Civil Services (General Recruitment) (Amendment) Rules, 2023

Whereas, the draft of the
Karnataka Civil Services (General Recruitment) Rules, 1977, was published as
required by clause (a) of sub-section (2) of section 3 read with section 8 of
the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), in
Notification No. DPAR 215 SRR 2022, dated 21.12.2022 in Part IV-A (No.611) of
the Karnataka Gazette Extraordinary dated 21st December 2022 inviting
objections and suggestions from persons likely to be affected thereby within
fifteen days from the date of publication of draft in the Official Gazette.
Whereas, the said Gazette
was made available to the public on 21st December2022,
And, whereas objections and
suggestions received have been considered by the State Government,
Now, therefore, in exercise
of the powers conferred by sub-section (1) of section 3 read with section 8 of
the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the
Government of Karnataka makes the following rules, namely:-
Rule - 1. Title and Commencement
(1)
These rules may be called the Karnataka Civil
Services (General Recruitment) (Amendment) Rules, 2023.
(2)
They shall come into force from the date of
their final publication in the Official Gazette.
Rule - 2. Insertion of Rule 16-A
In the Karnataka Civil Services (General Recruitment) Rules, 1977, after Rule
16, Rule 16-A shall be inserted, namely:-
"16-A.
Appointment by transfer within the service.-
Notwithstanding anything contained
in these rules or the rules of recruitment specially made in respect of any
service or post, a Head of the Department in respect of service for reasons to
be recorded inwriting and subject to any general instructions that may be
issued by the Government in this behalf appoint by transfer a member of a
Group-C or Group-D service only in such cases where both husband and wife are
in Government service
and a request for transfer
under this rule is made by a spouse, from a post in one unit of seniority to an
identical post in the same cadre in another unit of seniority subject to the
following conditions, namely :-
(i)
A Government servant shall have completed
minimum seven years of service in present place of working.
(ii)
Sanctioned post shall be vacant in the unit
or place to be transferred.
(iii)
Such transfer shall not be permissible from
one cadre to another cadre.
Note: Since the appointment
being made at the request of the Government servant his seniority shall be
placed below that of the last person in the cadre of the transferred unit.
Provided that such
appointment by transfer shall not be made more than once in the service of a
Government Servant.
Explanation:- For the
purpose of this rule "Unit of Seniority means the jurisdiction of the
appointing authority in respect of a post."
