KARNATAKA LAKE CONSERVATION AND DEVELOPMENT AUTHORITY RULES, 2015

PREAMBLE

In exercise of the powers conferred under sub-section (1) of Section 51 of the Karnataka Lake Conservation and Development Authority Act, 2014 (Karnataka Act 10 of 2015), the Government of Karnataka hereby makes the following rules, namely.--

Rule - 1. Title and commencement.--

(1)     These rules may be called the "Karnataka Lake Conservation and Development Authority Rules, 2015".

(2)     They shall come into force from the date of their publication in the Official Gazette.

Rule - 2. Definitions.--

(1)     In these rules, unless the context otherwise requires.--

(a)     "Act" means the Karnataka Lake Conservation and Development Authority Act, 2014 (Karnataka Act 10 of 2015);

(b)     "Form" means a form appended to these rules;

(c)      "Schedule" means a Schedule appended to these rules.

(2)     The words and expressions used in these rules but not defined shall have the same meaning assigned to them in the Act.

Rule - 3. Powers, Functions and Duties of Chief Executive Officer.--

The Chief Executive Officer shall exercise the powers and discharge and perform the functions and duties as specified below, namely.--

(a)     to take part in every meeting of the Authority.

(b)     to draw the proceedings of every meeting of the Authority or cause to draw such proceedings.

(c)      to send compliance report on all audit objections.

(d)     to cause to maintain a list of Lakes in Form 1.

(e)     to cause to host the particulars of all Lakes i.e., area of the lake, the location, the officer or staff in charge of lake, pending litigations if any in respect of said Lake, on the web site to be maintained by the Authority.

(f)      in the matter of acceptance of tenders, he shall have full powers subject to the concurrence of the Executive Committee.

(g)     subject to overall sanctioned budget provision, he shall have full powers to administratively approve and sanction all the estimates.

(h)     he shall submit Detailed Project Reports (DPRs) for approval of grants to Ministry of Environment and Forests or any other Ministry of Government of India or State Government.

(i)       he shall execute all the works under Karnataka Transparency in Public Procurements Act, 1999 and Rules 2000.

Rule - 4. Accounts and Audit.--

The authority shall maintain the details of Receipts and Payments in Form 2 and the details of Assets and Liabilities Form 2-A.

Rule - 5. Annual report.--

The annual report of the Authority shall be prepared in Form 3.

Rule - 6. Budget.--

(1)     The Authority shall during each financial year prepare in Form 4 in respect of financial year next ensuing showing the estimated receipt and expenditure, and copy thereof shall be forwarded to the Government.

(2)     Monthly Progress Report shall be submitted to the Government in Forms 4-A, 4-B and 4-C.

Rule - 7. Staff of the Authority.--

(1)     The Authority shall have the category of posts specified in column (2) of the Schedule I. The cadre strength, method of recruitment and minimum qualification shall be as specified in corresponding entries in columns (3), (4), (5), (6) and (7) thereof:

Provided that where there is no method of recruitment prescribed, such posts shall be filled by deputation holding equivalent scale of pay and grade, from any of the State Civil Services or Universities or Local Authorities or Public Sector Undertakings or Statutory Boards or Corporations owned and controlled by the State Government.

(2)     The appointments on deputation shall be as per the provisions of the Karnataka Civil Services (General Recruitment) Rules, 1977 and any other orders of the Government in force from time to time.

(3)     The conditions of service shall be governed as per the Karnataka Civil Services Rules in respect of all the staff.

(4)     The disciplinary proceedings shall be governed by the Karnataka Civil Services (Classification, Control and Appeal) Rules, 1957 subject to unidentifications as specified in the Schedule II.

(5)     The following Rules shall mutatis and mutandis apply to the Authority and its staff, namely.--

(a)     The Karnataka Civil Services (Conduct) Rules, 1966;

(b)     The Karnataka Government Servants' (Seniority) Rules, 1957;

(c)      The Manual of Contingent Expenditure etc., 1958;

(d)     The Karnataka Financial Code, 1958;

(e)     The Karnataka Transparency in Public Procurements Act, 1999 and Rules 2000.
