National
Commission For Homoeopathy (Minimum Essential Standards For Homoeopathic
Colleges And Attached Hospitals) Regulations, 2024

In exercise of the powers conferred by sub-section (1) and clauses (s)
and (t) of sub-section (2) of section 55 read with clauses (d) and (e) of
sub-section (1) of section 26 of the National Commission for Homoeopathy Act,
2020 (15 of 2020) and in supersession of the Homoeopathy Central Council
(Minimum Standards Requirement of Homoeopathic Colleges and attached Hospitals)
Regulations 2013, except as respects things done or omitted to be done before
such supersession, the Commission hereby makes the following regulations,
namely: -
Regulation 1. Short Title And Commencement :-
(1) These Regulations May Be Called
The National Commission For Homoeopathy (Minimum Essential Standards For
Homoeopathic Colleges And Attached Hospitals) Regulations, 2024.
(2)
They
shall come into force on the date of their publication in the Official Gazette.
Regulation 2. Definitions :-
In These Regulations, Unless The Context Otherwise Requires;
(a) "Act" means the
National Commission for Homoeopathy Act, 2020 (15 of 2020);
(b) "Appendix" means the
Appendix annexed to these regulations;
(c) "attached hospital"
means a teaching homoeopathic collegiate hospital attached to the medical
institution;
(d) "director" means the
Director of the medical institution;
(e) "Head of Department"
means a teacher of Department among senior faculties responsible for academic
and administrative control of the Department;
(f) "intern" means a
medical student who is undergoing a period of training, "Compulsory
Rotatory Internship" or "Internship" as provided under the
National Commission for Homoeopathy (Homoeopathy Graduate Degree Course -
Bachelor of Homoeopathic Medicine and Surgery Regulations, 2022;
(g) "nodal officer" means
an official who is responsible for a specific project or task within an
Organisation or institution;
(h) "Principal" means the
Principal of the medical institution;
(i) "Schedule" means the
Schedule annexed to these regulations;
(j) "teaching experience"
means full time teaching experience gained in the subject concerned in which he
is appointed in a medical institution recognised by the Central Government or
National Commission for Homoeopathy or National Medical Commission;
(k)
Words and
expressions used herein and not defined, but defined in the Act shall have the
same meanings as respectively assigned to them in the Act.
Regulation 3. Objective :-
The Objective Of These Regulations Shall Be;
(a) to specify minimum essential
standards;
(b) to ensure fully functional
medical institution and its teaching hospital;
(c)
to
provide for the requirement of staff (teaching and non-teaching); instruments;
equipment in the different Departments of the college and attached hospital and
infrastructure for approval of competent authority for assessment for the
purpose of grant or maintenance of permission and subsequent rating of medical
institution for recognised course.
Regulation 4. Departments :-
(1) Every medical institution shall
have the following Departments, namely: -
(a) Homoeopathic Materia Medica;
(b) Organon of medicine, Homoeopathic
Philosophy and Fundamentals of Psychology;
(c) Homoeopathic Pharmacy;
(d) Homoeopathic Repertory and Case
Taking;
(e) Human Anatomy;
(f) Human Physiology and Biochemistry;
(g) Forensic Medicine and Toxicology;
(h) Pathology and Microbiology;
(i) Community Medicine, Research
Methodology and Biostatistics;
(j) Surgery;
(k) Gynecology and Obstetrics;
(l) Practice of medicine with
Essentials of Pharmacology; and
(m) Yoga for health promotion.
(2) The medical institution, apart
from the Departments in sub-regulation (1), shall have a unit of medical
education technology for the purpose of teaching and training in Homoeopathy
medical education.
(3) Every Department shall maintain
the following registers or diary, namely: -
(a) non consumable or dead stock
register;
(b) perishable items stock register;
(c) consumable items register;
(d) teaching plan and compliance or
teaching diary;
(e) indent register;
(f) departmental activity record;
(g) departmental library registers;
and
(h)
students
attendance for lectures and non-lectures separately.
Regulation 5. Requirement of land :-
The land required for establishment of Homoeopathy medical institution
including attached hospitals and adequate infrastructure shall be as specified
in Establishment of New Homoeopathic medical institution (Opening of New or
Higher Course of Study and Increase of Intake Capacity by a Medical
Institution), Regulations-2024:
Provided that the said land requirement is not applicable for the Homoeopathy
medical institute established prior to the notification of these regulations in
Official Gazette.
(a) The plot, if separated by a road
or canal or rivulet but connected with a bridge, shall be treated as one piece
of land. A certificate from the Jila panchayat or local municipal authority
certifying or approving the construction plan of the proposed buildings having
the required construction area as per the First Schedule and the Second
Schedule which may be accommodated in the piece of land, must be provided at
the time of applying for permission of the Commission.
(b) There may be a separate building
or interconnected building for the college and hospital as per the requirements
mentioned in the First Schedule and the Second Schedule. The land should be owned
by the person or possessed on lease of not less than thirty years or maximum
permissible period as per the regulations made by the state concerned. Renewal
of permission shall be obtained one year prior to expiry of lease.
(c) For new college establishments,
the land in the name of person may be considered for grant of permission:
Provided that there may be a resolution of irrevocable authority for use
of land only for homoeopathic medical institution and attached hospital.
(d) The resolution passed shall have
to be concurrently approved by the registering authority with which applicant
is registered.
(e) The property shall be exclusively
demarcated for homoeopathy educational institution only.
(f) Medical institutions established
prior to the notification of these regulations shall fulfill the following
conditions, namely:-
(1) for the requirement of the size
and possession of the land, at the end of the current lease period, such
medical institutions shall either own the land or get it on the lease for a
period not less than thirty years or the maximum permissible period as per the
rules or regulations of the respective State Government or Union territory
Administration;
(2) if the institution submit the
application for increase in the existing number of seats or apply for higher
degree courses, they shall have to fulfill all the requirements of land and
infrastructure as specified in the Establishment of New Homoeopathic medical
institution (Opening of New or Higher Course of Study and Increase of Intake
Capacity by a medical institution), Regulations-2024:
Provided that these provisions shall not be applicable to an existing
post-graduate college willing to apply for the increase of seats in their
existing post-graduate course or addition of new subjects for Doctor of Medicine
(Homoeopathy) course;
(3) if an existing medical
institution is situated in an urban area, they may have a hospital or college
in a separate campus situated not more than five kilometers in distance or
fifteen minutes of travel time to fulfill the necessary requirements of the
constructed or built-up area.
(g) The building plan with
departmental measurements must be certified by the local authority after
verifying facilities as specified in these regulations.
(h) The buildings of the Homoeopathic
medical institute and hospital shall conform to the prevailing building codes
and local building bye-laws or norms. The hospitals should have fire-safety
measures, including patient evacuation plans as per local bye laws and
regulations. They shall comply with the requirements for providing access and
facilities to those who are disabled. The buildings of the institute and
hospital shall meet the requirements for the numbers of students to be admitted
as specified by these regulations.
Regulation 6. Intake capacity :-
The application in homoeopathic degree course, namely, Bachelor of
Homoeopathic Medicine and Surgery shall be considered up to one hundred seats.
Regulation 7. Power to call for information and returns :-
(a)
The
National Commission for Homoeopathy and its autonomous boards shall have the
power to call for such information and returns as it may deem fit. The
University and medical institution shall furnish the said information as
required by the National Commission for Homoeopathy:
Provided that if the medical institution fails to provide the
information and return to Commission within time-limit as notified by the
Commission from time to time, the Commission shall recommend for action against
the medical institution under clause (f) of sub-section (1) of section 28 of
the Act assuming that the medical institution is not complying with the
provisions of regulation.
(b)
Every
medical institution shall provide all necessary information, documents and
records to the inspectors appointed by the Medical Assessment and Rating Board
of Homoeopathy or Commission to discharge their functions demanded by them
during the inspection or assessment.
Regulation 8. Failure to comply :-
If any medical institution and attached hospital fails to comply with
minimum essential standards, the Commission shall recommend for action against
such institutions or hospitals under clause (f) of sub-section (1) of section
28 of the Act.
Regulation 9. Requirement of medical institution and attached hospital :-
(a) Every medical institution shall
have the required areas, infrastructure, staffs, equipment as given in the
First Schedule and attached hospital shall have the required areas,
infrastructure, staffs and equipment as specified in the Second Schedule and
qualification of the staff given in the Third Schedule.
(b) Every existing medical
institution with intake capacity of one hundred seats, established prior to the
date of notification of these regulations, shall fulfill the requirements of
built up or constructed area, as laid down in these regulations within a period
of five years from the date of notification of these regulations.
(c)
Every
existing medical institution with intake capacity of one hundred seats,
established prior to date of notification of these regulations, shall fulfill
the Department wise requirements, as laid down in these regulations within a
period of one year from the date of notification of these regulations.
FIRST SCHEDULE
[(See clauses (a) and (b) of
regulation 5 and clause (a) of regulation 9)]
Requirements of the Homoeopathic medical institution. - A. General. -
(1) (a) The medical institution shall
provide adequate built-up space to accommodate various teaching areas (both in
the medical institution and the attached hospital), library, administrative
areas, rooms for teaching and nonteaching staff, student amenities, and other
provisions as specified in this Schedule.
(b) Every medical institution
shall have the attached hospital and hostel facility for the students and
interns, with or without the residential area for faculty and other staff of
medical institution or hospital.
(2) College council. - (a) Every
medical institution shall have a college council comprising of the head of all
the Departments or faculty specified for medical education technology unit as
members and Principal or Director as Chairperson.
(b) The council shall meet at
least four times in a year to draw up the details of curriculum and training
programme, enforcement of discipline and other academic matters and minutes of
all the meetings shall be maintained properly.
(c) The council shall also
organize inter-departmental meetings like grand rounds, statistical meetings
and clinical meetings including periodical research review in the institution
regularly.
(3) Biometric attendance. - (a) Every
medical institution shall install aadhar enabled biometric attendance machine
as directed by the Commission from time to time for regular capturing of the
attendance of human resources in the manner as specified and shall be
essentially accessible to the Central Government or State Government or Union
territory Administration and Commission to ensure maintenance of the minimum
essential standards of education.
(b) The aadhar enabled biometric
attendance shall be made available on the dashboard of medical institution
website and to medical assessment and rating board in Homoeopathy on dedicated
portal as directed by the Commission from time to time. The Commission shall
seek such record of attendance from medical institution during or after
assessment for compliance of minimum essential standards of education.
(c) The installation, maintenance
and continuous smooth functioning of aadhar enabled biometric attendance system
shall be the responsibility of medical institutions and any technical problem
in the functioning of biometric system should be immediately reported to the
Commission through nodal officer in-charge designated for the biometric
attendance system and shall be rectified within seven days.
(d) At least one year attendance
record by aadhar enabled biometric machine shall be made available in the
Commission or assessment team and college shall maintain record for at least
one year.
(e) It shall be mandatory to have
at least seventy five percent. attendance of the total working days (excluding
vacations) for all the faculty and resident doctors. During vacation period,
other than sick leave or leave availed due to emergency situations, the faculty
on duty shall not avail any leave. Emergency leave shall be certified by the
Head of the Department or Head of the Institution.
(4) Closed circuit television.- (a)
In order to enable the Commission to maintain constant vigil on the standards
of medical education and training being imparted, every medical institution
shall have closed circuit television system in the campus and shall provide
live streaming video of classrooms and the attached hospital in the manner as
specified by the Commission and shall be essentially accessible to the Central
Government, State Government or the Union territory Administration and Commission
to enable the Commission to maintain a constant vigil on the standard of
medical education and training being imparted;
(b)For monitoring the medical
institutions, closed circuit television cameras shall be installed in the
colleges, which shall maintain backup of one month recording for quick
reference whenever asked during the inspections by the Commission or the
Central Government. A nodal officer from the medical institution may be
specially nominated to monitor the functioning or maintenance of the same;
(c)The installation, maintenance
and continued smooth functioning of closed circuit television system shall be
the responsibility of medical institution and in case of any technical problem
or break up faced by the institution, it must be immediately informed to the
Commission through nodal officer and shall be rectified within seven working
days;
(d)Areas and number of cameras
required for wider coverage are as per following Table, namely:-

(d) Requirements in museum.- (i) There shall be charts or digital display or
standees or photo panels (picturewise presentation) on topics covered for each
year. The charts need to be changed after every four months. In case of
establishment of new college, the number of charts in the museum shall be
proportionate to their level (during first to final Bachelor of Homoeopathic
Medicine and Surgery course) and five charts shall be added annually. Charts
shall be prepared by the students and record to be maintained in A4 size sheets
also.

Department.

A separate visiting faculty of the minimum cadre of Assistant professor

pharmacopoeia laboratory or a large-scale manufacturing unit of homoeopathic
medicines having Good Manufacturing Practices compliance and approved by the
Government authority. Record and attendance shall be maintained of such visit
along with certificate of visit.
(e)
List of equipment for pharmacy Department
shall be as per Appendix-1.
(f)
Following charts or digital display or
standee or photo panel are required in the Department and charts shall be
prepared by the students and record to be maintained in A4 size sheet also:-

C. Units. -
Medical Education Technology Unit
(1) Space required for teachers and
supporting staff : forty square meters.-
There shall be a medical
education technology unit for faculty development and for providing teaching or
learning resource material. The requirements of this unit shall be as specified
in these regulations and by notification from time to time by the National
Commission for Homoeopathy. Periodical training on technology used in teaching
shall be imparted to the faculty by the medical institution or University. The
certificate of participation of each faculty shall be documented in the unit
for verification during inspection. Principal or director shall be the
in-charge of the medical education technology unit. One of the professors, who
has attended medical education technology workshop conducted by University or
National Commission for Homoeopathy shall be appointed as coordinator.
Principal shall co-opt one faculty from pre or para clinical Department, one
from clinical Department and one from homoeopathic Department for a period of
three years on rotation basis. Functions of the Department shall, inter alia,
be as follows, namely:-
(a) Curriculum planning and
implementation of Competency Based Dynamic Curriculum as directed by the
Commission;
(b) Evaluation of teaching and
training programme;
(c) Conduct workshop for faculty in
areas of medical education technology;
(d) Conducting research in Medical
Education.

Note:- The space requirement in
square meters shall not be made applicable for the colleges with sixty seats

serial number 5(i), (m) and 6. However, all space requirements as mentioned
above in the table shall be fulfilled by all the existing colleges with one
hundred seats within the period of five years from the date of notification of
this regulation except serial number 5 (i), (m) and 6 which should be fulfilled
from the date of notification of this regulation along with all other

Note: -The requirement of minimum teaching staff as mentioned above in the
table shall be fulfilled by all the existing colleges within the period of one
year from the date of notification of this regulation.
(3) The Teaching Staff of all
Departments or subjects shall be full-time only and the following provisions
shall be considered namely:-
(a)
Additional
higher cadre faculty available in a Department shall be considered for the
vacant lower cadre in the same Department;
(b)
Contract
appointment on temporary basis shall be done against the vacant positions of
teaching faculties due to deputation or lien, for the equivalent period of
deputation or lien within a period of three months from the date of relieving
of teaching or non-teaching staff on deputation or lien;
(c)
The
responsibility of the Head of the Department shall be delegated essentially in
rotational manner for a period not exceeding three years among the senior
faculty of the concerned department but not below the level of Associate
Professor;
(d)
A
separate visiting faculty with a minimum designation of Assistant professor
having qualifications as specified in the Third Schedule shall be engaged for
teaching essentials of modern pharmacology;
(e)
A
separate visiting faculty of the minimum designation of Assistant professor
having qualifications as specified in Third Schedule shall be engaged for
teaching of fundamentals of psychology;
(f)
For teaching
yoga in context to Homoeopathy, a male and female yoga instructor shall be
appointed on regular basis with qualifications as specified in these
regulations in the Third Schedule;
(g)
One
statistical assistant for the statistical work of the college and attached
hospital shall be appointed to assist the teachers in the Department of
Community Medicine, Research Methodology and Biostatistics with qualification
as specified in these regulations;
(h)
Time
bound carrier progression scheme with financial upgradation and designation for
the full-time teaching and non-teaching staff who are stagnant for eight years
or more in the same designation, shall be made available by the concerned
authority and uploaded on the website of the Institution. The financial and designation
upgradation shall be as per the table under (5) of clause (E) of the First
Schedule of these regulations.
(i)
The
appointment and promotion order shall contain the details of post, name of the
Department, date of promotion, mode of appointment like full time or part time
or visiting faculty and type of employment (regular or contractual) along with
the term of appointment;
(j)
Faculty
or staff shall be posted on contract or probation only for a period of one year
or as per the extent State Government or Central Government rules. No teacher
shall be eligible for regular posting unless he has satisfactorily completed
his probation in the category in which he was appointed.
Note. - Staff Required For The
Medical Institution And Hospital Must Be Notified To The Commission Every Year.
In Case Of Resignation Or Removal Of Any Staff From The Institution, The Same
Must Be Notified And Intimated Along With Proper Documents To The Commission.
New Appointment Made Thereafter By The Institution Shall Be Informed To The
Commission Within A Period Of Three Weeks From The Date Of Appointment.
(4) Practicing consultant of
Modern medicine or Homoeopathy:-
(a)
To ensure
the exposure of students to experienced professional, it is essential to
provide adequate number of practicing consultants as visiting faculty from
modern medicine and Homoeopathy. This will be in-addition to the staff required
for the hospital and college;
(b)
This
visiting faculty, however, shall not be counted for the faculty requirement
laid down in these regulations;
(c)
Specialists
from modern medicine and Homoeopathy for experience sharing and discussion,
diagnosis and management of doubtful and difficult cases, shall be appointed in
the medical institution;
(d)
Documentary
evidences such as attendance and feedback from the students shall be kept in
Department of practice of medicine;
(e)
The
medical institution shall appoint practicing consultant with proven clinical
repute from modern medicine having post-graduate medical qualification or
Diplomate of National Board or Diploma in Child Health or Diploma in
Dermatology, Venerology and Leprosy as recognised by National Medical
Commission in the subject concerned along with the professional experience of
not less twenty years. While for Homoeopathy, professional experience of not
less than fifteen years for Bachelor of Homoeopathic Medicine and Surgery
degree holder and not less than ten years for M.D. (Hom.) degree holder as
recognised by the National Commission for Homoeopathy;
(f)
The
practicing consultant shall be from Homoeopathy and specialties such as
cardiology, pediatrics, psychiatry, radiology, ophthalmology, rheumatology,
pain palliative care, geriatrics, dermatology, nephrology, general medicine,
neurology, gynecology, obstetrics, emergency medicine and critical care,
surgery, dentistry, physiotherapy:
Provided that arrangements
shall be made for minimum of four different types of lectures or interactive
sessions from the above-mentioned subjects every month. A record of such
interactions and students participation is to be maintained.
(5) Salary of teaching and
non-teaching staffs:-
(a) For the teaching and non-teaching
staff of Government or Government aided institution or Government autonomous
institution or Government University or self-financing medical institution
including Central, Private, deemed University or State Private, deemed to be
University, salary and allowances including non-practicing allowance shall be
paid as specified in tables below respectively and there shall not be any
discrepancy of salary structure between medical systems. Teachers and
non-teaching medical officers who are paid non-practicing allowance shall not
do clinical practice during non - college hours.

(i) Note : The Librarian shall be considered under the teaching faculty cadre
as defined by the University Grant Commission. It is essential for every
self-financing medical institution including Central, Private, deemed
University or State Private, deemed to be University to provide at least basic
pay mentioned in the above cited table for the respective teaching cadre. This
shall be the minimum specified salary and not be restrictive for higher salary
structure if already being paid.
However, all applicable
allowances may be paid as per respective employers policy and annual increment
with respect to the year of experience to the concerned cadre or post.

(c)
Salary of
Resident medical officer in collegiate hospital shall not be less than
Rs.55000/- per month and that of senior medical officer shall not be less than
the Rs.65000/- per month.
(d)
The
salary shall be credited to the salary account through bank transfer from the
dedicated account of the medical institution to the teachers and all other
staff. Necessary facilities such as provident fund or employees state
insurance, gratuity, encashment of leaves and such others shall be provided by
the medical institution and income tax deduction certificate such as form 16 or
16A shall be issued by the college to the teacher as per the prevailing norms.
Note: Principal shall be the
signing authority or one of the signing authorities for the operation of bank
account of medical institution.
(6) Age Of Superannuation Of
Teaching And Non-Teaching Staff . - (A) The Age of Superannuation of Teaching
and Non-Teaching Staff Shall Be As Per The order of The Central Government or
State Government or Union Territory Administration. Retired Teachers,
Fulfilling The Eligibility Norms of Teachers May Be Re-Employed Upto the age of
Sixty-Five Year As Full Time Teacher. However, Such ReEmployed Teachers Shall
Not Be Given Any Administrative Charge.
(b) From The Age of Sixty-Five
Year And Till The age of Sixty-Seven Year, Teachers Can Be Re-Employed For The
Post-Graduate Teaching. They However, Should Full-Fill The qualifications
Required as per the Designation Mentioned In Third Schedule.
(7) Unique Teachers Code. - (a) A
Unique Teachers Code For All Eligible Teachers Shall Be Allotted By The
Commission After Their Appointment In The College Through An Online Faculty
Management System On Application Within Fifteen Working Days. This Shall Be
Continuously Monitored Through The Online Faculty Management System;
(b) Concerned faculty shall
update profile in the online teacher management system from time to time with
respect to change in their status and qualification, designation, posting and
superannuation and such other details;
(c) The commission shall have the
power to withdraw or suspend or withhold or cancel teachers code on ethical and
disciplinary grounds or if the teacher discontinued the teaching or not joined
to any institution for any reason or on superannuation or on demise or on such
other similar or other related events. If discontinued, he may rejoin the
teaching profession with the same teachers code after making fresh application
to the National Commission for Homoeopathy.
(8) Technical, Administrative And
Supporting Staff: (1) The Technical And Other Staff In Various Departments And
Units Of The Medical Institutions Shall Be As Per The Following Table, Namely:-

2. The medical institution shall provide adequate supportive staff in each of
the Department, laboratory, library, museum and administrative section. The
watch and ward duty, transport and sanitation shall be provided by the medical institution
from outsourcing or by appointment, as the case may be.
THE SECOND SCHEDULE
[(See clauses (a) and (b) of
regulation 5 and clause (a) of regulation 9)]
Requirement of Homoeopathic
Collegiate Hospital
A. General
(1)
At the
time of submission of application to the medical assessment and rating board
under the National Commission for Homoeopathy for grant of permission for
establishment of medical institution for course not below the graduate degree
or Bachelor of Homoeopathic Medicine and Surgery course, there shall be a fully
functional hospital having valid registration with state health authority,
existing for at least one year with all necessary infrastructure like
out-patient Department, indoor wards, operation theaters, laboratories etc. as specified
under these regulations. Registration certificate from pollution control board
shall be obtained.
(2)
The
teaching hospital shall fulfill all the statutory requirements of the concerned
State or Union territory or Local authority to establish and run the hospital
and shall submit the updated certified copies of such permission or clearance
to the National Commission for Homoeopathy. The concerned State Government or
Union territory Administration shall verify the availability of such permission
or clearance with one year validity before issuing the no objection certificate
to such applicant medical institution.
(3)
All
Teaching Homoeopathic Hospital Shall Have To Apply For National Accreditation
Board For Hospitals Accreditation Within A Period of one Year of Notification
of These Regulations In Official Gazette. The Hospital Shall obtain Entry Level
Certificate Within A Period of one Year of Registration And Full Accreditation
Within Two Years After obtaining Entry Level Certification.
(4)
Out-Patient
Department Shall Have Adequate Reception And Patient Waiting Area, Consultation
Or Examination Room. A First-Aid Kit Also Be Kept In Outdoor Department.
(a)
Furniture
or Fixture or Equipment Requirements: - For out-patient Department, furniture
or equipment shall be as per Appendix- 12
(b)
Peripheral
out-patient Department:-
(i)
Teaching
hospitals may establish maximum of ten peripheral Out-patient Departments
within the range of ten to twenty-five kilometers from main hospital to provide
effective affordable health care services to theperipheral population, clinical
exposure to the students and to function as a secondary level referral center
for the teaching hospital.
(ii)
Information
on daily Central out-patient Department and number of referrals from peripheral
outpatient Department shall be recorded in register and case records are to be
maintained and clubbed with record of out-patient Departments in the collegiate
hospital.
(iii)
Other
requirements and staff from the collegiate hospital shall be utilised for the
functioning of peripheral out-patient Department. Agreement with respect to
space allotted for peripheral out-patient Departments, own or leased must be
made available. Record showing functionality of minimum one year shall be
maintained. Documents related to possession of building and out-patient
Department or in-patient Department data shall be maintained.
(5)
The
Hospital Shall Be Suitably Spacious To Accommodate Out-Patient Department And
In-Patient Department In Addition To Reception, Patients, Waiting Area,
Dispensing Room, Dressing Room, Clinical Laboratory, Radiology Section, Medical
Record-Room, Operation Theatre, Labor Room, Store Room, Separate Wards For Male
And Female, Duty Rooms For Doctors, Nurses, Other Staffs And Clinical Teaching
Room Required For A Functional Hospital And The Specification Of Built-Up Area
In The Attached Hospital Shall Be As Specified In These Regulations.
(6)
The
Medical Institution And Hospital Shall Maintain Computerised Central
Registration System For Maintaining The Records Of Patients In Out-Patient
Department And In-Patient Department, And Shall Also Maintain The Department
Wise Out-Patient Department And In-Patient Department Records, Case Papers Of
Out-Patient Department And In-Patient Department Patients, Laboratory And
Radiological Investigation Reports, Medicine Dispensing Register, Diet Register
For In-Patient Department Patients, Duty Roster Of Hospital Staff, Birth And
Death Certificates, And Other Such Related Documents To Substantiate The Claim
Of Genuine Functional Homoeopathic Teaching Hospital Fulfilling The Norms As
Specified In These Regulations.
(7)
Medical
Record Management And Disposal.- (A) Mandatory Information To Be Recorded And
Maintained As Per The Extant Rules Or Regulations Or Law Of The State
Government Or Central Government Or The Union Territory Administration, As
Applicable.
(c)
Medical
Records Of Indoor Patients May Be Stored In Digitised Form For At Least Past
Ten Years Or As Per Availability. For Future, All Medical Records Of Indoor
Patients Should Be Digitised On Regular And Continuous Basis And Kept
Indefinitely For Future References Since It Contains Valuable Data Which May Be
Required For Research And Policy Planning Purposes.
(d)
The
Hospital May Store Medical Records In Hard Copy Form As Mentioned Below,
Namely:-
(iv)
In-
patients medical records, (that is, Case sheets etc.) - five years;
(v)
Out-patient
Department records (OPD registers and duplicate OPD record if any )- five
years;
(vi)
Medico
legal registers and case sheets - ten years or till the disposal of ongoing
cases in any of the court related to these records.
(8)
(A) In Case
An Attached Hospital Of A Colleges Does Not Have The Facilities To Handle
Critical Cases In The Operation Theatre, For The Purpose Of Exposure Of The
Students In The Clinical Field And To Understand The Depth Of Operative Surgery
And Operative Gynecology And Obstetrics As Well As Management In Critical And
Surgical Cases, A College Shall Have A Memorandum Of Understanding, Signed
Between Medical Superintendent Of Both The Hospitals, With A Reputed Nearby
Located MultiSpecialty Hospital Of Modern Medicine Having All Required
Facilities Namely:-
(i)
Operation
Theatre, Labor Room, Intensive Care Unit And Other Required Facilities For The
Management Of Emergency Cases And Critical Patients;
(ii)
All
Radiological (Including Computed Tomography Scan, Magnetic Resonance Imaging,
Ultrasonography) And Advanced Laboratory Investigation Facilities;
(iii)
Hospital
With Whom Memorandum Of Understanding Is Signed Shall Be Accredited National
Accreditation Board Of Hospitals.
(B) Students of medical
institution shall be deputed under the strict supervision of concerned
teachingfaculty of the college for the required exposure in the said field to
the attached multi-specialty hospital. Proper attendance record of visit of
students shall be maintained.
(9)

(B) Bed occupancy rate in In-patient Department during last one calend ar year shall not be less than fifty per
cent.
NOTE: -Relaxation of out-patient
Department and In-patient Department up to ten per cent. for medical
institution in hilly areas and notified tribal areas shall be provided.
(11) (A) THE HOMOEOPATHIC TEACHING HOSPITAL
SHALL HAVE WELL-FURNISHED SEPARATE DISPENSARIES FOR ITS OUT-DOOR AND IN-DOOR
DEPARTMENTS CONTAINING SUFFICIENT STOCK OF MEDICINE.
(B) The location of central
pharmacy should be adjacent to out-patient Department on the groundfloor of
collegiate hospital. There should be sufficient space for patients to sit and
should contain educative posters on health, hygiene and offer literature for
reading.
(C) Minimum staff requirement
shall be as mentioned below:-
(i)
Pharmacist:

shall be as per Third Schedule.
(D) Infrastructure requirements
and equipment:-
(i)
suitable
space for medicating and dispensing medicines;
(ii)
provisions
for water supply;
(iii)
suitable
space for washing bottles;
(iv)
counter
for dispensary;
(v)
facilities
required for store and dispensaries;
(vi)
waste
receptacle.
(E) Standard operating procedure
for quality assurance shall be maintained.
(12) (A) Collegiate hospital shall
have dedicated emergency room with adequate man power. It should preferably
have a distinct entry independent of out-patient Department main entry so that
a minimum time is lost in giving immediate treatment to casualties arriving in
the hospital. There should be an easy ambulance approach with adequate space
for free passage of vehicles and covered area for alighting of patients.
Signage of emergency must be displayed at the entry of the hospital. Separate
emergency beds must be provided. Emergency unit to have all basic instruments
required for examination of patient which shall include torch, thermometer,
tongue depressor, knee hammer, B.P. apparatus, nebulizer glucometer, pulse
oxymeter, needles, syringe, suturing material, scalpel, ryles tube, I.V. set,
oxygen cylinder, mask with kit for inhalation and suction machine.
(B) Emergency unit shall be
managed under the supervision of General Physician having qualification as
specified in the Third Schedule. Duty roaster for doctors and nurses shall be
displayed and maintained.
(C) Emergency Equipment shall be
as per Appendix-15.
(D) Drugs segment includes the
minimum essential drug which needs to be maintained in the facility.
(i)
Anesthetics
drugs shall be as per Appendix-16.
(ii)
Emergency
drugs shall be as per Appendix-17.
(13)
Central
Laboratories:-
(A)
There
shall be well equipped and updated central laboratory with proper
infrastructure and as specified in these regulations for carrying out routine,
pathological, biochemical and hematological investigation on the patients
referred from outdoor and indoor Department of the hospital. This laboratory in
the collegiate hospital shall be accredited with National Accreditation Board
for Testing and Calibration Laboratories.
Hospital shall essentially have
X-ray, E.C.G. facility. Hospital should also have facility of scanning and
sonography equipment either in its own hospital or under Memorandum of
Understanding with National Accreditation Board for Laboratories accredited Superspeciality
hospital located in nearby area.
(B)
Records
of patients shall be maintained.
(C)
List of
equipment in lab shall be as per Appendix 18.
(14)
Clinical
Teaching Room.- The collegiate hospital shall have teaching room for each of
the clinical departments for clinical cases discussions or demonstrations. The
purpose of the clinical room is to provide practical experience for the
students so that students acclimatise to clinical environments, develop
professionally, interact with patients with more confidence, develop self-
reflection and appraisal skills.
(15)
Skill
Laboratory -
(A)
Every
homoeopathic teaching hospital shall have a skill laboratory where students can
practice and improve skills pre-specified in the curriculum. The purpose of
skill laboratory is to provide asafe and nonthreatening environment for
students to learn, practice and be observed performing skills thus mitigating
the risks involved in direct patient exposure without adequate preparation and
supervision. The skill laboratory attempts to recreate the clinical environment
and tasks which future health care workers have to perform.
(B)
Skill
Laboratory shall have: -
(i)
room for
demonstration of skills to small groups;
(ii)
room for
faculty coordinator and supporting staff;
(iii)
adequate
space for storage of dummy or other equipment or instruments like suturing
material, needle, syringe, intravenous sets, plastering moulds, various types

THE THIRD SCHEDULE
[(See clause (a) of regulation
9)]
QUALIFICATIONS FOR TEACHING,
NON-TEACHING AND HOSPITAL STAFF OFMEDICAL INSTITUTION AND ATTACHED HOSPITAL
A. GENERAL
(1)
The
Principal or Director, Medical Superintendent, Professors, Associate Professor
and Assistant Professor, staff of college and hospital shall have the
qualification and experience as specified in these regulations.
(2)
All
teaching staff appointed under these regulations should possess recognised
post-graduate degree and their post-graduate degree should have been completed
before the age of forty-five years:
Provided that this age criteria
of forty-five years shall not be applicable to existing teaching staff
appointed prior to these regulations.
(3)
First
recruitment as a teacher on various cadres shall be through National Teachers
Eligibility Test and as per the provisions of National Commission for
Homoeopathy (National Examination in Homoeopathy) Regulations, 2023.
(4)
Teaching
experience counted shall be of recognised homoeopathic medical institution or
academic institution.
(5)
Number of
teachers appointed with post-graduate degree in anatomy, physiology,
biochemistry, forensic medicine and public health from any University or
institution recognised by the University Grant Commission in the respective
Departments shall not be more than one inspecific Departments. They shall not
be promoted as Head of Department.
(6)
Promotion
or transfer of existing teacher from one institution to another shall be as per
the regulation effective at the time of his appointment:
Provided that, if there is any
break in the continuity of teaching service of any teacher for a period of more
than six months, fresh appointment shall be made as per the regulation in
force.
B. QUALIFICATIONS FOR TEACHING
STAFF OF HOMOEOPATHIC MEDICALINSTITUTION
(1)
Principal
or Director
(i)
Essential
qualification:
(A)
Recognised
post-graduate degree in homoeopathy, and
(B)
Holding a
post of not less than the teaching cadre of professor in a degree level
recognised homoeopathic medical institution for a period of not less than two
years; or an Associate professor with recognised post-graduate degree and
teaching experience for a period of not less than seven years in the cadre of
Associate professor.
(C)
Must
possess experience in administration for a period of not less than three years
as head of Department or medical superintendent or deputy medical
superintendent or any other administrative experience.
(D)
Must have
published at least three original publications as principal or co- author in an
indexed or peer reviewed journals.
(ii)
Desirable
Qualification:
(A)
Degree or
diploma in administration or health administration from any recognised
institution; and
(B)
Five
years of experience as supervisor or guide for post-graduate programme in
homoeopathy; and
(C)
Research
experience as investigator in the project(s) registered with Clinical Trial
Registry -India.
(2)
Professor
(a)
In
Homoeopathic subjects namely, Homoeopathic Materia Medica, Organon of Medicine
and Homeopathic Philosophy, Homoeopathic Pharmacy, Homoeopathic Repertory and
Case taking-
(i)
Essential
qualifications:
(A)
Recognised
post-graduate degree in homoeopathy; and
(B)
Not less
than five years of teaching experience in the subject concerned as an associate
professor; or not less than ten years of regular teaching experience in the
subject concerned in a recognised homoeopathic medical institution.
(C)
Must have
published two original publications as Principal author or Co-author in indexed
or peer reviewed journal.
(ii)
Desirable
qualifications:
(A)
Experience
of not less than five years as supervisor or guide for post-graduate programme
in Homoeopathy; and
(B)
Administrative
experience of not less than three years in a homoeopathic medical college or
hospital.
(C)
Research
experience in a research institution recognised by the concerned University and
or the State Government or Central Government or the Union territory
administration, in a project registered with Clinical Trial Registry -India.
(a)
In allied
subjects, namely, Human Anatomy, Human Physiology and Biochemistry, Forensic
Medicine and Toxicology, Community Medicine, Research Methodology and
Biostatistics, Practice of Medicine With Essentials of Pharmacology, Pathology
and Microbiology, Surgery, Gynecology and Obstetrics-
(i)
Essential
Qualification:
(A)
Post-graduate
degree in homoeopathy with not less than five years of teaching experience as
an Associate Professor in the subject concerned or not less than ten years of
regular teaching experience in the subject concerned in a recognised
homoeopathic medical institution; or
(B)
Post-graduate
medical degree in the concerned subject recognised by the National Medical
Commission with five years of teaching experience as an Associate Professor in
the subject concerned or not less than ten years of regular teaching experience
in the subject concerned in a homoeopathic medical institution or in a medical
college permitted by the Central Government; or
(C)
Recognised
under graduate degree in homoeopathy along with post-graduate degree in medical
anatomy for anatomy or in medical physiology or biochemistry for physiology or
in legal medicine (forensic medicine) for forensic Medicine and toxicology or
in public health for community medicine from recognised University or medical
institution as recognised by the National Medical Commission with twelve years
of regular teaching experience in the subject concerned in a homoeopathic
medical institution; or
(D)
Recognised
post-graduate degree in medical anatomy for anatomy or in physiology or
biochemistry for physiology or in legal medicine or forensic medicine for
Forensic Medicine and Toxicology or in public health for community medicine
along with Ph.D from recognised University or medical institution as recognised
by the National Medical Commission with not less than twelve years of regular
teaching experience in the subject concerned in a homoeopathic medical
institution; and
(E)
Must have
published at least two original publications as principal or co-author in
indexed or peer reviewed journal.
(ii)
Desirable
Qualification:
(A)
Experience
of not less than five years as supervisor or guide for post-graduate programme
in Homoeopathy; and
(B)
Administrative
experience of not less than three years in a homoeopathic medical college or
hospital; and
(C)
Research
experience in a research institution recognised by the concerned University or
the State Government or Central Government or Union territory Administration or
in a project registered with Clinical Trials Registry-India.
(3)
Associate
Professor
(A)

post-graduate qualification in Homoeopathy in subject concerned with not less
than five years of full time research experience in Teaching Institution or in
Research Council of the Central Government or State Government or Union
territory Administration or University or National Institutions with at least
three publication in indexed or peer reviewed journal and qualified National
Teachers Eligibility Test conducted by the Commission; or
(D)
Must have
not less than five years of experience in regular service, after acquiring
post-graduate degree in subject concerned in the Central Government Health
Services or State Government Health services, Ministry of Ayush or full time
five years of experience as medical officer in regular service after acquiring
post-graduate degree in the concerned subject in recognised Homoeopathy Medical
Institute and having qualified National Teachers Eligibility Test conducted by
the Commission.
(ii)
Desirable
qualifications:
(A)
Experience
of not less than three years as supervisor or co-supervisor or guide or
co-guide for postgraduate course inhomoeopathy; and
(B)
Research
experience in a research institution recognised by the concerned University or
the State Government, Central Government or Union territory Administration or
in a project registered with Clinical Trials Registry-India.
(b)
In allied
subjects, namely, Human Anatomy, Human Physiology and Biochemistry, Forensic
Medicine and Toxicology, Community Medicine, Research Methodology and Biostatistics,
Pathology and Microbiology, Surgery, Gynecology and Obstetrics
(i)

Recognised
post-graduate qualification in homoeopathy with not less than five years of
experience in regular service of teaching experience in the subject concerned
in a recognised homoeopathic medical institution;

Commission with not less than five years of experience in regular service of
teaching experience in the subject concerned in a recognised homoeopathic

reviewed journal; or
(E)
Recognised
under graduate qualification in homoeopathy and post-graduate degree in medical
anatomy for anatomy or in medical physiology or biochemistry for physiology or
in legal medicine (forensic medicine) for forensic Medicine and toxicology or
in public health for community medicine from recognised University or medical
institution as recognised by the National Medical Commission with not less than
seven years of regular teaching experience in the subject concerned in a
recognised homoeopathic medical institution and;
(F)
Must have
published one article as principal or co-author in indexed or peer reviewed
journal; or
(G)
Recognised
post-graduate degree in medical anatomy for anatomy or physiology or
biochemistry for physiology or in legal medicine or forensic medicine for forensic
Medicine and toxicology or in public health for community medicine along with
Ph.D from recognised University or medical institution as recognised by the
National Medical Commission with not less than seven years of regular teaching
experience in the subject concerned in a recognised homoeopathic medical
institution; and
(H)
Must have
published at least one article as principal or co-author in indexed or peer
reviewed journal; or
(I)
Recognised
post-graduate qualification in Homoeopathy with not less than five years of
full time research experience in Teaching Institution or Research Council of
the Central Government or State Government or Union territory Administration or
University or National Institutions with at least three publication in indexed
or peer reviewed journal and qualified National Teachers Eligibility Test
conducted by the Commission; and
(J)
at least
three publications as principal or co-author in indexed or peer reviewed
journal and qualified National teachers eligibility test conducted by the
Commission; or
(K)
Must have
five years of experience in regular service after acquiring post-graduate
degree in the concerned subject in the Central Government Health Services or
State Government Health services, Ministry of Ayush or full time five years of
experience as medical officer in regular service after possessing Post-graduate
degree in the subject concerned in recognised Homoeopathy Medical College and
having qualified National Teachers Eligibility Test conducted by the
Commission.
(ii)
Desirable
qualification:
(A)
Experience
of not less than three years as supervisor or co-supervisor or guide or
co-guide for postgraduate course in Homoeopathy; and
(B)
Research
experience in a research institution recognised by the concerned University or
the State Government or Central Government or Union territory Administration or
in a project registered with Clinical Trials Registry-India.
(4)
Assistant
Professor
(a)
In the
subjects namely, Homoeopathic Materia Medica, Organon of Medicine, Homoeopathic
Pharmacy, Repertory, and Practice of Medicines.-
Essential Qualification:
(A)
Recognised
post-graduate degree in Homoeopathy in the subject concerned; and
(B)
Qualified
National Teachers Eligibility Test conducted by the Commission. Preference
shall be given to those candidates who holds experience of working as resident
medical officer or house physicians in a homoeopathic hospital attached to a
homoeopathic medical institution permitted by the Central Government or
Commission.
(b)
In the
subjects, namely, Anatomy, Physiology, Pathology, Forensic Medicine and
Toxicology, Surgery, Gynecology and Obstetrics.-
Essential Qualification:
(A)
Recognised
post-graduate degree in homoeopathy; and
(B)
Qualified
National Teachers Eligibility Test conducted by the Commission and preference
shall be given to those candidates who holds experience of working as resident
medical officer or house physicians in a homoeopathic hospital attached to a
homoeopathic medical institution permitted by the Central Government or
Commission; or
(C)
Post-graduate
medical degree in subject concerned recognised by the National Medical
Commission; and
(D)
Qualified
National Teachers Eligibility Test conducted by the Commission and preference
shall be given to those candidates who holds experience of working as resident
medical officer or house physicians in a hospital attached to a medical college
permitted by the Central Government; or
(E)
Recognised
under graduate degree in homoeopathy and post-graduate degree in medical
anatomy for anatomy or in medical physiology or biochemistry for physiology or
in legal medicine (forensic medicine) for forensic Medicine and toxicology from
recognised University or medical institution as recognised by the National
Medical Commission; and
(F)
Qualified
National Teachers Eligibility Test conducted by the Commission; or
(G)
Post-graduate
degree in medical anatomy for anatomy or Physiology or biochemistry for
physiology or in legal medicine or forensic medicine for forensic medicine and
toxicology from recognised University or medical institution as recognised by
the National Medical Commission; and
(H)
Qualified
National Teachers Eligibility Test conducted by the Commission.
(c)
In the
subject, namely, community medicine and research methodology and
biostatistics.- Essential Qualifications:

shall be given to those candidates who hold experience of working as resident
medical officer or house physicians in a homoeopathic hospital attached to a
homoeopathic medical institution permitted by the Central Government or
Commission;
(C)
Must have
published at least two original publications as principal or co-author in peer
reviewed journals; or
(D)
Recognised
under graduate degree in homoeopathy and post-graduate degree in public health
for community medicine from recognised University or medical institution as
recognised by the National Medical Commission; and
(E)
Qualified
National Teachers Eligibility Test conducted by the Commission; or
(F)
Post-graduate
degree in public health for community medicine along with Ph.D from recognised
University or medical institution as recognised by the National Medical
Commission; and
(G)
Qualified
National Teachers Eligibility Test conducted by the Commission.
(d)
Visiting
Assistant Professor In Fundamentals Of Psychology.-
Essential Qualifications:
(A)
Recognised
p ost-graduate degree in Homoeopathy and Masters degree in any branch of
psychology and preference shall be given to those candidates who hold experience
of working as resident medical officer or house physicians in a homoeopathic
hospital attached to a homoeopathic medical institution permitted by the
Central Government or Commission; or
(B)
Recognised
post-graduate degree in homoeopathy in psychiatry and preference shall be given
to those candidates who hold experience of working as resident medical officer
or house physicians in a homoeopathic hospital attached to a homoeopathic
medical institution permitted by the Central Government or Commission; or
(C)
Post-graduate
medical degree in psychiatry recognised by the National Medical Commission and
preference shall be given to those candidates who hold experience of working as
resident medical officer or house physicians in a hospital attached to a medical
college permitted by the Central Government or Commission.
(e)
Visiting
Assistant Professor In Modern Pharmacology.-
(A)
Post-graduate
degree in Pharmacology by a recognised Commission; or
(B)
Masters
degree in Pharmacy recognised by the Pharmacy council of India.
(5)
Yoga
Instructor
(i)
Essential
Qualification:
(a)
qualified
degree holder namely, bachelor of naturopathy and yogic sciences- a five and
half years regular medical course in yoga and naturopathy; or
(b)
diploma
in naturopathy and yogic sciences. having the registration to practice these
systems of health care from the State or Central authorities.

Preference shall be given to
persons with homoeopathic medical qualifications along with degree of Bachelor
of Naturopathy and Yogic Sciences.
