POLICE SUB-INSPECTOR [RECRUITMENT] RULES, 1995

PREAMBLE

In exercise of the powers conferred by clause (b) of section 5 of the Bombay Police Act, 1951 (Bom. XXII of 1951), and of all other powers enabling it in this behalf, and in supersession of all orders, rules or instruments made in this behalf and in force in the State of Maharashtra or in any part thereof, the Government of Maharashtra hereby makes the following rules regulating recruitment to the post of Sub-Inspectors of Police in the Police Force under the Home Department of the Government of Maharashtra, namely :-

Rule - 1.

These rules may be called the Police Sub-Inspector (Recruitment) Rules, 1995.

Rule - 2.

In these rules, unless the context requires otherwise,-

(a)      "Commission" means the Maharashtra Public Service Commission;

 

(b)      "degree" means a degree of a statutory University;

 

(c)      "Government" means the Government of Maharashtra;

 

(d)      "Higher Secondary School Certificate Examination" and "Secondary School Certificate Examination" means the Higher Secondary School Certificate Examination and the Secondary School Certificate Examination respectively, conducted by a Divisional Boards constituted under the Maharashtra Secondary and Higher Secondary Education Boards Act, 1965 (Mah. XLI of 1965) and includes any other examination declared by Government to be equivalent thereto;

 

(e)      "Police Force" means the Police Force of the Governments of Maharashtra.

Rule - 3.

Appointment to the post of Sub-Inspector of Police in the Police Force in the State of Maharashtra shall be made either,-

(a)      by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the posts of Havaldar and Assistant Police Sub-Inspector in the Police Force who have completed not less than five years continuous regular service or seven years broken service and who qualify in the departmental examination held by the Director General of Police in accordance with the rules laid down in paragraph 5 of the Government Resolution No. PSB. 0390/CR-408/POL-5-A, dated the 5th July, 1994;

[1][Provided that, those Police Constable Writer in Brihan Mumbai Police Force who were eligible for promotion to the post of Head Constable Writter prior to the 21st day of September, 1998 and directly promoted to the post of Head Constable Writer on the 1st day of September, 2001 shall be given chance to appear for the departmental examination to be held in 2003 and onwards.]

Or

(b)      by selection of persons working in the Police Force on the basis of the result of the limited departmental examination held by the Commission for appointment to the post of Sub-Inspector of Police for admission to which a candidate shall,-

(i)       not be more than thirty-five years of age :

Provided that, relaxation of age of five years may be granted to candidates of Backward Classes -

(ii)      [2][* * *]

[3][Provided further that, the candidates who were eligible to appear for the limited departmental examination as on 1st January. 1991, but could not appear as the said examination was not conducted since 1st January, 1991, and as such, have been deprived of the opportunity on account of the age limit, shall be given three chances to appear for three consecutive examinations to be held from 1997 onwards,]

[4][However those candidates who do not appear for the examination conducted by the Maharashtra Public Service Commission shall be deemed to have been lost the opportunity; and]

[5][Provided also that, the candidates who were eligible to appear for the limited departmental examination after the 1st January, 1991, but who were not allowed to appear for the limited departmental examinations held in 1998 and 2002 on account of the age limit,' shall be given three chances to appear for next consecutive examinations.]

(iii)     have completed a minimum regular service as Police Constable with educational qualifications as mentioned below :

Minimum Regular Service

Educational Qualification

4 years

Degree in any faculty.

5 years

Passed the Higher Secondary School Certificate Examination.

6 years

Passed the Secondary Certificate Examination.

Or

(c)      by nomination on the basis of the result of a competitive examination held by the Commission in accordance with the rules made in this behalf from time to time, and for admission to which a candidate shall,-

(i)       not be less than nineteen years of age and not more than [6][twenty-eight years] of age on the date specified by the Commission : Provided that, the maximum age limit may be relaxed upto [7][thirty-one years] in respect of candidates belonging to the Backward Classes:

Provided that, an ex-serviceman who has served continuously in the Armed Forces for a period of not less than 5 years may be allowed to deduct from his age, the period of 2 years over and above the length of his continuous service in the Armed Forces upto the date of release from the service.

(ii)      Possess a degree or any other qualification declared by Government to be equivalent thereto; (iii) Possess the following minimum physical measurements, namely:-

For Male

(i)       Height 165 centimetres minimum.

(ii)      Chest 79 centimetres and above with minimum expansion of 5 centimetres.

For Female

Height 157 centimetres.

Rule - 4.

Appointment to the post of Police Sub-Inspector by promotion. selection on the basis of limited departmental examination and nomination shall be made in the ratio of 25 : 25 : 50.

Rule - 5.

Notwithstanding anything contained in these rules, if in the opinion of Government, the exigencies of service, so require. Government may with prior consultation with the Commission make appointment to the post of Police Sub-Inspector in relaxation of the ratio prescribed for appointment by promotion, selection on the basis of limited departmental examination or nomination.

Rule - 6.

Selection of candidates for admission to the Police Sub-Inspector's Training Course at the Maharashtra Police Academy, Nashik, for eventual appointment to the post of Sub-Inspector of Police in the Police Force of the State of Maharashtra, shall be made on the basis of a Competitive Examination held by the Commission in accordance with the Scheme formulated by the Commission from time to time.

Rule - 7.

A person appointed to the post, whether by promotion, selection on the basis of limited departmental examination or nomination shall be required to pass the Departmental Examination and examination in Hindi and Marathi according to the rules made in that behalf, unless he has already passed, or has been exempted from passing those examinations,

Rule - 8.

A person appointed to the post shall be liable to be transferred to any place in Maharashtra.
