MADHYA
PRADESH PUBLIC HEALTH AND FAMILY WELFARE (GAZETTED) SERVICES RECRUITMENT RULES,
2022
PREAMBLE
In exercise of the powers conferred by the
proviso to Article 309 of the Constitution of India, the Governor of Madhya
Pradesh, hereby, makes the following rules relating to the Recruitments and
service condition of the members of the Madhya Pradesh Public Health and Family
Welfare (Gazetted) Services namely:
Rule - 1. Short title and commencement.
(1)
These
rules may be called the Madhya Pradesh Public Health and Family Welfare
(Gazetted) Services Recruitment Rules, 2022.
(2)
These
rules shall come into force with effect from the date of their publication in
the "Madhya Pradesh Gazette".
Rule - 2. Definitions.
In these rules, unless the context otherwise
requires,
(a)
"Appointing.
Authority" means the Government or the authority empowered to make a
recruitment to this services or post;
(b)
"Commission"
means the Madhya Pradesh Public Service Commission
(c)
"Commissioner"
means the Commissioner Health Service Madhya Pradesh;
(d)
"Committee"
means the Selection Committee/Departmental Promotion Committee/Screening
Committee;
(e)
"Examination"
means a competitive Examination for recruitment to the service held under rule
11 of these rules;
(f)
"Government"
means the Government of Madhya Pradesh;
(g)
"Governor"
means the Governor of Madhya Pradesh;
(h)
"Member
of Service" means a person appointed in a substantive capacity under the
provisions of these rules or of the rules and orders in force before the
commencement of these rules to a post in the cadre of the Service:
(i)
"Other
Backward Classes" means the other Backward Classes of citizens as
specified by the State Government vide notification No. F-8-5/XXV/4/84 dated
26th December, 1984 as amended from time to time;
(j)
"Schedule"
means the schedule appended to these rules;
(k)
"Scheduled
Castes" means any caste, race or tribe or part of or group within a caste,
race or tribe specified as scheduled Castes with respect to the State of Madhya
Pradesh under article 341 of the Constitution of India;
(l)
"Scheduled
Tribes" means any tribe, tribal community or part of or group within a
tribal of tribal community specified as Scheduled Tribes with respect to the
State of Madhya Pradesh under article 342 of the Constitution of India;
(m)
"Service"
means the Madhya Pradesh Public Health and Family Welfare (Gazetted) Services;
(n)
"State"
means the State of Madhya Pradesh.
Rule - 3. Scope and Application.
Scope and Application:-Without prejudice to
the generality of the provisions contained in the Madhya Pradesh Civil Service (General
Condition of Service) Rules, 1961, these rules shall apply to every member of
the service.
Rule - 4. Constitution of the Service.
The service shall consist of the following
persons namely:
(1)
Persons,
who at the time of commencement of these rules are holding substantively or in
the officiating capacity, the posts specified in Schedule-1;
(2)
Persons,
recruited to the service before the commencement of these rules; and
(3)
Persons
recruited to the service in accordance with the provisions of these rules.
Rule - 5. Classification, Scale of Pay etc.
(1)
The
classification of the Service, pay scale and the number of posts included in
the Service shall be as specified in Schedule-1:
Provided that the Government may, from time
to time, add or reduce the number of posts included in the Service either on
permanent or temporary basis.
(2)
No
member of the Service shall be entitled to compensation in consequence of any
change in the structure of the service or in the event of Government leaving
unfilled or holding in abeyance a vacant post in the cadre.
Rule - 6. Method of Recruitment.
(1)
Recruitment
to the service, after the commencement of these rules, shall be made by the
following methods, namely:-
(a)
By
direct recruitment, selection from competitive Examination or by both;
(b)
By
promotion of members of the service specified in column (2) of Schedule IV (B)
{Group B non-medical and Group C nursing services};
(c)
By
selection of the members of the service specified in column (2) of Schedule IV
(A) {Group "A" Medical};
(d)
By
transfer or deputation of the persons who holds in a substantive/officiating
capacity such posts in such services as may be specified in this behalf by the
State Government.
(2)
The
number of persons recruited under clause (b) to (d) of sub-rule (1) shall not
at any time exceed the percentage as shown in Schedule-II of the number of
posts as specified in Schedule-I.
(3)
Subject
to the provisions of these rules, the method or methods of recruitment to be
followed for the purpose of being filled during any particular period of recruitment
in accordance with clauses (a) and (b) of sub-rule (1) and the method of
recruitment by each The number of persons to be appointed shall, on each
occasion, be determined by the Government in consultation with the Commission.
(4)
Notwithstanding
anything contained in sub-rule (1), if in the opinion of the Government the
exigencies of the service so require, the Government may with prior concurrence
of the General Administration Department, adopt such methods of recruitment to
the service other than those specified in the said sub-rule as it may by order
issued in this behalf, prescribe.
Rule - 7. Appointment to the Service.
All appointment to the service after the
commencement of these rules shall be made by the Appointing Authority and no
such appointment shall be made except after selection by one of the methods of
recruitment specified in rule 6.
Rule - 8. Conditions of eligibility for direct recruitment.
In order to be eligible for direct
recruitment, a candidate must fulfil the following conditions, namely:-
(a)
Age:-
The minimum age, maximum age and relaxation
in maximum age limit shall be that as determined by the government as per the
circular issued by the General Administration Department, from time to time.
(b)
Educational
Qualification:-
Candidates must posses educational and other
qualifications as prescribed for the service/post in Schedule III;
(c)
Fee:-
The Candidate shall have to pay the fee
prescribed by the Appointing Authority/Commission/Government, as revised from
time to time.
Rule - 9. Disqualification.
(1)
Any
attempt on the part of a candidate to obtain support for his candidature by any
means may be held him disqualify for appearing in the examination/selection by
the Appointing Authority/Commission.
(2)
Any
candidate, who got married before the prescribed minimum age for marriage shall
be disqualified for appointment in the service or post.
(3)
Any
candidate who has more than two living children, one of them was born after
26th January, 2001, shall be disqualified for appointment to the service or
post, provided that the second child is not twin.
(4)
Any
candidate who has been convicted for any offence against women shall be
disqualified for appointment in the service whereas, if criminal proceedings
are pending in a court, his appointment shall kept on hold until disposal of
the criminal proceedings.
(5)
Any
male candidate, having more than one living wife and any female candidate who
married to a person who already has a living wife, shall disqualified for the
service.
(6)
Any
other reason, as prescribed by the State Government.
Rule - 10. Decision regarding eligibility.
The decision of the Appointing
Authority/Commission regarding the eligibility of a candidate for admission to
examination/interview shall be final and no candidate who has been disqualified
shall be admitted to the examination/interview.
Rule - 11. Direct recruitment by competitive examination.
(1)
A
competitive examinations for the recruitment to the service shall be held at
such intervals, as the Government, from time to time, may determine in
consultation with the commission. Examination shall be conducted in accordance
with the orders as issued by the Government.
(2)
According
to the provisions of the Madhya Pradesh Civil Services (Reservation for
Scheduled Castes, Scheduled Tribes and Other Backward Classes) Rules, 1998 for
direct recruitment, posts for candidates belonging to Scheduled Castes,
Scheduled Tribes and Other Backward Classes are subject to reservation by the
State Government from time to time, Will be kept in reserve as per the guidelines
issued in this regard. Out of the available vacancies, posts will also be
reserved for women candidates as per the Madhya Pradesh Civil Services (Special
Provisions for the Appointment of Women) Rules, 1997.
(3)
In
filling vacancies so reserved, candidates who are members of the Scheduled
Castes, Scheduled Tribes and Other Backward Classes shall be considered for
appointment in the order in which their names appear in the list referred to in
rule 12 without considering their relative position in comparison to other
candidates.
(4)
If
sufficient numbers of candidates belong to Scheduled castes, Scheduled Tribes
candidates are not available for filling all the vacancies reserved for them,
the remaining vacancies shall not be filled by other candidates in any way.
(5)
The
Provisions for reservation for physically challenged persons as declared by the
Government shall be horizontal and compartment-wise.
(6)
According
to the provision issued by the General Administration Department in circular
number F-07-11/2019/vk-iz-/1 dated July 02, 2019, ten percent of the number of
persons required to be filled by direct recruitment will be reserved for
Economically Weaker Sections (EWS).
Rule - 12. List of candidates recommended by the Commission.
(1)
The
commission shall prepare and forward a list to the Government arranged in order
of merit of the candidates, who have qualified by such standard as determined
by the commission and a list of the candidates belonging to the Scheduled
Castes, Scheduled Tribes and Other Backward Classes, who though not qualified
by that standard, but are declared by the commission to be suitable for
appointment to the service with due regard to the maintenance of efficiency in
administration. The list shall also be published for general information.
(2)
Subject
to the provisions of these rules and the Madhya Pradesh Civil Services (General
Conditions of Service) Rules, 1961, candidates shall be considered for
appointment to the available vacancies from the list in order in which their
names appear in the list,
(3)
The
inclusion of a candidate's name in the list confers no right to appointment
unless the Government is satisfied after such inquiry, as may be considered
necessary, that the candidate is suitable in all respect for appointment to the
service.
(4)
The
select list shall be valid for a period of one year from the date of issue.
Rule - 13. Probation.
Every person directly recruited to the
service shall be appointed on probation for a period of two years.
Rule - 14. Eligibility conditions and criteria for selection (appointment) on the posts of Public Health Management Cadre/Specialist Cadre/Doctor Cadre by kramonnat pay scale.
(1)
Those
officers will be eligible for selection (appointment) in the higher pay scale
Lo the post of service mentioned in column (3) from the post held in column (2)
of Schedule IV (A), who have been taken into consideration by the selection
committee prescribed in column (5) of Schedule IV (A), and have completed the
period of service as prescribed in column number (4) of Schedule IV (A) as on
1st January of the year to be selected.
Explanation: Method for computation of
eligibility for selection - The computation of qualifying service shall be
calculated in the relevant year in which the departmental committee is
convened. The period of qualifying service on 1st January shall be calculated
form beginning of the calendar year in which the public servant came into the
feeder cadre/part of the service/pay scale of post and shall not be calculated
from the date in which he joined the cadre/part of service/pay scale of post.
However, any junior member of the service on the basis of years of service
completed by him under these rules shall not be eligible for appointment before
a senior person in a higher pay scale of service.
(2)
If
the Appointing Authority considers it necessary to amend the list received from
the committee, then he shall intimate the proposed change to the committee and
after considering the comments of the committee, if any, shall approve the list
with such amendments, as he declares appropriate and justified.
(3)
The
basis of selection will be as per the manner mentioned in column (4) of
Schedule-IV (A), the selection list as above will be prepared keeping in view
the vacancies arising for the next one year. After the approval of the
selection list by the State Government, the appointment will be made on the
basis of availability of posts in the higher pay scales of the service from the
approved select list.
(4)
The
criteria for selection will be as follows:-
(1)
The
officers concerned should have completed their probation period.
(2)
The
integrity of the concerned officers should be certified.
(3)
No
departmental inquiry/Lokayukta case/EOW/unauthorized absentee cases should be
under consideration and no criminal case should be registered against the
concerned officers.
(4)
Officers
retired/deceased/resigned before the date of selection process will not be
considered for selection.
(5)
For
the selection of the class I to the class I post mentioned in schedule IV (A)
on the basis of the overall evaluation of the confidential report of the
previous years according to the period mentioned in column number (4) of
schedule IV (A), the minimum Marks will be fixed. In case the confidential
report of the desired period is not available, the confidential report of the
prior one or two years can be considered.
(6)
In
the event of non-agreement on the grading of the accepting officer in the
confidential reports, the committee may again take a decision to upgrade by 1
mark or downgrade by 1 mark after overall evaluation of the annual confidential
reports.
(7)
The
officers whose annual confidential reports are not received at the time of
consideration for selection, may be kept for circulation.
(8)
If
disciplinary proceedings/criminal cases are pending against any officer, the
Committee shall, without any discrimination, keep its recommendation in a
sealed cover in respect of those officers, irrespective of their disciplinary
proceedings/criminal case. On completion of pending disciplinary
proceedings/criminal case and if found completely free from conviction, action
will be taken after opening seal cover. If any such officer is punished, then
as per memorandum, no C-6-1/90/3/49, dated 30.06.1994 of General Administration
Department recommendation of sealed cover will not be opened their name will be
considered in the next regular departmental selection committee.
(9)
For
selection to the post of Specialist (First Class) from Medical Officer (Second
Class) Calculation of qualifying service duration after Post Graduate
Degree/Post Graduate Diploma next 02 years/03 years will be counted excluding
the calander year of passing Post Graduate Degree/Post Graduate Diploma.
(10)
For
selection to the post of Specialist (Class I) from Medical Officer (Class II),
02 years of regular service after postgraduate degree and 03 years of regular
service after postgraduate diploma is mandatory.
(11)
For
the Medical officers (Class II) who are in the zone of consideration for the
post of Specialist (Class I), Annual Confidential Report of the last 02 years
will be considered for the Degree Holders in the subject specialization and
Annual Confidential Report of the last 03 years will be considered for the
diploma holders in the subject specialization.
(12)
The
overall grading marks for selection to the Specialist posts for degree-holding
medical officers will be 04 and for diploma-holding medical officers will be
06. If the Confidential Report of required years is not available, then out of
the available Annual Confidential Reports, the Annual Confidential Reports of
the previous one or two years will also be considered.
(13)
The
officers who will be selected for the next post, it will be mandatory for them
to take charge at the new posting place within 15 days after the issuance of
the order. Otherwise, the issued selection order will be cancelled and such
officers will not be taken for consideration in the next selection process (for
once).
(14)
The
Selection Committee may from time to time include necessary points in the
criteria of selection as per the requirement.
Rule - 15. Appointment by promotion - (For non-medical posts).
(1)
A
Promotion Committee shall be constituted, consisting the members mentioned in
column (5) of Schedule IV (B) for promotion of eligible members of the service.
(2)
As
per the instruction issued by General Administration Department from time to
time the Committee Shall consider the case of all persons for the posts
mentioned in column (3) of Schedule IV (B) from the posts mention in column (2)
of the respective row.
(3)
Certification
by Appointing Authority :- Appointing Authority shall endorse a certificate to
the effect that the promotion order complies with the Madhya Pradesh Public
Service (Reservation for Scheduled Tribes and Other Backward Classes) Act, 1994
(No. 21 of 1994) and instruction under the provisions of the rules issued by
General Administration Department, from time to time.
(4)
The
Committee Shall meet at such intervals as directed by the Appointing Authority,
but the committee ordinarily shall meet at least twice in a year.
Rule - 16. Conditions for eligibility for promotions.
(1)
The
Committee shall consider the case of all persons in accordance with provisions
of promotion policy issued by the Government form time to time, who on the 1st
day of January of that year have completed the number of years (Whether
officiating or substantive) of service as mentioned in column (4) of
Schedule-IV (B);
Provided that no person junior in service
shall be considered for promotion only on the basis of completing the
Qualifying length of service prior to that of his seniors.
Explanation:- Method for computation of
eligibility for promotion:- The computation of qualifying service shall be
calculated in the relevant year, in Which the meeting of the Committee is
convened, the period of qualifying service on 1st January shall be calculated
form the beginning of the calender year in which the pubic servant came into
the feeder catre/part of the service/pay scale and shall not be calculated from
the date of commencement in the cadre/part of service/pay scale of post.
Rule - 17. Preparation of the List of the suitable candidate.
(1)
The
committee shall prepare a list of such persons who fulfils the conditions
prescribed in rule 15 and 16, and are held suitable by the Committee for
promotion to the service. The list shall be sufficient to cover the existing
and anticipated vacancies on account of retirement and promotion during the
course of one year from the date of preparation of the select list. A reserved
list equivalent to 25% of anticipated vacancies shall be prepared to fulfil the
unforeseen vacancies occurring, during the course of aforesaid period.
(2)
Selection
for including names in such a list shall be based on merit with proper
consideration of seniority and suitability in all respects.
(3)
The
names of the officers included in the list shall be arranged in an order of
seniority as specified in column (2) of Schedule IV (B) at the time of
preparation of such select list.
Explanation : A person, whose name is
included in the select list but is not promoted during the validity of the list
shall have no claim to the seniority over those considered in a subsequent
selection merely by the fact of his earlier selection.
(4)
The
list so prepared shall be reviewed and revised every year on the basis of
merit. If in the process of selection, review or revision, as the case may be,
it is proposed to supersede any member of the Service, the Committee shall
record its reasons for the proposed suppression.
Rule - 18. Select list.
(1)
The
final selection list shall be finally approved by the Appointing
Authority/Government from the select list for promotion of the members of
Service from the post mentioned in column (2) of Schedule-IV (B). The select
list shall be valid for a period of one year unless its review of revision
takes place under sub-rule (4) of rule 17, in any case the validity shall not
be extended beyond a period of 18 months in total from the date of approval:
provided that in the event of a grave lapse
in the conduct of performance of duties on the part of any person included in
the select list a special review of the select list may be made at the instance
of the Appointing Authority and the Committee may, if it thinks fit, May remove
the name of such member from the select list.
(2)
If
the Appointing Authority considers it necessary to make any change in the list
received from the committee, then it shall intimate the proposed change to the
committee and after taking into account the comments, if any, may approve the
list finally with such modifications if any, as may in its opinion be just and
proper.
(3)
Every
person appointed to the service by promotion shall be appointed on the
probation for a period of two years, if the work is not found satisfactory in
the probation period, the Government may extend the period up to one year.
After this period, if the work is not found satisfactory, he may be deprived
from promotion. Decision of Government in this regard shall be final.
(4)
Appointment
of the persons included in the select list to the post borne on the cadre of
the service shall follow the order in which the names of such persons appear in
the select list.
Rule - 19. Consultation with the commission.
In relation to the recommendation of the
committee it shall be deemed to have consulted the commission as per
sub-section (b) of section (3) of the Article 320 of the constitution, and no
separate consultation is required with the commission.
Rule - 20. Interpretation.
If any question arises relating to the
interpretation of these rules, it shall be referred to the Government, whose
decision thereon shall be final.
Rule - 21. Relaxation.
Nothing in these rules shall be construed to
limit or abridge the powers of the Governor to deal with the case of any person
to whom these rules shall apply in such manner as may appear to him to be it to
just and equitable:
Provided that no case shall be dealt with any
manner less, favourable to him than, that provide in these rules.
Rule - 22. Saving.
Nothing contained in these rules, shall
effect the reservation, relaxation and other conditions required to be provided
for the Scheduled Castes, Scheduled Tribes and Other Backward Classes in
accordance with the orders issued by the State Government from time to time in
this regard.
Rule - 23. Repeal.
All rules corresponding to these rules and in
force immediately before commencement of these rules are hereby repealed and in
respect of matters covered by these rules.
Provided that any order made or any action
taken under the rules so repealed shall be deemed to have been made or taken
under the corresponding provision of these rules.

(1) In Case of no departmental
enquiry and legal case and On the recommendation of Screening/Selection

2. In the event of

3 For the post of

(2) Medical officers
having degree/diploma in pediatrics or degree/diploma in preventive and social

provision.
(3) By adding new
provisions to the Medical Officer having degree/diploma in the subject of
Tuberculosis, only one time will be eligible for selection to the post of
Superintendent Tuberculosis Hospital or Director Tuberculosis Demonstration and
Training Center Bhopal as per the rules provided earlier.
(4) Before the
selection process on the posts mentioned at serial number (1) to (3), option
will be obtained from the Medical Officer for only one time as to which cadre
he wants to be selected, in the medical cadre or in the Public Health
Management cadre.
