RULES AND CONDITIONS FOR ISSUING CERTIFICATES OF COMPETENCY UNDER RULE 45 OF INDIAN ELECTRICITY RULES, 1956

 

PREAMBLE

In pursuance of rule 45 of the Indian Electricity Rules, 1956 and in Supersession of all previous Notifications and Orders, the Government of Maharashtra hereby makes the following Rules and Conditions for issuing Certificate of competency under the aforesaid rule viz.:--

I. LICENSING BOARD

Rule - 1. Appointment of Licensing Board.--

 

For carrying out the purpose of these rules, a Licensing Board (hereinafter referred to as " the Board ") representative of Electrical interests in the State shall be appointed.

Rule - 2. Constitution of Board.--

 

The Board shall consist of--

 

(i)       [1]The Chief Engineer (Elec), P.W. Department, Bombay who shall be the President,

 

(ii)     [2]The personal Assistant to the Chief Engineer, (Elec.), P.W., Bombay, who shall be the Secretary, and

 

(iii)    Representatives of the following bodies:-- Name of Body Number of Representatives

 

1.        State Council for Technical Education, Bombay ..

 

2.        Victoria Jubilee Technical Institute. Bombay ..

 

3.        The Tata Hydro Electric Group ..

 

4.        The Maharashtra State Electricity Board ..

 

5.        The Bombay Municipality-- The Bombay Electric Supply and

 

6.        Transport Undertakings.

 

7.        The Federation of Electricity Undertaking of India ..

 

8.        The Central Railway

 

9.        The Electrical Contractor's Association, Bombay ..

 

10.     The Electrical Contractor's Association, Nagpur ..

 

11.     The representative of each of the Electrical Contractor's Associations referred to above shall be a person who, in the opinion of the State Government, has sufficient knowledge of Electrical Engineering to enable him to participate in the proceedings of the Board and the representative of each of the other bodies referred to above shall be a qualified Electrical Engineer possessing the Degree or Diploma in Electrical Engineering from Universities or Institutions recognised by Government.

Rule - 3. Function of the Board.--

 

The functions of the Board shall be,--

 

(1)     to grant licences to Electrical Contractors,

 

(2)     to conduct examinations for Supervisors and Wiremen,

 

(3)     to grant certificates and permits to Supervisors and Wiremen,

 

(4)     to deal with applications and testimonials found to be incorrect and to take such action as deemed fit,

 

(5)     to nominate representatives in the various centres of the State for the purpose of carrying out local examinations and test under these rules,

 

(6)     to hear and decide cases of malpractice by Electrical Contractors, Supervisors or Wiremen, and

 

(7)     generally to carry out the provisions of these rules.

 

Note.--Any decision given by the Board in the execution of its functions shall be final.

Rule - 3A. Sub-Committees.--

 

The Board shall have power to appoint Sub-Committees and delegate such of it powers to these Sub-Committees as the Board considers fit.

Rule - 4. Meetings of the Board.--

 

The Board shall ordinarily meet once in six months after each half-yearly examination. The Board shall also meet for transacting any special business, which cannot be disposed of by circulation of papers. Notice of every meeting shall be sent to each member by the Secretary.

Rule - 5. Quorum.--

 

Five members shall form a quorum at any meeting of the Board.

Rule - 6. Duties of the President.--

 

The duties of the President shall be,--

 

(1)     to preside over all meetings of the Board, unless prevented by reasonable cause, and

 

(2)     to grant licences to electrical contractors and certificates and permits to Supervisors and Wiremen on behalf of the Board.

Rule - 7. Chairman of meeting.--

 

The President, and in his absence, such one of the members present, as may be elected by the meeting, shall be the chairman of the meeting.

Rule - 8. Duties of the Secretary.--

 

The duties of the Secretary shall be,--

 

(1)     to scrutinise all applications for electrical contractors' licences and submit the same to the President and carry on correspondence in connection therewith;

 

(2)     to scrutinise applications for admission to the examination for Supervisors and Wiremen and carry on correspondence in connection therewith;

 

(3)     to countersign licences to electrical contractors and certificates and permits to supervisors and wiremen;

 

(4)     to notify to all electric supply companies concerned and the electrical contractors association of all licences issued and/or cancelled.

II. EXAMINATIONS

Rule - 9. Examinations.--

 

Examinations under these rules shall be held twice in a year in May and November, in Bombay, Poona and such other places and on such dates as may be notified by the Secretary to the Board from time to time in the Maharashtra Government Gazette.

Rule - 10. Admission to Examinations.--

 

Examinations are intended for such candidates as are working or have worked in the State of Maharashtra.

III. MODE OF EXAMINATIONS

Rule - 11.

 

Every examination shall be of such a nature as to test the practical knowledge of the candidate and to ascertain his competency.

Rule - 12.

 

Every examination shall be conducted in a place where the candidate's knowledge can be practically tested and each candidate shall be tested vive voce.

 

IV. ADMISSION OF CANDIDATES FOR EXAMINATIONS

Rule - 13. Examinations for supervisors.--

 

The examination for supervisors is intended for electricians, supervisors, foremen, charge-hands and others, but any wireman may appear for the examination, if he desires to do so.

Rule - 14. Qualifications.--

 

A candidate for examination of supervisors must,--

 

(a)      have passed the examination for wireman; and

 

(b)      have at least,--

 

(i)       three and half years practical experience, if such candidate has completed the electrician classes at the Victoria Jubilee Technical Institute at Bombay or at any recognised technical Institute and has passed the examination held by the State Council Technical Education for Maharashtra State, or

 

(ii)      four years practical experience in any other case:

 

Provided that--

 

(i)       out of the period specified in item (i) of clause (b), not less than one and half year; and

 

(ii)      out of the period specified in item (ii) of clause (b), not less than two years, should be after passing the wireman's examination.

 

Note.--

 

(1)     Every candidate who produces a full technological certificate in Electrical Engineering from any recognised Technical Institute or College shall be exempted from appearing for this examination:

 

Provided that such candidate has after completing his training for such certificate undergone practical training in wiring and rectifying common defects in electric lights and power installation as may be considered satisfactory by the Board, for such period, being not less than one year, so that the total period of training undergone by him is not less than four years.

 

(2)     The Board may grant exemption to any candidate from the requirements of the proviso to Paragraph (1) above, if in the opinion of the Board the practical training obtained by the candidate is satisfactory.

 

(3)     [3]"The Board may at its discretion grant inter-state recognition to any person holding certificate of competency of electrical supervisor issued by other State on payment of prescribed fee as shown in rule 48".

Rule - 15. Examination for wireman.--

 

The examination for wireman is intended for working wiremen.

Rule - 16. Qualifications.--

 

Candidates for the examination of wiremen shall be the persons (a) who have worked on wiring and electric installation works for at least one year as may be considered satisfactory by the Board or (b) who have satisfactorily completed the wiremen's classes at the V.J.T.I. at Bombay or any other approved institution and passed the examination held by the Stats Council of Technical Education for Maharashtra State and in addition have worked on wiring and electrical installation works for at least six months as may be considered satisfactory by the Board.

 

Note.--A candidate who has passed the third year's course in electrical engineering from the V.J.T. Institute at Bombay, the College of Engineering, Poona, or other approved institutions, and obtained at least 50 per cent of the full marks in the annual examination in wiring, jointing and electrical experiments, will be exempted from appearing for this examination.

Rule - 17. Application for appearing for examinations.--

 

Every candidate for an examination under these rules shall make an application in Form 'A' and shall sign the same in the presence of his employer, an Honorary Magistrate, or a Government Official. The candidate shall forward the application duly filled in to the Secretary to the Board not less than forty-two days before the date fixed for the examination together with,--

 

(a)      testimonials from employers regarding good conduct and practical experience in Form 'K' appended to these rules;

 

(b)      wireman's examination certificate, if any;

 

(c)      a challan in support of payment of the fee; and

 

(d)      two copies of his latest photograph (size about 2" X 21/2") with his name on the back.

Rule - 18. Examination fee not to be returned.--

 

The fee paid by a candidate, whose application for an examination has been accepted, shall not be returned to him on any account:

 

Provided that in the event of a Candidate's inability to attend the examination for valid reasons it shall be competent to the Board to allow such candidate to appear at the next examination without further payment.

V. TESTIMONIALS

Rule - 19. Admission to examinations.--

 

No candidate shall be admitted to any examination whose testimonials are, in the opinion of the Board, unsatisfactory.

Rule - 20. Return of testimonials.--

 

The original testimonials after being scrutinised shall be returned to the applicant when his application is disposed of.

VI. SUBJECTS FOR EXAMINATIONS

Rule - 21. Electrical Supervisor's Examination.--

 

The examination will consist of--

 

(1)     the following three written papers, each of two hours' duration and each carrying 50 marks:--

 

Paper (I).--Compulsory: Electricity-Theory (Elementary knowledge);

 

Paper (II).--Optional: Electricity Utilisation to be taken by the candidates desiring to qualify for domestic, industrial and other installations.

 

Paper (III).--Optional: Mines Installation to be taken up by the candidates desiring to qualify for electrical installations in mines.

 

(2)     an Oral and Practical test carrying 100 marks.

 

(3)     To pass the examination, a candidate must secure 20 marks in each written paper, and 40 marks in the oral and practical test.

 

(4)     No certificate shall be issued unless a candidate passes in Papers (I) and (II), or Papers (I) and (III). Candidates who have passed in Paper I and II, and desire to qualify for mines installations, shall be exempt, from re-appearing in Paper I.

 

PAPER I

ELECTRICITY-THEORY (ELEMENTARY KNOWLEDGE)

 

Principles of Electricity.-- Electric pressure, current and resistance Ohms Law, Specific resistance. Laws of resistance and their application for calculating voltage drop. Series and parallel circuits. Practical units at voltage, current, resistance, power and energy. Relation between electrical power unit (KW) and mechanical power unit (H.P.) Electromagnetism. Production of E.M.F. and Flemings and rules, Magnetic, Chemical and heating effects of electric current. Magnetic properties of material. Electromagnets and their applications.

 

Material-conductors, non-conductors and insulators. Insulating materials and their relative merits. Transformer oil. Effect of heat and moisture on insulation. Lubricants and their uses.

 

Different types of wires, cables, switches, circuit-breakers, cut-outs etc., and their safe current carrying capacity. Use of tables and data sheets generally given in electrical hand books.

 

Generation of Electricity.-- Natural sources of energy. Types of prime movers. Methods of producing Electro Motive Force, alternating current and direct current.

 

A.C. Generators (Alternators).-- Essential components and constructional features. Methods of voltage and frequency control. Conditions and methods for synchronising, simple associated switch board and its accessories.

 

D.C. Generators.-- Essential components and constructional features. Shunt, series and compound dynamos and their characteristics. Causes of sparking. Interpoles. Commutators and their maintenance. Carbon brusher, their adjustment and care. Methods of voltage regulation. Conditions for paralled operation, simple associated switch board and its accessories.

 

Batteries.-- Primary cells. Dry cells. Storage or secondary batteries or accumulators and their installation. Lead acid cells. Nickel iron or alkaline cells. Initial and subsequent charging of batteries. Charging circuits and their calculations. Series and parallel circuits. Maintenance of batteries. Use of hydrometers.

 

A.C. Motors.-- Theory of Induction (squirrel cage and slip ring type) synchronous and commutated motors, their uses, installation method of starting and speed control and reversal of direction.

 

D.C. Motors.-- Theory of series, shunt and compound wound type motors, their uses, installation, method of starting and speed control and reversal of direction.

 

A.C. Circuits.-- Knowledge of vectors. Phase and phase difference. Resistance. Inductance and Capacitance in an A.C. circuit. Periodicity of frequency power and power factor. Single phase and three phase systems. Star and delta connections. Phase sequence.

 

Controlling and Regulating Gear-knowledge of various types of switches and circuit-breakers and cut-outs, starters, regulators, protective devices for both A.C. and D.C. motors and their wiring with the motors.

 

Transformation.-- Knowledge of single phase and three phase transformers, their construct on use and maintenance, Phasing out. Parallel working. Auto transformer. Transformer-tappings. Temperature rise. Instrument transformer.

 

Conversion.-- Principles of operation of motor generator sets, rotary convertors, and mercury are rectifiers.

 

Transmission and Distribution.--

 

(a)      Overhead lines.-- Simple calculations and general principles of construction of low, medium and high pressure lines; size of conductors, length of spans, sags, strength of poles, spacing of conductors, cross arms, effects of temperature, wind pressure, ice and snow; tension on wire. Insulators, brackets, stays, struts, guard-wires and other protective devices. Earthing; Lightening arrestors and lightening conductors and their testing. Testing and fault location. *Use and jointing of different types of aluminium conductors and cables. Precautions to be taken for handling, laying and stringing of aluminium conductors and cables.

 

(b)      Underground cables.-- Simple calculations and general principles of laying and jointing aluminium and other electrical cables direct in ground, in troughs and pipes; handling, bending, jointing, plumbing, underground and above ground junction boxes. Distribution board and pillars. Joint box compound, melting of compounds and filling boxes with compounds. Testing and fault location.

 

Illumination.-- Metal filament lamps. Flourescent lamp circuits. High voltage luminous tube sign installations. Photometric units and simple measurements. General requirements of efficient lighting and its elementary calculations. Street lighting. Time switches.

 

Safety Rules.--

Working knowledge of,--

 

(i)       the Indian Electricity Rules,

 

(ii)      wiring Rules.

 

Protection and restoration of persons suffering from electric shock.

 

PAPER II

ELECTRICITY-UTILISATION

 

Domestic Installations--

Wiring.-- Wiring layouts of different types such as cleat, metal sheathed, wood casing and capping, cab type sheathed, conduit and armoured cable for lighting and power installations in residential premises together with the necessary switchgear. Estimates of materials and cost of different types of installations. Wiring of temporary installations and portable appliances. Use and jointings of aluminium cables and precautions to be taken for laying such cables.

 

Circuit diagrams.-- Electrical connections of various circuits for--

 

(i)       house wiring including those for main and sub-distribution Boards, switches and cut-outs etc., together with the load statement for each circuit.

 

(ii)      lifts with their safety devices.

 

Apparatus.-- Installation and maintenance of heaters, cookers, refrigerators, and other domestic appliances, electric hells and indicators, small motors for pumps and electric lifts.

 

Energy measurement and charges.--Energy meters both D.C. and A.C. for house service.

 

Simple calculations relating to cost of energy. Elementary knowledge of methods of charging for energy.

 

Testing and fault attendance.--

 

Detertion and location of faults in domestic appliances and wiring insulation and continuity tests. Rectification of faults. Tests for insulation resistance to earth. Earth testing.

 

Protective devices.--

 

Elementary knowledge of the use of fuses and cut-outs, Earthing of domestic appliances, motors etc. Use of lightening arrestors.

 

Industrial Installations

 

Wiring.--

 

Wiring layouts of different types such as cleat, wood casing and capping, metal sheathed, cab type sheathed, conduit and armoured cable for lighting and power installations in industrial premises together with the necessary switchgear. Estimates of materials and cost of different types of installations. Wiring of temporary installations and portable appliances.

 

Circuit diagrams,--Electrical connections for--

 

(i)       D.C. and A.C. generators, switch-boards, transformers,

 

(ii)      main and sub-distributing boards with circuit breakers, switch-fuse units, with loads statement for each circuit.

 

(iii)     D.C. and A.C. motors, their starters, regulators,

 

(iv)    battery charging equipment,

 

(v)      converting machinery,

 

(vi)    lifts with their safety devices.

 

Pump Installations.-- General principles and elementary calculations of head, power and energy requirements.

 

Apparatus.-- Installation and maintenance of generators, electric motors, electric lifts, electric furnaces, electric welding plants, haulage and winding machines, cooling and heating appliances.

 

Power and energy measurement and charges.-- Measurement of Power. Watts-meter-Energy meters, both D.C. and A.C. Power factor correction by capacitors.

 

Simple calculations relating to cost of power and energy. Elementary knowledge of methods of charging for demand and energy.

 

Testing and fault attendance.-- Detection and location of faults in D.C. and A.C. generators, motors, overhead distribution lines and under-ground cables, electric instruments and apparatus and wiring installations; rectification of faults. Insulation and continuity tests. Tests for insulation resistance to earth. Earth testing.

 

Protective devices.-- Elementary knowledge of earthing of generators, motors, machines, installations and appliances. Use of lightening arrestors, fuses, including higher rupturing capacity fuses, cut-outs, circuit breakers. Overload and no-volt protection; thermal trips. Field breaking switches and overspeed protection.

 

PAPER III

MINES INSTALLATIONS

Wiring.-- Wiring layouts of different types such as cleats, lead covered, cab type sheathed for lighting purposes and armoured cables for power installation. Different types of trailing cables and their use. *Use and jointing of aluminium cables and precautions to be taken for laying such cables.

Circuit diagrams.--

Electrical connections for--

 

(a)      D.C. and A.C. generators, switch boards, transformers, etc.

 

(b)      Distribution boards, with circuit breakers, switch fuse units and gate-end switches.

 

(c)      D.C. and A.C. motors, their starters and regulators.

 

Apparatus.--

 

(i)       Installation and maintenance of--

 

(a)      Electrical Winders, haulages and pump units, their control gears and starters.

 

(b)      Rectifiers, rotary converters and electric locomotives.

 

(c)      Portable and transportable machineries:--Coal cutting machines, loaders, conveyors, Gate-end switches, drill panels with drill units and their control systems.

 

(ii)      General principles and elementary calculations of load power and energy consumption in pumping, hauling and winding installations and other working face machineries.

 

Power and energy measurement and charges.--

 

Measurement of power, watt meters, energy meters both D.C. and A.G. power factor correction by capacitors. Simple calculations relating to cost of power and energy. Elementary knowledge of methods of charging for demand and energy.

 

Testing and fault attendance.--

 

Detection and location of earth, or other faults in electrical apparatus and cables. Insulation and continuity test. Rectification of faults. Test for insulation resistance to earth. Testing of leakage protective device. Earth testing.

 

Protective devices.--

 

Elementary knowledge of earthing of metal frames of machineries. Use of fuses. Overload, no-volt and earth leakage protection of circuit breakers.

 

Safety Rules.--

 

Working knowledge of--

 

The Indian Electricity Rules, 1956 with particular reference to Chapter X.

 

Note.--Candidates desiring to qualify only for electrical installations in Mines need not appear for compulsory section under Part II. Part I is, however, compulsory for such candidates also.

 

ORAL AND PRACTICAL TEST

An oral and practical test based on the syllabus for written papers will be held.

Rule - 22. Syllabus for the Wiremen's Examination.--

 

(i)       The examination will consist of practical test (3 hours) carrying 100 marks and oral test carrying 50 marks.

 

(ii)      To pass the examination the candidate must secure at least 50 marks in practical, 15 marks in oral and an aggregate of 75 marks in the examination.

 

(iii)     Electric pressure (volts).

 

(iv)    Electric current (amperes).

 

(v)      Power (watts).

 

(vi)    Energy (watt-hrs.).

 

(vii)   Ohm's Law.

 

(viii)  Difference between A.C. and D.C. supply.

 

(ix)    Conductors and insulators.

 

(x)      Use of Standard Wire Gauge.

 

(xi)    Connections of voltmeters and ammeters.

 

(xii)   Reading of energy meters.

 

(xiii)  Simple calculations of power and energy.

 

(xiv)  Testing the supply for OFF and ON; A.C. and D.C.

 

(xv)   Positive and Negative; Live and Dead conductors.

 

(xvi)  Various uses of the Test Lamp and Bell.

 

(xvii) Connection and diagrams for distribution and Fuse Boards.

 

(xviii)   Cut-outs, ceiling roses, lamp holders, switches (including two-way and intermediate).

 

(xix)  Wiring on cleats, in. wood casing, metal sheathed.

 

(xx)   T.R.S. cab tyre sheathed conduit

 

(xxi)  Wiring of fittings of small motors and other domestic appliances.

 

(xxii) The installation of electric bells and indicators.

 

(xxiii)   Connections of A.C. and D.C. fans and regulators, common faults in them and their remedies.

 

(xxiv)   Method of carrying (overhead) bare, lead covered and cab tyre sheathed. Wires over short distances.

 

(xxv)Knowledge of danger points in simple lighting and power installations. Testing for faults. Measuring insulation resistance to earth by Megger. Precaution and method of treatment in case of a person suffering from electric shock.

 

(xxvi)   Making straight and Tee Joints in stranded insulated wires.

 

(xxvii)  Making Brittania and Western Union joints in bare copper and *aluminium wires.

 

(xxviii) Soldering lugs on wires and cables.

 

VII. CERTIFICATES AND PERMITS

Rule - 23. Grant of certificate of competency and permit to supervisors.--

 

Every candidate who passes the examination for supervisors, or who is exempted from, appearing for such examination, shall be granted a certificate of competency in form 'B' or 'C' as the case may be, and a permit in form 'D'

Rule - 24. Grant of certificate and permit to wiremen.--

 

Every candidate who passes the examination for wiremen shall be granted a certificate in Form 'E' and permit in form 'G'

Rule - 25. Grant of certificate and permit in certain cases.--

 

Candidates exempted from appearing for the examination under the note to rule 16 shall be granted a certificate in form 'F' and a permit in Form 'G' on payment of the prescribed fee.

Rule - 26. Withdrawal or suspension of permit.--

 

Every permit granted under these rules shall be liable to be withdrawn or suspended for such period as the Board may decide, if the holder thereof is found guilty of any malpractice under these rules.

Rule - 27. Duplicate of a certificate or permit to be recorded.--

 

A duplicate of every certificate and permit granted under these rules shall be recorded in the office of the Secretary.

Rule - 28. Grant of duplicate certificate or permit.--

 

A duplicate of certificate or permit granted under these rules shall be issued on payment of--

 

[4]Rs. 15 for supervisor;

 

[5]Rs. 5 for wiremen;

 

on production by the applicant of proof of the loss of the original certificate or permit together with the latest copy of his photograph to the satisfaction of the Secretary.

Rule - 28-A.

 

A fee of [6]Rs. 5 shall be charged for supplying information about the particular part or parts in which the candidate passed or failed in the examination, together with the actual number of marks he obtained in each part.

Rule - 28-B.

 

Notwithstanding anything contained in the foregoing provisions of these Rules, certificates of competency and wiremen's certificates granted by the competent authority in the territory formerly included in a merged State under the Rules made under an enactment corresponding to the Indian Electricity Act, 1910, and in force in the said State territory immediately before the repeal of the said corresponding enactment shall be deemed to have been granted by the Board under these Rules.

 

VIII. LICENCES TO ELECTRICAL CONTRACTORS

Rule - 29. Grant of Electrical Contractor's Licence--

 

An Electrical Contractor's Licence shall be granted only to a person (or a firm) who has in his possession the instruments necessary for carrying out the tests required under the Indian Electricity Rules, 1956, and who either himself holds a certificate of competency and permit and personally executes or supervises all work undertaken by him or who has in his employ a supervisor holding a certificate of competency and permit, under whose direct supervision all work undertaken by him is carried out:

 

Provided that the Board may refuse to grant such licence to any person (or firm) who (or which) in the opinion of the Board, is not fit to hold such licence.

Rule - 30. Form of Contractor's Licence.--

 

The Electrical Contractor's Licence shall be in Form 'H'.

Rule - 31. Electrical Contractor to keep instrument in good order.--

 

An Electrical Contractor to whom a licence in Form 'H' is granted shall keep the instruments necessary for carrying out the tests required under the Indian Electricity Rules, 1956, in good order.

Rule - 32. Cancellation of Contractor's Licence.--

 

If the holder of a competency certificate, on the strength of whose permit a licence has been granted to an Electrical Contractor, leaves the services of such contractor, such contractor's licence shall be deemed to have been suspended. Should such contractor fail to employ a person holding a supervisor's permit within one month from the date on which the holder of the competency certificate had left such contractor's service, such contractor's licence shall be cancelled.

 

The Secretary may, with the approval of the President, extend this period to a maximum of two months in extra ordinary cases.

Rule - 33. Notice of termination of service of supervisors to be given.--

 

If a holder of a supervisor's permit in the employment of a licenced electrical contractor leaves his service, the termination of the service of the permit holder shall be notified to the Secretary both by the contractor and the permit-holder. The contractor shall also notify the name and certificate number of the supervisor engaged under rule 29.

Rule - 34. When Contractor's Licence shall not be granted.--

 

A Contractor's Licence shall not be granted to any holder of a supervisor's permit whilst he is in the employ of any other firm.

Rule - 35. Cancellation of Contractor's Licence.--

 

If a holder of a Supervisor's permit to whom a contractor's licence has been granted, accepts employment in any other firm, the contractor's licence granted to such holder shall be automatically cancelled.

Rule - 35-A. When Contractor's Licence may be cancelled.--

 

The Board may at any time cancel a contractor's licence if the person (or firm) to whom (or to which) the licence is granted is, in the opinion of the Board, not fit to hold such licence.

Rule - 36. Inspection of instruments.--

 

All testing instruments in the possession of every electrical contractor shall be inspected from time to time by the Electrical Inspector or his representative.

Rule - 37. Staff of contractor.--

 

The entire staff of every Licensed Electrical Contractor shall consist of bonafide certificated and full-time employees, provided that a contractor may engage Apprentices for training purposes, in which case the total number of Apprentices employed by any Contractor at any time shall not exceed 50 per cent, of his total Wiring Staff, inclusive of Apprentices, but exclusive of coolies, and provided further that the Contractor shall not permit such Apprentices to carry out any electrical installation in work, including additions, alterations, repairs and adjustments to existing installations covered by rule 45 of the Indian Electricity Rules, 1956, except under the direct supervision of a person holding a certificate of competency and under the guidance of at least one certified Wireman on the premises.

 

Every Contractor shall maintain a Register in Form 'I' of all Supervisors' Wiremen and Apprentices; such Register shall be obtained from the Electrical Inspector, and shall be open to inspection a; any time by that Officer or his representative.

 

No person, whose name is not entered in such Register, shall be considered to be bona-fide employee on the Contractor's Wiring staff.

Rule - 38. Application for Contractor's Licence.--

 

Applications for a Contractor's Licence shall be made to the Secretary in Form 'J'

Rule - 39. Mode of contract.--

 

Every contract for electrical installation work undertaken by a Licensed Electrical Contractor shall be in writing, and the Licensed Electrical Contractor shall be held responsible for the quality of all materials used.

Rule - 39A. Notice of commencement of work.--

 

Notice of electrical installation work, including additions, alterations, repairs and adjustments to existing installation except such replacement of lamps, fans, fuses, switches and other component parts of the installation as in no way alters its capacity or character, shall be given in writing by a Licensed Electrical Contractor to the Electrical Inspector or his assistant, within 48 hours of the commencement of such work.

Rule - 40. Test Report.--

 

For all electric installation work carried out under rule 45 of the Indian Electricity Rules, 1956, a test report shall be submitted by the licensed electrical contractor to the Supply Company concerned. The test report shall be signed by the supervisor under whose supervision the work has been carried out, and countersigned by the Licensed Electrical Contractor. The Supervisor shall be wholly responsible for the due execution of the electric installation work and shall be present at the time of testing.

 

[7]Note.--Government of Maharashtra hereby exempts all the electrical works carried out by the staff directly employed by the consumers or owners specified in Schedule 'B' hereto within their premises from so much of sub-rule (1) of the said rule 45 as requires such works to be carried out by an electrical-contractor licensed by the State Government in that behalf subject to the following conditions, that is to say,--

 

(1)     The consumer or owner shall whenever any such work is being carried out, have in his employ a person holding a certificate of competency issued by the State Government, and all work shall be carried out under the direct supervision of such a person:

 

Provided that, if any such person holding a certificate of competency ceases to be in the employment of such consumer or owner, the consumer or owner shall employ a person holding a certificate of competency issued by the State Government, within one month (or such period not exceeding two months as the Licensing Board constituted under Government Notification, Industries and Labour Department, No. IER. 1962/Elec, dated the 15th March 1962 may permit in that behalf) from the date on which the person holding a certificate of competency ceased to be in his employment and the fact of such cessor (including the certificate number and the name of the person holding it) shall be communicated by the consumer or owner to the Secretary of the said Licensing Board.

 

(2)     The consumer or owner shall possess and keep in good order the instruments and equipment necessary for carrying out the tests requited under the Indian Electricity Rules, 1956, in relation to the said works.

 

(3)     The consumer or owner shall entrust the electrical installation works to the person holding a certificate of competency on the understanding that he shall be wholly responsible for the due execution of those works and that he shall remain present at the time of testing.

 

(4)     The consumer or owner shall submit a test report to the supply company concerned in respect of all the electrical installation works carried out by him, the consumer or owner shall require the holder of certificate of competency under whose supervision the works have been carried out to sign the test report, and then, it shall be countersigned by him.

Rule - 41. Register of contractors.--

 

A register of all licensed electrical contractors shall be maintained by the Secretary.

Rule - [8]42. Renewal of Contractor's Licence.--

 

Every electrical contractor's licence granted under these rules shall be renewable annually for the following calender year before the 31st December of the year for which such licence is valid. If a contractor's licence, together with the following documents, is not received by the Secretary, Licensing Board, for renewal within a period of fifteen days from 31st December of each year, it shall be deemed to be cancelled and full fee will be charged as for a new licence, namely:--

 

(i)       Electrical Contractor's Licence in original.

 

(ii)      Receipted Treasury Challan towards payment of renewal fee.

 

(iii)     Test report of correct working of the megger.

 

(iv)    Up-to-date register of Supervisors, Wiremen and Apprentices in Form 'I' as required under rule 37 in original along with a copy thereof.

 

(v)      Declaration signed by the Electrical Supervisor to the effect that he is a full-time and bona-fide employee of the Contractor applying for renewal of the licence and is not employed anywhere else in any capacity.

 

(vi)    This declaration should accompany a declaration signed by the Contractor concerned confirming that the supervisor is his full time and bona-fide employee.

Rule - 43. Grant of duplicate of Contractor's Licence.--

 

A duplicate of an electrical Contractor's Licence granted under these rules shall be issued on payment of a fee of Rs. 20 and on production by the applicant of proof of the loss of the original licence to the satisfaction of the Secretary.

Rule - [9]43A. Fee for a change of name.--

 

A fee of Rs. 25 shall be charged where a change in respect of the name of the contractor is to be made in the licence granted, provided that such change does not involve a transfer or an assignment of the licence to another person.

Rule - 44. Report of negligence.--

 

Where in the opinion of a Supply Company or a person for whom any electric installation work has been carried out, such work is not in accordance with the Indian Electricity Rules, 1956, the matter shall be reported to Electrical Inspector concerned for such action as may be necessary and the action taken by him shall be notified to the parties concerned.

Rule - 45. Malpractice or infringement of rules to be reported.--

 

If any person holding a permit and/or an Electrical Contractor's Licence is found guilty of malpractice or infringement of these rules, the Electrical Inspector concerned shall report the fact with full investigation to the Board. The decision of the Board on such report shall be communicated to the parties concerned.

 

X. ELECTRIC SUPPLY COMPANIES CARRYING ON THE BUSINESS OF ELECTRICAL CONTRACTORS

Rule - 46. Supply companies to obtain Contractors Licences.--

 

No electrical contracting work shall be carried out by any Electric Supply Company unless they have obtained an Electrical Contractor's Licence and employed a separate staff of supervisors and wiremen, in compliance with these rules:

 

Provided that where the services of a Licensed Electrical Contractor are not available to the public in the area of supply of an Electric Supply Company the Licensing Board may exempt such Electric Supply Company from the obligation of appointing of a separate staff of Electrical Supervisors and wiremen for a period of one year at one time.

Rule - 47. Cancellation of licence granted to supply companies.--

 

An Electrical Contractor's Licence granted to an Electric Supply Company shall be liable to be withdrawn by the Board if it is found that preferential treatment is being given to prospective consumers with a view to gain an unfair advantage in competition with local contractors.

XI FEES

Rule - [10]48. FEES.--

 

The following fees shall be levied under these rules for:--

 

(i)       Examination-- Rs.

 

(a)      Admission to the examination for supervisor and grant of competency certificate and supervisors permit to a successful candidate. 50

 

(b)      Admission to the examination for wiremen and grant of certificate and permit to a successful candidate. 20

 

(c)      Issue of mark sheet for the examination to a supervisor/wireman.[11]

 

(ii)      Issue of Certificate and permit to a candidate who is exempted from the examination of-- Rs.

Note.--All fees for examination, contractor's licence, the annual renewal thereof and any other fees leviable in this connection, shall be paid into Government Treasury in the Maharashtra State under relevant head of account specified by Government from time to time.

 

[12]XII. REMUNERATIONS PAYABLE TO EXAMINERS AND MEMBERS OF BOARD

Rule - 49. Remuneration for examiners.--

 

An examiner nominated by the Board shall receive such fees as Government may from time to time approve, and such assistance in the conduct of the examination as may be determined by the Board.

Rule - [13]50. Allowances payable to Members of Board in certain cases.--

 

Out of the funds placed at his disposal, the Secretary of the Board shall pay to each member of the Board who undertakes a journey for attending a meeting of the Board, "travelling allowances in respect of such journey in accordance with Scale I, in rule I(I)(b) in section I, in Appendix XLII-A, to the Bombay Civil Services Rules, 1959.".
