the man power of the force, for such period as he may order.
Rule - 25. Savings.
Nothing in
these rules shall affect such reservations and other concessions, in the
matters of which the Government through its Acts and Orders, issued from time
to time, desires that provisions be made for Scheduled Castes. Schedule Tribes
and other special category persons.
Rule - 26. Overriding clause.
Notwithstanding
anything to the contrary in any other rules framed or Government orders issued
or administrative instructions issued by the Government, the provisions under
these rules shall prevail.
