POSTS (ERSTWHILE CATEGORY 'D' POSTS) RECRUITMENT REGULATIONS, 2022
PREAMBLE
In exercise of the
powers conferred by clause (c) of sub-section (1) of section 43 of the New
Delhi Municipal Council Act, 1994 (44 of 1994) and with the approval of the
Central Government in terms of sub-section (2) of section 387 of the said Act,
the New Delhi Municipal Council hereby makes the following regulations
regulating the method of recruitment to Category 'C' (erstwhile Category 'D')
posts in New Delhi Municipal Council, namely:-
Regulation - 1. Short title and commencement.
(1)
These
regulations may be called the New Delhi Municipal Council, Category 'C' posts
(erstwhile Category 'D' Posts) Recruitment Regulations, 2022.
(2)
They
shall come into force on the date of their publication in the Official Gazette.
Regulation - 2. Application.
These regulations shall apply to the posts
specified in the Column (1) of the Schedule annex to these regulations.
Regulation - 3. Number of posts, classification and level in the pay matrix.
The number of posts, their
classification and level in the pay matrix attached thereto, shall be as
specified in Columns (2) to (4) of the aforesaid Schedule.
Regulation - 4. Method of recruitment, age-limit and other qualifications, etc..
The method of recruitment, age-limit,
qualifications and other matters relating to the said posts, shall be as
specified in Columns (5) to (13) of the said Schedule.
Regulation - 5. Initial Constitution.
All the Regular Muster Roll employees who
were regularized in New Delhi Municipal Council on or before the 31st January,
2014 with the approval of the New Delhi Municipal Council and were in service
as on date of Council's Resolution, dated the 4th August, 2020, on fulfilling
the criteria with one time relaxation in age, educational qualification and
mode of recruitment and after verification of antecedent, character, number of
working days on temporary muster roll, and regular number of working days on
muster roll, being found fit, shall be deemed to have been appointed against
the vacancies under these regulations in the respective grades and they shall
be members of the service from the date of commencement of these regulations.
Regulation - 6. Disqualification.
No person,
(a)
who
has entered into or contracted a marriage with a person having a spouse living;
or
(b)
who,
having a spouse living, has entered into or contracted a marriage with any
person, shall be eligible for appointment to the said post;
Provided that the New Delhi Municipal Council
may, if satisfied that such marriage is permissible under the personal law
applicable to such person and the other party to the marriage and that there
are other grounds for so doing, exempt any person from the operation of this
regulations.
Regulation - 7. Power to relax.
Whether New Delhi Municipal Council is of the
opinion that it is necessary or expedient so to do, it may, by order, for
reason to be recorded in writing and with the approval of the Central
Government, relax any of the provision of these regulations with respect to any
class or category of persons.
Regulation - 8. Saving.
Nothing in these regulations shall
affect reservations, relaxation of age-limit and other concessions required to
be provided for the Scheduled Castes, Scheduled Tribes, Other Backward Classes,
Economically Weaker Section, Ex-servicemen and other special categories of
persons, in accordance with the orders issued by the Central Government, from
time to time in this regard.
