PREAMBLE

In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Assam is pleased to make the following rules in respect of the officers of the Education Department regulating the condition of passing Departmental Examination and Training as specified for different categories.

This will come into force with immediate effect.

Rule - 1. Title.

These Rules may be called the Departmental Examination and Training (Education Department) Rules, 1982.

Rule - 2. Extent.

These Rules shall apply to officers discharging duties of administrative nature as shown in Schedule.I, and such other officers as may be declared by the State Government from time to time to be discharging similar duties.

Rule - 3. Definition..

(a)      "Advisory Board" means the Board constituted under Rule 7;

(b)      "Commission" means the Assam Public Service Commission;

(c)      "Commissioner" means the Commissioner of Training; 

(d)      "Departmental Examination" means the examination conducted in accordance with the Syllabi in Schedule.II attached to these rules;

(e)      "Director" means the Director of Administrative Staff College or the Head of the Institution where the training is imparted;

(f)       "Schedule" means the Schedule attached to these rules;

(g)      "State Government" means the Government of Assam;

(h)     "Training" means imparting of instructions under these rules.

Rule - 4. Training.

(1)     Officers mentioned in Schedule.I shall be liable to undergo training in the Staff College or any Training Institution, as the case may be, for a period to be determined by Government from time to time.

(2)     Notwithstanding foregoing provisions, the State Government shall have the authority to make for any other officer not mentioned in Schedule.I, liable to undergo the training or exempt any officer from undergoing such training.

Rule - 5.

(1)     All Officers of the Department as shown in the Schedule.I shall within a period of three years of their entry in service shall be liable to pass the departmental examination. A training in accordance with the Rule 8 will be arranged for all such officers but merely not attending the training course shall in no circumstances be treated as a valid reason for not passing the departmental examination. The examinations will be held once in every six months.

(2)     Notwithstanding foregoing provisions, the State Government shall have the authority to make for any other officer not mentioned in Schedule.I, liable to undergo the training and/or pass the Departmental Examination or exempt any officer from appearing in the Departmental Examination.

Rule - 6. Disqualification.

(1)     Officers not passing Departmental Examination under Rule 5 shall not be eligible for SECTION confirmation, promotion or for crossing the Efficiency Bar in their respective time scale of pay.

(2)     Notwithstanding foregoing provisions in sub.rule (1), the officers exempted from undergoing training under Rule 4(2) as well as from appealing in the Departmental Examination under Rule 5(2) shall not be subject to such disqualification.

Rule - 7. Advisory Board.

There will be an Advisory Board with following members for the purpose of reviewing and updating the Syllabi for training and the Departmental Examination from time to time under these rules.

3. Secretary, Personnel and A. R.

Member.Secretary:4. Director.

Rule - 8. Training.

(1)     Training shall be imparted and the Departmental Examination shall be conducted as per Syllabi in Schedule.II as amended from time to time by the Advisory Board under sub.rule (1).

(2)     The Director shall be responsible for imparting training under these rules under general guidance and supervision of the Commissioner.

(3)     The Director shall with prior consultation with the Commissioner, design the course for the training in such a way as to make it practical and need oriented for the Department.

(4)     The State Government shall determine the place of training in consultation with the Commissioner.

Rule - 9.

The Director shall also be responsible for conducting the Departmental Examination under these rules under general supervision and guidance of the Commissioner provided that responsibility of the examination of answer scripts and declaration of results shall rest with the Commissioner.

Rule - 10.

The Director may for the purpose of training under these rules, requisition the services of the Experts or Specialists as visiting Lecturers or course. Director on payment of honorarium and T.A./D.A. at such rate as may be determined with approval of the State Government.

Rule - 11.

Notwithstanding anything in these rules officers who are trained and passed the departmental examination in one cadre shall be exempted from undergoing training or passing departmental examination in another cadre to which they may be transferred or promoted provided that both the cadres are under the Education Department.

Rule - 12.

The State Government may exclude any Officer from the purview of these rules on sufficient grounds.

7.        Deputy and Additional Deputy Inspectors of Schools.

8.        Assistant Inspector of Schools.

9.        Sub.Inspector of Schools.

10.     Principal, Engineering Colleges.

11.     Joint Director, Technical Education/Principal Polytechnic.

12.     Superintendent, Junior Technical Schools.

13.     Deputy Director, Sports and Youth Welfare.

14.     Inspector, Physical Education.

15.     Deputy Director, Cultural Affairs.

16.     Principal, School of Arts and Crafts.

17.     Librarian, State Central Library.

18.     Deputy Librarian, State Central Library.

19.     Librarian, District Library.

20.     Director, Historical and Antiquarian Studies.

21.     Director, Archaelogy and State Museum.

22.     Registering Officers.

23.     All Executive Officers serving in the Public Sector Under.takings under the Education Department.
