Whereas the draft of the Karnataka Civil
Services (Direct Recruitment by Competitive Examinations and Selection)
(General) Rules, 2006 was published as required by clause (a) of subsection (2)
of Section 3 read with Section 8 of the Karnataka State Civil Services Act,
1978 (Karnataka Act 14 of 1990) in Notification No. DPAR 19 SCR 2006 dated
24-7-2006 and in Part IV-A of the Karnataka Gazette Extraordinary dated
24-7-2006 inviting objections and suggestions from all persons likely to be
affected thereby within fifteen days from the date of publication of the draft
in the official Gazette. Whereas the said Gazette was made available
to the public on 24th July 2006. And whereas the suggestions and objections
received have been considered by the State Government. Now, therefore, in exercise of the powers
conferred by sub-section (1) of section 3 read with-section 8 of the Karnataka
State Civil Services Act, 1978 (Karnataka Act 14 of 1990) the Government of
Karnataka hereby makes the following rules, namely:- (1)
These
rules may be called the Karnataka Civil Services (Direct Recruitment by
Competitive Examinations and Selection) (General) Rules, 2006. (2)
They
shall come into force on the date of their publication in the Official Gazette (3)
These
rules shall apply to all posts in Group-A, Group-B, Group-C and Group-D, which
are to be filled by direct recruitment," for which no special or general
rules have been made prescribing the method for such direct recruitment. (1)
In
these rules, unless the context otherwise requires,- (a)
"Appointing
Authority" in relation to a Government Servant means the appointing
authority specified in the Karnataka Civil Services (Classification, Control
and Appeal) Rules, 1957; (b)
"Commission"
means the Karnataka Public Service Commission; (c)
"Qualifying
Examination" means the examination or examinations prescribed, in the
rules of recruitment specially made in respect of any service or post as the
minimum qualification for direct recruitment; and (d)
"Technical
Post" means a post for which the qualifying examination prescribed is a
technical qualification notified as such by the State Government for the
purpose of these rules or a post graduate degree or doctorate prescribed as
qualifying examination. (2)
Words
and expressions used in these rules but not defined therein shall have the same
meaning as assigned to them in the Karnataka Civil Services (General
Recruitment) Rules, 1977. The appointing authority in each department
shall, from time to time, communicate to the Commission, the provisional number
of direct recruitment vacancies to be filled in Group-A, Group-B and Group-C
except the posts of drivers in Group-C, classifying the same in accordance with
the orders in force, relating to reservation of appointments or posts. The
appointing authority may, for reasons to be recorded in writing, alter the
number of vacancies released to the commission at any time before the
publication of the select list. The commission shall take necessary steps to
invite applications from eligible candidates by advertising the vacancies in
the Karnataka Gazette specifying the conditions of eligibility, method of
selection applicable, nature of post whether technical or non-technical,
provisional number of vacancies to be filled and their classification according
to reservation policy of the State. An abstract of such advertisement shall
also be published in more than one widely circulated news paper in the regional
language and such other media of publication as it may deem fit. The method of direct recruitment under these
rules shall be on the basis of average of total percentage of marks secured in
the qualifying examination in respect of technical posts and percentage of
total marks secured in the competitive examination conducted by the commission
under rule 6(B) of these rules in respect of non technical posts and the marks
secured in an interview conducted by the Commission, The Commission shall prepare a list of names
of candidates, eligible for interview prepared on the basis of merit determined
in" the following manner, namely:- (A)
In
respect of technical posts,- (i)
Where
only one qualifying examination is prescribed, the percentage of marks secured
in such qualifying examination shall be the basis for determination of order of
merit: Provided that where the rules of recruitment
to any cadre or post prescribe any preferential or desirable qualification
(whether academic or otherwise), then all candidates possessing such
qualifications shall be eligible for interview, irrespective of the marks
obtained in the qualifying examination. (ii)
Where
the qualifying examination consists of more than one examination the percentage
of total marks secured in the qualifying examination shall be the average
percentage of marks secured in those examinations for determination of order of
merit. ' (iii)
Where
different qualifying examinations have been prescribed alternatively in the
rules of recruitment applicable to a post or category of posts and a candidate
has passed more than one such qualifying examination the percentage of total
marks obtained in the qualifying examination shall be the percentage of total
marks obtained in such qualifying examination in which he has obtained highest
percentage of total marks for determination of order of merit. (iv)
Where
the qualifying examination prescribed is a Doctorate obtained on the basis, of
thesis submitted by the candidate, the percentage of marks secured by the
candidates in the qualifying examination shall be deemed to be ninety five. (v)
Subject
to reservation policy of the State, from among the candidates whose names are
included in the list of candidates, such number of candidates as is equal to
five times the number of vacancies notified shall be called for interview. (vi)
The
maximum marks for interview shall be fifteen. (B)
In
respect of non-technical posts,-- (i)
the
Commission shall conduct a competitive examination in the fallowing manner,
namely:- (a)
The
examination shall be in the form of objective multiple choice consisting of two
written papers carrying 200 marks each, namely:- Paper-I: General Paper.- Covering General
Knowledge of topics relating to current events, general sciences and matters of
every day observation and practical knowledge as may be expected of a person
who has passed the prescribed qualifying examination. Paper-II: Specific Paper.- The content of
this paper shall be determined by the commission keeping in a view the nature
of the job for which the selection is being made and the qualifying examination
in consultation with the head of the field department or the appointing
authority concerned. (b)
The
papers shall be set in both Kannada and English. A candidate may answer the
papers either wholly in Kannada or in English but not in both: Provided that if two or more candidates
secure equal marks in the competitive examination, the order of merit of such
candidates shall be fixed on the basis of their age, the person older in age
being placed higher in the order of the merit. (ii)
a
list of candidates shall be prepared in the order of merit determined on the
basis of the percentage of total marks secured by the candidates in the above
competitive examination; (iii)
subject
to reservation policy of the State from among the candidates whose names are
included in such list, such number of candidates as is equal to five times the
number of vacancies notified, shall be called for the interview; (iv)
the
maximum marks for interview shall be 12.2% of the total marks prescribed for
the competitive examination. (1)
The
commission shall conduct interview of the eligible candidates and award marks
based on the performance of the candidates in the interview and the marks so
awarded shall be published on the notice board of its office on the day on
which interview is held or on the day following but before the commencement of
the interview on that day, a list of marks obtained by each candidate in the
said interview: Provided that where the interview is held in
any place other than the place of its office, the said list shall be published
in such other places also. (1)
In
respect of technical posts: The Commission shall prepare a final selection list
of candidates eligible for appointment on the basis of merit determined on the
basis of the aggregate of the percentage of the total marks secured in the
qualifying examination and of the marks secured in the interview and taking
into consideration of the reservation policy of the State. The number of names
of candidates to be included in such list shall be equal to the number of
vacancies notified. (2)
In
respect of non-technical posts: The commission shall prepare a final selection
list of candidates eligible for appointment on the basis of merit determined on
the basis of percentage of total marks secured in the competitive examination
and the marks secured' In the interview and taking into consideration the
reservation policy of the State. (3)
The
final selection list prepared under sub-rules (1) and (2) shall be published in
the Karnataka Gazette and in such other media as the commission may deem fit
and in such manner as the State Government may direct and a copy thereof shall
be sent to the appointing authority concerned. The fact of selection shall be
intimated to the candidates selected by the commission. (1)
The
candidates, whose names are included in the select list made available by the
commission under sub-rule (3) of rule 8 may be appointed by the appointing
authority in the order in which their names appear in the select list, after
satisfying itself about the suitability and physical fitness of each such
candidate in accordance with the provisions of the Karnataka Civil Services
(General Recruitment) Rules, 1977. (2)
The
inclusion of the name of a candidate in any select list published under
sub-clause (3) of rule 8 shall not confer any right of appointment to the
candidate, (3)
If
a candidate consequent upon the issue of the order of appointment, does not
report for duty, the vacancy against which he was selected shall be treated as
a fresh vacancy to be filled in the next or subsequent recruitment. (1)
Notwithstanding
anything contained in these rules, or the rules of recruitment specially made
in respect of any service or' post, the recruitment to the posts of drivers in
Group-C and those in Group-D shall be made by the appointing authority in the
order of merit on the basis of the aggregate of the percentage of total marks
secured by the candidate in the qualifying examination specified in the rules
of recruitment taking into consideration the orders in force relating to
reservation. If two or more candidates secure equal percentage of marks in the
qualifying examination, the order of merit of such candidates shall be fixed on
the basis of their age, the person older in age being placed higher in the
order of merit. For this purpose, the appointing authority shall intimate to
the concerned employment exchange provisional number of vacancies to be filled
duly classifying with details of the conditions of eligibility, nature of
selection and obtain a list of candidates from concerned Employment Exchange.
An abstract of such intimation shall also be published in two widely circulated
regional newspapers and such other publication media in such form as the
appointing authority may determine inviting applications from all the eligible
candidates. (2)
The
applications shall be made in the form specified by the appointing authority
along with an application fee of rupees five to be remitted through a crossed
Indian Postal Order purchased not earlier than fifteen days prior to the date
of application payable to the appointing authority: Provided that no fee shall be payable by a
candidate belonging to Scheduled Castes or the Scheduled Tribes or to
Category-I of other Backward Classes. (3)
A
select list of candidates shall be prepared by the appointing authority in
accordance with the sub-rule (1), the select list shall be published in the
Karnataka Gazette and through such other media of publication as the appointing
authority may deem fit and the selection shall be communicated by the
appointing authority to the candidates selected. The candidates whose names are
included in the select list may be appointed by the appointing authority in the
order in which their names are found in it after satisfying itself about the
suitability and physical fitness of each such candidate in accordance with the
provisions of the Karnataka Civil Services (General Recruitment) Rules, 1977. All the rules, for the time being in force,
regulating the conditions of service of Government Servants, made or deemed to
have been made under the Karnataka State Civil Services Act, 1978 (Karnataka Act
14 of 1990) in so far as they are not inconsistent with the provisions of these
rules, shall apply to the persons appointed under these rules. (1)
The
Karnataka State Civil Services (Direct Recruitment by Competitive Examinations)
(General) Rules, 2001 are hereby repealed: Provided that such repeal shall not affect
the previous operation of the said rules or anything duly done or suffered
thereunder or affect" any right, liability or obligation already acquired
or incurred thereunder. (2)
Any
reference in any rule or order to the rules repealed by sub-rule (1) shall be
construed as a reference to the corresponding provisions of these rules. (3)
Notwithstanding
such repeal, process of recruitment to any of the vacancies covered by the said
repealed rules, if already commenced arid pending on the date of commencement
of these rules, shall be finalised in accordance with the said repealed rules
as in force prior to the commencement of these rules, as if the said rules were
