[1]KARNATAKA (LICENSING OF ELECTRICAL CONTRACTORS AND GRANT OF CERTIFICATES AND PERMITS TO ELECTRICAL SUPERVISORS AND WIREMEN) (AMENDMENT) RULES, 1980

PREAMBLE

In exercise of the powers conferred by Rule 45 of the Indian Electricity Rules, 1956, the Government of Karnataka hereby makes the following rules further to amend the Karnataka (Licensing of Electrical Contractors and Grant of Certificates and Permits to Electrical Supervisors and Wiremen) Rules, 1976, namely.

Rule - 1. Title and commencement.

(1)     These rules may be called the Karnataka (Licensing of Electrical Contractors and Grant of Certificates and permits to Electrical Supervisors and Wiremen) (Amendment) Rules, 1980.

(2)     They shall come into force at once.

Rule - 2. Substitution of Rule 16.

For Rule 16 of the Karnataka Licensing of Electricity Contractors and Grant of Certificates and permits to Electrical Supervisors and Wiremen) Rules, 1976, (hereinafter referred to as the said rules), the following rule shall be substituted, namely.--

"16. Duration and renewal of licence.

(1)     Every licence granted under sub-rule (3) of Rule 15 shall be valid for a period of one year from the first of the month in which it is granted.

(2)     Any licence may, subject to the same terms and conditions as are applicable to grant of licence, excepting the requirement of solvency certificate, be renewed for a further period of one year or two years or three years. An application for renewal shall be made in Form 'E', three clear months before the date of expiry of the licence and shall be accompanied by a challan or cash receipt for the payment of renewal fee specified in sub-rule 3: Provided that the Government may by previous notice to the licence require that the first application for renewal made after the commencement of the Karnataka (Licensing of Electrical Contractors and Grant of Certificates and Permits to Electrical Supervisors and Wiremen) Amendment Rules, 1980, shall be for a period which may be longer or shorter than the aforesaid further period of one year, two years or three years by not more than six months and the renewal fee shall be proportionately higher or lower, rounded off to the next higher rupee.

(3)     Renewal fee shall be.

(a)      Seventy five rupees per year for Class I Contractors Licence; and

(b)      fifty rupees per year for Class II contractors licence; and

(c)      twenty-five rupees per year for Class III Contractors licence.

(4)     Application for renewal made after the due date may be accepted if it is made not more than one month after the due date and is accompanied by a penal fee of twenty five rupees in addition to the renewal fee specified in sub-rule (3).

(5)     All applications for renewal received after one month from the due date shall be rejected".

Rule - 3. Substitution of Rule 27.

For Rule 27 of the said rules, the following shall be substituted, namely.

"27. Duration and renewal of permits.

(1)     Every permit granted under Rules 19, 22 and 24 shall be valid for a period of one year from the first of the month in which it is granted.

(2)     Any such permit may be renewed for a further period of one year, two years or three years. An application for renewal shall be made in Form "T-1" three clear months before the expiry of the permit and shall be accompanied by a challan or cash receipt for the payment of renewal fee specified in sub-rule (3):

Provided that the Government may, by previous notice to the permit holder, require that the first application for renewal made after the commencement of the Karnataka (Licensing of Electrical Contractors and Grant of Certificates and Permits to Electrical Supervisors and Wiremen) (Amendment) Rules, 1980, shall be for a period which may be longer or shorter than the aforesaid further period of one year, two years or three years by not more them six months and the renewal fee shall be proportionately higher or lower rounded off to the next higher rupee.

(3)     Renewal fee shall be.

(a)      Twenty five rupees per year for Industrial or Mining Electrical Supervisors Permit;

(b)      Ten rupees per year for Wiremen's Permit.

(4)     Application for renewal made after the due date may be accepted if it is made not more than one month after the due date and is accompanied by a penal fee of fifteen rupees in the case of Industrial or Mining Electrical Supervisors' Permit, and ten rupees in the case of Wiremen's Permit in addition to the renewal fee specified in sub-rule (3).

(5)     All applications for renewal received after one month from the due date shall be rejected".

Rule - 4. Substitution of Form "E".

For Form "E" of the said rules, the following Form shall be substituted, namely.

9. ???Whether the copies of (a) estimates and agreements duly signed by the consumes and the Contractor, (b) Z Form has been maintained for all the works undertaken by the Licensed Electrical Contractor.

10.   (i) Has the applicant maintained the following registers upto date:

(a)      Attendance Register

(b)      Application Register

(c)      Work Allocation Register

(d)      Material issue Register

(ii) The date of annual inspection of the same by the inspection authority and the designation of the authority

11.? ?Particulars of instruments maintained (make and Serial No. of the instruments to be entered)

(a)      For Class 'T' Contractors:

1.        1000 Volts Megger and 500 V Megger (if maintained)

2.        One 0-500 Volts Voltmeter

3.        One 0-60 A Ammeter

4.        One Phase Sequence Meter

5.        One live line Tester (One for each Wireman)

6.        Wire Guage or Micro Meter

7.        One pair of Rubber Hand Gloves, tested to 15,000 Volts

8.        One Tong Tester 0-600 Amps

9.        Earth Tester with accessories (if maintained)

10.     A copy of the I.E. Rules 1956 with Amendments upto date and a copy of the Licensing Rules

(b)      For Class II Contractors.

1.        500 Volts Megger (if maintained)

2.        live Line Tester (One for each Wiremen)

3.        Voltmeter 0-600 V Range

4.        One Pair of Rubber Hand Gloves, tested to

5.        15000 Volts

6.        One Ammeter 0-60 Amps

7.        One Wire Guage

8.        A copy of the I.E. Rules 1956 with amendments upto date and a copy of Licensing Rules

(c)      For Class HI Contractors.

1.        500 Volts Megger (if maintained)

2.        Live Line Tester (one for each Wiremen)

3.        One pair of Rubber Hand Gloves tested to 15,000 V

4.        One Wire Guage

I/We hereby declare that the particulars stated above are correct to the best of my/our knowledge and that I/We fully understand the terms and conditions under which an electrical Contractors Licence is renewed a breach of which will render the Licence liable for suspension or cancellation:

Rule - 5. Inserting of new Form T-I.

After Form T of the said rules, the following Form shall be inserted, namely.--

Instructions.-- The application form should be duly filled in and submitted to the Secretary, Electrical Licensing Examination Advisory Board, Office of the Chief Electrical Inspector to Government of Karnataka, Electrical Inspectorate Bangalore-I along with a Treasury/RBI/SBM challan or cash receipt of the Inspectorate for renewal in token of having paid the renewal fee as indicated below, as also 2 copies of the recent photograph of the applicant with the date marked thereon (in case the photo affixed to the existing permit enclosed to this application is more than 5 years old) and the name and signature on front.

In case of delayed application:

Additional late fee for renewal of permit when applied for renewal before one month after the due date in addition to the usual renewal fees as mentioned above.

1.        Industrial or Mining Electrical Supervisor's Permit Rs. 15

2.        Wireman Permit Rs. 10

Important:

1.        No renewal application shall be entertained after one month of the due date for application for renewal".
