PREAMBLE
In exercise of the powers
conferred by the proviso to article 309 of the Constitution of India and in
supersession of all existing rules, orders or instruments issued in this
behalf, the Governor of Maharashtra is hereby pleased to make the following
rules regulating recruitment to the posts of Director of Marketing or
Additional Commissioner and Special Registrar, Co-operative Societies,
Additional Registrar Co-operative Societies or Director (Sugar), Joint
Registrar, Co-operative Societies or Joint Director or Joint Commissioner,
Deputy Registrar, Co-operative Societies or Deputy Director or Deputy
Commissioner, Group A and Assistant Registrar, Co-operative Societies or
Assistant Director or Assistant Commissioner, Group B (Gazetted),
(Administration Wing) in the Office of the Commissioner for Co-operation and
Registrar, Co-operative Societies under the administrative control of the
Co-operation, Marketing and Textiles Department of the Government of
Maharashtra, namely :-
Rule 1.
These rules may be called
the Officer (Administration Wing) Group A and Group B (Gazetted) in the Office
of the Commissioner for Co-operation and Registrar, Co-operative Societies
(Recruitment) Rules, 2024.
Rule 2. Definitions.
In these rules, unless the
context requires otherwise,-
(a)
"Appointing Authority" means,-
(i)
the Chief Minister, in relation to the post
of the Director of Marketing or Additional Commissioner and Special Registrar,
Co-operative Societies, Additional Registrar, Cooperative Societies or Director
(Sugar), Joint Registrar, Co-operative Societies or Joint Director or Joint
Commissioner, Group A; and
(ii)
the Minister in charge of the Department, in
relation to the post of the Deputy Registrar, Co-operative Societies or the
Deputy Director or Deputy Commissioner, Group A and the Assistant Registrar,
Co-operative Societies or the Assistant Director or Assistant Commissioner,
Group B (Gazetted);
(b)
"Assistant Commissioner" means the
Assistant Commissioner of Textiles.
(c)
"Assistant Director" means the
Assistant Director of Sugar or Marketing;
(d)
"Commission" means the Maharashtra
Public Service Commission;
(e)
"Commissioner" means the
Commissioner for Co-operation and Registrar, Co-operative Societies,
Maharashtra State, Pune under the administrative control of the Department;
(f)
"degree" means a degree of a
statutory university;
(g)
"Department" means the
Co-operation, Marketing and Textiles Department of the Government of
Maharashtra;
(h)
"Deputy Commissioner" means the
Deputy Commissioner of Textiles.
(i)
"Deputy Director" means the Deputy
Director of Sugar or Marketing;
(j)
"eligibility for promotion" means
the eligibility for promotion in accordance with the terms and conditions
specified in the rules, resolutions or orders issued by the General
Administration Department of the Government, from time to time;
(k)
"Government" means the Government
of Maharashtra;
(l)
"Government Diploma in Co-operation and
Accountancy" means the Government Diploma in Co-operation and Accountancy
awarded by the Board established as per Government Resolution, Revenue
Department, No. 252-A, dated the 24th September 1936.
(m)
"Joint Commissioner" means the
Joint Commissioner of Textiles.
(n)
"Joint Director" means the Joint
Director of Marketing and Sugar.
Rule 3.
Appointment to the post of
Director of Marketing / Additional Commissioner and Special Registrar, Group A shall
be made either,-
(a)
By promotion of a suitable person on the
basis of strict selection with due regard to seniority from amongst the persons
holding the post of Additional Registrar, Group A having not less than three
years regular service in that post ;
Or
(b)
By transfer of a member from Indian
Administrative Services in the senior time scale.
Rule 4.
Appointment to the post of
Additional Registrar and Director, Group A shall be made either,-
(a)
By promotion of a suitable person on the
basis of strict selection with due regard to seniority from amongst the persons
holding the post of Joint Registrar/Joint Director, Group A having not less
than three years regular service in that post ; or
(b)
By transfer of a member from Indian
Administrative Services.
Rule 5.
Appointment to the post of
the Joint Registrar, Co-operative Societies or the Joint Director or the Joint
Commissioner, Group A, in the office of the Commissioner shall be made by
promotion of a suitable person having eligibility for promotion, on the basis
of strict selection with due regard to seniority, from amongst the persons
holding the post of the Deputy Registrar, Co-operative Societies or the Deputy
Director or Deputy Commissioner, Group A in the said office and having not less
than three years of regular service on that post.
Rule 6.
Appointment to the post of
the Deputy Registrar, Co-operative Societies or the Deputy Director or the
Deputy Commissioner, Group A in the office of the Commissioner shall be made
either,-
(a)
by promotion of a suitable person having
eligibility for promotion on the basis of seniority subject to fitness from
amongst the persons holding the post of the Assistant Registrar, Cooperative
Societies or the Assistant Director or the Assistant Commissioner, Group B in
the said office and having not less than three years regular and continuous
service on the said post; or
(b)
by nomination from amongst candidates
recommended by the Commission on the basis of result of Competitive Examination
conducted therefor, who fulfils the following criteria, namely :-
(i)
Age Limit.-
(A)
Lower Age Limit.- Eighteen years of age
completed as on the last date of receipt of application as per the
advertisement for recruitment to the post;
(B)
Upper Age Limit.- Thirty-eight years of age
completed for the persons not belonging to reserved category and forty-three
years of age completed for the persons belonging to reserved category as on the
last date of receipt of application as per the advertisement for recruitment to
the post;
(ii)
Minimum Educational Qualification.- A degree
of a statutory university or any other qualification declared by the Government
to be equivalent thereto.
Rule 7.
Appointment to the post of
the Assistant Registrar, Co-operative Societies or Assistant Director or the
Assistant Commissioner , Group B in the office of the Commissioner shall be
made either,-
(a)
by promotion of a suitable person having
eligibility for promotion on the basis of seniority subject to fitness from
amongst the persons holding the post of Co-operative Officer, Grade I and
Office Superintendent and having not less than three years regular and
continuous service on the said post and who has also passed the Government
Diploma in Co-operation and Accountancy (G.D.C. & A.); or
(b)
by nomination from amongst candidates
recommended by the Commission on the basis of result of Competitive Examination
conducted therefor, who fulfils the following criteria, namely :-
(i)
Age Limit.-
(A)
Lower Age Limit.- Eighteen years of age completed
as on the last date of receipt of application as per the advertisement for
recruitment to the post;
(B)
Upper Age Limit.- Thirty-eight years of age
completed for the persons not belonging to reserved category and forty-three
years of age completed for the persons belonging to reserved category as on the
last date of receipt of application as per the advertisement for recruitment to
the post;
(ii)
Minimum Educational Qualification.- A degree
of a statutory university or any other qualification declared to be equivalent
thereto.
Rule 8.
The appointment to the post
mentioned in rule 6 shall be made by promotion and nomination in the ratio of
75:25, respectively, for the total number of sanctioned posts to be filled
under the rule 6.
Rule 9.
The appointment to the post
mentioned in rule 7 shall be made by promotion and nomination in the ratio of
50:50, respectively, for the total number of sanctioned posts to be filled
under the rule 7.
Rule 10.
Appointment to the posts
mentioned in rules 3, 4, 5, 6 and 7 shall be made by the Appointing Authority.
Rule 11.
A person appointed to the
posts mentioned in rules 6 and 7 by nomination, shall be required to pass the
prescribed Departmental Examination for the post, within the prescribed time
limit, unless he has been exempted from passing that examination. If such
person shall not pass the prescribed Departmental Examination within the
prescribed time limit, then he shall not be entitled for annual increment till
passing of the said examination.
Rule 12.
A person appointed by
nomination to the posts mentioned in rules 6 and 7 shall be on probation for a
period of two years. Probation period may be extended maximum upto one year.
Completion of the probation period (including extended period) satisfactorily
as per the probation policy of the Government, passing of the prescribed
Departmental examination, if any, and completion of prescribe training, if any,
are mandatory. In the event of failing to complete the probation period
(including extended period) satisfactorily as per the probation policy of the
Government or in the event of failing to pass the prescribed Departmental
examination, if any, during the probation period or in the event of not
completing the prescribe training, if any, his services shall be liable to be
terminated.
Rule 13.
The rules and regulations of
Combined Probationary Training Programme (CPTP) prescribed by the General
Administration Department, if any, from time to time, for the seniority,
departmental examination, training and other consequential matters shall be
applicable to the persons appointed to the posts mentioned in rules 6 and 7.
Rule 14.
(1)
A person to be appointed to the posts
mentioned in rules 3, 4, 5, 6 and 7 by promotion shall pass the Marathi and
Hindi languages examinations as per the rules made in that behalf by the
Government, from time to time, unless he has already passed or has been
exempted from passing those examinations, before getting promoted to the said
post.
(2)
A person appointed to the posts mentioned in
rules 6 and 7 by nomination shall pass the Marathi and Hindi languages
examinations as per the rules made in that behalf by the Government, from time
to time, within the prescribed time limit after appointment, unless he has
already passed or has been exempted from passing those examinations. He shall
not be eligible for annual increment or promotion to the next promotional post
until he passes those examinations.
Rule 15.
(1)
A person to be appointed to the posts
mentioned in rules 3, 4, 5, 6 and 7 by promotion shall possess a Certificate of
Computer Operations prescribed by rules or orders issued in that behalf by the
Government, from time to time, unless he already possesses such Certificate or
has been exempted therefrom, before getting promoted to the said post.
(2)
A person appointed to the posts mentioned in
rules 6 and 7 by nomination shall possess a Certificate of Computer Operations
prescribed by the Government, from time to time, within the prescribed time
limit after appointment, unless he already possess or has been exempted from
possessing such Certificate, otherwise he shall not be eligible for annual
increment or promotion to the next promotional post until he possess the same.
Rule 16.
(1)
A person recommended for appointment by
nomination to the posts mentioned in rules 6 and 7 shall submit a declaration
of Small Family as per the provisions of the Maharashtra Civil Services
(Declaration of Small Family) Rules, 2005 or any other rules, orders or any
instruments issued in this behalf by the Government, from time to time.
(2)
A person having more than two children on the
date of submission of Declaration of Small Family shall be disqualified for the
appointment in Government Service.
(3)
After appointment of a person in the
Government service, if it is proved that he has more than two children at the
time of appointment or thereafter, then he shall be disqualified for continuing
on the said post in Government service.
Rule 17.
The persons appointed to the
posts mentioned in rules 3, 4, 5, 6 and 7 shall be liable to be transferred
anywhere in the State of Maharashtra.
Rule 18.
The terms and conditions
specified by the Government, subsequent to the appointment of any Government
Servant in any rules, orders or resolutions issued by the Government, from time
to time, shall also be applicable to the Government Servant.
