MAHARASHTRA POLICE CONSTABLES (RECRUITMENT) RULES, 2011

 

PREAMBLE

 

In exercise of the powers conferred by clause (b) of section 5 of the Bombay Police Act, 1951 (Bom. XXII of 1951), and of all other powers enabling it in this behalf, and in supersession of the Police Constables (Recruitment) Rules, 2006, the Government of Maharashtra hereby makes the following rules regulating recruitment to the post of Police Constables in the Police Force under the Home Department of the Government of Maharashtra, namely:--

Rule 1.

 

These rules may be called the Maharashtra Police Constables (Recruitment) Rules, 2011.

Rule 2. In these rules, unless the context requires otherwise:-

 

(a)      "Department" means the Home Department of the Government;

 

(b)      "Director General" means the Director General and Inspector General of Police, Maharashtra State, Mumbai;

 

(c)      "Government" means the Government of Maharashtra;

 

(d)      "Police Force" means the Police Force constituted under section 3 of the Bombay Police Act, 1951 (Bom. XXII of 1951).

Rule 3.(1) A candidate for selection to the post of Police Constable in the Police Force shall be required to possess the educational and physical qualifications, as follows, namely.-.?

 

(A)      Age.--

Minimum 18 years, maximum 25 years.

(Maximum age limit in respect of Backward Class candidates shall be relaxable as per Government Policy in this regard laid down, from time to time.)

(B)      Educational qualification.--

Passed the Higher Secondary School Certificate Examination (XIIth Standard) conducted by a Divisional Board under the Maharashtra Secondary and Higher Secondary Education Boards Act, 1965 (Mah. XLI of 1965), and includes any other examinations declared by the Government to he equivalent thereto.

(C)      Physical qualification.--

Female

Male

(i)       Height. .

Shall not be less than 155 centimeters.

Shall not be less than 165 centimeters.

(ii)      Chest . .

Shall not be less than 79 centimeters deflated and the difference between deflated chest and expanded chest shall not be less than 5 centimeters.

(2) ? Relaxations in educational and physical qualifications. -

(A)      Special provisions for naxal affected areas.

 

(a)      Educational qualification.- 

Candidates belonging to the Scheduled Tribes category or children of Police Informants, Police Patils or Policemen who are killed or seriously injured in Naxalite attacks or operations against Naxalites and have passed VIIth standard examination; and are residing in areas notified by the Government as Naxalite areas, shall be eligible for recruitment on the condition that such a candidate shall not be entitled to transfer outside the said Naxalite areas.

(b)      Physical qualifications. - 

Relaxations for the candidates belonging to the Scheduled Tribes category or children of Police Informants or Police Patils or Policemen who are killed or seriously injured in Naxalites attacks or operations against Naxalites and who are residing in the areas notified by the Government as Naxalite areas, are enumerated to the extent as set out below, -

(i)       Height - 2.5 centimeters for male and female candidates.

 

(ii)      Chest-measurement is not required.

 

(c)      The powers of relaxation in educational and physical qualifications prescribed in sub-clauses (a) and (b) above in respect of candidates residing in the Naxalite areas notified by the Government shall lie with the Additional Director General, Training and Special Unit, Maharashtra State.

 

(d)      In the Naxalite areas notified by the Government, preference will be given to the candidates having knowledge of one of the local tribal dialects.

 

(B)      Police Band.?

 

(a)      Educational qualification.-- 

Candidates who have passed Secondary School Certificate Examination (Xth Standard) conducted by a Divisional Board under the Maharashtra Secondary and Higher Secondary Education Boards Act, 1965 (Mah. XLI of 1965), shall be eligible for recruitment.

(b)      Physical qualifications.-- 

The Additional Director General, Training and Special Unit, M.S. may relax the physical qualifications prescribed in sub-clauses (i) and (ii) of clause (C) of sub-rule (1) of this rule in favour of candidates who appear for recruitment in the Police Band to the extent as set out below, -

(i)       Height.--

2.5 centimeters.

(ii)      Chest.--

2 centimeters deflated and 1.5 centimeters expanded.

(c)      Experience and other conditions. ?

 

(i)       Knowledge of instruments of brass band and experience in playing of musical instruments is necessary for recruitment in the Police Band;

 

(ii)      wherever feasible, an officer from Defence Service Bands may be included in the Selection Committee exclusively for recruitment in the Police Band;

 

(iii)     police personnel recruited in the Police Band will also have to perform other police duties at the Police Head quarters;

 

(iv)    police personnel recruited in the Police Band will not be eligible for transfer to executive duties but will be eligible for inter-district transfer in the same cadre, i.e. in a Band unit.

 

(C)      Sports category.-- 

Relaxation in the required height by 2.5 centimeters, shall be given to the sports persons, who fulfill the required eligibility conditions.

(D)     Policeman's family.--

Only one eligible relative of a policeman who has been missing or has been retired on compassionate ground on the basis of medical certificate due to ill health, may get the following relaxations in respect of physical qualifications, namely:--

(a)      Height.-2.5 centimeters for male and female candidates.

 

(b)      Chest.--

2 centimeters deflated and 1.5 centimeters expanded for male candidates.

Explanation.--The following family members of the policeman will be considered eligible relative.

(a)      Husband /Wife, son, unmarried daughter

 

(b)      Dependable unmarried brother or sister in case of unmarried Policeman.

 

(c)      Daughter-in-law in case of Policeman's diseased son.

Rule 4.(1) Physical Test (100 Marks).?

 

The candidates who fulfill the physical and educational qualifications shall be required to appear for a physical fitness test. The physical lest will be of a total 100 marks as follows, namely:--

(A)      Male candidates.?

 

(a)      5 Kilometers running 20 marks

 

(b)      100 meters running 20 marks

 

(c)      Shot put 20 marks

 

(d)      Long Jump 20 marks

 

(e)      10 Pull-ups 20 marks Total 100 mark

 

(B)      Female candidates.?

 

(a)      Kilometer running 25 marks

 

(b)      100 meters running 25 marks

 

(c)      Shot put (4 kg.) 25 marks

 

(d)      Long Jump 25 marks Total 100 marks

(2) ? Written Test (100 Marks).--

(A)      Candidates securing a minimum of 50% marks in the Physical Fitness Test shall be eligible to be called to appear for a written test of 100 marks in the ratio of 1:15 of vacancies advertised in the respective categories.

 

(B)      (1)) The Written Test will include the following subjects, namely:--

 

(i)       Arithmetic;

 

(ii)      General knowledge and current affairs;

 

(iii)     Intellectual test;

 

(iv)    marathi grammar.

 

(C)      ?The questions asked in written test shall be objective type and conducted in Marathi language. The duration of written test will be 90 minutes.

Explanation.-- Candidates securing a minimum of 50% marks in the physical fitness test shall be eligible to be called to appear for a written test in the ratio of 1:15 of vacancies advertised in the respective categories. If, for example, there are 10 vacancies in the Scheduled Caste category and 5 vacancies in the Scheduled Tribes category, then 150 (15 X 10 = 150) candidates will be listed on merit in the Scheduled Caste category and 75 (15 X 5 = 75) candidates will be listed in the Scheduled Tribes category. However, all candidates in the Scheduled Caste category who have secured the same marks as the Scheduled Caste candidate at the 150th rank shall be eligible to be called to appear for a written test. Similarly, all Scheduled Tribes category candidates who have secured the same marks as the Scheduled Tribes candidate ranking 75th will be eligible to be called to appear for a written test.

(3) ? The Selection Board constituted by the Director General shall prepare a merit list from amongst the candidates based on the results of the two criteria enumerated at sub-rules (1) and (2) of this rule. After amalgamation of marks obtained in physical and written test, the final merit list will be prepared as per steps mentioned in the General Administration Department's Government Resolution No. SRV-1097/CR-31/98/16A, dated 16th March 1999 and any subsequent orders issued by Government, from time to time.

Rule 5. Verification of antecedents / character.?

 

The candidates selected for the post of police constable shall not be given appointment or shall not to be sent for training till the report of his character is obtained. The appointment shall not be given to the candidates against whom offence is registered or a case is pending or who have been acquitted by court before or after recruitment. It will be obligatory for appointing authority to send all such proposal for consideration before the High Power Committee of Government.

Rule 6. Medical test.?

 

The medical test of selected candidates shall be done as per the provisions of Maharashtra Civil Services (General Conditions of Services) Rules, 1981 and as per subsequent orders issued by the Government, from time to time, in addition, the medical test shall consists, of test for squint eye, colour blindness, knock-knees, flat-foot and skin and chest diseases and any other medical tests prescribed by the Director General, from time to time. The selected candidates who are not found fit in these medical tests shall not be given appointment.

Rule 7.

 

Recruitment to the post of Police Constable in the Police Force shall be made by intimating and calling for names from the Employment Exchange or Social Welfare Officer or District Military Board and Training Centers conducted by the Tribal Development Department and inviting applications after giving advertisement thereof in Marathi, Hindi, Urdu and English language local newspapers having wide circulation and giving wide publicity through media as per the directions given by the General Administration Department, from time to time. In addition, information pertaining to the recruitment shall be posted on the police website and displayed on office notice boards or announced on radio, television, employment bulletins and newspapers. There shall be simultaneous recruitment in all Police Units in the state. The date shall be finalised by Director General. Applications forms for this purpose shall be prescribed by the Additional Director General, Training and Special Unit of Police. Application Forms for this purpose shall be made available at the offices of the Commissioner of Police/District Superintendent of Police/Commandant, State Reserve Police Force/Taluka Police Stations. The procedure to implement the recruitment drive will be implemented as per the direction given by the Government, from time to time.

Rule 8. Reservation.?

 

(i)       Sports category.-- 

5% of the total posts available for recruitment of police constables shall be reserved for sports persons. The terms and conditions governing this reservation shall be in consonance with Education and Sports Department, Government Resolution, No. NSP-2002/CR-68/SYS-2, dated 30th April, 2005 and any subsequent orders issued by Government, from time to time.

(ii)      Women.-- 

30% of the total posts available for recruitment of Police Constables shall be reserved for women. The terms and conditions governing this reservation shall be in consonance with the Government Resolution, No. 82/2001/MSA-2000/CR-415/ Desk-2, dated 25th May, 2001 and any subsequent orders issued by Government, from time to time.

(iii)     Home Guards.-- 

Out of the total posts available for recruitment to the post of Police Constable in the Police Force, 5% posts shall be filled in from amongst the members of Home Guards who have completed minimum three years service i.e. 1095 days of consolidated service as Home Guards and possess the requisite educational and physical qualifications and age limit as per these rules.

(iv)    Ex-servicemen, project-affected persons and any other categories eligible as per the guidelines issued by the Government, from time to time.

 

(v)      All the categories enumerated in this rule shall be required to pass the eligibility criteria and obtain the requisite marks in the physical and written tests prescribed for the post.

Rule 9. Recruitment on compassionate ground.?

 

The procedure for compassionate appointment scheme will be adopted as per the orders issued by the General Administration Department, from time to time.

But the eligible candidate may get the following relaxations in respect of physical qualifications, namely:--

(i)       Height: 2.5 centimeters for male and female candidates.

 

(ii)      Chest: 2 centimeters deflated and 1.5 centimeters expanded for male candidates.

Rule 10.

 

A parson appointed to the post shall be required to pass examinations in Hindi and Marathi according to the rules made in that behalf, unless he has already passed, or has been exempted from passing those examinations.

Rule 11.

 

A person appointed to the post shall not be liable for transfer from police unit where he was appointed.

Rule 12.

A candidate appointed to the post shall be required to complete the training prescribed for the post and have to pass concerned examinations within four chances, failing which his or her services would stand terminated. During this period, annual increments due shall be forfeited.

Rule 13.

 

The candidates appointed to the post shall be governed by Bombay Police Manual, 1959, Bombay Police (Discipline and Appeal) Rules, 1956 and similar other rules prescribed by the Government, from time to time.
