PREAMBLE

In exercise of the powers conferred by subsection (1) of section 2 of the Kerala Public Services Act, 1968 (19 of 1968), the Government of Kerala hereby make the following Kerala Irrigation Engineering Service, Special Rules namely:

Rule - 1. Short title and Commencement.

(1)     These Rules may be called the Kerala Irrigation Engineering Service Special Rules, 2010

(2)     They shall come into force at once.

Rule - 2. Constitution.

The service shall consist of the following categories of officers, namely:-

Category 1:   

 Chief Engineer

Category 2:   

 Superintending Engineer/Deputy Chief Engineer/Director

Category 3:   

 Executive Engineer/Joint Director/PA to Superintending Engineer

Category 4:   

 Assistant Executive Engineer/Deputy Director/Technical Assistant/Personal Assistant to Executive Engineer

Category 5:   

 Assistant Engineer/Head Draftsman/Assistant Director.

Rule - 3. Method of Appointment.

The Appointment to the various categories mentioned in column (1) of the Table below shall be made by the method of specified in column (2), there of:-

(1) By direct recruitment and

(2) By transfer from the category of First grade Draftsmen/First grade Overseers in the Kerala Irrigation Engineering Sub-ordinate service

Note- (1) The direct recruitment and appointment by transfer shall be made In the ratio of 6:4.

Note- (2)     (i) Out of the posts for direct recruitment, 10% shall be filled up by direct recruitment from among Overseers/Draftsman, Clerks and Last Grade Servants in the Irrigation Department possessing any of the qualification prescribed for the category by direct recruitment and having not less than two years service in the Department,

(ii) If at any time adequate number of qualified candidates are not available from among those in service of the Department, appointment to such vacancies in the above quota shall be made by direct recruitment.

(iii) The upper age limit fixed for direct recruitment to the category shall not apply to the candidates for direct recruitment from service in the above mentioned quota.

Note- (3) The appointment by transfer shall be in the ratio of 3:1 from among the Diploma holders and Certificate holders in the feeder category.

Note- (4)     (i) The ratio fixed for appointment by direct recruitment and by transfer shall be applied to the cadre strength of the category of Assistant Engineer in the Department and not to the vacancies.

(ii) Separate Seniority List of Graduates, Diploma holders and Certificate holders shall be maintained and promotion and reversion of each category of officers shall be confined to the quota allotted to each category within the cadre strength.

(iii) Vacancies that are caused by promotion, retirement, deputation etc. in quota allotted to Graduates shall be filled up by graduates only.

Note- (5) Promotion and appointments by transfer shall be made from a select list of eligible officers prepared on the basis of merit and ability, seniority being considered only where merit and ability are approximately equal and persons included in the select list shall be ranked therein in the order of their seniority.

Rule - 4. Qualification.

No person shall be eligible for appointment to any of the categories specified in column (1) of the Table below by the method specified in column (2) unless he possesses the qualifications specified in the corresponding entry in column (3) thereof:-

Diploma in Civil Engineering or any other qualification recognized as equivalent thereto.

Note- (1) Such number of vacancies of Executive Engineers as the State Government may from time to time determine but not exceeding 5% of the total sanctioned cadre strength of Executive Engineer, shall be filled up by selection from among Assistant Executive Engineers possessing Diploma in Engineering.

Note- (2) A Diploma holder Assistant Executive Engineer shall not be eligible for promotion over a Senior Graduate Assistant Executive Engineer unless the latter is otherwise rendered ineligible for promotion to the post of Executive Engineer.

4. Assistant Executive Engineer/Deputy Director/Technical Assistant/Personal Assistant to Executive Engineer

By Promotion

Must possess a Degree in Civil Engineering from any of the Universities in Kerala or a qualification recognized as equivalent thereto

 

 

OR

 

 

Associate Membership of Institution of Engineers India in Civil Engineering

 

 

OR

 

 

Diploma in Civil Engineering or any other qualification recognized as equivalent thereto.

Note- (1) Promotion to the category of Assistant Executive Engineer shall be made from among Assistant Engineers in the ratio of 8:2 between Degree holders and Diploma holders respectively. The ratio fixed for promotion to the cadre of Assistant Executive Engineer shall be applied to the cadre strength of the category of Assistant Executive Engineers in the Department.

Note- (2) A Diploma holder Assistant Engineer shall not be eligible for promotion over a Senior Graduate Assistant Engineer unless the latter is otherwise rendered ineligible for promotion to the post of Assistant Executive Engineer

Note- (3) A person who obtains the Associate Membership of the Institution of Engineers (India) Diploma of the Institution of Engineers in Civil Engineering after appointment to the post of Assistant Engineer shall be eligible for promotion as Assistant Executive Engineer only after considering the claims of all Assistant Engineers, who on the date of his obtaining the AMIE (India) Diploma of the Institution of Engineers in Civil Engineering, possessed the required qualifications.

Note- (4) A person who obtains higher qualification, i.e. degree in Civil Engineering shall be deemed to have come over to the degree quota from the date of publication of result of such examination by the University and he shall be placed as the Junior to the junior most as on that date in the respective quota:

Provided that an option for change of category has been filed by such person within two years from the date of publication of result by the University.

5. Assistant, Engineer/Head Draftsman/Assistant Director

(a) By Direct recruitment

Must possess a Degree in Civil Engineering from any of the Universities in Kerala or a qualification recognized as equivalent thereto

 

 

OR

Associate Membership of Institution of Engineers India in Civil Engineering

 

(b) By transfer (from Diploma holders)

(a) Diploma in Civil Engineering or any other qualification recognized as equivalent thereto.

 

 

(b) A minimum of 4 (Four) years service in the Department as I Grade Overseer/Draftsman.

 

(c) By transfer (from Certificate holder)

(a) Must have passed SSLC Certificate or equivalent.

 

 

(b) Must possess any of the certificates mentioned below, namely:-

 

 

(i) Kerala Government Certificate Examination in Civil Engineering, course of duration two years.

 

 

(ii) Diploma in Craftsman ship in the trade of Draftsman (Civil) obtained after 18 months course (followed by six months practical training) at the Industrial Training Institute/Centers conducted by Government of India. Ministry of Labour.

 

 

(iii) Diploma in Civil Engineering from Women's Polytechnics.

 

 

(c) Minimum 5(five) years service of which not less than two years shall be as First Grade Overseer.

 

Rule - 5. Appointing Authority.

The appointing authority in respect of the posts under category 1, 2, 3 and 4 shall be the Government and the appointing authority in respect of the posts under category 5 shall be the Chief Engineer (Irrigation and Administration)

Rule - 6. Qualification regarding age.

No person shall be eligible for appointment by direct recruitment, to any of the categories included in the service if he has not completed 18 years of age or has completed 35 years of age as on 1st day of January of the year in which applications for appointment are invited subject to the usual relaxation in upper age limit to candidates belonging to any of the Scheduled Caste/Scheduled Tribe and other Backward Classes as provided in the Kerala State and Subordinate Service Rules.

Rule - 7. Reservation of Appointment.

The rules regarding reservation of appointments contained in General Rules 14 to 17. Part II of the Kerala State and Subordinate Service Rules 1958 shall apply to appointments to the service by direct recruitment, provided that in the case of direct recruitment from among departmental candidates the above rules shall not apply.

Rule - 8. Probation.

Every person appointed to any of the categories mentioned in these rules shall be on probation,-

(i)       if appointed by direct recruitment or by transfer through PSC or by transfer to a category to which direct recruitment is one of the methods of appointment, for a total period of two years on duty within a continuous period of three years.

(ii)      if appointed by transfer to a category to which direct recruitment is not one of the methods of appointment or by promotion, for a period of one year on duty within a continuous period of two years, provided that the one year period of probation shall not be insisted in case if a post of Chief Engineer is lying vacant and Superintending Engineers who have completed probation are not available for promotion against that post.

Rule - 9. Test Qualification.

Assistant Engineer/Head Draftsman directly appointed or appointed by transfer shall pass (1) Account Test (Lower), (2) Kerala PWD Manual Test, (3) Kerala PWD Test within the period of probation if he has not already passed the same:

Provided that nothing in this rule shall not apply to those who have attained the age of 50 years.
