PREAMBLE
An Act further to amend the Tamil Nadu
Government Servants (Conditions of Service) Act, 2016.
Be it enacted by the Legislative
Assembly of the State of Tamil Nadu in the Seventy-second Year of the Republic
of India as follows.
Section 1 - Short title and commencement
(1) This Act may be
called the Tamil Nadu Government Servants (Conditions of Service) Second
Amendment Act, 2021.
(2) (a) Sections 2, 4, 5,
6, 7 and 8 shall be deemed to have come into force on the 26th day of February
2021.
(b) Section 3 shall be deemed to have
come into force on the 7th day of June 2021.
Section 2 - Substitution of references to certain expressions by other expressions
In the Tamil Nadu Government Servants
(Conditions of Service) Act, 2016 (Tamil Nadu Act 14 of 2016) (hereinafter
referred to as the principal Act), unless otherwise expressly provided for, for
the expressions “Most Backward Classes and Denotified Communities” and “Most
Backward Class and Denotified Community”, wherever they occur, with the words
therein are in any order and are interpolated with the word “or” or “and” or
“/”, the expression “Most Backward Classes (V), Most Backward Classes and
Denotified Communities and Most Backward Classes” shall be substituted.
Section 3 - Amendment of section 67
In section 67 of the principal Act,
(i) in sub-section (1),
for the expression “Personnel and Administrative Reforms Department”, the
expression “Human Resources Management Department” shall be substituted;
(ii) in sub-section (3),
for the expression “Personnel and Administrative Reforms”, the expression
“Human Resources Management” shall be substituted.
Section 4 - Amendment of Schedule I
In Schedule-I to the principal Act, for
“Part-C” and “Part-D”, the following shall be substituted, namely.

Section 9 - Substitution of Schedule - IX
For Schedule – IX to the principal Act,
the following Schedule shall be substituted, namely.
“SCHEDULE – IX
(See section 27)
1.
The
method of carrying forward of vacancies reserved for the Most Backward Classes
(V), Most Backward Classes and Denotified Communities, Most Backward Classes,
Scheduled Castes, Scheduled Castes (Arunthathiyar) and Scheduled Tribes
candidates by direct recruitment is illustrated below.
2.
If
five vacancies reserved for the candidates belonging to Scheduled Castes, one
vacancy reserved for Scheduled Tribes and one vacancy reserved each for Most
Backward Classes (V), Most Backward Classes and Denotified Communities and Most
Backward Classes respectively, remain unfilled in earlier years and they are
carried forward as “backlog” vacancies and fifty new vacancies arise in the
year of recruitment of which seven vacancies are to be reserved for the
Scheduled Castes, two vacancies are to be reserved for the Scheduled Castes
(Arunthathiyar), one vacancy is to be reserved for Scheduled Tribes, thirteen
vacancies are to be reserved for Backward Classes, two vacancies are to be
reserved for Backward Classes Muslims, seven vacancies are to be reserved for
Most Backward Classes (V), two vacancies reserved for Most Backward Classes and
Denotified Communities, one vacancy reserved for Most Backward Classes and
fifteen vacancies for General Turn following the existing instructions on
reservation, the number of vacancies to be announced shall be as follows.

It
may be seen from the above that while the vacancies reserved for the Scheduled
Castes, Scheduled Tribes, Most Backward Classes (V), Most Backward Classes and
Denotified Communities and Most Backward Classes, which remain unfilled shall
be carried forward to the next year of recruitment as “backlog” vacancies, the
carried forward reservation for the above communities as a result of the
filling up of the relevant vacancies after dereservation, shall continue to be
operated against “current” vacancies. If such reserved vacancies are still not
filled up, they shall be again carried forward as “backlog” vacancies.
4.
In
respect of direct recruitment to vacancies in Groups A and B Services, there
may be rare and exceptional situations wherein due to non-availability of
suitable candidates belonging to the Scheduled Castes, and Scheduled Tribes,
posts cannot be allowed to remain vacant in public interest. In such a
situation, the Government may, by order, provide for dereservation of the posts
on the recommendation of a committee comprising of the Director of Adi Dravidar
and Tribal Welfare, the Secretary to Government, Adi Dravidar and Tribal
Welfare Department, the Secretary to Government, Human Resources Management
Department and the Secretary to Government in charge of the Department to which
the recruitment is being made.
5.
In
such a situation, in the case of vacancies reserved for Most Backward Classes
(V), Most Backward Classes and Denotified Communities and Most Backward
Classes, the Government may, by order, provide for dereservation of such posts
on the recommendation of a committee comprising of the Director of Most
Backward Classes and Denotified Communities, the Secretary to Government in
charge of the department for the welfare of the Most Backward Classes and
Denotified Communities, the Secretary to Government, Human Resources Management
Department and the Secretary to Government in charge of the Department in which
the recruitment is being made.”.
