RAILWAY RED TARIFF RULES, 2000

PREAMBLE

In exercise of the powers conferred by Section 67 and Section 87 of the Railways Act, 1989 (No. 24 of 1989) and in supersession of the Railways Red Tariff Rules, 1960 except as respect things done or omitted to be done before such supersession, the Central Government hereby makes the following rules for the conveyance by rail of dangerous goods, namely:-


Rule 1 - Short title, commencement and application

PRELIMINARY

(1) These rules may be called the Railways Red Tariff Rules, 2000.

(2) They shall come into force on the 16th day of August, 2000.

(3) They shall apply to the carriage by rail including carriage in containers of the dangerous goods specified in these rules but not to the carriage of explosives and certain other dangerous goods for the Defence Services of the Government of India, in respect of which separate rules have been provided in the Military Tariff.


Rule 2 - Definition

In these rules, unless the context otherwise requires:-

(a) "Authorised railway servant" means any person employed by a railway administration in connection with the service of a railway and for the time be authorised to transact the concerned business of the railway;

(b) "B.G." means Broad Gauge;

(c) "Carriage" means a four-wheeled carriage used for transport and includes a goods wagon;

(d) "C.C." means carrying capacity and indicates that the weight for charge is the carrying capacity of the wagon used;

(e) "Goods train" means a train (other than a ballast train) intended solely or mainly for the carriage of animals or goods;

(f) "Gross weight" means the weight of the article including the weight of the packing;

(g) "I.R.C.A." means Indian Railway Conference Association:

(h) "M.G." means Metre Gauge;

(i) "Mixed Train" means a train intended for the carriage of passengers and goods or of passengers, animals and goods;

(j) "Naked, Light" means the common type of electric torch, hand lanterns and ordinary portable electric appliances other than those complying with the Indian Standard Specification No. IS. 2206-1984 and IS. 2148-1984.

(k) "N.G." means Narrow Gauge;

(l) "N.O.C." means not otherwise classified;

(m) "Parcels Train" means a train intended solely or mainly for the carriage of coaching traffic other than passenger traffic;

(n) "Passenger Train" means a train intended solely or mainly for the carriage of passengers and other coaching traffic;

(o) "Railways Act" means the Railway Act 1989 (No. 24 of 1989);

(p) "Sectional Van", means any carriage, including a parcel van, used for the collection and distribution of consignments of goods insufficient in weight to form an authorised minimum wagon load for a particular station;

(q) "Station" means any place on a line of railway at which traffic is dealt with or at which an authority to proceed is given under the system of working.

(r) "Tranship or Road Van Train" means a train which collects and distributes consignments of goods insufficient in weight to form an authorised minimum wagon load for a particular station;

(s) "W" means the minimum weight in quintals per 4-wheeled wagon, to which the rate applies;

(t) "Wagon" means goods stock, whether attached to goods, passenger, mixed or parcels trains;


Rule 3 - Arrangement of Chapters

(1) Dangerous goods shall, having regard to the Hazard involved in their carriage by rail, be classified into the following eight classes, namely:-

(i) Explosives

(ii) Gases, compressed, liquefied or dissolved under pressure

(iii) Petroleum and other flammable liquids

(iv) Flammable solids

(v) Oxidizing substances

(vi) Poisonous (Toxic) substances

(vii) Radio-active substances; and

(viii) Acids and other corrosives

(2) Chapters I to VIII respectively deal with the classes of dangerous goods specified in clauses (i) to (viii) of sub-rule (1) and contain:-

(a) General rules governing acceptance, handling, carriage, storage, delivery and the like of the commodities included in that class;

(b) A Table indicating the names of commodities, their packing conditions, marking and labelling storage and carriage of the commodities aforesaid and is numbered after the chapter to which it relates. General classification and "W" or "CC" weight condition under which wagonload rates apply are available in R.C.A. Goods Tariff, Part I (Vol. II) in force from time-to-time.

(c) Appendices which are numbered after the Chapter to which they relate.

(3) The forms of the forwarding note and the notice of arrival of consignments which are common to all classes of dangerous goods are set out in Annexures A and B to these rules.


Rule 4 - Numbering of rules

Every rule is given a three digits number in which the 100th digit indicates the number of the chapter and the other two digits the number of the rule. The main parts of a rule are indicated with decimal point and further sub-divisions are indicated with numeric or letters placed in brackets.


Rule 5 - Labels and Colours

(1) The pictorial labels prescribed for use on packages, wagons or carriages are those specified in the Indian Standard Code of Symbols for Labelling of Dangerous Goods (IS: 1260-1958) issued by the Indian Standards Institution;

(2) The identification colours prescribed for gas cylinders or containers conform to the Indian Standards Specifications as contained in IS: 4379 and IS: 3933.

(3) Cylinders used for new gases and gas mixtures for which identification colours are not provided in sub-rule (i) shall be painted with the colours indicated in the following table, namely:-

Rule 6 - Other goods of Hazardous nature

(1) Carriage of goods of a Hazardous nature other than those specified in these rules shall not be accepted for transport by rail unless specially authorised by the railway administration.

(2) Every application for transportation under sub-rule (1) shall be made by the Consignor to the railway administration on which the traffic originates with full details of commodity, the nature of the Hazards involved and the manner of packing.


Rule 7 - Minimum weight for acceptance and minimum weight for charge

(1) Minimum weight to be despatched by goods, passenger or mixed train is 10 kgs., but packages of less weight may be despatched when forming part of a consignment of 10 kgs. or more, the Railway reserving the right to refuse any article under 10 kgs., which may be considered unsuitable to be carried by goods, passenger or mixed train.

(2) Except where otherwise provided, the minimum weight for charge per consignment when booked to be carried by goods train shall be 100 kgs. and by passenger, parcel or mixed train shall be 10 kgs.


Rule 8 - Saving

Unless other wise provided in these rules, the rates and conditions of transport by rail contained in the goods and coaching tariffs issued by the Indian Railway Conference Association shall also apply to explosives and other dangerous goods specified in these rules.


Rule 9 - Penalty

Any person committing a breach of these rules shall be punished with fine which may extend to Rs. 150/-.
