MAHARASHTRA COUNTRY LIQUOR (AMENDMENT) RULES, 2022

 

PREAMBLE

Whereas, the Government of Maharashtra considers that the following rules further to amend the Maharashtra Country Liquor Rules, 1973, should be brought into force at once, and therefore, the rules should be made without previous publication as provided by the proviso to sub-section (3) of section 143 of the Maharashtra Prohibition Act, 1949 (XXV of 1949);

Now, therefore, in exercise of the powers conferred by clauses (b), (g) and (h1) of sub-section (2) of section 143 of the Maharashtra Prohibition Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby makes the following rules further to amend the Maharashtra Country Liquor Rules, 1973, as follows, namely:--

Rule - 1.

These rules may be called the Maharashtra Country Liquor (Amendment) Rules, 2022.

Rule - 2.

In rule 15 of the Maharashtra Country Liquor Rules, 1973 (hereinafter referred to as "the principal Rules"), after sub-rule (2) the following sub-rule shall be added, namely:--

"(3) Prohibition to grant or renew license.--

No license under rule 14 shall be granted or renewed in respect of any shop which shall bear a name of the national personalities or any subsequent change in the name of national personalities and shall not bear the name of any of the Forts declared by the Central Government as protected monuments under the Ancient Monuments Preservation Act, 1904 (7 of 1904) and by the State Government as protected monuments under the Maharashtra Ancient Monuments and Archaeological Sites and Remains Act, 1960 (Mah. XII of 1961), as specified in the Schedule-II appended to these rules."

Rule - 3.

In rule 24 of the principal Rules,--

(i)       In sub-rule (4), in the Explanation, in para (iv), for the word "Schedule" the word and letter "Schedule-I" shall be substituted ;

(ii)      after sub-rule (4A), the following sub-rule shall be inserted, namely:--

"(4B) Prohibition to grant or renew license.--

No license under sub-rule (1A) shall be granted or renewed in respect of any shop which shall bear a name of the national personalities or any subsequent change in the name of national personalities and shall not bear the name of any of the Forts declared by the Central Government as protected monuments under the Ancient Monuments Preservation Act, 1904 (7 of 1904) and by the State Government as protected monuments under the Maharashtra Ancient Monuments and Archaeological Sites and Remains Act, 1960 (Mah. XII of 1961), as specified in the Schedule-II appended to these rules."

Rule - 4.

In the principal Rules, the existing "Schedule" shall be re-numbered as "Schedule-I" and after "Schedule I" as so re-numbered the following "Schedule" shall be added, Namely:--
