Lead Stabilizer in Polyvinyl Chloride (PVC) Pipes and Fittings Rules,
2021[1] [30th March, 2021] Now, therefore, in exercise of the powers conferred by Section 3 and
Section 6 of the Environment (Protection) Act, 1986 (29 of 1986), read with
Rule 13 of the Environment (Protection) Rules, 1986, the Central Government
hereby makes the following rules, namely:— (1)
These
rules may be called the Lead Stabilizer in Polyvinyl Chloride (PVC) Pipes
and Fittings Rules, 2021. (2)
They
shall come into force six months after the date of their publication in the
Official Gazette. (1)
Every
manufacturer and importer, of the PVC pipes and fittings falling in category A,
B and C of the Schedule, shall ensure to comply with the limits of the lead
extraction, as specified for the Indian Standards by the Bureau of Indian
Standards (BIS) and the same is [2][provided
in column (4)] of the said Schedule. (2)
[3][(i) The manufacturer shall submit water test report of pipes and
fittings carried out by authorised agencies for testing as per sub-rule (1) of
Rule 4, to respective State Pollution Control Board or Pollution Control
Committee in accordance with the consent to operate granted by respective State
Pollution Control Board or Pollution Control Committee subject to the provision
of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974): Provided that the manufacturer having valid licence from Bureau of
Indian Standards for manufacturing of all such Polyvinyl Chloride Pipes and
Fittings, and having all such Polyvinyl Chloride Pipes and Fittings marked with
“Standard Mark” in accordance with the specification provided in the Licencse
issued by the Bureau of Indian Standards, shall be exempted from submission of
such test report. (ii) Every manufacturer and every importer of Polyvinyl Chloride Pipes
and Fittings for every product under the respective Category A, B, and C
specified in the Schedule shall comply with the conditions mentioned in that
Schedule with respect to IS code of Bureau of Indian Standard or equivalent
which are presently available or shall be developed in the future. Explanation. For the purposes of this rule and Rule 3, “manufacturer”
means manufacturer of Polyvinyl Chloride Pipes and Fittings situated within the
territory of India or outside the territory of India.] (3)
The
manufacturer of PVC pipes and fittings shall be prohibited to use lead or lead
compounds as stabilizer in manufacturing of such PVC pipes and fittings as
provided in column (2) of the Schedule for trade in the country, from the date
as specified in column (4) of the said Schedule. (4)
No
importer of the PVC pipes and fittings shall be allowed to import such PVC
pipes and fittings manufactured using lead or lead compounds as stabilizer for
the items specified in column (2) of the Schedule after expiry of three months
from the date of publication of these rules. (1)
The
State Pollution Control Board (SPCB) and Pollution Control Committee (PCC)
concerned shall be the Nodal Agency for implementation and enforcement of the
provisions of these rules in their respective State or Union Territories. (2)
Every
dispute or issue relating to the implementation of these rules shall be
referred to the Nodal Agency. (3)
[4][A Panel including a representative from manufacturer] may be
constituted by the Nodal Agency for the purpose of implementation of these
rules and to resolve any dispute or issue relating to these rules. [5][(1) The Laboratories accredited by National Accreditation Board for
Testing and Calibration Laboratories shall be authorised to carry out such
tests as are necessary to ascertain the compliance of Rule 2]. (2) Every
manufacturer and importer of the PVC pipes and fittings, falling under Category
A, B and C in the Schedule, shall produce such PVC pipes and fittings for
testing before the laboratories as specified in sub-rule (1), to ensure the
compliance of Rule 2. (3) Every
manufacturer and importer shall submit the test reports to the Nodal Agency and
the BIS for verification and any action, as may be required. (4) The
Nodal Agency shall furnish a comprehensive report on the status of
implementation and enforcement of the provisions of these rules to the Central
Pollution Control Board (CPCB) in every six months. Sale and import of the PVC Pipes and Fittings falling under category A,
B and C in the Schedule shall be regulated through this notification, except
