In exercise of the powers conferred by the proviso to Article 309 of the
Constitution of India, the Governor of Orissa is pleased to make the following
rules, namely (a)
These rules may be called the "Rules for the Sanction of
Expenditure on Obsequies or Transport of Deceased Government Employees,
1967". (b)
They shall come into force at once. (c)
They shall apply to all State Government servants including the work
charged, job contracts and contingency-paid employees other than daily rated
employees but shall not apply to persons to whom the Workmen's Compensation Act
applies and the members of All India Services. The Head of the office shall be the sanctioning authority. Explanation. - The term "Head of Office" shall mean- (i)
in the case
of the Secretariat, the Secretary of the concerned Department in which the
deceased officer was last working; (ii)
in the case
of Heads of Department and offices in the District, the Head of the Department
or office or in his absence the next officer in charge of the Department or
office. (iii)
in any other
case, the Pay Disbursing Officer. Subject to the minimum and maximum specified in Rule 4, the Head of the
office shall sanction such amount as he considers sufficient in each case of
death of a Government employee while on duty or on leave sanctioned by the
competent authority in connection with performance of obsequies or the
transport charges of the body to the native or other place of the deceased
Government employee, if the occasion so requires. Before sanctioning the
amount, the Head of office shall obtain necessary particulars and satisfy
himself about the quantum of amount to be sanctioned in each case : Provided that the sanctioning authority shall, in cases where the amount
sanctioned is more than the minimum, record the reasons and circumstances
necessitating the sanction of such amount. The amount that may be sanctioned by the Head of Office for the purpose
of Rule 3 shall be not less than Rs. 50 and more than Rs. 300 having due regard
to the circumstances of each case. The amount sanctioned under Rule 3 may be drawn on production of a death
certificate to be given by the attending medical practitioner, if any, at the
time of death of the Government employee and where there is no such doctor, a
statement of circumstances and reasons resulting in the death of the Government
employee shall be produced, duly authenticated by the Head of the office. The amount sanctioned under these rules shall be paid to the nearest
relative of the deceased Government employee or to the person lawfully in
possession of the body of the deceased Government employee for purposes of
performing obsequies, after obtaining due acknowledgement in this regard. The expenditure involved shall be not from the contingent provision of
the Department or office concerned.The Rules for the Sanction of
