In pursuance of rule
45 of the Indian Electricity Rules, 1956 and in Supersession of all previous
Notifications and Orders, the Government of Maharashtra hereby makes the
following Rules and Conditions for issuing Certificate of competency under the
aforesaid rule viz.:-- I. LICENSING BOARD For carrying out the
purpose of these rules, a Licensing Board (hereinafter referred to as "
the Board ") representative of Electrical interests in the State shall be
appointed. The Board shall
consist of-- (i)

the Secretary, and (iii)
Representatives of the

The representative of each
of the Electrical Contractor's Associations referred to above shall be a person
who, in the opinion of the State Government, has sufficient knowledge of
Electrical Engineering to enable him to participate in the proceedings of the
Board and the representative of each of the other bodies referred to above
shall be a qualified Electrical Engineer possessing the Degree or Diploma in
Electrical Engineering from Universities or Institutions recognised by
Government. The functions of the
Board shall be,-- (1)
to grant licences to
Electrical Contractors, (2)
to conduct examinations for
Supervisors and Wiremen, (3)
to grant certificates and
permits to Supervisors and Wiremen, (4)
to deal with applications
and testimonials found to be incorrect and to take such action as deemed fit, (5)
to nominate representatives
in the various centres of the State for the purpose of carrying out local
examinations and test under these rules, (6)
to hear and decide cases of
malpractice by Electrical Contractors, Supervisors or Wiremen, and (7)
generally to carry out the
provisions of these rules. Note.--Any decision
given by the Board in the execution of its functions shall be final. The Board shall have
power to appoint Sub-Committees and delegate such of it powers to these
Sub-Committees as the Board considers fit. The Board shall
ordinarily meet once in six months after each half-yearly examination. The
Board shall also meet for transacting any special business, which cannot be
disposed of by circulation of papers. Notice of every meeting shall be sent to
each member by the Secretary. Five members shall
form a quorum at any meeting of the Board. The duties of the
President shall be,-- (1)
to preside over all meetings
of the Board, unless prevented by reasonable cause, and (2)
to grant licences to
electrical contractors and certificates and permits to Supervisors and Wiremen
on behalf of the Board. The President, and in
his absence, such one of the members present, as may be elected by the meeting,
shall be the chairman of the meeting. The duties of the
Secretary shall be,-- (1)
to scrutinise all
applications for electrical contractors' licences and submit the same to the
President and carry on correspondence in connection therewith; (2)
to scrutinise applications
for admission to the examination for Supervisors and Wiremen and carry on
correspondence in connection therewith; (3)
to countersign licences to
electrical contractors and certificates and permits to supervisors and wiremen; (4)
to notify to all electric
supply companies concerned and the electrical contractors association of all
licences issued and/or cancelled. II. EXAMINATIONS Examinations under
these rules shall be held twice in a year in May and November, in Bombay, Poona
and such other places and on such dates as may be notified by the Secretary to
the Board from time to time in the Maharashtra Government Gazette. Examinations are
intended for such candidates as are working or have worked in the State of
Maharashtra. III. MODE OF EXAMINATIONS Every examination
shall be of such a nature as to test the practical knowledge of the candidate and
to ascertain his competency. Every examination
shall be conducted in a place where the candidate's knowledge can be
practically tested and each candidate shall be tested vive voce. IV. ADMISSION OF CANDIDATES FOR
EXAMINATIONS The examination for
supervisors is intended for electricians, supervisors, foremen, charge-hands
and others, but any wireman may appear for the examination, if he desires to do
so. A candidate for
examination of supervisors must,-- (a)
have passed the examination
for wireman; and (b)
have at least,-- (i)
three and half years
practical experience, if such candidate has completed the electrician classes
at the Victoria Jubilee Technical Institute at Bombay or at any recognised
technical Institute and has passed the examination held by the State Council
Technical Education for Maharashtra State, or (ii)
four years practical
experience in any other case: Provided that-- (i)
out of the period specified
in item (i) of clause (b), not less than one and half year; and (ii)
out of the period specified
in item (ii) of clause (b), not less than two years, should be after passing
the wireman's examination. Note.-- (1)
Every candidate who produces
a full technological certificate in Electrical Engineering from any recognised
Technical Institute or College shall be exempted from appearing for this
examination: Provided that such
candidate has after completing his training for such certificate undergone
practical training in wiring and rectifying common defects in electric lights
and power installation as may be considered satisfactory by the Board, for such
period, being not less than one year, so that the total period of training
undergone by him is not less than four years. (2)
The Board may grant
exemption to any candidate from the requirements of the proviso to Paragraph
(1) above, if in the opinion of the Board the practical training obtained by
the candidate is satisfactory. (3)
[3]"The
Board may at its discretion grant inter-state recognition to any person holding
certificate of competency of electrical supervisor issued by other State on
payment of prescribed fee as shown in rule 48". The examination for
wireman is intended for working wiremen. Candidates for the
examination of wiremen shall be the persons (a) who have worked on wiring and
electric installation works for at least one year as may be considered
satisfactory by the Board or (b) who have satisfactorily completed the
wiremen's classes at the V.J.T.I. at Bombay or any other approved institution
and passed the examination held by the Stats Council of Technical Education for
Maharashtra State and in addition have worked on wiring and electrical
installation works for at least six months as may be considered satisfactory by
the Board. Note.--A candidate
who has passed the third year's course in electrical engineering from the
V.J.T. Institute at Bombay, the College of Engineering, Poona, or other
approved institutions, and obtained at least 50 per cent of the full marks in
the annual examination in wiring, jointing and electrical experiments, will be
exempted from appearing for this examination. Every candidate for
an examination under these rules shall make an application in Form 'A' and
shall sign the same in the presence of his employer, an Honorary Magistrate, or
a Government Official. The candidate shall forward the application duly filled
in to the Secretary to the Board not less than forty-two days before the date
fixed for the examination together with,-- (a)
testimonials from employers
regarding good conduct and practical experience in Form 'K' appended to these
rules; (b)
wireman's examination certificate,
if any; (c)
a challan in support of
payment of the fee; and (d)
two copies of his latest
photograph (size about 2" X 21/2") with his name on the back. The fee paid by a
candidate, whose application for an examination has been accepted, shall not be
returned to him on any account: Provided that in the
event of a Candidate's inability to attend the examination for valid reasons it
shall be competent to the Board to allow such candidate to appear at the next
examination without further payment. V. TESTIMONIALS No candidate shall be
admitted to any examination whose testimonials are, in the opinion of the
Board, unsatisfactory. The original
testimonials after being scrutinised shall be returned to the applicant when
his application is disposed of. VI. SUBJECTS FOR EXAMINATIONS The examination will
consist of-- (1)
the following three written
papers, each of two hours' duration and each carrying 50 marks:-- Paper
(I).--Compulsory: Electricity-Theory (Elementary knowledge); Paper
(II).--Optional: Electricity Utilisation to be taken by the candidates desiring
to qualify for domestic, industrial and other installations. Paper
(III).--Optional: Mines Installation to be taken up by the candidates desiring
to qualify for electrical installations in mines. (2)
an Oral and Practical test
carrying 100 marks. (3)
To pass the examination, a
candidate must secure 20 marks in each written paper, and 40 marks in the oral
and practical test. (4)
No certificate shall be
issued unless a candidate passes in Papers (I) and (II), or Papers (I) and
(III). Candidates who have passed in Paper I and II, and desire to qualify for
mines installations, shall be exempt, from re-appearing in Paper I. PAPER I ELECTRICITY-THEORY (ELEMENTARY
KNOWLEDGE) Principles of
Electricity.-- Electric pressure, current and resistance Ohms Law, Specific
resistance. Laws of resistance and their application for calculating voltage
drop. Series and parallel circuits. Practical units at voltage, current,
resistance, power and energy. Relation between electrical power unit (KW) and
mechanical power unit (H.P.) Electromagnetism. Production of E.M.F. and
Flemings and rules, Magnetic, Chemical and heating effects of electric current.
Magnetic properties of material. Electromagnets and their applications. Material-conductors,
non-conductors and insulators. Insulating materials and their relative merits.
Transformer oil. Effect of heat and moisture on insulation. Lubricants and
their uses. Different types of
wires, cables, switches, circuit-breakers, cut-outs etc., and their safe
current carrying capacity. Use of tables and data sheets generally given in
electrical hand books. Generation of
Electricity.-- Natural sources of energy. Types of prime movers. Methods of
producing Electro Motive Force, alternating current and direct current. A.C. Generators
(Alternators).-- Essential components and constructional features. Methods of
voltage and frequency control. Conditions and methods for synchronising, simple
associated switch board and its accessories. D.C. Generators.-- Essential
components and constructional features. Shunt, series and compound dynamos and
their characteristics. Causes of sparking. Interpoles. Commutators and their
maintenance. Carbon brusher, their adjustment and care. Methods of voltage
regulation. Conditions for paralled operation, simple associated switch board
and its accessories. Batteries.-- Primary
cells. Dry cells. Storage or secondary batteries or accumulators and their
installation. Lead acid cells. Nickel iron or alkaline cells. Initial and
subsequent charging of batteries. Charging circuits and their calculations.
Series and parallel circuits. Maintenance of batteries. Use of hydrometers. A.C. Motors.-- Theory
of Induction (squirrel cage and slip ring type) synchronous and commutated

house wiring including those

higher rupturing capacity fuses, cut-outs, circuit breakers. Overload and
no-volt protection; thermal trips. Field breaking switches and overspeed
protection. PAPER III MINES INSTALLATIONS Wiring.-- Wiring
layouts of different types such as cleats, lead covered, cab type sheathed for
lighting purposes and armoured cables for power installation. Different types
of trailing cables and their use. *Use and jointing of aluminium cables and
precautions to be taken for laying such cables. Circuit diagrams.-- Electrical

desiring to qualify only for electrical installations in Mines need not appear
for compulsory section under Part II. Part I is, however, compulsory for such

lugs on wires and cables. VII. CERTIFICATES AND PERMITS Every candidate who
passes the examination for supervisors, or who is exempted from, appearing for
such examination, shall be granted a certificate of competency in form 'B' or
'C' as the case may be, and a permit in form 'D' Every candidate who
passes the examination for wiremen shall be granted a certificate in Form 'E'
and permit in form 'G' Candidates exempted
from appearing for the examination under the note to rule 16 shall be granted a
certificate in form 'F' and a permit in Form 'G' on payment of the prescribed
fee. Every permit granted
under these rules shall be liable to be withdrawn or suspended for such period
as the Board may decide, if the holder thereof is found guilty of any
malpractice under these rules. A duplicate of every
certificate and permit granted under these rules shall be recorded in the
office of the Secretary. A duplicate of
certificate or permit granted under these rules shall be issued on payment of-- [4]Rs.
15 for supervisor; [5]Rs.
5 for wiremen; on production by the
applicant of proof of the loss of the original certificate or permit together
with the latest copy of his photograph to the satisfaction of the Secretary. A fee of [6]Rs. 5 shall be charged for
supplying information about the particular part or parts in which the candidate
passed or failed in the examination, together with the actual number of marks
he obtained in each part. Notwithstanding
anything contained in the foregoing provisions of these Rules, certificates of
competency and wiremen's certificates granted by the competent authority in the
territory formerly included in a merged State under the Rules made under an
enactment corresponding to the Indian Electricity Act, 1910, and in force in
the said State territory immediately before the repeal of the said
corresponding enactment shall be deemed to have been granted by the Board under
these Rules. VIII. LICENCES TO ELECTRICAL CONTRACTORS An Electrical
Contractor's Licence shall be granted only to a person (or a firm) who has in
his possession the instruments necessary for carrying out the tests required
under the Indian Electricity Rules, 1956, and who either himself holds a
certificate of competency and permit and personally executes or supervises all
work undertaken by him or who has in his employ a supervisor holding a
certificate of competency and permit, under whose direct supervision all work
undertaken by him is carried out: Provided that the
Board may refuse to grant such licence to any person (or firm) who (or which)
in the opinion of the Board, is not fit to hold such licence. The Electrical
Contractor's Licence shall be in Form 'H'. An Electrical
Contractor to whom a licence in Form 'H' is granted shall keep the instruments necessary
for carrying out the tests required under the Indian Electricity Rules, 1956,
in good order. If the holder of a
competency certificate, on the strength of whose permit a licence has been
granted to an Electrical Contractor, leaves the services of such contractor,
such contractor's licence shall be deemed to have been suspended. Should such
contractor fail to employ a person holding a supervisor's permit within one
month from the date on which the holder of the competency certificate had left
such contractor's service, such contractor's licence shall be cancelled. The Secretary may,
with the approval of the President, extend this period to a maximum of two
months in extra ordinary cases. If a holder of a
supervisor's permit in the employment of a licenced electrical contractor
leaves his service, the termination of the service of the permit holder shall
be notified to the Secretary both by the contractor and the permit-holder. The
contractor shall also notify the name and certificate number of the supervisor
engaged under rule 29. A Contractor's
Licence shall not be granted to any holder of a supervisor's permit whilst he
is in the employ of any other firm. If a holder of a
Supervisor's permit to whom a contractor's licence has been granted, accepts
employment in any other firm, the contractor's licence granted to such holder
shall be automatically cancelled. The Board may at any
time cancel a contractor's licence if the person (or firm) to whom (or to which)
the licence is granted is, in the opinion of the Board, not fit to hold such
licence. All testing
instruments in the possession of every electrical contractor shall be inspected
from time to time by the Electrical Inspector or his representative. The entire staff of
every Licensed Electrical Contractor shall consist of bonafide certificated and
full-time employees, provided that a contractor may engage Apprentices for training
purposes, in which case the total number of Apprentices employed by any
Contractor at any time shall not exceed 50 per cent, of his total Wiring Staff,
inclusive of Apprentices, but exclusive of coolies, and provided further that
the Contractor shall not permit such Apprentices to carry out any electrical
installation in work, including additions, alterations, repairs and adjustments
to existing installations covered by rule 45 of the Indian Electricity Rules,
1956, except under the direct supervision of a person holding a certificate of
competency and under the guidance of at least one certified Wireman on the
premises. Every Contractor
shall maintain a Register in Form 'I' of all Supervisors' Wiremen and
Apprentices; such Register shall be obtained from the Electrical Inspector, and
shall be open to inspection a; any time by that Officer or his representative. No person, whose name
is not entered in such Register, shall be considered to be bona-fide employee
on the Contractor's Wiring staff. Applications for a
Contractor's Licence shall be made to the Secretary in Form 'J' Every contract for
electrical installation work undertaken by a Licensed Electrical Contractor shall
be in writing, and the Licensed Electrical Contractor shall be held responsible
for the quality of all materials used. Notice of electrical
installation work, including additions, alterations, repairs and adjustments to
existing installation except such replacement of lamps, fans, fuses, switches
and other component parts of the installation as in no way alters its capacity
or character, shall be given in writing by a Licensed Electrical Contractor to
the Electrical Inspector or his assistant, within 48 hours of the commencement
of such work. For all electric
installation work carried out under rule 45 of the Indian Electricity Rules,
1956, a test report shall be submitted by the licensed electrical contractor to
the Supply Company concerned. The test report shall be signed by the supervisor
under whose supervision the work has been carried out, and countersigned by the
Licensed Electrical Contractor. The Supervisor shall be wholly responsible for
the due execution of the electric installation work and shall be present at the
time of testing. [7]Note.--Government
of Maharashtra hereby exempts all the electrical works carried out by the staff
directly employed by the consumers or owners specified in Schedule 'B' hereto
within their premises from so much of sub-rule (1) of the said rule 45 as
requires such works to be carried out by an electrical-contractor licensed by
the State Government in that behalf subject to the following conditions, that
is to say,-- (1)
The consumer or owner shall
whenever any such work is being carried out, have in his employ a person
holding a certificate of competency issued by the State Government, and all
work shall be carried out under the direct supervision of such a person: Provided that, if any
such person holding a certificate of competency ceases to be in the employment
of such consumer or owner, the consumer or owner shall employ a person holding
a certificate of competency issued by the State Government, within one month
(or such period not exceeding two months as the Licensing Board constituted
under Government Notification, Industries and Labour Department, No. IER.
1962/Elec, dated the 15th March 1962 may permit in that behalf) from the date
on which the person holding a certificate of competency ceased to be in his
employment and the fact of such cessor (including the certificate number and
the name of the person holding it) shall be communicated by the consumer or
owner to the Secretary of the said Licensing Board. (2)
The consumer or owner shall
possess and keep in good order the instruments and equipment necessary for
carrying out the tests requited under the Indian Electricity Rules, 1956, in
relation to the said works. (3)
The consumer or owner shall entrust
the electrical installation works to the person holding a certificate of
competency on the understanding that he shall be wholly responsible for the due
execution of those works and that he shall remain present at the time of
testing. (4)
The consumer or owner shall
submit a test report to the supply company concerned in respect of all the
electrical installation works carried out by him, the consumer or owner shall
require the holder of certificate of competency under whose supervision the
works have been carried out to sign the test report, and then, it shall be
countersigned by him. A register of all
licensed electrical contractors shall be maintained by the Secretary. Every electrical
contractor's licence granted under these rules shall be renewable annually for
the following calender year before the 31st December of the year for which such
licence is valid. If a contractor's licence, together with the following documents,
is not received by the Secretary, Licensing Board, for renewal within a period
of fifteen days from 31st December of each year, it shall be deemed to be
cancelled and full fee will be charged as for a new licence, namely:-- (i)
Electrical Contractor's
Licence in original. (ii)
Receipted Treasury Challan
towards payment of renewal fee. (iii)
Test report of correct
working of the megger. (iv)
Up-to-date register of
Supervisors, Wiremen and Apprentices in Form 'I' as required under rule 37 in
original along with a copy thereof. (v)
Declaration signed by the
Electrical Supervisor to the effect that he is a full-time and bona-fide
employee of the Contractor applying for renewal of the licence and is not
employed anywhere else in any capacity. (vi)
This declaration should accompany
a declaration signed by the Contractor concerned confirming that the supervisor
is his full time and bona-fide employee. A duplicate of an
electrical Contractor's Licence granted under these rules shall be issued on
payment of a fee of Rs. 20 and on production by the applicant of proof of the
loss of the original licence to the satisfaction of the Secretary. A fee of Rs. 25 shall
be charged where a change in respect of the name of the contractor is to be
made in the licence granted, provided that such change does not involve a
transfer or an assignment of the licence to another person. Where in the opinion
of a Supply Company or a person for whom any electric installation work has
been carried out, such work is not in accordance with the Indian Electricity
Rules, 1956, the matter shall be reported to Electrical Inspector concerned for
such action as may be necessary and the action taken by him shall be notified
to the parties concerned. If any person holding
a permit and/or an Electrical Contractor's Licence is found guilty of
malpractice or infringement of these rules, the Electrical Inspector concerned
shall report the fact with full investigation to the Board. The decision of the
Board on such report shall be communicated to the parties concerned. X. ELECTRIC SUPPLY COMPANIES CARRYING ON
THE BUSINESS OF ELECTRICAL CONTRACTORS No electrical
contracting work shall be carried out by any Electric Supply Company unless
they have obtained an Electrical Contractor's Licence and employed a separate
staff of supervisors and wiremen, in compliance with these rules: Provided that where
the services of a Licensed Electrical Contractor are not available to the
public in the area of supply of an Electric Supply Company the Licensing Board
may exempt such Electric Supply Company from the obligation of appointing of a
separate staff of Electrical Supervisors and wiremen for a period of one year
at one time. An Electrical
Contractor's Licence granted to an Electric Supply Company shall be liable to
be withdrawn by the Board if it is found that preferential treatment is being
given to prospective consumers with a view to gain an unfair advantage in
competition with local contractors. XI FEES The following fees
shall be levied under these rules for:-- (i)

examination, contractor's licence, the annual renewal thereof and any other
fees leviable in this connection, shall be paid into Government Treasury in the
Maharashtra State under relevant head of account specified by Government from
time to time. [12]XII.
REMUNERATIONS PAYABLE TO EXAMINERS AND MEMBERS OF BOARD An examiner nominated
by the Board shall receive such fees as Government may from time to time
approve, and such assistance in the conduct of the examination as may be
determined by the Board. Out of the funds
placed at his disposal, the Secretary of the Board shall pay to each member of
the Board who undertakes a journey for attending a meeting of the Board,
"travelling allowances in respect of such journey in accordance with Scale
I, in rule I(I)(b) in section I, in Appendix XLII-A, to the Bombay Civil
Services Rules, 1959.". Printed copies of
