THE ALLAHABAD NAGER MAHAPALIKA
(REGULATION OF BURIAL GROUNDS, PLACES FOR CERMATION AND ELECTRIC CREMATORIOUM)
BYE LAWS, 1988
PREAMBLE
The following draft bye-law for
the regulation of burial ground cremation places and electric crematoriums
within the limits of Allahabad Nagar Mahapalika made under clause (32) of
Section 541 and published under Section 542 of the U.P. Nagar Mahapalika Adhiniyam,
1959 (U.P. Act No. 2 of 1959) are hereby confirmed by the Government as
required under Section 544 of the said Act:
Regulation - 1. Short title and commencement.--
(1) These
bye-laws may be called the Allahabad Nagar Mahapalika (Regulation of Burial Grounds,
Places for Cremation and Electric Crematorium) Bye-Laws, 1988.
(2) They
shall come into force at once.
Regulation - 2. Definitions.--
In these bye-laws unless there is
anything repugnant in the subject or context-
(a) Adhinyam
means the U.P. Nagar Mahapalika Adhinyam, 1959;
(b) Burial
ground means any land used for, burying the dead bodies of human beings in
accordance with the customary practice or usage of the local area;
(c) Cremation
place means any ghat or place where the funeral of dead bodies of human being is
performed by burning in accordance with the religious faith, customary practice
or usage;
(d) Electric,
Crematorium means an electric machine installed for the cremation of the dead
body of any human being.
(e) Mahapalika
means the Nagar Mahapalika, Allahabad.
Regulation - 3. Conditions for burying a dead body.--
The following condition shall be
observed for byrying a dead body of any human being in a burial grounds:
(a) the dead
body shall be interred within eight hours from the time of its arrival at the burial
ground;
(b) the dead
body shall not be buried in which another body has already been interred for
the last two years; and
(c) the grave
shall not be less than six feet deep and the distance from the nearest grave
shall not be less than two feet.
Regulation - 4. Conditions for the cremation of a dead body.--
The following conditions shall be
observed for the cremation of a dead body of any human beimg at a cremation
place:
(1) the dead
body shall be cremated within eight hours after its arrrival at the cremation place;
(2) no part
of the body shall remain unconsumed by the fire.
(3) no part
of the body shall be removed from the cremation place until it is completely
reduced to ashes.
Regulation - 5. Conditions for the cremation of a dead body in an Electric Crematorium.--
In case of Electric Crematorium
within the limits of Mahapalika following conditions are to be observed for the
cremation of a dead body of any human being:
(a) the body
shall be brought to the Electric Crematorium by the mourners, got registered in
the register kept in the electric crematorium;
(b) the
amount to be charged from the mourner for consumption of the body shall be such
as may be fixed by the Mahapalika from time to time;
(c) the
electric crematorium will remain functioning for such time as may be fixed by
the Mahapalika subject to supply of electricity and the conditions of the
machine;
(d) no
Medico-legal cases will be entertained unless valid order from the competent
authority and a death certificate from the registerted medical
practitioner/hospital is produced; and
(e) remaining
part of the ashes out of the furnace will be handed over to the accompanying
mourners.
Regulation - 6.
(a) No person
shall remove wood or coal that has been employed in the pyre from the cremation
place. The owner or person in charge of the place must see that all wood or
coal is reduced to ashes.
(b) The
clothes, bed, bedding or other articles which have been in contact with and are
brought to a burning place or Electric Crematorium with the corpse of a person
who has died of cholera, small pox or plague or other infections or contagious
disease shall be burnt to ashes at the cremation place, and the person
arranging the cremation and the Dom or sweeper in attendance at the cermation
place of Electric Crematorium as the case may be, shall be responsible that
this shoule be done. Cholera corpses must not be dipped in the river or stream
for washing before cremation. If washing is necessary as a religious
observance, water from the river should be brought and thrown over the corpse
at the spot where the funeral pyre will be performed. The body must not be
burnt within 15 feet of the water's edge.
Regulation - 7.
The Licensee of a wood stall at
the cremation place shall always keep at his stall such quantity of suitable
wood as may from time to time be fixed by the health officer to be necessary
for cremation purposes and shall sell the same at merket rates.
Regulation - 8. Penalty.--
In exercise of the powers
conferred by Section 467 of the Adhiniyam, the Mahapalika hereby directs that
any breach of the provision of the above bye-laws shall be punishable with fine
which may extend to Rs. 100 and in the case of continuing breach with a further
fine which may extend to Rs. 20 for every day, after the date of the first
conviction during which the offender is proved to have persisted in the
offence.
