Of Road Transport And Highways, Central Engineering Service (Roads) Rules, 2022

In exercise of the
powers conferred by the proviso to article 309 of the Constitution and in
supersession of the Ministry of Road Transport and Highways, Central
Engineering Service (Roads) Group 'A' Rules, 2003, except as respects things
done or omitted to be done before such supersession, the President hereby makes
the following rules, namely:-
Rule - 1. Short title and commencement.
(1)
These rules may be called
the Ministry of Road Transport and Highways, Central Engineering Service
(Roads) Rules, 2022.
(2)
They shall come into force
on the date of their publication in the Official Gazette.
Rule - 2. Definitions.
In these rules, unless the context otherwise requires,-
(a)
"Commission" means
the Union Public Service Commission;
(b)
"controlling
authority" means the Ministry of Road Transport and Highways, Government
of India;
(c)
"duty post" means
a post included in Schedule I;
(d)
"Economically Weaker
Sections" shall have the same meaning and applicability as laid down in
Department of Personnel and Training O.M. No. F.36039/1/2019- Estt.(Res) dated
the 19th January,2019;
(e)
"Government" means
the Government of India;
(f)
"Grade" means a
Grade of the service specified in column 2 of Schedule I;
(g)
"Other Backward
Classes" shall have the same meaning and applicability as laid down in
Department of Personnel and Training O.M. No. 36012/22/93-Estt (SCT), dated the
8th September ,1993;
(h)
"regular continuous
service" means service rendered on continuous basis after regular
appointment to a grade on the recommendations of the Departmental Promotion
Committee or in consultation with the Commission, as the case may be;
(i)
"Schedule" means a
Schedule appended to these rules;
(j)
"Scheduled Castes"
and "Scheduled Tribes" shall have the same meanings as are assigned
to them in clauses (24) and (25) respectively of article 366 of the
Constitution;
(k)
"senior duty post"
means posts in level 11 and above;
(l)
"Service" means
the Central Engineering Service (Roads) Group A constituted under rule 3 of
these rules.
Rule - 3. Constitution of Service.
All duty posts included in the Service as specified in Schedule - I shall
constitute the Central Engineering Service (Roads) Group A.
Rule - 4. Grade, authorised strength and its review.
(1)
The authorised permanent
strength of various grades of the Service on the commencement of these rules,
the number of posts in each level shall be as specified in Schedule I.
(2)
On and from the commencement
of these rules, the authorised permanent strength of various grades of the
service shall be as may be determined by the Central Government through the
established procedure laid by the Department of Expenditure and the Department
of Personnel and Training, from time to time.
(3)
The controlling authority
may, in consultation with the Commission and the Government the Ministry of
Finance, Department of Expenditure, wherever applicable, and the Department of
Personnel and Training), make temporary addition to or reduction in the
strength of the posts in various grades as it may deem necessary, from time to
time, subject to any general or special orders issued by the Government.
(4)
The controlling authority
may, in consultation with the Commission and the Government (the Ministry of
Finance and the Department of Personnel and Training), include in the Service
such posts as may be equivalent to the posts included in the Service in status,
Grade, level and professional content, other than those included in Schedule I,
or exclude from the Service a post included in the said Schedule.
(5)
The controlling authority
may, in consultation with the Commission, appoint an officer whose post is
included in the Service under sub-rule (4) to the appropriate Grade in a
temporary capacity or in a substantive capacity as it may deem fit and fix his
seniority in such Grade in accordance with the general orders and instructions
issued by the Government, from time to time.
Rule - 5. Members of Service.
The following persons shall be members of the Service, namely:-
(i)
all the existing officers
holding Group A duty posts on regular basis in the Central Engineering Service
(Roads) Group A on the commencement of these rules, in the respective grades;
and
(ii)
persons appointed to duty
post under rule 6.
Rule - 6. Method of recruitment to service.
(1)
The vacant posts in any of
the grades referred to in Schedule I shall be filled in the manner provided in
these rules.
(2)
All vacancies in the Grade
of Assistant Executive Engineer shall be filled by direct recruitment on the
basis of the results of the Engineering Services Examination conducted by the
Commission, on the basis of educational qualifications and age-limits as
specified in Schedule II.
(3)
Appointments in the Service
to the posts of Director General (Road Development) and Special Secretary,
Additional Director General, Chief Engineer, Superintending Engineer and
Executive Engineer shall be made by promotion from amongst the officers of the
respective discipline with minimum qualifying service specified in Schedule
III.
(4)
The selection of officers
for promotion shall be made on the recommendation of a Departmental Promotion
Committee specified in Schedule IV.
Rule - 7. Grant of Non Functional Up-gradations.
(1)
Non-functional upgradation
may be granted to Members of the Service in accordance with the orders or
instructions issued by the Government, from time to time, and on the basis of
recommendations of Departmental Screening Committee specified in Column (4) of
Schedule V.
(2)
All prescribed eligibility
criteria and promotion norms including benchmark for upgradation to a
particular Grade pay shall have to be fulfilled at the time of screening for
higher Grade pay level.
Rule - 8. Seniority.
(1)
The relative seniority of
the members of the Service shall be the relative seniority in their respective
Grades as already determined before the commencement of these rules:
Provided that if the
seniority of any such member had not been determined before the commencement of
these rules, it shall be determined by the Controlling authority in accordance
with the general orders or instructions on seniority issued by the Government,
from time to time.
(2)
The seniority of persons
appointed to various Grades of the Service on and from the commencement of
these rules shall be determined in accordance with the general orders or
instructions on seniority issued by the Government, from time to time.
Rule - 9. Probation.
(1)
Every officer on appointment
to the Service in the Grade of Assistant Executive Engineer (by direct
recruitment) and Executive Engineer who are promoted from the post of Assistant
Engineer (Group B post) shall be on probation for a period of two years:
Provided that the
controlling authority may extend the period of probation in accordance with the
instructions issued by the Government, from time to time, in this regard:
Provided further that
any decision for extension of period of probation shall be taken ordinarily
within eight weeks after expiry of the previous period of probation and
communicated in writing to the concerned officer together with the reasons for
so doing within the said period.
(2)
On completion of the period
of probation or an extension thereof, officers shall, if considered fit for the
permanent appointment, be retained in their appointment on regular basis and be
confirmed against the available substantive vacancy, as the case may be.
(3)
If during the period of
probation or any extension thereof, as the case may be, the Government is of
the opinion that an officer is not fit for permanent appointment, it may
discharge the officer or revert to the post held by him prior to his
appointment in the Service, as the case may be.
(4)
During the period of
probation or any extension thereof, an officer may be required by the
Government to undergo such courses of training or pass such examination or test
as the Government may deem fit as condition for satisfactory completion of
probation.
(5)
As regards other matters
relating to probation, the members of the Service shall be governed by the
orders or instructions, issued by the Government in this regard, from time to
time.
Rule - 10. Appointment to the Service.
All appointments to the Service shall be made by the controlling authority for
all the duty posts in various Grades of the Service.
Rule - 11. Liability for service in any part of India and other service conditions.
(1)
The officers appointed to
the Service shall be liable to serve anywhere in India or outside.
(2)
An officer appointed to the
Service, if so required shall be liable to serve in any Defence Service or a
post connected with the defence of India, for a period of not less than four
years, including the period spent on training if any:
Provided that such
officer,-
(a)
shall not be required to
serve in any Defence Service or a post connected with the defence of India, on
expiry of ten years from the date of his appointment of the service or from the
date of his joining prior to the initial constitution of the service;
(b)
shall not ordinarily be
required to serve in any Defence Service or a post connected with the defence
of India, if he has attained the age of forty years.
(3)
The other conditions of
service of the members of the Service, not covered by these rules, shall be
governed by the rules applicable generally to the officers of the Government of
equivalent grade.
Rule - 12. Disqualifications.
No person,-
(a)
who has entered into or
contracted a marriage with a person having a spouse living; or
(b)
who, having a spouse living,
has entered into or contracted a marriage with any person, shall be eligible
for appointment to the Service:
Provided that the
Government may, if satisfied that such marriage is permissible under the
personal law applicable to such person and the other party to the marriage and
that there are other grounds for so doing, exempt any person from the operation
of this rule.
Rule - 13. Powers to relax.
Where the Government is of the opinion that it is necessary or expedient so to
do, it may, by order, for reasons to be recorded in writing, and in
consultation with the Commission, relax any of the provisions of these rules
with respect to any class or category of persons.
Rule - 14. Saving.
Nothing in these rules shall affect reservation, relaxation in age-limit and
other concessions required to be provided for the Scheduled Castes, the
Scheduled Tribes, Other Backward Classes, Persons with Benchmark Disabilities,
Ex-servicemen, Economically Weaker Sections and other special categories of
persons in accordance with the orders issued by the Government, from time to
time, in this regard.
Rule - 15. Interpretation.
If any question arises relating to the interpretation of these rules, it shall
be decided by the Government in consultation with the Commission.
Rule - 16. Phasing out of Mechanical Cadre.
(1)
Mechanical Cadre shall be
phased out without adversely affecting the present incumbents.
(2)
The posts of the Mechanical
Cadre are to be phased out on their superannuation, resignation or promotion of
the officer holding the post and the posts left vacant thereafter shall be
merged with the Civil Cadre.
Rule - 17. Mid-career training.
(1)
Mid-career training course
in different phases is mandatory for promotions from Executive Engineer to
Superintending Engineer, Superintending Engineer to Chief Engineer and Chief
Engineer to Additional Director General.
(2)
The training referred to in
sub-rule (1) shall be governed by orders or instructions, issued by the
Government in this regard, from time to time.

Minimum educational

such conditions as may be recognised by the Government for the purpose, from
time to time; and
(b) attained the age of 21 years but
not have attained the age of 30 years on the 1st day of August of the year in
which the examination is held.

Note 1.- The crucial
date for determining the age-limit shall be as advertised by Commission.
Note 2 .- Age is
relaxable for Government servant up to five years in accordance with the
instructions or orders issued by the Government from time to time.
Note 3.-
Qualifications are relaxable at the discretion of the Commission, for reasons
to be recorded in writing in the case of candidates otherwise well qualified.
