OF SERVICE) AMENDMENT ACT, 2021

PREAMBLE
An Act further to amend the
Tamil Nadu Government Servants (Conditions of Service) Act, 2016.
BE it enacted by the
Legislative Assembly of the State of Tamil Nadu in the Seventy-second Year of
the Republic of India as follows:--
Section 1 - Short title and commencement
(1)
This Act may be called the Tamil Nadu Government Servants
(Conditions of Service) Amendment Act, 2021.
(2)
(a) Section 3 shall be deemed to have come into force on the 15th
day of September 2016.
(b) Section 4 shall be
deemed to have come into force on the 2nd day of March 2017.
(c) The remaining sections
shall come into force at once.
Section 2 - Amendment of section 73
In section 73 of the Tamil
Nadu Government Servants (Conditions of Service) Act, 2016 (Tamil Nadu Act 14
of 2016), (hereinafter referred to as the principal Act), for subsection (1),
the following sub-section shall be substituted, namely:--
“(1) The
Government may, by notification, either prospectively or retrospectively,
alter, add to or cancel any of the Schedules.”.
Section 3 - Substitution of Schedule-IV
In the principal Act, for
Schedule–IV, the following Schedule shall be substituted, namely:--

Explanation.- In the case
of candidates who are required to pass the Second Class Language Test (Full
Test), they will be allowed to appear for Part ‘D’ separately and will be
required to appear for all the other Parts at one time.
Section 4 - Amendment of Schedule-IV
In Schedule-IV to the
principal Act as so substituted,--
(1)
under the sub-heading “PART-A. WRITTEN EXAMINATION”, for the
expression “Time Duration – 3 hours”, the expression “Time Duration – 2.30
hours” shall be substituted;
(2)
under the sub-heading “PART-B. VIVA-VOCE EXAMINATION”, for item 1,
and the entries relating thereto, the following item and entries, shall,
respectively, be substituted, namely:--

“1. Conversing with accuracy and
fluency in Tamil.

Provided that in the case of
candidates belonging to linguistic minorities, the minimum pass mark shall be
50.”.

Section 5 - Validation
Notwithstanding anything
contained in the principal Act, all acts done or any action taken by the Tamil
Nadu Public Service Commission in regard to the conduct of the Second Class
Language Test in Tamil prescribed in sub-section (1) of section 21 during the
period commencing on and from the 15th September 2016 and ending with the date
of publication of this Act in the Tamil Nadu Government Gazette, shall be
deemed to have been validly done or taken in accordance with law, as if the
principal Act, as amended by this Act, had been in force at all material times
when such acts or actions were done or taken.
