[THE
SPECIAL RULES FOR THE EXISTING TECHNICAL POSTSIN THE FORENSIC SCIENCE
LABORATORY, 2003]
PREAMBLE
In exercise of powers conferred by
sub-section (1) of Section 2 of the Kerala Public Service Act, 1968 (19 of
1968) and in supersession of all existing rules and orders on the subject, the
Government of Kerala hereby make the following Special Rules, namely:-
Rule 1. Short title and commencement.
(i)
These rules may be called
the Special Rules for the existing technical posts in the Forensic Science
Laboratory.
(ii)
They shall come into force
at once.
Rule 2. Constitution.
The following categories of posts (1
to 4) in the Forensic Science Laboratory shall constitute a separate class in
the Kerala General Service. The post of Photographer (Category-5) constitute a
separate class in the Kerala General Subordinate Service.

Rule 2B. Promotion.
The promotion to the post of Director,
Joint Directors and Assistant Directors shall be made from the select list of
eligible persons prepared on the basis of merit and ability Seniority being
considered only when merit and ability are approximately equal Persons included
in the select list shall be ranked in the order of their seniority.
Rule 3. Appointing Authority.
The appointing authority for the post
of Director, Joint Directors and Assistant Directors shall be Government. The
Appointing Authority for the post of Scientific Assistants and Photographer
shall be the Director General of Police.
Rule 4. Qualifications.
(a)
No person shall be
eligible for appointment to the categories specified in column (1) of the Table
below by the methods specified in the corresponding entry in column (2) unless
he possesses the qualification specified in the corresponding entry in column
(3) thereof.

Zoology/Botany from a recognised Institution.

(a) Essential Qualification:
1. Post-graduate Degree in Psychology with not less than
50% marks from a recognised Institution or its equivalent qualification.
2. 5 years experience in experimental
Psychology/Psychological process from a recognised Institution.

1. M.Phil Degree in Psychology from a recognised
University.
2. Previous experience in handling Polygraph (lie.
Detector) and interrogation from a recognised Institution.

3. (1) Assistant Director (Serology).

5 years experience as Scientific Assistant (Biology) in
Category 4 (c) of the Forensic Science Laboratory. FSL includes FSL, Tvpm. or
any other unit of FSL such as branches of FSL established anywhere and also
the Mobile Laboratories attached to DCRB in the Districts.

(ii) By Direct Recruitment
|
(a) Essential Qualification:
1. Post-graduate Degree in Botany/ Zoology with not less
than 50% marks from a recognised University.
2. 5 years Research/Analytical experience in the field of
Botany/Zoology from a recognised University.

1. M.Phil Degree in Botany/Zoology from a recognised

Category 4 (b) of the forensic Science Laboratory, Forensic Science
Laboratory includes Forensic Science Laboratory. Thiruvananthapuram or any
other unit of it such as branches of Forensic Science Laboratory established
anywhere and also the Mobile Laboratories attached to DCRB in the Districts.

Post-graduate Degree in Psychology with not less than 50%
marks from a recognised University.

(b) Preferential Qualification:
1. M.Phil. Degree in Psychology from a recognised
University.
2. Two years experience in experimental
Psychology/Psychological process from a recognised Institution
|
|
5. Photographer
|
(i) By transfer from the category of Photographers in the
Police Department
|
(a) Essential Qualification:
1. Degree' or Diploma in Fine Arts with photography as
one of the subject of study.
|
|
|
(ii) By Direct Recruitment
|
2. Proficiency in Photography to be proved at a practical
test.
|
Note:- Each eye must have a full
field of vision and color blindness will be a disqualification.
Rule 5. Age.
(a)
Director and Joint
Directors.- No person shall be eligible for appointment to these posts by
Direct Recruitment if the person has not completed 40 years or has completed 51
years of age on the 1st of January of the year in which applications for
appointment to the posts are invited.
(b)
Assistant Directors.- No
person shall be eligible for appointment to these posts by Direct Recruit if
the person has not completed 30 years of age or has completed 41 years of age
on the 1st day of January of the year in which applications for appointment to
the posts are invited.
(c)
Scientific Assistants.- No
person shall be eligible for appointment to these posts by Direct Recruitment
if the person has not completed 20 years' of age or has completed 35 years of
age on the 1st day of January of the year in which applications for appointment
to the posts are invited.
(d)
Photographer.- No Person
shall be eligible for appointment by Direct Recruitment to the post if he has
not completed 20 years of age or has completed 35 years of age on the first day
of January of the year in which applications for appointment to the posts are
invited.
Relaxation of upper age limit approved
in Rule 10 of Part II of the Kerala State and Subordinate Service Rules, 1958
shall be applicable for appointment by Direct Recruitment.
Rule 6. Reservation of Appointments.
The rules relating to reservation of
appointment issued by the Government of Kerala from time to time shall apply to
the appointments by Direct Recruitment to all categories.
Rule 7. Training.
Any person appointed to a post by
Direct Recruitment shall undergo 6 months training in all branches of Forensic
Science in the Forensic Science Laboratory. Any person appointed to a post of
Scientific Assistant or Assistant Director by Direct Recruitment shall also
undergo a training in that those discipline(s) of Forensic Science which will
be dealt with in the division(s) of Forensic Science Laboratory to which he/she
will be appointed/ transferred, in a Forensic Science Laboratory or in the
NICFS, Government of India, New Delhi or similar institution to be decided by
the Government on the advice of the Director General of Police for a minimum
period of six months or for such period/periods is required to complete the
course/courses of training in the institution/institutions to which he/she is
deputed. Every person appointed for the post of Photographer shall undergo a
training in Scientific Photography conducted by the NICFS, New Delhi or similar
institutions as desired by the Government on the recommendation of the Director
of Forensic Science Laboratory.
For example, a person appointed to a
post of Scientific Assistant (Physics) by Direct Recruitment shall undergo 6
months training in Crime Scene Examination in all branches of Forensic Science
in the Forensic Science Laboratory and shall also undergo a training in
Forensic Physics and Forensic Ballistics in Forensic Science Laboratory or the
NICFS, Government of India New Delhi or similar institutions to be decided by
the Government on the advice of the Director General of Police for a minimum
period of six months or for such periods as required to complete the courses of
training in the institution to which he is deputed, Similarly any person
appointed to the post of Scientific Assistant (Biology) by Direct Recruitment
shall also undergo training in Forensic Biology and Forensic Serology in
addition to the basic training for 6 months in all branches of Forensic
Science, subject to the general conditions said above in the case of Scientific
Assistant (Physics).
Any person appointed to the post of
Scientific Assistant (Documents) by Direct Recruitment shall also undergo
training in forensic documents in addition to the basic training for 6 months
in all branches of Forensic Science subject to the general condition said above
in the case of Scientific Assistant (Physics).
A trainee will be entitled to the
following benefits during the period training.
(a)
A person appointed by
Direct Recruitment will be eligible to draw amount equal to the minimum of the
scale of pay of the post and the usual allowances, He will also be eligible for
travelling allowances for to and fro journeys and journeys incidental to the
training at the rates admissible to the officers drawing pay at the minimum of
the scale of pay of the post under Kerala Service Rules.
(b)
Any other allowances like
compensatory allowances, warm clothing allowance etc.. which Government may by
general or special orders, sanction to officers deputed for travelling.
(c)
The period of training and
transit will be in service and treated as duty under Rule 12(7) (iii) Part 1
Kerala Service Rules.
Rule 8. Test.
Every person appointed to any post
included in the Service shall, within the period of probation, pass the Account
Test for Executive Officers or Account Test (Lower) if he has not already
passed the test.
Rule 9. Probation.
Every person appointed to a category
shall on completion of the training be on probation for a total period of 2
years on duty with in a continuous period of 3 years if appointed by Direct
Recruitment or by transfer from any other service and for, a period of one year
on duty within a continuous period of 2 years, if appointed by promotion,
Rule 10. Bond.
Every person appointed to a post
included in the Service by transfer or by Direct Recruitment shall execute a
Bond in such form as may be prescribed by the Government to serve the State
Government, for a minimum period of 5 years, after completion of training,
failing which he will be liable to pay a sum of rupees Twenty Five Thousand
only as Liquidated damages to the Government in addition to the actual cost of
training assessed by the Accountant General (A&E), Kerala,
Thiruvananthapuram.
