In exercise of the powers under clause (c) of
sub-section (2) of Section 46 read with sub-section (3) of the said section and
Section 2 of the Police Act, 1861 (Act No. 5 of 1861) and all other powers
enabling him in this behalf and in supersession of all existing rules or orders
issued in this behalf, the Governor is pleased to make the following rules with
a view to regulating the selection, promotion, training, appointment,
determination of seniority and confirmation etc. of Constables and Head
Constables of the Police in Uttar Pradesh Police Force.
PART I: GENERAL
Rule
- 1. Short title and
commencement.
(1) These rules shall be called the Uttar Pradesh Police Constable and
Head Constable Services Rules, 2015.
(2) The shall come into force from the date of their publication in
the Gazette.
Rule
- 2. Status of the Service.
The Uttar
Pradesh Constable and Head Constable Service is a service comprising Group 'C'
posts.
In these
rules unless there is anything repugnant in the subject or context
(a) 'Act' means the Uttar Pradesh Public Services (Reservation for
Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act, 1994 (U.P.
Act No. 4 of 1994) as amended from time to time;
(b) 'Appointing Authority' means the Superintendent of Police;
(c) 'Board' means the Uttar Pradesh Police Service Recruitment and
Promotion Board, established in accordance with Government orders issued from
time to time in this regard;
(d) 'Constitution' means the Constitution of India;
(e) 'Citizen of India' means a person who is or is deemed to be a
citizen of India under Part II of the Constitution;
(f) 'Department' means the Department of Police Uttar Pradesh;
(g) 'Government' means the State Government of Uttar Pradesh;
(h) 'Governor' means the Governor of Uttar Pradesh;
(i) 'Head of the Department' means the Director General of Police,
Uttar Pradesh;
(j) 'Service' means the Uttar Pradesh Police Constable and Head
Constable Service;
(k) 'Member of Services' means a person appointed under these rules or
any previous rules before the commencement of these rules and has been
substantively appointed to a post in the service;
(l) 'Other Backward Classes of Citizen' means the backward classes of
citizens specified in Schedule I of the Act;
(m) 'Police Headquarters' means the Headquarters of the Director
General of Police, Uttar Pradesh at Lucknow or Uttar Pradesh Police
Headquarters at Allahabad;
(n) 'Selection Committee' means the Committee duly constituted by the
Board to select candidates for appointment to the post in the service;
(o) 'Substantive Appointment' means an appointment, not being an
ad-hoc appointment, on a post in the cadre of the service, made after selection
in accordance with these rules and, if there were no rules, in accordance with
the procedure prescribed for the time being by executive instructions issued by
the Government;
(p) 'Year of Recruitment' means a period of twelve months commencing
on the first day of July of a calendar year.
PART II: CADRE
Rule
- 4. Cadre of service.
(1)
The
strength of the service and of each category of posts therein shall be such as
may be determined by the Government from time to time.
(2)
The
strength of the service and of each category of posts therein shall, until
orders varying the same are passed under sub-rule (1), be as given below

Provided that,
(i)
the
Head of the Department may re-determine the number of posts of various units
within the overall sanctioned allocation;
(ii)
the
appointing authority may leave unfilled or the Governor may hold in abeyance
any vacant post, without any kind of claim to compensation; or
(iii) the Governor may
create such additional permanent or temporary posts as he may consider proper.
PART III: RECRUITMENT
Rule
- 5. Source of recruitment.
Recruitment to the various categories of
posts in the service shall be made from the following sources
(1)
Police
Constablehundred per cent posts of Police constables shall be filled by direct
recruitment through the Board.
Note. Dependants of personnel of police
department deceased during service who apply for the post of Police Constable
in the dependant of deceased category shall be recruited by the Board as per
the policy decided by the Government.
(2)
Head
Constable
(a)
hundred
per cent of the total number of sanctioned posts of Head Constable shall be
filled by promotion by the Board on the basis of seniority subject to rejection
of unfit, from amongst substantively appointed constables of police who have
completed seven years of service as such on the first day of the year of
recruitment, including the probation period.
(b)
such
Constable of Police promoted to ex-cadre posts of Head Constable Police shall
also be eligible for promotion under sub-section (a) who fulfil the
requirements.
Reservation for the candidates belonging to
the Scheduled Castes, Scheduled Tribes and other categories shall be in
accordance with the provisions of the Act and the Uttar Pradesh Public Services
(Reservation for Physically Handicapped, Dependents of Freedom Fighters and
Ex-Servicemen) Act, 1993 as amended from time to time and the orders of the
Government in force at the time of the recruitment. The reservation of the
National/State level sportsmen shall be in accordance with the Government
Orders in force at the time of recruitment provided that physically handicapped
persons will not be eligible for police services.
PART IV: QUALIFICATIONS
A candidate for direct recruitment to a post
in the service must be
(a)
a
citizen of India; or
(b)
a
Tibetan Refugee who came over to India before the 1st January, 1962, with the
intention of permanently settling in India; or
(c)
a
person of Indian origin who has migrated from Pakistan, Burma, Sri Lanka or any
of the East African Countries of Kenya, Uganda and the United Republic of
Tanzania (formerly Tanganyika and Zanzibar) with the intention of permanently settling
in India:
Provided that a candidate belonging to
category (b) or (c) above must be a person in whose favour a certificate of
eligibility has been issued by the State Government:
Provided further that a candidate belonging
to the category (b) will also be required to obtain a certificate of
eligibility granted by the Deputy Inspector General of Police, Intelligence
Branch, Uttar Pradesh:
Provided also that if a candidate belongs to
category (c) above, no certificate of eligibility will be issued for a period
of more than one year and the retention of such a candidate in service beyond
the period of one year shall be subject to his acquiring Indian Citizenship.
Note. A candidate in whose case a
certificate of eligibility is necessary but the same has neither been issued
nor refused, may be admitted to an examination or interview and he may also be
provisionally appointed subject to the necessary certificate being obtained by
him or issued in his favour.
Rule
- 8. Academic Qualification.
A candidate for direct recruitment to the
post of Police Constable must possess the qualification of 10th and 12th
standard by a Board established by law in India or a qualification recognized
by the Government as equivalent thereto.
Rule
- 9. Preferential
Qualification.
Other things being equal a candidate for
direct recruitment shall be given preference who has
(i)
obtained
"O" Level Certificate in Computer from DOEACC/NIELIT Society;
(ii)
Has
served for minimum of two years in Territorial Army; or
(iii)
Has
obtained a 'B' Level Certificate of National Cadet Corps.
Note. Above noted preferential
qualification shall carry no marks, but in the event of two or more candidates
having equal marks, candidates with preferential qualifications shall be given
preference in final selection list under Rule 15(e).
For direct recruitment to the post of
constable it is necessary that male candidate must have attained the age of 18
years and must not have attained the age of 22 years and female candidate must
have attained the age of 18 year and must not have attained the age of 25 years
on the first day of July of the calendar year in which vacancies for direct
recruitment are advertised:
Provided that the upper age limit in the case
of candidates belonging to the Scheduled Castes, Scheduled Tribes and such
other categories may be greater by such number of years as may be specified in
the Act and Government Orders applicable at the time of the notification of the
vacancies by the Board.
The character of a candidate for direct
recruitment to a post in the service must be such as to render him suitable in
all respect for employment in Government Service. The appointing authority
shall satisfy itself on this point.
Note. Persons dismissed by the Union
Government or any State Government or by a Local Authority or by a Corporation
or Body owned or controlled by the Union Government or any State Government
shall be ineligible for appointment to the service. Persons convicted of an
offence involving moral turpitude shall also be ineligible.
A male candidate who has more than one wife
living or a female candidate who has married a man already having a wife living
shall not be eligible for appointment to a post in the service:
Provided that the Government may, if
satisfied that there exist special grounds for doing so, exempt any person from
the operation of this rule.
Rule
- 13. Physical fitness.
No candidate shall be appointed to a post in
the service unless he is in good mental and bodily health and free from any
physical defect likely to interfere with the efficient performance of his
duties. Before a candidate is finally approved for appointment, he shall be
required to pass an examination by a Medical Board.
Note. The Medical Board shall examine
the candidate for any physical standards prescribed for height, chest and
weight measurement as the case may be and deficiencies such as Knock Knee,
bow-legs, flat feet, varicose veins, distant and near vision, colour blindness
(total or partial), hearing test comprising of Rinne's Test, Webber's Test and
tests for vertigo, speech defects etc., and such other deficiencies as may be
notified by the State Government from time to time.
PART V: PROCEDURE FOR RECRUITMENT
Rule
- 14. Determination of vacancies.
The appointing authority shall determine and
intimate to the Head of the Department the number of vacancies to be filled
during the course of the year of recruitment as also the number of vacancies
reserved for candidates belonging to Scheduled Castes, Scheduled Tribes and
other categories under Rule 6. The Head of the Department shall intimate the
number of vacancies for both male and female candidates separately, to the
Board and also to the Government. Subsequently the Board shall notify the vacancies
for both male and female candidates separately in the following manner
(i)
by
issuing advertisement in daily Hindi and English newspapers having wide
circulation;
(ii)
by
pasting the notice on the notice board of the office or by advertising through
Radio/Television and other Employment newspapers;
(iii)
by
notifying vacancies to the Employment Exchange; and
(iv)
by
other means of mass communication.
Rule
- 15. Procedure for Direct
Recruitment to the post of Constable.
(a)
Application
Form
(i)
A
candidate shall fill only one application Form. The Board will accept only
online applications. The application of candidates, who fill more than one
Forms, may be rejected by the Board.
(ii)
The
details of the information regarding educational qualification, age, minimum
qualifying standards for each category of examination, including physical,
medical examination etc., other important guidelines as determined by the Board
from time to time shall be made available by the Board on its own website and
or by other means as it deems necessary.
(iii)
The
applications shall be invited by the Board giving the applicants adequate time
for making application, the candidate shall be personally and solely
responsible for its accuracy and completeness, if the Form of any candidate is
found incomplete, wrong or having inaccurate information, it may be cancelled
and the decision of the Board in this regard shall be final.
(iv)
An
applicant shall certify himself his certificates and documents and be
responsible for their genuineness and correctness.
(v)
In
the Application Form the detail of the identity, specific identity card number,
thumb and finger impression, photographs or bio-matrix details will be so
included as determined by the Board from time to time.
(vi)
The
Head of the Department may fix an application fee for any recruitment in
consultation with the Recruitment Board.
(vii)
The
Board shall have the right to summarily reject the candidature of an applicant
for any incompleteness or inaccuracy or variation or conflict with any previous
or subsequent information submitted by the candidate.
(viii)
The
Government may change the number of vacancies for any recruitment at any time
before the first examination and may also cancel any recruitment at any time or
stage of recruitment without assigning any reason thereof.
(b)
Merit
List on the basis of 10th and 12th examination resultsAll such candidates whose
application forms are found correct, shall be awarded marks on the basis of
their 10th and 12th standard Board examination results, or qualification
equivalent thereto, as provided under clause (8) of these rules. For awarding
these marks, maximum of 100 marks will be awarded on the basis of 10th standard
Board examination and maximum of 200 marks will be awarded on the basis of 12th
standard Board examination. The marks such awarded to them will be counted up
to second digit after decimal point and will be awarded as per following
procedure
(1)
Marks
awarded on the basis of 10th examination result = percentage of marks obtained
by the candidate in 10th standard Board or examination equivalent thereto.
(2)
Marks
awarded on the basis of 12th examination result = 2 x percentage of marks
obtained by the candidate in 12th standard Board or examination equivalent
thereto.
If any examination Board, awards grades in
place of marks to the candidates, in above mentioned 10th and 12th examination,
then Board shall proceed only after taking information from concerned
examination Board, regarding marks to be a awarded equivalent to corresponding
grades. Candidates shall be awarded total marks on the basis of sum total of
marks awarded to them on the basis of 10th class examination results and marks
awarded to them on the basis of 12th class examination results, as above. All
candidates will be awarded total marks as per sum total of marks awarded as
above, out of a maximum of 300 marks and a list in the order of merit will be
prepared on the basis of these total awarded marks. Out of the merit list such
prepared, candidates equal to 15 times the number of total vacancies, on the
basis of merit shall be called for Physical Efficiency Test. If more than one
candidates are found on the marks obtained by the last candidate in the merit
list then all such candidates shall be considered eligible for Physical
Efficiency Test.
(c)
Physical
Efficiency Test.
All Candidates declared eligible in the merit
list under clause (b) shall be required to participate in Physical Efficiency
Test which shall be of 200 marks. The procedure for conducting the Physical
Efficiency Test shall be as prescribed in Appendix 1.
(d)
Scrutiny
of Documents & Physical Standard Test.
The scrutiny of documents & Physical
Standard Test of candidates selected under clause (c) mentioned above shall be
done according to Appendix 2. In case any document is found to be manipulated,
inaccurate or forged during the scrutiny or at anytime after the scrutiny, the
candidature of the applicant will be cancelled at the discretion on the Board
or the Appointing authority as the case may be.
(e)
Selection
and Final Merit List.
From amongst the candidates found successful
after Physical Standards Test and scrutiny of documents under clause (d), the
Board shall prepare, as per the vacancies, a select list of each category of
candidates, on the basis of sum total of, marks awarded to each candidate on
the basis of 10th and 12th examination results as per clause (b) and marks
obtained by him in physical efficiency test as per clause (c), keeping in view
the reservation policy and send it with recommendation to the head of the
department subject to character verification, medical examination and 10th and
12th examination mark sheet verification. No waiting list shall be prepared by
the Board. List of all candidates with marks obtained by each candidate shall
be uploaded on its website by the Board. The Head of the Department shall after
his approval forward the list sent by the Board to the concerned Authority for
further action.
Note. If two or more than two candidates
obtain equal marks then the merit list shall be decided according to the
following procedure
(1)
If
marks of two or more candidates are equal then candidate obtaining higher
marks, as per total marks awarded in clause (b), will be given preference.
(2)
If
two or more candidates are equal even after this the candidates who have the
preferential qualification (in the same order as stated in Rule 9) will be
given preference. Candidate having more than one preferential qualification
shall get the benefit of only one preferential qualification.
(3)
Even
then if two or more candidates have equal marks then candidate older in age
shall be given preference.
(4)
If
despite the aforementioned more than one candidate are equal, then preference
to such candidate shall be determined according to the order in English
Alphabets of their names mentioned in High School Certificate.
(f)
Verification
of 10th and 12th examination marks sheets.
While preparing the final select list, the
Board will send for verifications to the concerned Education Board, the 10th
and 12th class mark sheets of all candidates, include in the select list. As
and when their verification reports from concerned Education Boards are
received, the Board will send them separately to Police Headquarter later on,
who will subsequently send it to the Appointing Authority for necessary action.
If as per report sent by concerned Educations Board, the 10th or 12th
examination marks sheets of any candidate, is not verified, then such candidate
shall be declared unfit by the Appointing Authority and such vacancies shall be
carried forward for new selection.
(g)
Medical
Examination.
The candidates whose name are in the select
list sent as per clause (e), will be required to appear for Medical Examination
by the Appointing authority. Medical Examination will be conducted in the
Police Line of the concerned District or at the place mentioned by the Appointing
authority. Medical Examination will be conducted as per Appendix 3. The
candidates found unsuccessful in Medical Examination shall be declared unfit by
the Appointing authority and such vacancies shall be carried forward for next
selection.
Rule
- 16. Character Certificate
Verification.
Character Verification shall be completed
under the supervision of appointing authority before issuing of appointment
letter and before sending the candidates for training. Ordinarily character
verification shall be completed within a month. On adverse fact coming to light
during character verification of any candidate, he shall be declared unfit by
the appointing authority and such vacancies shall be carried forward for next
selection.
Rule
- 17. Procedure for promotion to
the post of Head Constable.
(1)
The
appointment to the post of the Head Constable shall be made from amongst the
eligible personnel substantively appointed as constable Police according to the
following policy
(a)
100
per cent of the total sanctioned posts of the Head Constable shall be filled by
recruitment through promotion on the basis of seniority subject to rejection of
unfit from amongst such substantively appointed constables police who have
completed seven years of service including probation period on the first day of
the year of recruitment.
(b)
Such
constables Police promoted to ex-cadre post of Head Constable Police shall also
be eligible for promotion to the posts of Head Constable Police under clause
(a) who fulfil the qualifications.
(2)
Selection
Committee for Promotion.
(a)
The
selection committee for promotion shall be constituted by the Board.
(b)
The
Chairman of the committee will be nominated by the Board and shall not be
junior in rank than the Appointing Authority for the promotional post for which
the selection committee is constituted. One member of appropriate rank shall be
nominated by the Head of the Department in the committee and remaining members
of the committee shall be nominated by the Board according to prevalent
Government Orders.
(c)
Undisputed
seniority list for promotion shall be made available by the Police Headquarters
to the Board.
(d)
The
Selection Committee shall submit the result of successful candidates along with
its recommendation to the Board. The Board shall submit the list of selected
candidates along with its recommendation to Head of the Department. The list
shall not be more than the notified vacancies.
(e)
The
Head of the Department shall after his approval send the List to Appointing
Authority who will issue final orders for promotion.
(f)
After
approval by the Head of Department, Final list of candidates selected for
promotion shall be displayed by the Board on its website and U.P. Police
website.
PART VI: TRAINING, APPOINTMENT,
PROBATION, CONFIRMATION AND SENIORITY
(1)
Subject
to the provisions of Rules 15 and 16 the appointing authority shall make
appointment by taking the names of candidates in the same order in which they
stand in the list prepared under clause (g) of Rule 15. The appointing
authority shall issue the appointment letter to the candidates with the
direction that they should report for service/training within one month of the
date of issue of the letter or any date specified for this purpose in the
appointment letter. If he does not do so his selection/appointment shall be
cancelled:
Provided that any person appointed to a post
in the service prior to the commencement of these rules and is working on the
post, shall be deemed to have been substantively appointed under these rules.
(2)
If
more than one order of appointments are issued in respect of any one selection
under Rule 17, then a combined order shall also be issued, mentioning the names
of the persons in order of seniority as determined in the selection or, as the
case may be, as it stood in the cadre from which they are promoted:
Provided that any person appointed before the
commencement of these rules to a post in the service and working on that post
shall be deemed to have been substantively appointed under these rules and such
substantive appointment shall be deemed to have been made under these rules.
(1)
(a)
The candidates finally selected to the posts of constable under Rules 15 and 16
shall be required to pass the training prescribed by the Head of the
Department. Provisions of Police Training College Manual shall be effective on
the cadets during the basic training. If the candidate finally selected for
basic training does not report for training within the prescribed time limit
then his selection/candidature shall be cancelled.
(b) Re-examination of the cadets failing in
basic training shall be organized by the Head of the Department after doing
supplementary training. The proceeding for termination of service of candidates
failing in examination of training after supplementary training shall be done
by the Appointing Authority.
(2)
The
candidates appointed by promotion under Rule 17 shall be required to complete
the training prescribed by the Head of the Department.
(1)
A
person on substantive appointment to a post in the service shall be placed on
probation for a period of two years.
(2)
During
the probation period a probationer shall be required to undergo such training
as may be determined by the Head of Department.
(3)
The
appointing authority may, for reasons to be recorded, extend the period of
probation in individual cases specifying the date up to which extension is
granted:
Provided that, except in exceptional
circumstances, the period of probation shall not be extended beyond one year
and in no circumstances, beyond two years.
(4)
If
it appears to appointing authority at any time during or at the end of the
period of probation or extended period of probation that a probationer has not
made sufficient use of his opportunities or has otherwise failed to give
satisfaction, he may be reverted to his substantive post, if any, and if he
does not hold a lien on any post, his services may be dispensed with.
(5)
A
probationer who is reverted or whose services are dispensed with under sub-rule
(4) shall not be entitled to any compensation.
(6)
The
appointing authority may allow continuous service, rendered in officiating or
temporary capacity in a post included in the cadre or any other equivalent or
higher post to be taken into account for the purpose of computing the period of
probation.
(1)
Subject
to the provisions of Rule 20 a probationer shall be confirmed in his
appointment at the end of the period of probation or the extended period of
probation if,
(a)
he
has successfully undergone the prescribed training; and
(b)
his
work and conduct is reported to be satisfactory; and
(c)
his
integrity is certified.
(2)
Where
in accordance with the provisions of the Uttar Pradesh State Government
Servants Confirmation Rules, 1991, confirmation is not necessary, the order
under sub-rule (3) of Rule 5 of the said rules declaring that the person
concerned has successfully completed the probation shall be deemed to be the
order of confirmation.
Seniority of persons substantively appointed
to any posts of service shall be determined as follows
(1)
Determination
of seniority of constables recruited before December 2, 2008
(a)
Seniority
of all constables appointed by means of a single selection shall be determined
on the basis of the marks obtained by them in training after selection in
training institutions;
(b)
Constables
appointed by previous selection shall be senior to constables appointed by
subsequent selection.
Note. If marks obtained in training are
not available for all the constables coming within the purview of promotion
then promotion shall be done batch wise according to the following policy
(1)
Year
of the date of recruitment shall be considered as "Year (Batch)".
(2)
Constables
appointed in previous "Year (Batch)" shall be senior to constables
appointed in subsequent "Year (Batch)".
(3)
No
seniority shall be determined from the order in which the names of constables
appear in the list prepared year wise (batch wise).
(2)
Determination
of seniority of constables recruited after December 2, 2008
(1)
Seniority
of Constable appointed by any type of selection shall be determined from their
date of selection. Here date of selection means the date on which the head of
department approves the select list sent by the Board after the completion of
recruitment process.
(2)
Selection
of constables by the Board by means of direct recruitment shall be considered a
separate selection. Inter-se seniority of constables recruited in a single
selection under direct recruitment shall be according to the order of the final
select list issued by the Board.
(3)
Constables
recruited under the dependents of deceased category and constables recruited
under the Skilled Sportsmen Rules, 2011 shall be considered a separate
selection of direct recruitment. The inter-se seniority of constables so
recruited shall be determined according to the percentage of marks obtained by
them in training after selection in training institutions. In one training
session if percentage of marks obtained in training institutions are same for
more than one candidate then senior in age according to date of birth shall be
senior in determination of inter-se seniority. In case of percentage of marks
and date of birth being same the seniority shall be determined according to the
alphabetical order of the names in High School Certificates in English.
(4)
Constables
appointed by previous selection shall be senior to constables appointed by
subsequent selection.
(3)
Determination
of seniority of head constables promoted before December 2, 2008
(1)
Seniority
of Head Constable Police shall be determined from the date of joining as Head
Constable of Police.
(2)
If
date of joining as Head Constable is same for more than one Head Constables
then seniority shall be determined according to the date of joining as
Constable.
(3)
If
date of joining as Head Constable and date of joining as Constable is same for
more than one Head Constables then seniority shall be determined according to
the date of birth the Head Constable senior in age shall be senior.
(4)
If
date of joining as Head Constable, date of joining as Constable and date of
birth is same for more than one Head Constables then seniority shall be
determined according to the alphabetical order of the names in High School
Certificates in English.
(4)
Determination
of seniority of head constables promoted after December 2, 2008.
Seniority of Head Constables appointed on the
basis of promotion shall be determined from their date of selection. Inter-se
seniority of Head Constables appointed on same date of selection shall be
according to their authority in their feeder cadre and head constables selected
in previous year shall be senior to head constables selected in subsequent
year. Here date of selection means the date on which the head of department
approves the select list sent by the Board after the completion of recruitment
process.
But in case of batch wise promotion from the
post of constable to head constables the seniority on the post of head
constable shall be determined as per the following policy
(1)
Head
Constables substantially appointed before December 2, 2008 shall be senior to
those head constables promoted subsequently.
(2)
Constables
appointed in previous "Year (Batch)" who are found suitable for
promotion shall be senior to constables appointed in subsequent "Year
(Batch)".
(3)
Amongst
promoted constables having same "Year (Batch)", the constable whose
date of appointment to the post of constable is previous shall be senior as
head constable to the constable whose date of appointment to the post of
constable is subsequent.
(5)
Amongst
promoted constables having same "Year (Batch)" and whose date of appointment
to the post of constable is also same, their inter-se seniority on the post of
head constable shall be determined according to the percentage of total marks
obtained in training as Head Constable.
(6)
Amongst
promoted constables having same "Year (Batch)", same date of
appointment to the post of constable and same percentage of total marks
obtained in training as Head constable, their inter-se seniority on the post of
head constable shall be determined according to the percentage of marks obtained
in outdoor training as Head Constable and in case of that being equal it shall
be determined according to the date of birth the Head Constable senior in age
shall be senior.

The
seniority in some special case determined according to a previously determined policy
shall remain the same.
(6)
Despite
the aforesaid if new facts come to light about seniority determination or in
case some dispute arises then it shall be resolved by the head of department.
PART VII: PAY ETC.
(1)
The
scales of pay admissible to persons appointed to the various categories of
posts in the Service shall be such as may be determined by the Government from
time to time.
(2)
The
scales to pay at the time of the commencement of these rules are given as
follows:

Rule
- 24. Pay during Probation.
(1)
Notwithstanding
any provision in the Fundamental Rules to the contrary, a person on probation,
if he is not already in permanent Government Service shall be allowed his first
increment in the time scale when he has passed departmental examination and
undergone training where prescribed and second increment when he has completed
the probationary period and is also confirmed:
Provided that if the period of probation is
extended on account of failure to give satisfaction, such extension shall not
count for increment unless the appointing authority directs otherwise.
(2)
The
pay during probation of a person who was already holding a post under the
Government shall be regulated by the relevant fundamental rules:
Provided that if period of probation is
extended on account of failure to give satisfaction such extension shall not
count for increment unless the appointing authority directs otherwise.
(3)
The
pay during probation of a person who was already in permanent Government
Service shall be regulated by the relevant rules, applicable generally to
Government Servants serving in connection with the affairs of the State.
PART VIII : OTHER PROVISIONS
No recommendations, either written or oral,
other than those required under the rules applicable to the post in the service
will be taken into consideration. Any attempt on the part of a candidate to
enlist support directly or indirectly for his candidature will disqualify him
for appointment.
Rule
- 26. Regulation of other
matters.
In regard to the matters not specifically
covered by these rules or special orders persons appointed to the post in the
service shall be governed by the rules, regulations and orders made under the
Police Act.
Rule
- 27. Relaxation from the
conditions of service.
Where the State Government is satisfied that
the operation of any rule, regulating the conditions of service of persons
appointed to the post in the service causes undue hardship in any particular
case, it may, notwithstanding anything contained in the rules applicable to the
case, by order, dispense with or relax the requirements of that rule to such
extent and subject to such conditions as it may consider necessary for dealing
with the cases in just and equitable manner.
Nothing in these rules shall affect
reservations and other concessions required to be provided for the candidates
belonging to the Scheduled Castes, Scheduled Tribes and other special
categories of persons in accordance with the orders of the Government issued
from time to time in this regard.
