NATIONAL CAPITAL TERRITORY OF
DELHI PENSION SCHEME TO WOMEN IN DISTRESS IN THE AGE GROUP OF 18 TO 60 YEARS
RULES, 2010
PREAMBLE
In
supersession of the NCT of Delhi Pension Scheme to Widows in the Age Group of
18 to 60 years Rules. 2007, Government of National Capital Territory of Delhi
is pleased to make the Following rules for assistance to widows divorced,
separated/destitute or abandoned women.
Rule 1. Short Title, Extent & Commencement.
(1)
These rules shall be called, The National Capital Territory of
Delhi Pension Scheme to Women in Distress in the age group of 18 to 60 years
Rules, 2010.
(2)
They shall extend to the whole of the National Capital Territory
or Delhi.
(3)
They shall come into force from the current financial year.
Rule 2. Aims and Objective.
To provide social security by way
of financial assistance to widows, divorced, separated abandoned, deserted or
destitute women in the age group of 18 to 60 years who have no adequate means
of subsistence and are poor, needy and vulnerable.
Rule 3. Definitions.
In
these rules, unless the content otherwise requires.
(a)
"Applicant" means a person making an application to the
authority proscribed under rule 5(ii) for seeking assistance.
(b)
"Application form" means the form prescribed under these
rules.
(c)
"Family"' means children, unmarried, divorced or
separated daughter/sisters, parents who are solely dependent on the applicant,
(d)
"Financial Assistance" means recurring financial aid
from the month next to the month of application under these rules till the age
of 60 years or the death of the person whichever is earlier.
(e)
"Investigator" means an official appointed by the
Department of Social Welfare/Women and Child Development under rule 6.
(f)
"Sanctioning Authority" means an officer appointed under
rule 6 to sanction the amount of Financial assistance.
(g)
"Women in Distress" means any widowed, divorced,
separated, abandoned, deserted/destitute women or victims of domestic violence
above the age of 18 till 60 yean,
Rule 4. Eligibility.
A woman in distress as
defined in clause (g) of rule 3 shall be eligible for financial assistance
under this scheme if:-
(i)
she has been residing in Delhi for more than 5 years preceding the
date of application.
(ii)
Her family's annual income does not exceed Rs. 60.000/- Rs. sixty
thousand);
(iii)
she has a 'singly-operated' account in any Bank for receiving the
payment through electronic clearing system.
(iv)
she is not receiving any pension from Central Govt./State
Govt./MCD and/or NDMC or any other source for this purpose.
Rule 5. Application for Financial Assistance.
(1)
A woman eligible under this scheme shall apply for the grant of
assistance in the prescribed application Form which may be obtained free of
cost from the District Social Welfare/Women and Child Development Offices of
their respective Districts, area MLA/MM, Financial Assistance Section,
Department of Women and Child Development, GNCT of Delhi, Canning Lane. K.G.
Marg, New Delhi- 110001 or downloadable from the websites of Samajik Suvidha
Sangam or Department of Women and Child Development.
(2)
The applicant shall submit the duly filled application form in the
office of the concerned District Social Welfare, Women and Child Development
Officer, along with the following documents:-
(a)
proof of death of husband/divorce decree' separation
papers/divorce proceedings/any other document which establishes
abandonment/separation.
(b)
for proof of death, the following documents shall he admissible:-
(1)
Death certificate issued by the Registrar, Births & Deaths;
(2)
Receipt issued by authority at cremation ground/graveyard;
(3)
Death certificate issued by the Hospital at the time of Death;
(4)
In case The death has occurred outside Delhi or in a village with
no receipt of cremation ground, certificate of local pradhan of she village can
also be accepted;
(5)
Post modem report:
(6)
Any other document which clearly establishes the death of the
husband, showing the time, date and place of death.
(c)
for divorced' separated/abandoned or deserted women, any legal
proceedings including reports in the police station, Crime against Women Cell,
Family Counselling Centers (FCC), Delhi Commission for Women, National
Commission for Women, Mahila Panchayats shall be admissible.
(d)
proof of residence, which clearly shows at least live years of
residence in Delhi. Any one of the following documents of any of the family
members (as defined above) only may be submitted for residence proof-
(1)
Ration card:
(2)
Voter card;
(3)
Passport:
(4)
Driving license;
(5)
Birth certificate issued by MCD/Registrar-Births & Deaths:
(6)
Death certificate issued by MCD/Registrar-Births & Deaths:
(7)
Insurance policy document:
(8)
Immunization card of any family member;
(9)
Medical records of treatment in Delhi,
(10)
Electricity Bill;
(11)
Water Bill;
(12)
Telephone bill;
(13)
Gas connection receipt;
(14)
Bank passbook:
(15)
Caste certificate issued in Delhi:
(16)
Student I-card:
(17)
Servite identity card of public/private sector company/established
concern;
(18)
Property document:
(19)
Any other document which clearly shows at least 5 years of
residence in Delhi,
(e)
proof of age-any one of the following documents may be submitted
for proof age-
(1)
Birth certificate issued by MCD/Registrar of Births & Deaths:
(2)
School leaving certificate of class last attended:
(3)
Matriculation/10th certificate;
(4)
Hospital discharge slip at the time of birth of the child;
(5)
Driving license:
(6)
Passport:
(7)
PAN Card:
(8)
Ration Card:
(9)
Voter card:
(10)
Immunization card;
(11)
Age assessment medical certificate:
(12)
Any document issued by the Government/Govt. recognized body
slating dale and place of birth:
(f)
all self-declaration by the applicant retarding her family income
as written in the from.
(g)
All documents shall be self-attested
(h)
the applicant may also attach a recommendation from the Member of
Legislative Assembly of National Capital Territory of Delhi/the Member of the
Parliament of the area concerned or a Gazetted Officer of the Central/Delhi
Govt. in support of his/her application
(i)
in case 'No Documentary Evidence' is available with the applicant
in respect of proof of residence, the following shall be admissible:-
(1)
The inclusion of name of the person in the database of the Samajik
Suvidha Sangam
(2)
The applicant may produce any of the two witnesses from the
following list in front of the DSWO/WCDO/any official deputed by the DSWO/DWCDO
or any official deputed by the DSWO/DWCDO for the said purpose.
(a)
president or General Secretary of RWA of the locality
(b)
registered Shopkeepers/Registered Doctors working in the locality
(with their registration number)
(c)
two neighbours of the applicant with their contact details
(d)
registered women SHGs'/Mahila Mandals' President or General
Secretary or authorized signatory
(e)
ICDS Supervisors/ASHA workers of the area
(f)
Gazetted Officer of the Central/Delhi Govt.
(g)
In case the applicants are employed in households/stops etc. a
letter from the employer about the number of years the applicant has been
working with them.
(3)
Along with the witness's statement the relevant document for proof
of his photo identity, residence and length of stay shall also have to be
appended with the application, clearly showing that the witnesses themselves
have been around in the same area for the number of years they claim to have
known the applicant.
Rule 6. Verification and sanction of assistance.
The District Social Welfare/Women
and Child Development Officer or Joint Director (FAS) shall he the competent
authority for verification and sanction of the payment under the scheme, The
Competent Authority may satisfy him/herself about the contents of the
application by screening the documents submitted, by the applicant. In doubtful
cases only, this Competent Authority may get the verification conducted through
the departmental investigators or other officials or anganwadi workers
Specialty deputed for the purpose.
Rule 7. Quantum of Assistance and Mode of payment.
(i)
the rate of assistance shall be Rs. one thousand per month per
head remitted to the bank account of the beneficiary on a quarterly has is
through RCS of RBI.
(ii)
The assistance shall become payable from the month next to the
month of application,
Rule 8. Continuation of Pension.
Every year, each beneficiary
shall have to submit a self-attested certificate about her marital status to
the concerned District Social welfare/Women and Child Development Officer for
continuation of pension.
Rule 9. Stopping of Assistance.
(i)
The sanctioning authority shall have the right to stop payment of
assistance if at any stage it is found that it was sanctioned on furnishing of
fake information or the conditions for which the assistance was granted no
longer exist.
(ii)
If it is found that the assistance was sanctioned on furnishing of
false documents, penal action shall be initiated and appropriate liability
fixed against people furnishing false documents;
(iii)
If a person resorts to professional begging, i.e. if the person
has been apprehended and warned or any oilier proceedings conducted by the
court in this regard against him/her the assistance shall be forfeited.
(iv)
Assistance shall cease to by payable on the death of the
beneficiary and if the person dies before receiving assistance for a particular
period, the same shall lapse,
(v)
The pension shall be slopped if:-
(a)
A widow or divorcee remarries.
(b)
The separated/deserted woman reconciles with her husband/partner
or remarries.
Rule 10. Change of Address.
(i)
It shall be obligatory for the person receiving assistance to
intimate any change of address, along with proof, to the Sanctioning Authority
within one month of such change,
(ii)
Persons shifting to a place outside Delhi permanently shall not be
eligible for this assistance.
Rule 11. Appellate Authority.
In case of any grievances, the
applicant may appeal to the Director, Department of Women and Child Development
for redressal of her grievances In this regard and his decision shall be final.
Rule 12. Miscellaneous.
(i)
The beneficiary who attains the age of 60 years shall
automatically be transferred to the Old Age Pension Scheme.
(ii)
If any applicant has already taken assistance under the scheme
'National Family Benefit Scheme' she can still avail of assistance under this
scheme if she fulfills the other eligibility criteria.
(iii)
Similarly, if the beneficiary is taking assistance under this
scheme, they can still apply for assistance under National family Benefit
Scheme, provided the death of the primary bread winner has happened within the
last one year
(iv)
The beneficiary of the scheme shall not be debarred from seeking
assistance in the following schemes of financial assistance-Ladli, Jan Shree
Beema Yojana, Widows' daughter marriage and/or any other financial assistance
schemes in existence the Department of Social Welfare and Women and Child
Development simultaneously, provided she fulfills the norms.
(v)
A review and evaluation of the scheme as well as verification of
the beneficiaries will be conducted every three years.
