PRADESH GOVERNMENT INDUSTRIAL TRAINING INSTITUTES (INSTRUCTORS AND FOREMAN
INSTRUCTORS) SERVICE RULES, 2021
PREAMBLE
In exercise of the powers
conferred by the proviso to Article 309 of the Constitution and in supersession
of all existing rules and orders on the subject, the Governor is pleased to
make the following rules regulating recruitment and the conditions of service
of persons appointed to the Uttar Pradesh Government Industrial Training
Institutes (Instructors and Foreman Instructors) Service.
PART
I
GENERAL
Rule - 1. Short title and commencement.
(1)
These rules may be called the Uttar Pradesh
Government Industrial Training Institutes (Instructors and Foreman Instructors)
Service rules, 2021.
(2)
They shall come into force at once.
Rule - 2. Status of the Service.
The Uttar Pradesh Government
Industrial Training Institute (Instructor and Foreman Instructors) Service is a
service comprising Group 'C' Posts.
Rule - 3. Definitions.
In these rules, unless there
is anything repugnant in the subject or context:
(a)
'Act' means the Uttar Pradesh Public Services
(Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes)
Act, 1994;
(b)
'Appointing authority' means the Director,
Training and Employment, Uttar Pradesh;
(c)
'Citizen of India' means a person who is or
is deemed to be a citizen of India under Part II of the Constitution;
(d)
'Commission' means Uttar Pradesh Subordinate
Services Selection Commission;
(e)
'Constitution' means the Constitution of
India;
(f)
'Crafts Instructor Training Scheme (CITS)'
means the training scheme of the National Council for Vocational Training
(NCVT) for preparing trained instructors for Industrial Training Institutes;
(g)
'Government' means the State Government of
Uttar Pradesh;
(h)
'Governor' means the Governor of Uttar Pradesh;
(i)
'Member of the service' means a person
substantively appointed under these
(j)
rules or the rules or orders in force prior
to the commencement of these rules to a post in the cadre of the service;
(k)
'National Craft Instructor Certificate
(NCIC)' for a trade means a certificate awarded by NCVT upon successful
completion of training under CITS or in case of modular pattern the combined
certificate awarded by NCVT upon successful completion of all the prescribed
modules;
(l)
'National Council for Vocational Training
(NCVT)' means the council set up by Directorate General of Training (DGT),
Under Ministry of Skill Development and Entrepreneurship Government of India
for regulating the vocational training throughout India;
(m)
'National Trade Certificate (NTC)' in a trade
means the certificate awarded by the NCVT Upon successfully passing the
All-India Trade Test in that trade.
(n)
'National Apprenticeship Certificate (NAC)'
in a trade means the certificate awarded by the NCVT upon successfully passing
the National Apprenticeship Test;
(o)
'other backward classes of citizens' means
the backward classes of citizens specified in Schedule I of the Act, as amended
from time to time;
(p)
'Principles of Teaching (POT) Certificate'
means the certificate awarded by NCVT upon successful completion of the
relevant training or the completion of the module on Training Methodology under
the modular pattern of CITS;
(q)
'Service' means the Uttar Pradesh Government
Industrial Training Institutes (Instructors & Foreman Instructor) Service;
(r)
'State Council for Vocational Training
(SCVT)' means a Council set up by the State Government corresponding to the
National Council of Vocational Training to deal with all matters relating to
vocational training at the level of the State;
(s)
'Subject' means and includes subjects such as
Workshop Calculation and Science, Engineering Drawing, and Employability
Skills, and any other subject which may be notified by the NCVT as a required
subject to be taught as a part of the Craftsmen Training Scheme (CTS);
(t)
'substantive appointment' means an
appointment not being an ad-hoc appointment, on a post in the cadre of the
service, made after selection in accordance with the rules and, if there were
no rules, in accordance with the procedure prescribed for the time being by
executive instructions issued by the Government;
(u)
'Trade' means a vocation or occupation which
is notified by the National Council for Vocational Training or the State
Council for Vocational Training in Industrial Training Institutes under the
Craftsmen Training Scheme;
(v)
'year of recruitment' means a period of
twelve months commencing on the first day of July of a calendar year.
PART
II
CADRE
Rule - 4. Cadre of service.
(1)
The number of posts for Instructors and
Foreman-Instructors in the service shall be determined by the Government from
time to time.
(2)
The number of posts for Instructors and
Foreman-Instructors in the service shall, until orders varying the same are
passed under sub-rule (1), be as given in column 3 of the Appendix:
Provided that:-
(i)
the appointing authority may leave unfilled
or the Governor may hold in abeyance any vacant post, without, thereby
entitling any person to compensation; or
(ii)
the Governor may create such additional
permanent or temporary posts as he may consider proper.
PART
III
RECRUITMENT
Rule - 5. Source of Recruitment.
Recruitment to the various
categories of posts in the service shall be made from the following sources:
Name of Post
(1)
Instructor-
(a)
hundred percent by direct recruitment through
commission :-
(i)
fifty percent by degree/diploma candidates.
(ii)
fifty percent by NTC/NAC candidates.
(2)
Foreman-Instructor- By promotion through the
Departmental selection committee from amongst substantively appointed
Instructor who have completed ten years service as such on the first day of the
year of recruitment.
Rule - 6. Reservation.
Reservation for the
candidates belonging to the Scheduled Castes, Scheduled Tribes, and other
categories shall be in accordance with the Act, and the Uttar Pradesh Public
Services (Reservation for Physically handicapped, Dependents of Freedom
Fighters, Ex-Servicemen) Act, 1993 and The Uttar Pradesh Public Services
(Reservation For Economically Weaker Sections) Act, 2020 as amended from time
to time, and the orders of the Government in force at the time of the
recruitment.
PART
IV
QUALIFICATION
Rule - 7. Nationality.
A candidate for recruitment
to a post in the Service must be:-
(a)
a citizen of India; or
(b)
Tibetan refugee who came over to India before
the 1st January, 1962 with the intention of permanently settling in India; or
(c)
a person of Indian origin who has migrated
from Pakistan. Burma, Sri Lanka or any of the East African countries of Kenya,
Uganda and the United Republic of Tanzania (formerly Tanganyika and Zanzibar)
with the intention of permanently settling in India:
Provided that also a
candidate belonging to category (b) or (c) above must be a person in whose
favour a certificate of eligibility has been issued by the State Government:
Provided further that a
candidate belonging to category (b) will also be required to obtain a
certificate of eligibility granted by the Deputy Inspector General of Police,
Intelligence Branch, Uttar Pradesh:
Provided also that if a
candidate belongs to category (c) above, no certificate of eligibility will be
issued for a period of more than one year and the retention of such a candidate
in service beyond a period of one year, shall be subject to his acquiring
Indian citizenship.
NOTEA candidate in whose
case a certificate of eligibility is necessary but the same has neither been
issued nor refused, may be admitted to an examination and he may also be
provisionally appointed subject to the necessary certificate being obtained by
him or issued in his favour.
Rule - 8. Age.
A candidate for direct
recruitment to the post of Instructor in the service must have attained the age
of 21 years and must not have attained the age of more than 40 years on the
first day of July of the calendar year in which vacancies for direct
recruitment are advertised.
Provided that the upper age limit
in the case of candidates belonging to the Scheduled Castes, Scheduled Tribes,
and such other categories as may be notified by the Government from time to
time shall be greater by such number of years as may be specified.
Rule - 9. Academic & Technical qualification.
A candidate for direct
recruitment to the post of Instructor in the service must possess the following
qualifications:
(1)
Must have passed the High School Examination
of the Board of High School and Intermediate Education, Uttar Pradesh or an
Examination recognized by the Government as equivalent there to;
(2)
Must possess the qualifications for different
trades/subjects as prescribed in column 4 of the appendix.
(3)
Must possess relevant National Craft
Instructor Certificate (NCIC) in any of the variants under DGT and other
qualification if any, as prescribed in column 4 of Appendix.
Rule - 10. Experience.
For direct recruitment to
the post of Instructor in the service, a candidate must have experience of
working as prescribed in column 4 of Appendix. In case of an Industry
experience, Industry must be registered in accordance with government rules and
having a valid TIN/TAN number. In case of experience from Institutions,
candidate must have experience of working as a teacher/trainer, in relevant
field from reputed institution/college after declaration of the final result
and passing the final examination of the technical qualification. The
experience certificate must contain nature of work, duration of work and salary
paid to the candidate.
Rule - 11. Other Preferential qualification.
A candidate who has:-
(i)
served in the Territorial Army for a minimum
period of two years, or
(ii)
obtained a 'B' certificate of National Cadet
Corps, Shall, other things being equal, be given preference in the matter of direct
recruitment.
Rule - 12. Character.
The character of a candidate
for direct recruitment to a post in the service must be such as to render him
suitable in all respects for employment in Government service. The appointing
authority shall satisfy itself on this point.
Note- Persons dismissed by
the Union Government or a State Government or by a Local Authority or a
Corporation or Body owned or controlled by the Union Government or a State
Government shall be ineligible for appointment to any post in the service.
Persons convicted of an offence involving moral turpitude shall also be
ineligible.
Rule - 13. Marital Status.
A male candidate who has
more than one wife living or a female candidate who has married a man already
having a wife living shall not be eligible for appointment to a post in the
service:
Provided that the Government
may, if satisfied that there exist special grounds for doing so, exempt any
person from the operation of this rule.
Rule - 14. Physical fitness.
No candidate shall be appointed
to a post in the service unless he be in good mental and bodily health and free
from any physical defect likely to interfere with the efficient performance of
his duties. Before a candidate is finally approved for appointment, he shall be
required to produce a Medical Certificate of fitness in accordance with the
rules framed under Fundamental rule 10, contained in Chapter III of the
Financial Hand-Book, Volume II, Part III. But no needs of medical certificates
for promoted candidates on the post of Foreman Instructor.
For candidates belonging to
physically challenged category, applicable government rule shall be followed

PROCEDURE
FOR RECRUITMENT
Rule - 15. Determination of vacancies.
(1)
Determination of vacancies for Direct
Recruitment.
(a)
For direct recruitment determination of
vacancies on the Subject to the provisions of sub-rules (b) of this rule the
appointing authority shall determine the number of vacancies to be filled
during the course of the year of recruitment as also the number of vacancies to
be reserved for candidates belonging to Scheduled Castes, Scheduled Tribes, and
other Categories under rule 6. For making direct recruitment the appointing
authority shall prepare the vacancies chart in as above and will provide the
information of vacancies to commission.
(b)
The selecting authority will select the
candidates for the posts of Instructors for a trade/subject from amongst
candidates in two streams, namely (i) National Trade Certificate/National
Apprenticeship Certificate holders, and (ii) Diploma/Degree holders in the
proportion laid down in rule 5 as shall be requested by appointing authority:
Provided that if in any
trade/subject the existing strength of Instructors from any stream is in excess
of the proportion laid down for that stream, the said proportion shall be
gradually achieved by adjusting such excess numbers in future recruitments,
without affecting the incumbents:
Provided further that the
sum of the vacancies for both the streams shall not exceed the total number of
vacancies for that trade/subject.
(2)
Determination of vacancies for Promotion
For promotion on the post of
Foreman Instructors the appointing authority shall determine the number of
vacancies to the course of the year any permitted as rule 5(2) as per promotion
rule.
Rule - 16A. Procedure for direct recruitment.
(1)
Direct recruitment to the post of Instructor
in the service shall be made in accordance with the Uttar Pradesh Direct
Recruitment to Group 'C' posts (Mode and Procedure) Rules, 2015, as amended
from time to time.
(2)
In making selection for direct recruitment,
the merit list of the eligible candidates shall be prepared in view of sub rule
(1) in the following manner:-
(a)
Twenty percent of the percentage of marks
secured in CITS Examination shall be given to each candidate.
(b)
(i) After the results of the evaluations
under clause (a) have been received and tabulated, the selecting authority
shall conduct written examination. If the eligible candidates found more than
five times for any trade, then in such situation the number of candidates to be
called for written examination shall be five times the number of vacancies. For
this purpose, the merit list of candidates shall be prepared separately on the
basis of aggregate of marks obtained by them under clause (a) of sub-rule (2).
(ii) The written exam shall
carry one hundred marks. Eighty percent of the marks obtained in the written
exam shall be given to the each candidate.
(3)
The marks obtained by each candidate under
clause (a) of sub-rule (2) shall be added to the marks obtained by him under
clause (b)) (ii) of sub-rule (2). The final select list shall be prepared on
the basis of aggregate of marks so arrived. If two or more candidates obtain
equal marks in the aggregate, the candidate obtaining higher marks under clause
(b) (ii) of sub-rule (2) shall be placed higher in the select list. In case two
or more candidates obtain equal marks under clause (b) (ii) of sub-rule (2)
also, the candidate senior in age shall be placed higher in the select list.
(4)
The select list referred to in sub-rule (3)
shall be forwarded to the appointing authority.
Rule - 16B. Procedure for Recruitment by promotion through the Departmental selection committee.
(1)
Recruitment by promotion shall be made on the
basis of the criterion laid down in the Uttar Pradesh Government servants
criterion for Recruitment by Promotion Rules, 1994, as amended from time to
time, through the Selection Committee Constituted in accordance with the
provisions of the Uttar Pradesh Constitution of Departmental Promotion Committee
for Posts outside the purview of the service commission Rules, 1992, as amended
from time to time.
NOTE-Nomination of officers
for giving representation to the scheduled Castes/Scheduled Tribes and Other
Backward Classes of Citizens in the selection Committee shall be made in
accordance with the order made under section 7 of the Uttar Pradesh Public
Service (Reservation for Scheduled Castes, Scheduled Tribes and Other Backward
classes) Act 1994, as amended from time to time.
(2)
The appointing authority shall prepare
eligibility list of the candidates in accordance with the Uttar Pradesh
Promotion by Selection (on posts outside the purview of the Public Service
Commission) Eligibility list rules, 1986, as amended from time to time, and
place the same before the selection committee along with their character rolls
and such other records, pertaining to them, as may be considered proper:
"Provided that where
there are two or more feeding cadres-
(a)
bearing different pay scales, the candidates
belonging to the cadre bearing higher pay scale shall be placed higher in the
eligibility list,
(b)
bearing same pay scale, the names of the
candidates shall be arranged in the eligibility list in order of their date of
substantive appointment in their respective cadres, but of the date of
substantive appointment of two or more candidates in the same, them in such
situation the candidate who is older in age shall be placed higher in the
eligibility list".
(3)
The selection Committee shall consider the
cases of candidates on the basis of records, referred to in sub rule (2), and
if it considers necessary, it may interview the candidates also.
(4)
The Selection Committee shall prepare a list
of selected candidates in order of seniority as it stood in the cadre from
which are to be promoted and forward the same to the appointing authority.
PART
VI
APPOINTMENT,
PROBATION, AND SENIORITY
Rule - 17. Appointment.
(1)
The appointing authority shall make
appointment by taking the name of candidates in the order in which they stand
in the list prepared under rule 16.
(2)
If more than one order of appointment is
issued in respect of any one selection, a combined order shall also be issued,
mentioning the names of the persons in order of seniority as determined in the
selection by selecting authority.
Rule - 18. Probation.
(1)
A person on substantive appointment to a post
in the service shall be placed on probation in accordance with the Uttar
Pradesh Govt. Servants Probation rules, 2013, as amended from time to time.
(2)
If it appears to the appointing authority at
any time during or at the end of the period of probation or extended period of
probation that a probationer has not made sufficient use of his opportunities
or has otherwise failed to give satisfaction, his services may be dispensed
with.
(3)
A probationer who is reverted or whose
services are dispensed with under sub-rule (2) shall not be entitled to any
compensation.
Rule - 19. Confirmation.
(1)
Subject to the provisions of sub rule (2), a
probationer shall be confirmed in his appointment at the end of the period of
probation or the extended period of probation if,-
(a)
he passed the prescribed departmental
examination, if any,
(b)
he has successfully undergone the prescribed
training, if any,
(c)
his work and conduct are reported to be
satisfactory,
(d)
his integrity is certified, and
(e)
the appointing authority is satisfied that he
is otherwise fit for confirmation.
(2)
Where in accordance with the provisions of
the Uttar Pradesh State Government Servants Confirmation Rules, 1991,
Confirmation is not necessary, the order under sub rule (3) of rule 5 of those
rules declaring that the person concerned has successfully completed the
probation shall be deemed to be the order of confirmation.
Rule - 20. Seniority.
The seniority of persons
substantively appointed in any category of post in the service shall be
determined in accordance with the Uttar Pradesh Government Servants Seniority
Rules, 1991, as amended from time to time.

VII
PAY
ETC.
Rule - 21. Scales of pay.
(1)
The scale of pay admissible to persons
appointed to the various categories of posts in the service shall be such as
may be determined by the Government from time to time.
(2)
The scales of pay at the time of the
commencement of these rules are given as follows:

Rule - 22. Pay during probation.
(1)
Not withstanding any provision in the
fundamental Rules to the contrary, a person on probation, if he is not already
in permanent Government service, shall be allowed his first increment in the
time-scale when he has completed one year of satisfactory service, and second increment
after two years' service when he has completed the probationary period.
(2)
The pay during probation of a person who was
already holding a post under the Government, shall be regulated by the relevant
fundamental rules:
Provided that, if the period
of probation is extended an account of failure to give satisfaction, such
extended shall not count for increment unless the appointing authority directs
otherwise.
(3)
The pay during probation of a person already
in permanent Government service shall be regulated by the relevant rules,
applicable generally to Government Servants serving in connection with the
affairs of the State.
PART
VIII
OTHER
PROVISIONS
Rule - 23. Canvassing.
No recommendations, either
written or oral, other than those required under the rules applicable to the
post or service will be taken into consideration. Any attempt on the part of a
candidate to enlist support directly or indirectly for his candidature will
disqualify him for appointment.
Rule - 24. Regulation of other matters.
In regard to the matters not
specifically covered by these rules or special orders, persons appointed to the
service shall be governed by the rules, regulations and orders applicable
generally to Government servants serving in connection with the affairs of the
State.
Rule - 25. Relaxation from the conditions of service.
Where the State Government
is satisfied that the operation of any rule and regulation the conditions of
service of persons appointed to service causes hardship in any particular case,
it may, notwithstanding anything contained in the rules applicable to the case,
by order, dispense with or relax the requirements of that rule to such extent
and subject to such conditions as it may consider necessary for dealing with
the case in a just and equitable manner.
Rule - 26. Saving.
Nothing in these rules shall
affect reservation and other concession required to be provided for the
candidates belonging to the Scheduled Castes, Scheduled Tribes, and other
special categories of persons in accordance with the orders of the Government
issued from time to time in this regard.
