Uttar Pradesh Palika (Centralised) Services (Twenty-Eighth Amendment) Rules, 2024

PREAMBLE

WHEREAS, the Uttar Pradesh Palika (Centralised) Services (Twenty-eighth Amendment) Rules, 2024 which the Governor proposes to make in exercise of the powers under section 112 - A of the Uttar Pradesh Municipal Corporation Act, 1959 (Act no. 2 of 1959) and Section 69B Uttar Pradesh Municipalities Act. 1916 (Act no. 2 of 1916) read with Section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no.1 of 1904) with a view to amend the Uttar Pradesh Palika (Centralised) Service Rules, 1966 were published vide Notification no. 876/9-4-2023-5J-2011, dated 15 March, 2024 as required by sub-section (2) of Section 540 of the aforesaid Act of 1959 and Section 300 of the aforesaid Act of 1916 for the information of all concerned and with a view to invite objections and suggestions in respect thereof within a period of 30 days from the date of publication of the said notification in the official Gazette.

AND, WHEREAS, the aforesaid period of 30 days was further extended by 15 days vide Order no. 1108/9-4-24-05J/2011, dated 12-04-2024 of Nagar Vikas Anubhag-4;

AND, WHEREAS, the objections or suggestions received within the aforesaid period have been considered by the Uttar Pradesh Government vide Order no. 2477/9-4-24-05 J/2011 dated 08-08-2024.

NOW, THEREFORE, in exercise of the powers under Section 112-A of the Uttar Pradesh Municipal Corporation Act, 1959 (Act no. 2 of 1959) and Section 69-B of the Uttar Pradesh Municipalities Act, 1916 (Act no. 2 of 1916) read with Section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904), the Governor is pleased to make the following rules, namely:-

Rule 1. Short title, application and commencement.

(1)     These rules shall be called the Uttar Pradesh Palika (Centralised) Services (Twenty-eighth Amendment) Rules, 2024.

(2)     They shall be applicable to all the Municipal Corporations, Municipal Councils and Nagar Panchayats in the state of Uttar Pradesh.

(3)     They shall come into force with effect from the date of their publication in the official Gazette.

Rule 2. Amendment of rule 3.

In the Uttar Pradesh Palika (Centralised) Service Rules, 1966, (hereinafter referred to as the "said rules", for rule 3 set out in Column-I below the rule as set out in Column- II shall be substituted, namely:-
