THE MADHYA PRADESH KRISHIK PASHU PARIRAKSHAN (SANSHODHAN) ADHINIYAM, 1991

PREAMBLE

An Act further to amend the Madhya Pradesh Krishik Pashu Parirakshan Adhiniyam, 1959.

Be it enacted by the Madhya Pradesh Legislature in the Forty-second Year of the Republic of India as follows:-

Section 1 - Short title

This Act may be called the Madhya Pradesh Krishik Pashu Parirakshan (Sanshodhan) Adhiniyam, 1991.

Section 2 - Amendment of Section 4

For sub-section (1) of Section 4 of the Madhya Pradesh Krishik Pashu Parirakshan Adhiniyam, 1959 (No. 18 of 1959) (hereinafter referred to as the Principal Act), the following sub-section shall be substituted, namely:-

"(1) Notwithstanding anything contained in any other law for the time being in force or in any usage or custom to the contrary, no person shall slaughter or cause to be slaughtered or offer or cause to be offered, for slaughter-

(a)      cow, calf or cow, calf of she-buffalo, bull or bullock; and

(b)      any other agricultural cattle unless he has obtained in respect of such cattle a certificate in writing issued by the Competent Authority for the area in which the cattle is to be slaughtered that the cattle is fit for slaughter"

Section 3 - Amendmnt of Section 6

In Section 6 of the Principal Act, for the words "agricultural cattle other than cow or calf of cow" the words "cow, calf of cow, calf of she-buffalo, bull or bullock" shall be substituted.

Section 4 - Amendment of Section 6-A

In Section 6-A of the Principal Act, for the words "cow or calf of cow" the words "cow, calf of a cow, calf of she-buffalo, bull or bullock" shall be substituted.

Section 5 - Amendment of Section 6-B

In Section 6-B of the Principal Act,-

(a)      in sub-section (1),-

(i)       for the words "cow or calf of cow" the words "cow, calf of cow, calf of she-buffalo, bull or bullock" shall be substituted;

(ii)      for the words "cows and calf of cows" the words "cow, calf of cow, calf of she-buffalo, bull or bullock" shall be substituted;

(iii)     for the words "cows or calves of cows for which the permit for export is required" the word "it" shall be substituted;

(b)       in sub-section (2) for the words "cows or calves of cows" occurring twice the words "cow, calf of cow, calf of she-buffalo, bull or bullock" shall be substituted.

Section 6 - Substituted of Section 6-C

For Section 6-C of the Principal Act, the following Section shall he substituted, namely:-

"6-C. Special Permits

The State Government may issue special permits for transport or export of cow, calf of cow, calf of she buffalo, hull or bullock if it is of the opinion that it will be in the public interest to do so.".

Section 7 - Amendment of Section 7

In Section 7 of the Principal Act,-

(a)      for the marginal heading, the following marginal heading shall be substituted, namely:-

"Prohibition of purchase, sale or any other manner of disposal of cow, calf of cow, calf of she-buffalo, bull or bullock";

(b)       for the words "cows, calves of cows or calves of she-buffaloes", the words "cow, calf of cow, calf of she-buffalo, bull or bullock" shall be substituted.

Section 8 - Amendment of Section 9

In sub-section (3) of Section 9 of the Principal Act,-

(a)      in clause (a), for the words "cows or calves of cows" the words "cow, calf of cow, calf of she-buffalo, bull or bullock" shall be substituted;

(b)      in clause (b), for the words "cows or calves of cows" occurring twice and for the words "cows or calves of cows", the words "cow, calf of cow, calf of she-buffalo, bull or bullock" shall respectively be substituted.

Section 9 - Amendment of Section 17

In Section 17 of the Principal Act, the words "religious" shall be omitted.
