KARNATAKA SELECTION OF CANDIDATES FOR ADMISSION TO PROFESSIONAL INSTITUTIONS RULES, 2005

 

PREAMBLE

Whereas, it is considered necessary to make certain modifications in the Karnataka Selection of Candidates for Admission to Professional Institutions Rules, 2004. Therefore, in exercise of the powers conferred by sub-section (1) of Section 14 of the Karnataka Educational Institutions (Prohibition of Capitation Fee) Act, 1984 (Karnataka Act 37 of 1984), the Government of Karnataka hereby makes the following rules/namely.

Rule - 1. Title, commencement and application.

(1)     These rules may be called the Karnataka Selection of Candidates for Admission to Professional Institutions Rules, 2005.

(2)     These rules shall come into force from the date of their publication in the Official Gazette.

(3)     These rules shall apply to the selection of candidates for admission to the following courses, namely.

(A)     In Medical and Dental Institutions, to the first year of.

(a)      Bachelor of Medicine and Bachelor of Surgery; and

(b)      Bachelor of Dental Surgery.

(B)     In the Indian Systems of Medicine and Homoeopathy Institutions to the first year of.

(a)      Bachelor of Ayurvedic Medicine and Surgery;

(b)      Bachelor of Unani Medicine and Surgery;

(c)      Bachelor of Naturopathy and Yoga; and

(d)      Bachelor of Homoeopathic Medicine and Surgery.

(C)     In Engineering Institutions, to the First Year, First Semester and in respect of Diploma holders to the Second Year, Third Semester (in the case of Architecture course First Year, First Semester) of both full- time and part-time courses in.

(a)      Bachelor of Engineering;

(b)      Bachelor of Technology; and

(c)      Bachelor of Architecture.

Rule - 2. Definitions.

In these rules, unless the context otherwise requires.

(a)      "Admission Centre" means, a centre at which selection and allotment of candidates to various courses in Professional Institutions are made;

(b)      "Aided Institution" means, any institution, which receives Grant-in-Aid from the Government, but does not include a course of study, which does not receive Grant-in-Aid in such institution;

(c)      "Candidate" means, an applicant to the Common Entrance Test seeking allotment of a seat in professional institution as per the academic eligibility;

(d)      "Casual Vacancy" means, unfilled, surrendered, forfeited or newly added seat available after completion of the seat selection round;

(e)      "Committee" means, the Common Entrance Test Committee constituted under sub-rule (1) of Rule 5;

(f)       "Director" means, the Director of Technical Education or Director of Medical Education or Director of Indian Systems of Medicine and Homoeopathy, in Karnataka, as the case may be;

(g)      "Entrance Test" means, the Common Entrance Test conducted under these rules;

(h)     "Ex-serviceman" means, a person who has served in any rank whether as a combatant in the regular Army, Navy or Air Force of the Indian Union; and

(i)       who retired from such service after earning his pension; or

(ii)      who has been released from such service on medical ground attributable to military service or circumstances beyond his control and awarded medical or other disability pension; or

(iii)     who has been released, otherwise than on his own request, from such service as a result of reduction in establishment; or

(iv)    who has been released from such service after completing the specific period of engagement, otherwise than at his own request or by way of dismissal or discharge on account of misconduct or inefficiency and has been given a gratuity, and includes personnel of the territorial army of the following categories, namely.

(a)      pension holders for continuous embodied service;

(b)      pension holder with disability attributable to military service; and

(c)      gallantry award winners,

excluding Defence security Corps, General Reserve Engineering Force, the Lok Sahayak Sena and the Para Military Territorial Army other than those in sub-clause (iv):

Provided that a person who has served for not less than five years and was honorably discharged prior to 1st July, 1987, shall also be considered as an Ex-serviceman.

(i)       "Gadinadu Kannadiga" means, a candidate whose mother tongue is Kannada or Tulu or Kodava and who resides in Kannada speaking areas of South Sholapur or Akkalakot or Jath or Gadhinglaj Taluk of Maharashtra State or Kasargod Taluk of Kerala State;

(j)       "Government" means, the Government of Karnataka;

(k)      "Government seat" means, the seats in Government/University colleges and also the seats coming under the Government quota in Aided and Un-aided institutions as specified by Government notification;

(l)       "Horanadu Kannadiga" means, a candidate whose mother tongue is Kannada or Tulu or Kodava and who is residing outside the State of Karnataka, as on 1st May of the year in which the Common Entrance Test is held, such candidates, having passed the qualifying examination from an University or Board or any other institution located outside Karnataka;

(m)    "Indian Systems of Medicine" means, Ayurveda, Naturopathy and Yoga and Unani Systems of Medicine;

(n)     "Institution" means, any institution or college affiliated to any University in Karnataka and carrying on the activity of imparting education in Medicine, Dentistry, Indian Systems of Medicine, Homoeopathy, Engineering, Technology and Architecture Courses;

(o)      "Intake" means, the sanctioned strength of a course in an institution fixed by the authority competent to fix such intake;

(p)      "Management Seat" means, the seats specified as such by Government Notification;

(q)      "Merit" means, merit as determined under Rule 7;

(r)      "Pre-University Examination" means, the Second year Pre-University Examination conducted by the Department of Pre-University Education in the State of Karnataka;

(s)      "Professional Institution" means, an institution imparting instructions in Medical, Dental, Ayurvedic Medicine and Surgery, Naturopathy and Yoga, Unani Medicine and Surgery, Homoeopathic Medicine and Surgery, Engineering, Technology and Architecture courses, as the case may be and affiliated to any University in Karnataka;

(t)       "Qualifying Examination" means, 

(i)       2nd year Pre-University Examination or any other qualifying examination, declared as equivalent by the Government, for admission to first year Bachelor of Medicine and Bachelor of Surgery, Bachelor of Dental Surgery, Bachelor of Ayurvedic Medicine and Surgery, Bachelor of Naturopathy and Yoga, Bachelor of Unani Medicine and Surgery, Bachelor of Homoeopathic Medicine and Surgery, Bachelor of Engineering, Bachelor of Technology and Bachelor of Architecture courses.

(ii)      Three years Diploma Examination of the Board of Technical Examination" in Karnataka or any other qualifying examination, declared as equivalent by the Government, for admission to Second Year, Third Semester of Bachelor of Engineering, Bachelor of Technology, First Year, First Semester Bachelor of Architecture, in full-time and part-time degree courses;

(u)     "Schedule" means, a Schedule appended to these rules;

(v)      "Seat Matrix" means, statements showing college-wise, course-wise and category-wise break-up of seats as notified by the Government for the academic year;

(w)     "Special Officer" means, an officer belonging to Indian Administrative Service, appointed by the Government, in connection with conduct of Common Entrance Test and Regulation of all matters pertaining to seat selection and admission to the courses;

(x)      "Unaided Institution" means, any privately managed institution, which is not receiving Grant-in-Aid from the Government,

Rule - 3. Academic Eligibility.

(1)     A candidate who appears either for the Common Entrance Test conducted by the CET Cell or by the Association of Professional Colleges/Institutions shall be eligible for admission to any of the full time degree courses specified in sub-rule (3) of Rule 1, if he

(a)      is a citizen of India; and

(b)      has passed the Second year Pre-University or XII standard or equivalent examinations preceding the Entrance Test.

(i)       with Physics, Chemistry and Biology as optional subjects and English as one of the languages for Medical, Dental, Indian Systems of Medicine and Homoeopathy and has secured not less than fifty per cent of the aggregate marks in the optional subjects in respect of Medical, Dental, Ayurveda, Naturopathy and Yoga, Unani and Homoeopathy courses or as revised by the respective academic Councils from time to time;

(ii)      with Mathematics and English as subjects and has secured fifty per cent of the aggregate marks in all subjects for Architecture Course or as revised by the Architecture Council of India from time to time and shall take an Aptitude Test conducted by the CET Cell;

(iii)     with Physics and Mathematics as compulsory subjects, along with one of the following subjects. Chemistry, Bio-Technology, Computer Science, Biology, Electronics and has secured not less than thirty-five per cent of the aggregate marks in the optional subjects with English as one of the languages, in respect of Engineering and Technology courses or as revised by the All India Council for Technical Education from time to time:

Provided that the minimum marks for the purpose of eligibility shall be forty per cent of the aggregate in the optional subjects in case of candidates belonging to the Scheduled Castes, Scheduled Tribes and Category I of other Backward Classes specified in the relevant Government Order for the purpose or reservation in respect of Medical, Dental, Indian Systems of Medicine, Homoeopathy and forty per cent of the aggregate marks in ell subjects in respect of Architecture course:

Provided further that, for Dental course the candidate must have secured fifty per cent marks in English language and in case of the candidate belonging to the Scheduled Castes, Scheduled Tribes and Category 1 of other Backward Classes forty per cent; and

(c)      has appeared for the three subjects viz., Physics, Chemistry and Biology in respect of Medical, Dental, Indian Systems of Medicine, Homoeopathy courses or Physics, Chemistry and Mathematics in respect of Engineering and Technology Courses, in the Common Entrance Test conducted under these Rules; and

(d)      has completed 17 years of age as on 31st December of the year of admission, for admission to Medical, Dental, Indian Systems of Medicine and Homoeopathy courses:

Provided that no candidate who has obtained a seat in any discipline through the CET cell in any previous year shall be eligible to appear for the Common Entrance Test conducted by the CET Cell for selection of a seat in the same discipline.

(2)     A candidate shall be eligible for admission to any of the full-time degree courses specified in clause (C) of sub-rule (3) of Rule 1, if he is a holder of diploma in the appropriate branch of Engineering specified in Schedule I, awarded by the Board of Technical Examination in Karnataka or equivalent qualification and has passed in the final year examination and in respect of Architecture shall have secured not less than fifty per cent of the marks in the final year Diploma examination.

(3)     No candidate shall be eligible for admission to part-time course in Second Year, Third Semester of Bachelor's degree in Engineering, Technology, unless he.

(a)      is a holder of 'Diploma' in appropriate branch of Engineering specified in the Schedule I granted by the Board of Technical Examination in Karnataka and has passed in the final year examination; and

(b)      has on the first September of the year of admission, not less than one year Professional experience in the branch of Engineering, Technology in which the candidate holds a diploma, after passing diploma course.

Explanation. Professional experience means.

Employed on a regular basis.

(a)      in Government, Government undertaking, Public Sector Undertaking, Corporation; or

(b)      in a private concern registered under the Directorate of Industries and Commerce or the Directorate of Small Scale Industries; or

(c)      in a Private Limited Company; or

(d)      in Government, Government recognised institutions as technical staff;

Provided that the period of apprenticeship undergone shall also be treated as professional experience, if sponsored by the Board of Apprenticeship Training, Southern Region, Chennai:

Provided further that, employment shall be in an establishment situated within the urban agglomeration of the city in which the professional institution is situated.

Rule - 4. Eligibility for Government Seat.

Government seats shall be filled by candidates who satisfy one of the following conditions, namely.

(i)       A candidate should have studied and passed in one or more Government or Government recognised Educational Institutions located in the State of Karnataka for a minimum period of SEVEN academic years commencing from 1st Standard to II PUC or 12th standard as on 1st July of the year in which the Common Entrance Test is held and should have appeared and passed SSLC or 10th Standard or 12th Standard or equivalent examination from institutions located in the State of the Karnataka:

Provided that in the case of a candidate who takes more than one year to pass a class or standard, the years of academic study is counted as one year only;

(ii)      A candidate should have studied and passed I and II year Pre-University Examination or equivalent examination, within the Slate of Karnataka from an educational institution run or recognised by the State Government and that either of his parents should have studied in an educational institution run or recognised by the State Government and located in the State of Karnataka for a minimum period of SEVEN years;

(iii)     The candidate is a Horanadu Kannadiga:

Provided that the candidate shall undergo a simple Kannada language test conducted by the CET Cell to prove his or her ability to speak, read and write Kannada;

(iv)    The candidate is a Gadinadu Kannadiga:

Provided that the candidate shall undergo a simple Kannada language test conducted by the CET Cell to prove his or her ability to speak, read and write Kannada;

(v)      In the case of a candidate whose parent is a defence personnel who worked continuously in Karnataka for a minimum period of one year as on any day from 1st July of the previous year to 30th June of the year of admission, the candidate should have studied and passed the qualifying examination from any Government pr Government recognised institutions located in Karnataka;

(vi)    A candidate, whose parent is a serving defence personnel, who at the time of joining the defence service had declared the hometown, as a place in the State of Karnataka, proof of such domicile having been produced by obtaining the extract from the record office of the Defence Unit;

(vii)   A candidate, whose parent is a defence personnel who had served in Karnataka for at least one year and is posted on duty directly to the disturbed areas of Jammu and Kashmir or North-East and whose family is permitted by the Defence Authorities to continue to stay in Karnataka and such candidate has studied and passed the qualifying examination from any Government or Government recognised institution located in Karnataka;

(viii)  A candidate, whose parent is an Ex-serviceman, who at the time of joining the defence service had declared a place in Karnataka as the hometown, proof of such domicile having been produced from the Rajya Sainik Welfare Board.

(ix)    In the case of a candidate whose parent is an employee of the Union or Karnataka State Government undertaking or a joint sector undertaking, is liable to transfer anywhere in India as per terms and conditions of employment, has worked continuously for at least one year in Karnataka from 1st July of the previous year to 30th June of the year of admission and such candidate has studied and passed the qualifying examination from any Government or Government recognised educational institution located in Karnataka.

(x)      A candidate whose parent is a working or retired employee of the Union Government or employee of Union or Karnataka State Government undertaking or Joint Sector undertaking where such employee.

(a)      had declared to the employer at the time of joining any place in Karnataka to be his hometown; and

(b)      had studied in any Government or Government recognised educational institutions located in Karnataka for not less than seven years; and

(c)      was or is liable for transfer anywhere in India as per the terms and conditions of employment

(xi)    A candidate whose parent is a Member of Parliament elected from Karnataka;

(xii)   A candidate whose parent is a serving or retired employee.

(a)      belonging to All India Service of Karnataka Cadre; or

(b)      of the Government of Karnataka who has served or is serving outside the State of Karnataka, during the period corresponding to the candidate's study outside the State from 1st standard to II PUC or 12th Standard examination:

Provided that notwithstanding any thing contrary contained in this rule, in case of a candidate who is a Diploma holder seeking admission to the third semester, second year, full-time and part-time degree courses mentioned in Schedule I, he must have.

(i)       studied and passed final year Diploma as on 1st July of the year in which admission is sought, in one or more Government or Government recognised educational institutional institutions located in the State of Karnataka; and

(ii)      studied for seven academic years from 1st standard to final year diploma in one or more Government or Government recognised educational institutions located in the State of Karnataka; or

(iii)     either of the parents should have studied in institutions run or recognised by the State Government located in Karnataka for a minimum period of seven years.

Rule - 5. Constitution of Common Entrance Test Committee.

(1)     The Government shall constitute the Common Entrance Test Committee, which shall consist of.

(a)

Vice-Chancellor of either Rajiv Gandhi University of Health Sciences or Vishveshwaraiah Technological University, nominated by the Government

Chairperson

(b)

Director of Medical Education

Member

(c)

Director of Technical Education

Member

(d)

Director of Indian Systems of Medicine and Homoeopathy

Member

(e)

Two persons nominated by the Government of whom:

 

 

(i) one shall be the principal of a college run recognised by the Government; and

 

 

(ii) Professor of a University

Members

(f)

Special Officer, Common Entrance Test Cell

Member-Secretary

(2)     The Committee shall conduct the Common Entrance Test.

(3)     The Chairperson shall preside over the meetings.

(4)     The Committee shall take decisions from time to time on the following aspects;

(a)      pattern of question papers, which shall be in English or in Kan-nada and which shall be of objective type;

(b)      fixing up of maximum marks for each paper;

(c)      fixing up of duration of the test for each of the papers;

(d)      syllabus contents, as far as may be within the syllabus of I and II years Pre-University Course of Karnataka and the questions shall be to elicit the aptitude of the candidate;

(e)      general guidelines and directions in regard to all matters connected with the conduct of the test.

(5)     The Committee shall have the power to accord approval on the following matters, namely,

(a)      location of test centres for conducting the Entrance Test;

(b)      fixing of timetable and calendar for conducting the Entrance Test;

(c)      appointment of Chief Superintendent, Deputy Chief Superintendents for each examination centre;

(d)      appointment of Supervisors and invigilators for each centre of the examination;

(e)      payment of remuneration for different items of work connected with conducting of the Common Entrance Test and the Seat Selection;

(f)       requiring the production of such particulars or documents or papers by the candidates, as may be deemed necessary from time to time;

(g)      preparation and publication of the merit lists of the Entrance Tests for Medical, Dental, Indian Systems of Medicine and Homoeopathy and Engineering, Technology, Architecture courses;

(h)     the expenditure incurred from time to time by the CET Cell;

(i)       approval of the accounts of CET Cell;

(j)       any other matters as may be referred to it by the Member-Secretary, Chairman or Government from time to time.

(6)     The Member-Secretary shall act on the instructions of the Committee and shall follow the directions of the Government in discharging the duties in connection with the conduct of Entrance Test. The Member-Secretary shall be responsible for conducting of the Entrance Test, Seat Selection and all incidental matters thereto. The Member-Secretary shall have the following powers, namely.

(a)      printing of application forms, brochure containing instructions to candidates, admission tickets and various other registers, forms, cards etc;

(b)      placing orders relating to application format, instructions to candidates and other details on the CET website;

(c)      issuing the notifications regarding the holding of the Common Entrance Test;

(d)      sale and receipt of Entrance Test application-cum-brochure and issuing of admission tickets through schools and colleges where the students are studying or studied 12th standard or qualifying examination in the State of Karnataka and through speed post to the candidates from outside the State of Karnataka;

(e)      arrange for confidential printing of question papers and transport to District Treasury or Sub-Treasury for safe storage;

(f)       appointment of examiners for evaluation of answer scripts, if necessary;

(g)      arranging for computerization of data relating to the conduct of the Entrance Test, evaluation of the answers, determination of order of merit of the candidates, fixing the seat selection schedule, holding of the seat selection, issue of admission orders to the candidates etc.;

(h)     payment of remuneration to the personnel engaged in matters relating to the conduct of Entrance Test, Seat Selection and maintaining of accounts;

(i)       custody and maintenance of records of the Entrance Test and allotment process.

(7)     The Special Officer shall

(i)       be the Chief Executive of the CET Cell;

(ii)      outsource various tasks of CET Cell to the private agencies;

(iii)     exercise administrative, disciplinary control over the personnel of CET Cell and personnel engaged on contract;

(iv)    operate the Bank Accounts;

(v)      maintain books of accounts and other records;

(vi)    delegate duties and responsibilities to the staff;

(vii)   upon completion of the Entrance Test, seat selection and allotment, order disposal of the records of the entrance Test, Seat Selection and seat allotment and other records of the previous years;

(viii)  issue of admission orders and related records to the candidates under his signature and office seal;

(ix)    inquire into matters of allegations of malpractice, if any, during the period of the Entrance Test committed either by the candidates or personnel engaged as invigilators, Custodians, Observers, Deputy Chief Superintendent and personnel engaged in the matter of evaluation of answer scripts, matters relating to computerisation of Common Entrance Test data, personnel engaged in the matter of determination of merit order, rank, publications thereto, verification and acceptance of the records produced by the candidates or by their parents, selection of seats and issue of Admission Orders, refund of admission fee, etc.

(8)     The Deputy Commissioner of the district shall be the Chief Superintendent for all the Entrance Test Centres in the District. The Deputy Commissioner shall be in charge of matters relating to the conduct of the Entrance Test. The Deputy Chief Superintendent at each centre appointed by the Common Entrance Test Committee shall assist the Chief Superintendent. The Deputy Commissioner-cum-Chief Superintendent, shall be responsible for.

(a)      appointing observers not below the rank of an Assistant Commissioner for each centre, who shall report the irregularities etc., if any, noticed at the examination centre or by the examiners, candidates, others, to the Deputy Commissioner;

(b)      arranging the receipt and dispatch of the sealed packets of question papers, OMR answer sheets, their security; secrecy, safety and their safe storage in the District Treasury or Sub-Treasury;

(c)      arranging the physical facilities required for the conduct of the Entrance Test;

(d)      arranging for the conduct of the Entrance Test as per the directions and schedule notified by the Committee;

(e)      constituting a Committee of three officers not below the rank of Grade B, for the following purpose:

(i)       To receive the sealed bundles containing question papers and OMR answer sheets from the Route Officers appointed by the Member-Secretary;

(ii)      Storage of such sealed bundles at the District Treasury, Sub-Treasury;

(iii)     Handing over of the sealed bundles of Question Paper, OMR answer sheet, to the Deputy Chief Superintendent, Principal of the test centre on the day of the test;

(iv)    Collection of the sealed bundles containing used, unused OMR answer sheets and unused question papers from the test centres after completion of the Entrance Test on both days and their safe storage at the District Treasury, Sub-Treasury;

(v)      Handing over the sealed bundles containing used and unused OMR answer sheets and unused question papers to the designated officer appointed by the Member-Secretary;

(vi)    Such other duties and responsibilities as are required to be carried out from time to time.

(f)       such other matters as may be entrusted or required by the Special Officer.

(9)     Duties of Deputy Chief Superintendents and other staff shall be as may be specified by the Special Officer.

Rule - 6. Procedure for issue of application for Entrance Test etc.

The procedure for the selection of candidates for admission to Government Seats in Professional Institutions shall be as follows.

(1)     The Special Officer shall publish details regarding the conduct of Entrance Test on the notice board of the CET Cell, on the CET website and in such other places as he deems fit and also by giving publicity in Kannada and English Newspapers, having wide circulation in the State and call for duly completed application forms for taking the Entrance Test and admission to courses under these Rules.

(2)     The Special Officer shall publish on the notice board of the CET Cell and on the CET Website, the information with regard to the aided and unaided institutions and particulars of courses, the number of seats available, the names and location of the institutions, the fees payable, minimum eligibility conditions, reservation of seats, the method of seat selection and such other information, as he may consider necessary. The Special Officer shall notify on the notice Board, the certificates, affidavits, marks cards, academic records, eligibility certificate, etc., which shall be required to be produced by the candidates, at the time of seat selection.

(3)     A candidate 

(i)       claiming equivalence in qualifying examination, shall produce at the time of Seat Selection, a copy of the order in which such qualification has been declared equivalent to the Karnataka Pre-University Examination or the eligibility certificate issued by Rajiv Gandhi University of Health Sciences, in the case of applicant for Medical, Dental, Indian Systems of Medicine, Homoeopathy courses and by the Vishveshwaraiah Technological University, in the case of applicant for Engineering, Technology and Architecture courses;

(ii)      claiming qualification as equivalent to the Diploma conducted by the Board of Technical Examination in Karnataka, shall produce at the time of Seat Selection, a copy of the eligibility certificate issued by the Board of Technical Examination in Karnataka.

(4)     Application shall be duly filled as per the instructions in the Brochure issued along with the application. Applications received after the last date fixed for receipt of application or incomplete applications shall be rejected without any intimation to the candidate.

(5)     Relevant data of the applications shall be stored in the CET Cell.

Rule - 7. Determination of merit.

(1)     The merit of a candidate eligible for a Government seat shall be determined as follows.

(a)      For Medical, Dental, Indian Systems of Medicine and Homoeopathy courses, with reference to the marks obtained in the optional subjects in the Entrance Test and marks obtained in Physics, Chemistry and Biology subjects in the qualifying examination, taken in equal proportions;

(b)      For Engineering, Technology courses, with reference to the marks obtained in the optional subjects in the Entrance Test and marks obtained in Physics, Chemistry and Mathematics subjects in the qualifying examination, taken in equal proportions-Provided that in the case of a candidate eligible to Management seats specified in sub-rule (3) of Rule 12, merit shall be determined with reference to the marks obtained in the optional subjects in the entrance test only.

Provided that where the merit of two or more candidates is the same, the inter se merit shall be determined with reference to the marks obtained in the Common Entrance Test in Biology in the case of Medical, Dental, Indian Systems of Medicine and Homoeopathy courses and in Mathematics in the case of Engineering, Technology courses and where the marks obtained in such cases are equal then the inter se merit shall be determined on the basis of the marks obtained in Chemistry in the case of Medical, Dental, Indian Systems of Medicine and Homoeopathy courses and in Physics in the case of Engineering, Technology courses and where the marks obtained are equal again the inter se merit shall be determined on the basis of the marks obtained in respective subjects in the qualifying examination as stipulated above and where marks obtained are equal again, the inter se merit shall be determined on the basis of the age of the candidate, the elder candidate placed above the younger.

Explanation. For the purpose of this rule, optional subjects means, Physics, Chemistry and Biology for the courses specified in clauses (A) and (B) of sub-rule (3) of Rule 1 and Physics, Chemistry and Mathematics for the courses specified in sub-clauses (a) and (b) of clause (C) of sub-rule (3) of Rule 1.

(c)      for Architecture Course with reference to the marks obtained in the qualifying examination and the marks in the aptitude test conducted by the CET Cell, taken in equal proportions;

Provided that where merit of two or more candidates is same, the inter se merit shall be determined with, reference to the marks obtained in the aptitude test, where marks obtained in aptitude test is equal, then the inter se merit shall be determined on the basis of marks obtained in Mathematics in the qualifying examination and where marks obtained in Mathematics is equal, the inter se merit shall be determined on the basis of the age of the candidate, the elder candidate placed above the younger;

(d)      for Diploma holders for full-time and part-time courses in Engineering, Technology shall be prepared with reference to the marks obtained in the final year examination or final two semesters examination leading to Diploma in the relevant branch of Engineering specified in column (2) of the Schedule I (Internal assessment marks count for determination of merit in case of semester students where internal assessment marks are counted for declaring the Diploma result) and on the basis of Entrance Test conducted separately under Rule 13, taking the marks obtained in the qualifying examination and Entrance Test in equal proportions:

Provided that where the merit of two or more candidates is the same, the inter se merit shall be determined with reference to marks obtained in the entrance test and where the marks obtained in such cases are same then the inter se merit shall be determined with reference to marks obtained in the Second year/Third and Fourth Semester marks and where the marks obtained in such cases are same then the inter se merit shall be determined on the basis of the marks of the first year/first and second semester marks and where the marks obtained in such cases are same then the inter se merit shall be determined on the basis of the age of the candidate, the elder candidate shall be placed above the younger.

(e)      for Diploma holders for full-time Architecture course shall be prepared on the basis of the marks obtained in the final year examination or final two semesters examination leading to Diploma in the relevant branch of Engineering specified in column (2) of Schedule I. (Internal assessment marks count for determination of merit in case of semester students where internal assessment marks are counted for declaring the Diploma result) and on the basis of the marks obtained in the Aptitude Test conducted by the CET Cell taking the marks obtained in the qualifying examination and the Aptitude Test in equal proportions:

Provided that where the merit of two or more candidates is same, the inter se merit shall be determined with reference to the marks obtained in the aptitude test and where marks obtained is equal, then the inter se merit shall be determined on the basis of marks obtained in Second year, Third and Fourth semesters and where the marks obtained are equal then the inter se merit shall be determined on the basis of marks obtained in first year, first and second semesters and where the marks obtained are equal again then the inter se merit shall be determined on the basis of the age of the candidate, the elder candidate shall be placed above the younger.

(2)     The inter se merit determined for Government seats under sub-rule (1) shall be the basis for the merit list of candidates claiming benefit of reservation under Rule 14.

Note. Everything being equal as specified in the provisos to clauses (a), (b) and (c) of sub-rule (1), then the inter se merit shall be determined by draw of lots.

Rule - 8. Preparation and publication of merit list.

(1)     The Member Secretary of the Committee shall prepare the merit list of candidates eligible for selection of Government seats. Separate merit lists for Medical, Dental, Indian Systems of Medicine, Homoeopathy courses and Engineering, Technology and Architecture courses shall be prepared, in accordance with Rule 7 and cause publication of the said lists, on the notice boards of all the CET examination centres and on the CET website.

(2)     The Member-Secretary shall prepare separate merit lists of eligible candidates referred to in the proviso to clauses (a), (b) and (c) of sub-rule (1) of Rule 7.

(3)     Mere appearance at the Common Entrance Test or Aptitude Test does not entitle a candidate to be considered for admission automatically, unless the candidate fulfills the eligibility conditions required for admission to the course.

Rule - 9. Constitution of Overseeing Committee and its powers.

(1)     The Government shall constitute an Overseeing Committee (hereinafter referred to as 'the Committee' in this rule) for overseeing the Common Entrance Test conducted by the Association of Private Professional Institutions, consisting of.

(i) a retired Judge of High Court of Karnataka nominated by the Chief Justice of the High Court

Chairman

(ii) Vice-Chancellor of University

Member

(iii) a person of repute in the field of education nominated by the Committee

Member

(iv) a person nominated by the Chairman who shall be a Doctor or an Engineer of eminence (depending on whether the course is Medical, Engineering, Technical)

Member

(v) the Secretary to Government in charge of Medical, Engineering, Technical (depending on whether the courses is Medical, Engineering, Technical)

Member-Secretary

(2)     The Committee shall have the power.

(i)       to oversee and supervise the test conducted by the Association " of Private Professional Colleges/Institutions, in order to ensure that it is conducted in a fair and transparent manner;

(ii)      to permit a minority institution which has been established and which has been permitted to adopt its own admission procedure for at least the last 25 years, immediately preceding the date of commencement of these rules, to adopt its own admission procedure and if the Committee feels that the needs of such an institution are genuine, to admit, students of their community, in excess of the quota allotted to them by the State Government:

Provided that no order exempting any institution or varying the percentage of quota fixed by the State shall be made without consulting the State Government;

(iii)     in case of any dispute as regards fixation of percentage of quota in each minority and non-minority professional institution by the Government, it will be open to the management to approach the Committee.

Rule - 10. Fee structure and constitution of Fee Committee.

(1)     The fees for admission to the courses under these rules in respect of Government, University Colleges and Aided Institutions, shall be as determined by the Government by notification.

(2)     The fees for admission to the courses under these rules in respect of Private Unaided Professional Institutions, - shall be notified by the Government, based on the fee fixed by the Fee Committee, constituted by the Government, consisting of.

(i)

a retired Judge of the High Court of Karnataka, nominated by the Chief Justice of Karnataka .

(ii)

a representative of the Medical Council of India, All India Council for Technical Education, as the case may be

Member

(iii)

a person of repute nominated by the Committee

Member

(iv)

a Chartered Accountant of repute nominated by the Chairman

Member

(v)

the Secretary to Government in charge of Medical, Technical Education, as the case may be

Member Secretary

(3)     The Committee shall have powers.

(i)       to require each educational institution to place before the Committee proposed fee structure of such institution with all relevant documents and books of accounts for scrutiny, well in advance of the academic year;

(ii)      to verify whether the fee proposed by each institution is justified and that it is not profiteering or charging capitation fee;

(iii)     to approve the fee structure or to propose some other fee which can be charged by the institution;

(iv)    to oversee that the institution shall not charge either directly or indirectly any other amount, over and above the amount fixed as fees by the Committee.

(4)     The fee fixed by the Committee shall be binding on the institution for. a period of three years, at the end of which period, the institution would be at liberty to apply for revision.

(5)     An institution which charges capitation fees or indulges in profiteering shall be appropriately penalised and face the consequence of losing its recognition/affiliation.

Rule - 11. Publication of seat matrix and admission schedule.

(1)     The Government shall notify the provisional seat matrix of the professional institutions and call for objections, if any.

(2)     Any institution or person aggrieved by the provisional seat matrix may file objections within seven days from the date of notification of the provisional seat matrix and the Government shall, after considering the objections, if any, notify the final seat matrix which shall be issued before the commencement of the Seat Selection by the CET Cell.

(3)     Any increase in the intake or introduction of new course in any existing institution or recognition of a new institution after the commencement of the Seat Selection for the relevant year shall be taken into account for the purpose of allotment of seats under these rules and any such increase shall be effective from the same academic year, provided the consequential seat matrix is issued by the Government, before the commencement of the date notified for casual vacancy seat selection.

(4)     If any Medical and Dental seat becomes available under All India Quota as communicated by the Directorate of Medical Services (Medical Education Cell), Government of India, the State Government shall issue seat matrix in respect of those seats and such seats shall be offered to the candidates during the casual vacancy round:

Provided that the seats made available under such quota shall not be offered for allotment, if they are communicated after the commencement of the casual vacancy round.

(5)     The seat selection shall be held and completed by the Special Officer as per the calendar to be notified. In case of modification of the calendar the same shall be notified in at least two newspapers published in the State of Karnataka and also put on the CET Website. No individual intimation will be sent in this regard.'

(6)     From the date 'of commencement of seat selection and till the completion thereof, the Special Officer shall cause daily publication of the availability of college-wise, course-wise and category-wise seats, by issue of daily bulletin and shall also put the same on the CET Website.

Rule - 12. Allotment of seats.

(1)     The seats under these rules will be classified as Government Seats and Management Seats. The sharing of seats shall be as notified by Government separately.

(2)     The Government seats shall be filled by the CET tell.

(3)     The Management of the professional institution may fill the management seats based on merit determined after conducting the Common Entrance Test by the Association of Professional Colleges/Institutions under the supervision of the Committee constituted by the Government under Rule 9.

(4)     The merit-lists of the candidates shall be published at all the examination centres where the Common Entrance Test is conducted by the Association of Private Professional Institutions and also at all the Private Professional Institutions.

(5)     The management may fill such Government seats as may be remaining unfilled by the CET Cell, after the reconciliation meeting referred to in Rule 18 and before the last date fixed by the respective University for admission to the course concerned.

Rule - 13. Allocation of seats and procedure for admission to Second Year, Third Semester Engineering and Technology Courses.

(1)     Ten per cent of the sanctioned intake of the first year of Bachelor of Engineering or Bachelor of Technology as reckoned from the sanctioned intake of the previous year shall be allocated for candidates possessing Diploma in the relevant branches of Engineering specified at column (2) of Schedule 1 for admissions to Second Year, Third Semester Bachelor of Engineering, Bachelor of Technology courses specified in column (3) thereof. Such seats shall be Government seats:

Provided that in respect of Siddaganga institute of Technology Engineering day college, existing intake for the first year Bachelor of Engineering shall be treated as the intake of Second Year, Third Semester Bachelor of Engineering, Bachelor of Technology courses:

Provided further that in respect of Evening Engineering Colleges, the intake of First Year Bachelor of Engineering is treated as the intake of third semester of Second year Bachelor of Engineering, Bachelor of Technology Courses.

(2)     The conditions specified in Rule 4 and reservation specified in clauses (A), (D), (E) and (G) of sub-rule (1) and sub-rules (2), (3) and (4) of Rule 14, as are applicable under these Rules shall apply mutatis mutandis to full-time and part-time Diploma seats except clause (A) which shall not be applicable to part-time Diploma seats.

(3)     The Special Officer shall publish on the notice board, CET website and in the office of the Director of Technical Education and such other offices as he may deem fit and also by giving wide publicity in at least two newspapers one in Kannada and one in English having circulation in the State calling for duly filled applications for Entrance Test and admission to full time and part time Engineering, Technology degree courses by specifying the last date for receipt of application.' The details of the applications received shall be stored at the CET Cell. The Director of Technical Education shall conduct an Entrance Test both for full time and part time Engineering, Technology courses, with the assistance of Special Officer, CET Cell and shall cause preparation of merit list as specified in Rule 4 among Diploma holders in the order of merit as specified under Rule 7 which shall be the basis for allotment of seats to first year of Bachelor Architecture or to Third Semester, Second Year Bachelor of Engineering or Bachelor of Technology, full time and part time courses. The seats under Diploma quota shall then be allotted as per the seat matrix issued by the Director of Technical Education in Karnataka in accordance with these rules.

(4)     For admission to part time Engineering, Technology courses, out of the total seats, there shall be two categories, namely, (i) 30 per cent of the seats to the candidates possessing professional experience of SIX years and above; and (ii) 70 per cent of seats to the candidates possessing professional experience of ONE year and above but less than SIX years:

Provided that if candidates with Professional Experience of SIX years and above are not available in the reserved class, such seats shall be filled by the respective reserved class candidates with professional experience of less than six years but more than one year.

Rule - 14. Reservations applicable to Government Seats.

(1)     There shall be reservations in Government seats for the following categories, the extent of which shall be as specified by the Government from time to time.

(A)     The following candidates shall be eligible for selection under NCC Category, namely.

(i)       who have participated in Republic Day Camp conducted by the Directorate General of NCC, New Delhi from Karnataka and who possess at least 'B' Certificate obtained during the five years period of study in Karnataka between 8th to 12th Standards; or

(ii)      who have participated in the following camps conducted by the Directorate General of NCC, New Delhi from Karnataka and who possess at least 'B' Certificate obtained during the five years period of study in Karnataka between 8th to 12th standards, namely.

(a)      All India Thal Sainik Camp (Boys);

(b)      All India Thal Sainik Camp (Girls);

(c)      All India Nau Sainik Camp;

(d)      All India Vayu Sainik Camp.

And Youth Exchange Programmes and Foreign Naval Cruise;

(iii)     who have participated in the following camps conducted by the Directorate General of NCC, New Delhi from Karnataka and who possess at least 'B' Certificate obtained during the five years period of study in Karnataka between 8th to 12th standards namely.

(a)      All India Thal Sainik Camp (Boys);

(b)      All India Thal Sainik Camp (Girls);

(c)      All India Nau Sainik Camp;

(d)      All India Vayu Sainik Camp.

And complete  Mountaineering Expeditions (over 5900 Mtrs.), Sailing Expeditions using wind power only (401 Kms.), Motor-cycle Expeditions (more than 3500 Kms.) and Cycling Expeditions (more man 1500 Kms.);

(iv)    who have participated in the following camps/courses from Karnataka conducted by the Directorate General of NCC, New Delhi and Dy. DG, NCC Directorate of Karnataka and Goa and who possess at least 'B' Certificate obtained during the five years period of study in Karnataka between 8th to 12th standards, namely.

(a)      National Integration Camp;

(b)      Trekking Camp;

(c)      Mountaineering Course,

(d)      Basic Leadership Course;

(e)      Advanced Leadership Course;

(f)       Rock Climbing Training Camp;

(g)      Army, Navy, Air Force and Hospital Attachments;

(v)      who possess at least 'B' certificate obtained during the five years period of study in Karnataka between 8th to 12th standards:

Provided that for selection of a reserved seat under NCC category, candidates possessing 'B' certificate and adjudged overall All India BEST CADET with Gold/Silver/Bronze medal in the Republic Day camp shall be considered first; 'B' certificate holders who are adjudged overall All India BEST CADET and have won Gold/Silver/Bronze medal in the camps mentioned in sub-clause (ii) shall be considered second; 'B' certificate holders who have participated from Karnataka in the Republic Day camp shall be considered third; 'B' certificate holders who have participated from Karnataka in the camps mentioned in sub-clause (ii) shall be considered fourth; 'B' certificate holders who have participated from Karnataka in the camps mentioned in sub-clause (iii)' shall be considered fifth and 'B' certificate holders who have participated in the camps mentioned in sub-clause (iv) shall be considered sixth before considering the candidates referred to in sub-clause (v):

Provided further that the candidates belonging to sub-clause (v) i.e., only 'B' certificate holders shall be eligible to select the NCC special category seats, if any in the general round of seat selection along with the other General Merit and Reserved category candidates as per their merit order:

Provided that in the case of Diploma candidates, preference shall be given to candidates with NCC 'C Certificate over candidates with NCC 'B' Certificate:

Provided also that the Director of NCC or his authorized nominee shall be present in the CET Cell on the notified day of NCC seat selection, along with the list of eligible NCC candidates to assist in the selection of candidates under NCC category.

(B)     The following candidates shall be eligible for selection under Sports category, namely.

(i)       who have represented the country and won medals/cups in the Super-A Games specified in Schedule II during the five years period of study in Karnataka between 8th and 12th standards;

(ii)      who have represented the country and won medals/cups in 'A-Games' specified in Schedule II during the five years period of study in Karnataka between 8th and 12 standards;

(iii)     who have won medals/cups in 'B Games' specified in Schedule II by representing Karnataka State and participated in the Super-A Games or A-Games specified in Schedule II during the five years period of study in Karnataka between 8th and 12th standards;

(iv)    who have presented Karnataka State in 'B Games' specified in Schedule II and won medals/cups during the five years period of study in Karnataka between 8th and 12th standards;

(v)      who have represented Karnataka State in any sports or games in the 'B Games' specified in Schedule II during the five years period of study in Karnataka between 8th and 12th standards:

Provided that for selection of a reserved seat in sports category, the candidates who belong to sub-clause (i) shall be considered first; candidates who belong to sub-clause (ii) shall be considered second; candidates who belong to sub-clause (iii) shall be considered third and candidates who belong to sub-clause (iv) shall be considered fourth before considering the candidates belonging to sub-clause (v):

Provided further that, while considering the candidates mentioned in sub-clauses (i), (ii), (iii), (iv) and (v), Gold medal winners will be preferred to Silver medalist who in turn will be preferred to Bronze medalist under the respective sub-clauses, irrespective of the number of medals-Provided also that the achievements of the candidates mentioned in sub-clauses (i), (ii), (iii), (iv) and (v) must be on or before the date of Common Entrance-Test of the relevant yean

Provided also that the candidates belonging to sub-clause (v), i.e., only who have represented the Karnataka State, shall be eligible to select the Sports Special Category seats, if any, in the general round of seat selection along with the other General Merit and Reserved category candidates as per their merit order:

Provided also that the Commissioner for Youth Services and Sports or his authorised nominee shall be present in the CET Cell on the notified day of Sports seat selection, along with the list of eligible candidates to assist in the selection of candidates under Sports category.

(C)     Candidates who as Scouts, Guides have received the "President's Award" during five years period of study in Karnataka between 8th and 12th standards:

Provided that the candidates shall submit the "President's Award" certificate on the day of general round of seat selection as per their merit order-

Provided that in case of Diploma holders, period of study shall be reckoned from 8th standard to final year Diploma.

(D)     Son or daughter of Defence Personnel.

Explanation. Subject to the conditions laid down in clauses (v), (vi) and (vii) of Rule 4, Defence personnel for the purpose of this clause means a person in Defence Service including personnel belonging to Civil GT COYS ASC who were Civilian Class 'III' or Class 'IV' Government servants "and Border Roads Organisational personnel", (vide Notification No. ED 189 TGL 94, Bangalore, dated 29-07-1994).

(E)     Son or daughter of Ex-serviceman.

Explanation. Ex-serviceman for the purpose of this clause includes personnel belonging to Civil GT COYS ASC who were Civilian Class III or Class IV Government servants, who became permanently disabled or were killed during hostilities:

Provided that in case of Evening Colleges, preference shall be given to serving defence personnel and employed ex-defence personnel, over wards of defence and ex-defence personnel.

(F)      Candidates from Anglo-Indian Community.

(G)     Candidates who are persons with disability.

(H)     Candidates possessing Diploma in the relevant branch of Engineering Diploma specified in column (2) of Schedule 1 at Serial Number (2) for admission to first year Architecture course.

Note. Candidates belonging to clauses (C) to (F) above shall be allowed to select the respective special category scats as per their merit order in the General round of seat selection along with other general merit and reserved category candidates.

(2)     (a) Out of the total number of Government seats available after deducting the total number of seats reserved under sub-rule (1), reservation shall be made in favour of candidates belonging to the Scheduled Castes, Scheduled Tribes and other Backward Classes, as notified by the Government of Karnataka under Categories I, II-A, II-B, III-A and III-B in accordance with Government Order No. SWL 251 BCA 94, dated 31st January, 1995 and as amended from time to time.

(b) In case of Architecture course, the total number of Government seats in accordance with Rule 12 in full time courses after deducting ten per cent of seats for Diploma holders and the total number of seats reserved under sub-rule (1), reservation shall be made in favour of candidates belonging to the Scheduled Castes, Scheduled Tribes and other Backward Classes, as notified by the Government of Karnataka under Categories I, II-A, II-B, III-A and III-B in accordance with Government Order No. SWL 251 BCA 94, dated 31st January, 1995 and as amended from time to time:

Provided that no candidate other than those who are claiming eligibility for Government merit Seats in accordance with clauses (i), (ii), (vi), (viii), (x), (xi) and (xii) of Rule 4 shall be eligible to claim the benefit of reservation under this sub-rule.

(3)     Fifteen per cent of Government seats shall be reserved horizontally in favour of rural candidates and the eligibility criteria shall be as defined in the Karnataka Reservation of Appointments or Posts in the Civil Services of the State for Rural Candidates Act, 2000 (Karnataka Act 1 of 2001).

(4)     Five per cent of Government seats shall be reserved horizontally for allotment to the candidates who have studied in Kannada Medium in accordance with Government Order No. ED 91 URC 2002, Bangalore, dated 31-7-2002 and as amended from time to time.

(5)     Inter se merit determined under Rule 7 shall remain for availing benefit of reservation under this rule.

(6)     If any seat reserved in favour of candidates belonging to the categories referred to in sub-rules (3) and (4) remains unfilled, such vacant seats shall stand transferred to the respective categories specified in sub-rule (2).

Rule - 15. Exercising option for selection of Government seats.

(1)     The candidate shall exercise the option to select the seat of his choice in the order of merit as follows.

(i)       The candidate shall have the option to select a seat from among the available seats displayed using a projector linked to a computer, which is programmed to account for the ongoing seat selection, college-wise, course-wise and category-wise as per the seat matrix;

(ii)      The candidate shall have the option to select a seat in the discipline to which he is eligible;

(iii)     The candidate may choose the course and the institution:

Provided that a candidate selecting a seat in any of the Medical Colleges run by the Government of Karnataka shall execute a bond undertaking to serve in any Primary Health Centre or Primary Health Unit in Rural areas of Karnataka for minimum period of one year and that in default thereof, the candidate will be liable to pay a penalty of Rs. 1 lakh to Government of Karnataka.

(iv)    The candidate while selecting a seat, shall deposit the notified fee, for the first year, first semester, through a crossed Demand Draft, Pay Order, drawn in favour of "The Special Officer, Common Entrance Test Cell, Bangalore', payable at Bangalore;

(v)      The candidate shall produce the specified original documents along with photocopies thereof and the Special Officer may cause verification of the documents produced. The CET Cell shall retain copies of the documents and return the originals to the candidate along with the admission order. The candidate, upon obtaining the admission order from the CET Cell, shall report to the college concerned on or before the date specified in the admission order;

(vi)    The candidate belonging to reserved category, special category shall have the opportunity to select a seat under the general merit category also;

(vii)   The candidate seeking selection of reserved category seat under sub- rule (2) of Rule 14 shall not be entitled to participate in the seat selection, unless the candidate produces a Caste Certificate in Form 'D' in case of Scheduled Castes and Scheduled Tribes and in Form 'E' in case of Category X and a Caste Income Certificate in Form 'F' for other Backward Classes like 2A, 2B, 3A and 3B, issued by the jurisdictional Tahsildar, in accordance with the Government Order No. Sa Ka E 225 BCA 2002, dated 30th March, 2002 as amended from time to time. The candidate shall also produce an affidavit in the format as prescribed in the brochure along with the Caste Certificate:

Provided that the candidate belonging to SC, ST and Category I claiming seat under reserved category shall also produce income certificate issued by the jurisdictional Tahsildar.

(viii)  The candidate claiming reserved category seat under sub-rule (1) of Rule 14, except those claiming reservation under Scouts and Guides and Physical Disability, shall produce the specified original documents in support of the claim, to the Special Officer, who may refer the same to the respective authorities for scrutiny and confirmation, namely.

(a)      N.C.C.To the Directorate of N.C.C. in Karnataka;

(b)      Sports.To the Commissioner for Youth Services and Sports in Karnataka;

(c)      Defence.The Officiating Education Officer, (HQ), Karnataka, Kerala and Goa sub-area, Bangalore;

(d)      Ex-serviceman.To the Director, Department of Sainik Welfare and Resettlement in Karnataka;

(e)      Anglo-Indian.Nominated Anglo-Indian MLA of State of Karnataka.

(ix)    The candidate suffering from less than forty per cent of disability shall not be eligible for selection of a seat under the persons with disability category. The candidate claiming a seat under the persons with disability category shall appear on the date notified by the Special Officer, before the Medical Board constituted by the Director of Medical Education, consisting of the Special Officer, three specialists, one each from the Department of Orthopedics, Ophthalmology and ENT. The Medical Board shall examine the candidate and certify regarding the percentage of disability. A nominee of the Commissioner for persons with disabilities in Karnataka shall be present in the CET Cell on the notified day of seat selection. The decision of the Medical Board shall be final, depending upon which the candidate's eligibility for the allotment of seat shall be determined by the Special Officer.

Explanation. For the purpose of this proviso, persons with disability shall have the same meaning assigned to it, in the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (Central Act 1 of 1995).

(2)     Candidates with Physical Disability, candidates under NCC quota and Sports quota, shall be allowed to select seats in the first instance for the courses referred to in sub-rule (3) of Rule 1.

(3)     Selection of seats shall be held in respect of Medical, Dental, Indian Systems of Medicine and Homoeopathy courses in the first instance, where all the eligible candidates and also those who have already selected seats under sub-rule (2) whether reported to the college or not, shall be allowed as per their merit order to select seats in the respective courses. The seat held by a candidate shall automatically stand cancelled if such candidates selects a seat in Medical, Dental, Indian Systems of Medicine and Homoeopathy courses. The candidate, who selects the seat, shall produce the specified original documents and deposit the specified admission fee in accordance with clause (iv) of sub-rule (1). The CET Cell shall issue the Admission Order and the candidate shall report before the Principal/Administrative Officer of the concerned institution.

(4)     The Engineering, Technology seat selection shall be held after completion of the seat selection under sub-rules (2) and (3), where all the eligible candidates and also those who have already selected seats under sub-rules (2) and (3) whether reported to the college or not, shall be allowed as per their merit order, to select a seat in Engineering courses. The candidates who have selected seats under sub-rules (2) and (3), if satisfied with the seat, need not attend the Engineering, Technology seat selection round. If the candidate who has selected a seat under sub-rules (2) and (3) and selects an Engineering, Technology seat, the seat selected earlier shall automatically stand cancelled. The candidate who selects an Engineering, Technology seat shall produce the specified original documents and deposit the specified admission fee in accordance with clause (iv) of sub-rule (1). The CET cell shall issue the Admission Order and the candidate shall report before the Principal/Administrative Officer of the concerned institution.

(5)     The Architecture seat selection shall be held after completion of the seat selection under sub-rules (2) to (4), where all the eligible candidates and also those who have already selected seats under sub-rules (2) to (4) whether reported to the college or not, shall be allowed as per their merit order, to select a seat in Architecture course. The candidates who have selected a seat under sub-rules (2) to (4), if satisfied with the seat, need not attend the Architecture seat selection round. If the candidate has selected a seat under sub-rules (2) to (4) and selects an Architecture seat, the seat selected earlier shall automatically stand cancelled. The candidate who selects an Architecture seat shall produce the specified original documents and deposit the specified admission fee in accordance with clause (iv) of sub-rule (1). The CET Cell shall issue the Admission Order and the candidate shall report before the Principal/Administrative Officer of the concerned institution.

[1][(5-A) Nothing contained in sub-rules (3) to (5) of the said Rules shall be deemed to preclude holding of the seat selection for Engineering and Architecture courses in two phases, one of which can precede the seat selection process for Medical, Dental, Indian System of Medicine and Homeopathy Courses, in case of exigency.]

(6)     After completion of the seat selection round under sub-rules (2) to (5), the seats that remain unfilled, surrendered, cancelled, forfeited and newly added seats shall be treated as Casual Vacancies. In the first instance, such reserved seats that remain under Rural and Kannada Medium categories under reserved categories or under General Merit as the case may be, shall be transferred to the respective general categories. Casual Vacancy seat selection will be held for reserved categories like SC, ST, Categories-1, 2A, 2B, 3A and 3B in the first instance. The seats that remain unfilled thereafter shall be transferred to GM category and shall be offered to all the eligible candidates including reserved category candidates. The consequential vacancies arising in any category shall be retained in the same category and shall be offered to candidates belonging to the respective category only.

(7)     Casual Vacancy seat selection shall be held first for Medical, Dental, Indian System of Medicine and Homoeopathy courses, which shall be followed by Engineering and Technology courses and then Architecture course.

(8)     Candidates who have selected Medical or Dental or Indian Systems of Medicine or Homoeopathy or Engineering or Technology or Architecture seat and also candidates who have not selected any seat are eligible to participate in the casual vacancy round.

(9)     Seat already selected shall automatically stand cancelled when such candidate selects a casual vacancy seat in Medical, Dental and Indian Systems of Medicine and Homoeopathy courses. The candidate who selects the Medical or Dental or Indian Systems of Medicine or Homoeopathy seat for the first time, shall produce the specified original documents and deposit the specified admission fee in accordance with clause (iv) of sub-rule (1).

(10)   The casual vacancy round for Engineering, Technology courses shall be held after completion of the casual vacancy round under sub-rule (9). The candidate selecting such seats shall produce the specified original documents and deposit the specified admission fee in accordance with clause (iv) of sub-rule (1).

(11)   The casual vacancy round for allotment for Architecture seat shall be held after completion of the casual vacancy round under sub-rule (10). The candidates selecting such seats shall produce the specified original documents and deposit the specified admission fee in accordance with clause (iv) of sub-rule (1).

(12)   A candidate who selects a seat in any discipline, course during casual vacancy round shall not be eligible to participate in further casual vacancy seat selection round.

(13)   The seats that remain unfilled after the completion of the casual vacancy round under sub-rules (9), (10) and (11) may be transferred to the respective colleges by the concerned Directors after reconciliation meeting.

(14)   The Government may by order cancel any seat selection made under these rules, for the reasons specified therein.

Rule - 16. Execution of Bond by candidates selecting Medical Seats (MBBS) in Government Colleges.

A candidate who selects MBBS seat in any of the Medical Colleges run by the Government of Karnataka is required to execute a bond (signed by the candidate and parent) giving an undertaking that he is prepared to serve in any Primary Health Centre or Primary Health Unit in rural areas of Karnataka on completion of the course for a minimum period of one year and that in default thereof, the candidate will be liable to pay a penalty of Rs. 1 lakh to Government of Karnataka.

Rule - 17. Forfeiture and refund of fee.

(1)     If a candidate who has selected a seat under sub-rules (2) to (5) of Rule 15, surrenders or cancels such seat, before the turn of such candidate in the Casual Vacancy Round, the Special Officer shall forfeit 20% of the fee paid.

(2)     If a candidate who has selected a seat under sub-rules (2) to (5) of Rule 15, surrenders, cancels seat after the turn of such candidate in the Casual Vacancy Round is over, the Special Officer shall forfeit the entire fee paid.

(3)     If a candidate selecting a casual vacancy seat under sub-rules (9) to (11) of Rule 15, surrenders, cancels the seat, the Special Officer shall forfeit the entire fee.

(4)     No surrender or cancellation of seat shall be accepted, unless the candidate surrenders the original admission order issued by the CET Cell and the original Bank Challan.

Rule - 18. Reconciliation meetings.

After the closing date for allotment of seats to the courses by the CET Cell, reconciliation meetings regarding the number of unfilled, un-allotted seats, shall be held at the CET Cell by the Directorate of Technical Education, Directorate of Medical Education, Directorate of Indian Systems of Medicine and Homoeopathy, as the case may be, with the Special Officer, CET Cell and the Principal, Secretary of the Institutions. After identifying the vacant seats, if any, notification shall be issued by the concerned Director regarding the vacant seats. Such seats may thereafter be filled by the Institutions, within the date stipulated by the University concerned for admission to the course from the merit list of the CET conducted by the Association of Private Professional Colleges:

Provided that the seat that remain after exhausting the merit list of the CET conducted by the CET Cell and Association of Private Professional Colleges, may be filled by the respective institutions by following a fair and transparent procedure.

Rule - 19. Penalties.

(1)     Where a candidate, parent, guardian furnishes any incorrect information in the application form for Common Entrance Test or produces any documents, records such as incorrect marks card's, statement of marks, any certificate's and affidavit etc., or commits fraud of any kind or obtains allotment by making incorrect statement or commits forgery or impersonation or indulges in any malpractice or makes any statement which is not true, at the time of entrance test or the seat selection and obtains the admission ticket, any record, admission order or where candidate commits malpractice of any kind in the qualifying examination, Common Entrance Test conducted by CET Cell or is a beneficiary of any malpractice detected or noticed during the Common Entrance Test or the Seat Selection or subsequent to the issue of the Admission Order, the seat allotted to the candidates, if any, shall be liable to be forfeited along with the fees paid at any time during the period of candidate's study. The candidate may also be debarred from appearing for the Entrance Test for such period as deemed fit.

(2)     Candidate, parent or guardian, as the case may be, shall also be liable for both civil and criminal action. The original documents submitted by the candidate, may also be impounded.

(3)     Where the Special Officer considers that the action should be taken under sub-rules (1) and (2), he shall pass order in that regard after holding such enquiry as deemed necessary, after giving reasonable opportunity to the candidate or parent or guardian to make representations, if any.

Rule - 20. Appeal.

Any person "aggrieved by the order or decision of the Special Officer under these rules may within 15 days from the date of such order or decision, appeal to the Principal Secretary, Secretary to Government (Higher Education) Education Department, Government of Karnataka, who after calling for records from the Special Officer and after examining the same, shall pass orders as he deems fit, which shall be final.

Rule - 21. General.

(1)     A candidate is deemed to have been admitted to professional college once the candidate has been allotted a seat by the CET Cell and the prescribed fee is paid to the CET Cell. The Principal of the college shall immediately, allow such candidate to join the course of study. In the event of refusal by the institution to allow the candidate admitted by the CET Cell to join the course, the aggrieved candidate may approach the jurisdictional Deputy Commissioner. The Deputy Commissioner is authorised to enforce the compliance of the admission order issued by the CET Cell.

(2)     In case of refusal by the institution to allow the candidate to join the course with the admission order issued by the Special Officer, the concerned University to which the college is affiliated shall enforce the admission order issued under these rules, failing which, the concerned University shall take such action as it deems fit against the institution concerned by exercising the powers vested in it under the Karnataka State Universities Act, 2000 (Karnataka Act 29 of 2001), Rajiv Gandhi University of Health Sciences Act, 1994 (Karnataka Act 44 of 1994) and the Vishveshwaraiah University of Technical Education' Act, 1994 (Karnataka Act 39 of 1994), as the case may be.

(3)     All admissions made to and by the colleges shall be subject to approval by the concerned University.

(4)     Any refusal by the concerned University to approve the admission after such verification as deemed fit regarding the eligibility or otherwise of the candidate to the course, shall not be the responsibility of the Special Officer or the Government and no claims shall lie against the Special Officer or the Government.

Rule - 22. Repeal and savings.

(1)     Karnataka Selection of Candidates for Admissions to Professional Institutions Rules, 2004 is hereby repealed.

(2)     Notwithstanding such repeal anything done or any action taken under the repealed Rules shall be deemed to have been done or taken under these Rules.
