PRINCIPAL, PROFESSOR, ASSOCIATE PROFESSOR, ASSISTANT PROFESSOR, HEAD OF THE DEPARTMENT AND LECTURER, GROUP-A, ART COLLEGES UNDER DIRECTORATE OF ART (RECRUITMENT) RULES, 2023

PRINCIPAL, PROFESSOR, ASSOCIATE PROFESSOR, ASSISTANT PROFESSOR, HEAD OF THE DEPARTMENT AND LECTURER, GROUP-A, MAHARASHTRA ART EDUCATION SERVICES, IN THE GOVERNMENT ART COLLEGES UNDER DIRECTORATE OF ART (RECRUITMENT) RULES, 2023

 

PREAMBLE

In exercise of the powers conferred by the proviso to article 309 of the Constitution of India the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the Principal, Professor, Associate Professor, Assistant Professor, Head of the Department and Lecturer, Group- A, Maharashtra Art Education Services, in Government Art Colleges on the establishment of Directorate of Art and under the Higher and Technical Education Department of the Government of Maharashtra, namely:

Rule - 1.

These rules shall be called the Principal, Professor, Associate Professor, Assistant Professor, Head of the Department and Lecturer, Group-A, Maharashtra Art Education Services, in the Government Art Colleges under Directorate of Art (Recruitment) Rules, 2023.

Rule - 2.

In these rules unless the context requires otherwise,--

(a)      "AICTE" means the all India council of Technical Education; New Delhi, constituted under the All India Council of Technical Education Act, 1987 (52 of 1987);

(b)      "Committee means" a committee set up for the recommendation of a candidate for the post of Principal and to evaluate the performance of the person working on the post of Principal. The Additional Chief Secretary/Principal Secretary/Secretary, Higher and Technical education shall be the Chairman of the Committee. The Director, Directorate of Art shall be Member-Secretary, Director, Technical Education and the Director, Higher Education shall be members of the Committee;

(c)      "Commission" means the Maharashtra Public Service Commission;

(d)      "CGPA" means Cumulative Grade Point Average;

(e)      "Degree" means degree of a statutory University;

(f)       "Directorate of Art" means Directorate of Art, Maharashtra State, Mumbai under the Higher and Technical Education Department;

(g)      "Government" means the Government of Maharashtra;

Rule - 3.

(1)     Appointment on the post of Principal, Group-A, shall be made on tenure appointment, on the basis of seniority, from amongst the persons holding the post of Professor/Senior Professor in the Government Art Colleges, recommended by the committee who fulfill the following criteria, namely:

(i)       Minimum Educational Qualifications:- Possess the educational qualification as prescribed by the AICTE for the post of the Principal, from time to time.

Provided that, the appropriate class of passing mentioned in the certificate of obtaining educational qualification shall be taken into consideration. If class of passing is not mentioned in the certificate of the obtaining educational qualification and the grading system is followed in that case the Cumulative Grade Point Average (CGPA) as prescribed by AICTE shall be considered.

(ii)      Experience:--Possess an experience as prescribed by the AICTE for the post of Principal, from time to time.

Provided that, if the candidate has conducted research during the period he was teaching, in that case, the experience either of the teaching or research shall be taken into consideration.

Provided further that, at the time of taking into consideration the minimum professional experience, the experience gained, after obtaining the minimum necessary educational qualification shall be considered.

(2)     The appointment on the post of Principal shall be on tenure for five years.

Provided that, appointment on the post of Principal shall be for tenure up to the age of retirement of such person or maximum of five years, whichever is earlier. After assessing performance of the person working on this post by the committee, tenure of the appointment can be extended up to maximum of five years.

(3)     After completing the five years tenure, the person on the post of Principal shall take charge of the original post held by him in his original Government Art college.

Rule - 4.

The Appointment of the candidate on the post of Professor, Group-A, shall be done by nomination from amongst the candidates recommendation by the Commission, on the basis of result of Competitive Examination conducted thereof, who fulfils the following criteria, namely:

(i)       Age limit:

(A)     Lower Age Limit- Eighteen years completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(B)     Upper Age Limit- Forty five years completed for the persons not belonging to reserved categories and fifty years completed for the persons belonging to reserved categories as the last date of receipt of applications as per advertisement for recruitment to the post.

(ii)      Minimum Educational Qualification:--Possess the educational qualification as prescribed by the AICTE for the post of the Professor, from time to time.

(iii)     Experience:-- Possess an experience as prescribed by the AICTE for the post of Professor, from time to time.

Provided that, if the candidate has conducted research during the period he was teaching, in that case, the experience either of the teaching or research shall be considered.

Provided further that, at the time of taking in to consideration the minimum professional experience, the experience gained, after obtaining the minimum necessary educational qualification shall be considered.

Provided also that, the appropriate class of passing mentioned in the certificate of obtaining educational qualification shall be taken into consideration. If class of passing is not mentioned in the certificate of obtaining educational qualification and the grading system is followed in that case the Cumulative Grade Point Average (CGPA) as prescribed by AICTE shall be considered.

Rule - 5.

The Appointment of the candidate on the post of Associate Professor, Group-A, shall be made by nomination from amongst the candidates recommendation by the Commission, on the basis of result of Competitive Examination conducted thereof, who fulfils the following criteria, namely:

(i)       Age limit:

(A)     Lower Age Limit- Eighteen years completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(B)     Upper Age Limit- Forty three years of age completed for the persons not belonging to reserved categories and forty eight years completed for the persons belonging to reserved categories as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii)      Minimum Educational Qualification :-- Possess the educational qualification as prescribed by the AICTE for the post of the Associate Professor, from time to time.

(iii)     Experience - Possess an experience as prescribed by the AICTE for the post of Associate Professor, from time to time.

Provided that, if the candidate has conducted research during the period he was teaching, in that case, the experience either of the teaching or research shall be considered.

Provided further that, at the time of taking in to consideration the minimum professional experience, the experience gained, after obtaining the minimum necessary educational qualification shall be considered.

Provided also that, the appropriate class of passing mentioned in the certificate of obtaining educational qualification shall be taken into consideration. If class of passing is not mentioned in the certificate of obtaining educational qualification and the grading system is followed in that case the Cumulative Grade Point Average (CGPA) as prescribed by AICTE shall be considered.

Rule - 6.

The Appointment of the candidate on the post of Assistant Professor, Group-A, shall be done by nomination from amongst the candidates recommendation by the Commission, on the basis of result of Competitive Examination conducted thereof, who fulfils the following criteria, namely:--

(i)       Age limit:--

(A)     Lower Age Limit- Eighteen years completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(B)     Upper Age Limit- Thirty eight years completed for the persons not belonging to reserved categories and forty three years completed for the persons belonging to reserved categories as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii)      Minimum Educational Qualification :-- Possess the educational qualification as prescribed by the AICTE for the post of the Assistant Professor, from time to time.

(iii)     Experience - Possess an experience as prescribed by the AICTE for the post of Assistant Professor, from time to time. Provided that, if the candidate has conducted research during the period he was teaching, in that case, the experience either of the teaching or research shall be considered.

Provided further that, at the time of taking in to consideration the minimum professional experience, the experience gained, after obtaining the minimum necessary educational qualification shall be considered.

Provided also that, the appropriate class of passing mentioned in the certificate of obtaining educational qualification shall be taken into consideration. If class of passing is not mentioned in the certificate of obtaining educational qualification and the grading system is followed in that case the Cumulative Grade Point Average (CGPA) as prescribed by AICTE shall be considered.

Rule - 7.

The Appointment of the candidate on the post of Head of the department, Group-A, shall be done by nomination from amongst the candidates recommendation by the Commission, on the basis of result of Competitive Examination conducted thereof, who fulfils the following criteria, namely :--

(i)       Age limit:--

(A)     Lower Age Limit- Eighteen years completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(B)     Upper Age Limit- Forty five years completed for the persons not belonging to reserved categories and fifty years completed for the persons belonging to reserved categories as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii)      Minimum Educational Qualification:- Possess the educational qualification as prescribed by the AICTE for the post of the Head of the Department, from time to time.

(iii)     Experience - Possess an experience as prescribed by the AICTE for the post of Head of the Department, from time to time.

Provided that, if the candidate has conducted research during the period he was teaching, in that case, the experience either of the teaching or research shall be considered.

Provided further that, at the time of taking in to consideration the minimum professional experience, the experience gained, after obtaining the minimum necessary educational qualification shall be considered.

Provided also that, the appropriate class of passing mentioned in the certificate of obtaining educational qualification shall be taken into consideration. If class of passing is not mentioned in the certificate of obtaining educational qualification and the grading system is followed in that case the Cumulative Grade Point Average (CGPA) as prescribed by AICTE shall be considered.

Rule - 8.

The Appointment of the candidate on the post of Lecturer, Group-A, shall be done by nomination from amongst the candidates recommendation by the Commission, on the basis of result of Competitive Examination conducted thereof, who fulfils the following criteria, namely:

(i)       Age limit:--

(A)     Lower Age Limit.--Eighteen years completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(B)     Upper Age Limit.--Thirty eight years completed for the persons not belonging to reserved categories and forty three years completed for the persons belonging to reserved categories as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii)      Minimum Educational Qualification :-- Possess the educational qualification as prescribed by the AICTE for the post of Lecturer, from time to time.

(iii)     Experience:-- Possess an experience as prescribed by the AICTE for the post of Lecturer, from time to time.

Provided that, if the candidate has conducted research during the period he was teaching, in that case, the experience either of the teaching or research shall be considered.

Provided further that, at the time of taking in to consideration the minimum professional experience, the experience gained, after obtaining the minimum necessary educational qualification shall be considered.

Provided also that, the appropriate class of passing mentioned in the certificate of obtaining educational qualification shall be taken into consideration. If class of passing is not mentioned in the certificate of obtaining educational qualification and the grading system is followed in that case the Cumulative Grade Point Average (CGPA) as prescribed by AICTE shall be considered.

Rule - 9.

A person appointed to the post mentioned in rule 4,5,6,7 or 8 by nomination shall be on probation for a period of two years. Probation period may be extended maximum upto one year. A person appointed to the post shall be required to complete the probation period successfully with prescribed probation period. If he does not complete the probation period successfully or is not found suitable for the post, then the person shall be liable to be terminated from service.

Rule - 10.

A person appointed to the post mentioned in rule 4,5,6,7,8 by nomination shall pass the Marathi and Hindi language examinations as per the rules made in that behalf by the Government, from time to time, within the prescribed time limit after appointment, unless he has already passed or has been exempted from passing those examinations. He shall not be eligible for annual increment or promotion to the next promotional post until he passes those examinations.

Rule - 11.

A person appointed to the post mentioned in rule 4,5,6,7 or 8 by nomination shall possess a Certificate of Computer Operations prescribed by the Government from time to time, within the prescribed time limit, after appointment, unless he has been exempted from possessing such Certificate of Computer Operations, otherwise he shall not be eligible for annual increment or promotion to the next promotional post until he possess the same.

Rule - 12.

(1)     A person recommended for appointment by nomination to the post mentioned in rules 4, 5, 6, 7 or 8 shall submit a declaration of Small Family as per the provisions of the Maharashtra Civil Services(Declaration of Small Family) Rules, 2005 or any other rules, orders or any instruments issued in this behalf by the Government, from time to time, otherwise he shall not be eligible for appointment to the post.

(2)     A person having more than two children on the date of submission of S declaration of Small Family shall be disqualified for the appointment in Government service.

(3)     After appointment of a person in the Government service, if it is proved that he has more than two children at the time of appointment or thereafter, then he shall be disqualified for continuing on the said post in Government service.

Rule - 13.

A person appointed to the post mentioned in rules 4,5,6,7 or 8 shall be liable for transfer anywhere in Maharashtra.

Rule - 14.

The terms and conditions specified by the Government, subsequent to the appointment of any Government servant in any rules, order or resolutions issued by the Government, from time to time, shall also be applicable to the Government servant.
