THE RAJASTHAN PUBLIC EXAMINATION (PREVENTION OF UNFAIRMEANS) (AMENDMENT) ACT, 2001

PREAMBLE

An Act to amend the Rajasthan Public Examination (Prevention of Unfair means) Act, 1992.

Be it enacted by the Rajasthan State Legislature in the Fifty-second Year of the Republic of India, as follows:--

 

Section 1 - Short title and commencement

(1)     This Act may be called the Rajasthan Public Examination (Prevention of Unfair means) (Amendment) Act, 2001.

 

(2)     It shall come into force at once.

 

Section 2 - Amendment of section 6, Rajasthan Act No. 27 of 1992

For the existing section 6 of the Rajasthan Public Examination (Prevention of Unfair means) Act, 1992, hereinafter referred to as the principal Act, the following shall be substituted, namely:--

"6. Penalty.--

Whoever contravenes or attempts to contravene or abets the contravention of the provisions of,--

(i)       section 3, shall be punishable with imprisonment for a term which may extend to three years or with fine which may extend to two thousand rupees or with both; and

 

(ii)      section 4 or section 5, shall be punishable with imprisonment for a term which shall not be less than five years but which may extend to seven years and with fine which may extend to ten thousand rupees."

Section 3 - Insertion of new section 6-A, Rajasthan Act No. 27 Of 1992

After section 6 so substituted and before the existing section 7 of the principal Act, the following new section shall be inserted, namely:--

"6-A. Punishment for committing theft, extortion or robbery of question papers.--

Whoever commits theft, extortion or robbery of question papers of any public examination, at any time before the examination in such question paper is over, shall, notwithstanding anything to the contrary contained in the Indian Penal Code, 1860 (Central Act No. 45 of 1860) be punishable with imprisonment for a term which shall not be less than five years but which may extend to seven years and with fine which shall not be less than fifteen thousand rupees but which may extend to one lac rupees."
