Civil Services (Special Selection And Special Conditions Of Service For
Appointment Of Personnel In The English Medium Schools) Rules, 2023

In
exercise of the powers conferred by the proviso to Article 309 of the
Constitution of India, the Governor of Rajasthan hereby makes the following
rules laying down the procedure for special selection and special conditions of
service for appointment of various personnel in the English Medium Schools
under the School Education Department, Rajasthan, namely:-
Rule - 1. Short title and commencement
(1)
These mles may be
called the Rajasthan Civil Services (Special Selection and Special Conditions
of Service for Appointment of Personnel in the English Medium Schools) Rules,
2023.
(2)
They shall come
into force from the date of their publication in the Official Gazette.
Rule - 2. Scope and application
These
rules shall apply for appointment of the personnel on various posts of English
Medium Schools as specified in Schedule-I.
Rule - 3. Definitions
In these
rules, unless the context otherwise requires,-
(a)
Appointing
Authority means the Director or such other authority to whom the power may be
delegated by the Director with the concurrence of the State Government;
(b)
Department"
means the School Education Department, Rajasthan;
(c)
Director means
the Director. Secondary Education Rajasthan, Bikaner;
(d)
English Medium
Schools means the Mahatma Gandhi Government (English Medium) Schools, Swami
Vivekanand Government Model Schools (SVGMS) and all other Government English
Medium Schools;
(e)
Government means
the Government of Rajasthan:
(f)
Personnel means a
personnel appointed on the posts referred to in Schedule-I;
(g)
Selection
Committee means the committee referred to in rule 9;
(h)
Schedule means
the Schedule appended to these rules:
(i)
State means the
State of Rajasthan; and
(j)
Year means the
financial year.
Rule - 4. Interpretation
Unless
the context otherwise requires the Rajasthan General Clauses Act, 1955 (Act No.
VIII of 1955) shall apply for the interpretation of these mles, as it applies
for the interpretation of a Rajasthan Act.
Rule - 5. Composition, nature and strength of posts
(1)
The nature of
posts included in the English Medium Schools shall be as specified in column 2
of the Schedule-I.
(2)
The strength of
the posts in each English Medium School shall be such as may be determined by
the Government, from time to time:
Provided
that the Government may,-
(a)
create any post,
permanent or temporary, from time to time, as may be found necessary; and
(b)
leave unfilled or
hold in abeyance or abolish any posts permanently or temporary, from time to
time, without thereby entitling any person to any compensation.
Rule - 6. Determination of vacancies
The
Appointing Authority shall determine on 1st April every year, the number of
vacancies anticipated to be filled in English Medium Schools of each district
during the year or as and when such contingency arises.
Rule - 7. Source of selection
Selection
for appointment to the posts as specified in column number 2 of Schedule-I,
after the commencement of these mles shall be made on the recommendation of the
Selection Committee from amongst the eligible personnel of the department,
preferably of the district in which vacancies are to be filled, mentioned in
column number 3 of Schedule-I.
Rule - 8. Eligibility for selection
Only
such persons shall be eligible for consideration for appointment to the posts
specified in Schedule-I, who are incumbents of the department, preferably of
the district in which vacancies are to be filled, and eligible for
posting/appointment in the English Medium Schools on the posts specified in
Schedule-I.
Rule - 9. Selection committee
For the
post-wise selection of suitable eligible candidates on all the posts enumerated
in Schedule-I shall be made on the recommendation of the following State Level
Selection Committee, Range Level Selection Committee or District Level
Selection Committee, as the case may be.
(A)
State Level
Selection Committee.-
The
State Level Selection Committee consisting of the following for selection to
the posts mentioned at serial number 1, 2 and 3 of the Schedule-I, namely:-

One
representative nominated by the Administrative Department, not below the rank
of Deputy Secretary

representative nominated by the Rajasthan State Council of Educational

(iv)
|
One
representative nominated by the Director, Elementary Education Rajasthan,
Bikaner, not below the rank of District Education Officer (DEO)
|
Member

|
(v)
|
One
representative nominated by the Rajasthan Council of School Education,
Jaipur, not below the rank of Deputy Commissioner
|
Member
|
|
(vi)
|
Deputy
Director (MGGS), Directorate Secondary Education Rajasthan, Bikaner.

Member
Secretaiy
|
In
the event of non-availability of any member in the State Level Selection
Committee, any subordinate officer may be nominated by the Director as a
substitute for the formation of the full committee.
(B)
Range Level Selection Committee.-
The
Range Level Selection Committee consisting of the following for selection to
the posts mentioned at serial number 4 to 9 of the Schedule-I, namely:-

One
representative nominated by the Administrative Department, not below the rank
of District Education Officer (DEO)

any English Medium School of the range nominated by the Joint Director

representative nominated by the Director, Rajasthan Council of School
Education, Jaipur, not below the rank of Principal

Director (MGGS), Office of the Joint Director, School Education of the range
concerned

In
the event of non-availability of chairperson/ member in the Range Level
Selection Committee or if the officer holding additional charge having multiple
assignments, any officer subordinate to him may be nominated by the Director as
a substitute for the formation of the full committee.
(C)
District Level Selection Committee.-
The
District Level Selection Committee consisting of the following for selection to
the posts mentioned at serial number 10 to 17 of the Schedule-I, namely:-

|
One
representative nominated by the Administrative Department, not below the rank
of District Education Officer (DEO)

In
the event of non-availability of chaiiperson/member in the District Level
Selection Committee or if the officer holding additional charge has multiple
alignments, any subordinate officer may be nominated by the Joint Director of
the Range concerned as per the requirement for the fonnation of the full
committee.
Rule - 10. Criteria for selection
Selection shall be made by the Selection Committee, concerned after an
interview having regard to the personality, character, previous record of
service and previous experience in respective services or any other criteria of
selection e.g. proficiency in English language communication skill and teaching
his/her subject well through English medium or whatever the committee considers
to be appropriate. The Director shall be empowered to formulate, amend and
issue the further detailed instruction as per the exigency.
Rule - 11. Procedure for selection
(1)
As
soon as it is decided that selection is to be made to fill a certain number of
vacant posts as specified in column number 2 of the Schedule-I, from amongst
the eligible candidate mentioned in column number 3 of the Schedule-I. the
Director or any other officer authorized for this purpose shall invite
application from all eligible candidates by a stipulated date through a way as
he considers to be appropriate.
(2)
The
eligible candidates may apply for the posts as advertised by the Appointing
Authority in accordance with the procedure as decided by the Director.
(3)
The
candidates may mention as many choices as decided for the time being for
posting on the advertised posts/vacancies.
(4)
After
screening of the applications received, pending departmental inquiries,
prosecution reports, other service records or any other information which is
considered to be appropriate may be sought. After due consideration over such
information, the decision of the Appointing Authority shall be final.
(5)
The
Appointing Authority shall issue the schedule for interview of the eligible
candidates as per their post/subjects. Selection of the candidates shall be
done on the basis of merit list prepared in accordance with the perfoimance in
the interview and the nomas as prescribed by the Director. The selection of the
candidates, equal to the number of vacancies likely to be filled in, shall be
made as per their suitability and a list of the names of the suitable
candidates shall be prepared accordingly:
Provided
that the Selection Committee may, if suitable persons are available, keep on
reserve list more candidates whose number shall not exceed 50% of the vacancies
determined. The name of such candidates may be considered for posting until new
selection process is initiated.
Rule - 12. Posting after Selection
The list of selected candidates shall be provided by the selection committee to
the State Level Nodal Officer nominated for English Medium Schools. The records
of all selected candidates and non-selected candidates along with the selection
list shall be sent by the Member Secretary of the Selection Committee. The
selection list after approval of the Director shall be provided to the
Appointing Authority for posting by the State Level Nodal Officer. Posting
orders of the selected candidates shall be issued by the Appointing Authority
according to the selection list received.
Rule - 13. Reversion
Reversion of the personnel postal after selection in the English Medium Schools
to the Hindi medium schools shall not generally be admissible in the
mid-session. Every year application for reversion shall be taken in time as
specified by the Director before the new selection process is initiated. The
vacancies due to such reversion shall be included in the forthcoming selection
process as prospective vacancies. The personnel willing for such reversion
shall be handed over to the previous Appointing Authority for posting after
joining of the replacing personnel on the completion of the new selection
process. In exceptional circumstances, the Director may allow reversion at any
time on duly recorded grounds.
Rule - 14. Other conditions of service
(1)
Personnel
shall be posted after selection to the post enumerated in Schedule-I generally
for a period of one year which shall be extendible by a process specified by
the Director after review of the performance of the services rendered. The
Appointing Authority shall have right of relieving a personnel for office of
the previous Appointing Authority before completion of the such service
duration without assigning any reasons. The Appointing Authority other than the
Director shall seek approval from the Director before such action.
(2)
Annual
review of the performance of all personnel posted after selection in the
English Medium Schools shall be done by the Appointing Authority by the manner
and process specified by the Director, from time to time.
(3)
As
soon as the personnel posted after selection in the English Medium Schools is
promoted to a higher post in the parent cadre, he/ she shall be deemed reverted
for posting on promotion. In case of having the desirable qualifications for
posting in the English Medium Schools, the Appointing Authority may take a
decision for retention of posting of the promoted personnel in any of the
English Medium Schools in accordance with the vacancies and exigency.
(4)
Except
as provided in these rules, other service conditions to the post as specified
in column 2 of Schedule-I, shall be regulated by other rules applicable to the
employees of the State Government made under the proviso to Article 309 of the
Constitution of India.
(5)
An
additional allowance may be made admissible as an incentive as per exigency to
personnel to be posted in the schools situated in remote rural areas as
specified in Schedule-II, if adequate number of candidates does not apply for
the post concerned, as specified by the State Government, from time to time.
(6)
The
personnel working in the English Medium Schools may be posted/transferred to
any other English Medium Schools across the state according to their
post/subject. The original seniority of the candidate concerned shall remain
unaffected due to the said change in posting.
(7)
In
case of posting of the personnel working on posts whose seniority is maintained
at range/district level, even after selection in the English Medium Schools of
other range/district jurisdiction, the seniority of the candidate concerned
shall be protected in the patent range/district and they shall be entitled to a
lien in the parent range/district for further promotion.
(8)
In
case of the posts where seniority is maintained at range/district level, the
probationer trainees/probationers being posted after selection in the English
Medium Schools of other range/district, the confinnation after successful
completion of the probation period shall be done by the previous Appointing
Authority of parent range/district where his/her seniority is maintained before
being posted in the English Medium Schools.
(9)
The
incumbents of the Rajasthan Voluntary Rural Service Rules, 2010 shall not be
eligible for posting in the urban/municipal areas.
Rule - 15. Power of posting to fill vacant posts or in exceptional matters
Notwithstanding anything contained in these rules, the Director may post or
instruct to the competent authority to post any personnel regularly appointed
in the school education department at English Medium Schools to fill the
vacancies or in exceptional matters for reasons to be recorded in writing. To
fill the vacancies or the prospective vacancies in the English Medium Schools
of the department, the State Government may impose a compulsory provision of
minimum one year duration of service in these schools.
Rule - 16. Removal of Doubts
If any doubt arises relating to the application, interpretation and scope of
these rules, it shall be referred to the Department of Personnel whose decision
thereon shall be final.
Rule - 17. Repeal and Saving
All rules and orders in relation to matters covered by these rules and in force
immediately before commencement of these rules are hereby repealed:
Provided
that any action under the rules and orders so superseded shall be deemed to
have been taken under the provisions of these rules.

Note:
(1) The applicants, who are proficient in English language communication skill
and efficient in teaching through English medium, shall be given preference in
selection for the teaching posts, as mentioned at serial number 1 to 14.
(2)
For selection of the applicants for the non-teaching posts, as mentioned at
serial number 15 to 17, a practical knowledge of English language shall be
desirable.
