Indian Antarctic Environmental Protection
Rules, 2023

In
exercise of the powers conferred by section 55 of the Indian Antarctic Act,
2022 (13 of 2022), the Central Government hereby makes the following rules,
namely: -
CHAPTER
1 PRELIMINARY
Rule - 1. Short title and commencement
(1)
These
rules may be called the Indian Antarctic Environmental Protection Rules, 2023.
(2)
They
shall come into force on the date of their publication in the Official Gazette.
Rule - 2. Definitions
(1)
In
these rules, unless the context otherwise requires, -
(a)
"Act"
means the Indian Antarctic Act, 2022 (13 of 2022);
(b)
"Chairperson"
means the Chairperson of the Committee established under sub-section (1) of
section 23;
(c)
"Commission"
means the Commission for Conservation of Antarctic Marine Living Resources,
established by the international Convention on Conservation for Antarctic
Marine Living Resources;
(d)
"Committee
for Environmental Protection" means the Committee of the representatives
of the Parties, established under Article 11 of the Protocol for Protection of
Antarctic environment;
(e)
"Form"
means a Form annexed to these rules;
(f)
"Government"
means the Central Government;
(g)
"Guidelines"
means guidelines for environmental impact assessment in Antarctica issued by
the Committee for Environmental Protection established under Article 11 of the
Protocol;
(h)
"harmful
interference" means, -
(i)
flying
or landing helicopters or other aircraft, or
(i)
using
vehicles or vessels, including hovercraft and small boats, or
(ii)
using
explosives or firearms in a manner that disturbs concentrations of birds or
seals or disturbing breeding or molting birds or seals or damaging native
terrestrial plants by landing aircraft, or
(iii)
driving
vehicles or walking on them or any activity that results in the significant
adverse modification of habitats of any species or population of native mammal,
bird, plant or invertebrate; "Schedule" means a Schedule annexed to
these rules;
(j)
"section"
means the section of the Act;
(k)
"take"
or "taking" means to kill, injure, capture, handle or molest a native
mammal or bird or to remove or damage native plants; and
(l)
"transitory
impact" shall have the meaning assigned to it in the Guidelines for
environmental impact assessment in Antarctica, issued by the Committee for
Environmental Protection, established under Article 11 of the Protocol for the
Protection of the Antarctic environment.
(2)
Words
and expressions used herein and not defined in these rules but defined in the
Act shall have the meanings respectively assigned to them in the Act.
CHAPTER
2 APPLICATION FOR PERMIT
Rule - 3. Prohibition of certain acts
Subject to the provisions of the Act, unless a permit has not been obtained in
accordance with these rules, it is unlawful to,-
(a)
take
of native mammals, birds or plants from Antarctica;
(b)
engage
in harmful interference;
(c)
enter
into Protected Areas and Historic Site and Monuments;
(d)
possess,
sell, export and import of native mammals, birds and plants;
(e)
introduce
non-indigenous animals, plants, non-sterile soil and microscopic organism into
Antarctica;
(f)
do
scientific, logistics, commercial fishing or tourism activities in Antarctica
or in Convention area;
(g)
violate
permit conditions;
(h)
carry
out mineral resource activities;
(i)
discharge
into the sea any garbage, plastic, oil or oily mixture, effluent, bilge water
or any food waste;
(j)
enter
into Antarctica or Indian Antarctic stations; and
(k)
engage
any such matter referred to in the Act.
Rule - 4. Application for permit
(1)
An
application for a permit by any person or an operator shall be made to the
Committee in Form 1, Form 1A, Form 1B, Form 1C and Form 2, as the case may be,
either online or offline; in both the cases and it shall be signed by the
applicant.
(2)
In
case the application under sub-rule (1) is submitted offline, it shall be
submitted in duplicate.
(3)
In
the application submitted under sub-rule (1), the name of the applicant,
complete address, address proof including Aadhaar Card or Passport, period of
permit required, purpose, nationality and date of submission shall be
indicated.
(4)
Where
the applicant is an individual, or representing group of participants or
expedition members his business or profession or institutional affiliation
shall be indicated.
(5)
Where
the applicant, proposes to make use of a vessel or an aircraft, registered in
India or outside India, he shall indicate the names, addresses and other
particulars of Operators and such vessel or aircraft and make a mention for
obtaining a permit for them.
(6)
Subject
to the provisions of the proviso to sub-rule (1) of rule 9, along with the
application under subrule (1), a fee and security of such sum as is mentioned
in Schedule 1, by way of on-line transfer payable to the Committee shall be
paid.
(7)
Three
passport size photographs of the applicant and each other person accompanying
him to carryout activities shall also be submitted along with the application
Form.
(8)
Where
the applicant is a company, corporation, partnership firm, institution, joint
venture, body corporate, society or agency or an association of persons, either
private or public, the name and address of its president, Chairperson, manager,
secretary, principal officer, or Director, by whatever name called, shall be
mentioned in the application.
Explanation.
- For the purposes of this sub-rule, the expressions,-
(a)
"agency"
means the legal entity which provides specific services or work on behalf of
another person;
(b)
"association
of person" means the integration of two or more individuals with legal
obligations and rights for a common goal primarily with the intention of making
profit;
(c)
"body
corporate" shall have the meaning assigned to it in clause (11) of section
2 of the Companies Act 2013 (18 of 2013);
(d)
"company"
shall have the meaning assigned to it in clause (20) of section 2 of the
Companies Act, 2013 (18 of 2013);
(e)
"corporation"
means a legally established entity distinct from its owners which can hold
authority, incur liability on its own assets, enter into contracts, sue and be
sued separately from its owners i.e., board of directors, management team, and
shareholders;
(f)
"institution"
means a facility, establishment, foundation or established organisation,
especially of a public character including a bank, university or church;
(g)
"joint
venture" means a combination of two or more parties that seek the
development of a single enterprise or project for profit, sharing of risks
associated with its development including project based and functional based;
(h)
"partnership
firm" shall have the meaning assigned to it in the Indian Partnership Act
1932 (9 of 1932) and shall include a limited liability partnership as defined
in the Limited Liability Partnership Act, 2008 (6 of 2008);
(i)
"society"
means a society registered under the Societies Registration Act, 1860 (21 of
1860) or any other law for the time being in force;
(9)
Where
the applicant proposes to take away some specimens of native mammals, native
birds or native plants, he shall mention numbers and description of such
specimens, mammals, birds or plants.
(10)
Whether
native mammals, native birds or native plants are to be imported into India,
the purpose for their import and ultimate disposition to be indicated.
(11)
The
description of location, time period and the manner in which the interference
or specimen of native mammals, native birds or native plants is proposed to be
removed shall be mentioned in the application.
(12)
Whether
the applicant intend to enter or stopover specially protected area or Historic
Site and Monument, shall be mentioned in the application.
(13)
Whether
to make interference with specially protected species, the purpose and time
period of such interference to be mentioned in the application.
(14)
Where
the applicant proposes to carryout activities in a specially protected area,
the applicant shall procure the copy of the management plan and make a mention
about same in the application.
(15)
Where
the applicant proposes to introduce any non-native plant or animal referred to
in section 9 or microscopic organism referred to in section10 or intend to
collect any kind of specimen referred to in section14 or intend to introduce
any soil, shall be mentioned in the application.
(16)
The
applicant shall submit along with the application, environmental impact
assessment, a waste management plan and an emergency plan.
Rule - 5. Scrutiny of application
(1)
The
Committee shall scrutinise the application and make such enquiries as deemed
necessary.
(2)
After
scrutiny and enquiry under sub-rule (1), if the Committee is satisfied that,-
(a)
the
application is in order and the activities mentioned therein may have less than
a minor or transitory impact on the Antarctic environment, it shall, within a
period of forty-five days from the date of receipt of the application under
sub-rule (1) of rule 4 grant a permit under rule 9;
(b)
the
application is in order and that such activity, mentioned therein, has
reasonable apprehension of causing minor or transitory impact on the
environment, it shall require the applicant to conduct an Initial Environmental
Evaluation and to submit a report thereon to it three months prior to the
commencement of the proposed activity as required under sub-section (5) of
section 27.
(3)
On
examination of the Initial Environmental Evaluation of proposed activity, if
the Committee is satisfied that the activities shall have more than minor or
transitory impact on the environment, it shall intimate within a period of
thirty days from the receipt of Initial Environmental Evaluation to the
applicant to submit draft Comprehensive Environmental Evaluation for examination.
(4)
On
receipt of draft Comprehensive Environmental Evaluation, if the Committee is
satisfied that the draft Comprehensive Environmental Evaluation is in order in
all respect, it shall, after examination of the same, submit it to the
Committee for Environmental Protection for its approval.
(5)
Where
the Committee for Environmental Protection requires more improvement in the
draft Comprehensive Environmental Evaluation, the applicant shall have to act
accordingly and submit Final Comprehensive Environmental Evaluation of the
proposed activities for approval.
(6)
Where
the Final Comprehensive Environmental Evaluation is submitted, the Permit shall
be granted to the applicant only on receipt of final approval of the Committee
for Environmental Protection.
(7)
Where
the Committee observed that the proposed activities are likely to cause
significant adverse impact on the Antarctic environment or the clarifications
made or the information provided under this rule is not sufficient to the
satisfaction of the Committee, it shall reject the application for reasons to
be recorded for such rejection and intimate the same to the applicant:
Provided
that before rejecting the application, the Committee shall give an opportunity
of being heard to the applicant.
CHAPTER
3 ENVIRONMENTAL EVALUATION
Rule - 6. Initial Environmental Evaluation
The Initial Environmental Evaluation to be submitted to the Committee shall
include sufficient details to assess whether a proposed activity may have more
than a minor or transitory impact and shall include,-
(a)
description
of the proposed activity including its purpose, location, duration and
intensity;
(b)
consideration
of alternate to the proposed activity, nature, special extent, reversibility or
resilience, lag time, direct impact, unavoidable impact including consideration
of cumulative impacts in the light of existing and known planned activity; and
(c)
any
other data or information as described in the "Guidelines for
Environmental Impact Assessment in Antarctica".
Rule - 7. Comprehensive Environmental Evaluation
On the directions of the Committee under sub-rule (3) of rule 5, the applicant
shall submit a draft Comprehensive Environmental Evaluation for consideration
and evaluation which shall include,-
(a)
a
description of the proposed activity including its purpose, location, duration
and intensity, and possible alternatives to the activity, including the
alternative of not proceeding, and the consequences of those alternatives;
(b)
a
description of the initial environmental reference state with which predicted
changes are to be compared and a prediction of the future environmental
reference state in the absence of the proposed activity;
(c)
a
description of the methods and data used to forecast the impacts of the
proposed activity;
(d)
estimation
of the nature, extent, duration, and intensity of the likely direct impacts of
the proposed activity;
(e)
consideration
of possible indirect or second order impacts of the proposed activity;
(f)
consideration
of cumulative impacts of the proposed activity in the light of existing
activities and other known planned activities;
(g)
identification
of measures, including monitoring programmes, that could be taken to minimise
or mitigate impacts of the proposed activity and to detect unforeseen impacts
and that could provide early warning of any adverse effects of the activity as
well as to deal promptly and effectively with accidents;
(h)
identification
of unavoidable impacts of the proposed activity;
(i)
consideration
of the effects of the proposed activity on the conduct of scientific research
and on other existing uses and values;
(j)
an identification
of gaps in knowledge and uncertainties encountered in compiling the information
required under these rules;
(k)
a
non-technical summary of the information;
(l)
the
name and address of the person or organisation which prepared the Comprehensive
Environmental Evaluation and the address to which comments thereon shall be
directed; and
(m)
any
other such data or information as described in the "Guidelines for
Environmental Impact Assessment in Antarctica".
Rule - 8. Draft Comprehensive Environmental Evaluation to be available to public
(1)
On
receipt of the draft Comprehensive Environmental Evaluation from the applicant,
the Committee shall make it available on the website of the Ministry of Earth
Sciences for information of the general public and soliciting the suggestions
or objections, if any, from the interested or affected persons.
(2)
While
making public draft Comprehensive Environmental Evaluation, the Committee shall
clearly indicate the name and address of the authority to which suggestions or
objections may be forwarded by the interested or affected persons.
(3)
The
interested or affected persons may send their suggestion or objections, if any,
to the Committee within a period of thirty days from the date of making it or
available to public.
(4)
On
receipt of the suggestions or objections, if any, or where no objection has
been received, the Committee shall consider the draft Comprehensive
Environmental Evaluation for further processing.
(5)
Where
after taking into consideration the suggestions or objections, the Committee is
of the opinion that the draft Comprehensive Environmental Evaluation require
certain modification or improvement, it may inform the applicant accordingly to
do the needful.
CHAPTER
4 GRANT AND REVOCATION OF PERMIT
Rule - 9. Permit
(1)
Where
the Committee is fully satisfied about the evaluation, contents of the
application and on receipt of such permit fee and a refundable security deposit
as mentioned in Schedule 1, it may issue a permit to the applicant in Form P 1
to P 4, as the case may be:
Provided
that where an expedition for scientific purposes is sponsored by the Central
Government or any State Government, such Government shall not be required to
deposit application fee and security amount.
(2)
The
permit issued under sub-rule (1) shall contain,-
(a)
the
name, address, occupation and photograph of the applicant;
(b)
period
of permit with date of issue and the date of expiry;
(c)
name
of persons authorised to conduct activities in Antarctica;
(d)
name
of vessels and or aircraft authorised to conduct activities in Antarctic;
(e)
the
description of authorised activities and the specification of the place, where
these are to be carried out;
(f)
the
description of native mammals, native birds or native plants, which the permit
holder is allowed to remove from Antarctica; and
(g)
the
conditions of the permit.
Rule - 10. Conditions of permit
(1)
A
permit holder shall,-
(a)
ensure
that all persons to whom the permit applies receive training designed to limit
the impact of their activities on the Antarctic environment;
(b)
inform
all persons to whom the permit applies of the requirements of the provisions of
the Act, these rules and conditions of permit, including the requirements
relating to the waste management plan and the emergency plan;
(c)
provide
the Committee an itinerary for the activities including the area of activity;
(d)
bring
to the notice of the Committee in advance the facts about any significant
changes to the itinerary, including changes in the area of activity followed
with justification for such change;
(e)
within
the time mentioned in the permit, provide to the Committee a written post visit
report in Form R1, R2 or R3 on the activities conducted within Antarctica;
(f)
declare
in the said written post visit report that all the conditions of the permit
have been fully adhered to and no harmful interference is contemplated to
native mammals, plants or species and any sample or specimen collected other
than permitted;
(g)
provide
any additional information that may be required by the Committee; and
(h)
not
transfer the permit.
(2)
The
permit issued for a vessel or an aircraft shall be kept on board the vessel or
the aircraft.
(3)
The
emergency plan referred to in clause (b) of sub-rule (1) shall,-
(a)
identify
the potential emergencies, including the potential impact on human health and
the environment, that could result from the activities to which the permit is
to relate;
(b)
include
an assessment of the relative risk of occurrence of the potential emergencies;
(c)
set
out the names and telephone numbers of personnel and describe their roles and
responsibilities during an environmental emergency;
(d)
identify
the training required for emergency response personnel;
(e)
enlist
the equipment that will be available to deal with potential emergencies and
indicate where it is located;
(f)
identify
the procedures by which emergency resources, including personnel, equipment,
facilities and financial resources, can be obtained, and
(g)
describe
the procedures for implementing, reviewing and updating the plan.
Rule - 11. Failure to comply with conditions
(1)
If
the permit-holder or any other person to whom the permit applies, fails to
comply with any condition of the permit, the permit-holder shall give the
Committee,-
(a)
notice
of such failure without delay and in any event within fifteen days after the
day on which the failure to comply occurs; and
(b)
a
written report, within forty-five days, after the day on which the failure to
comply occurs, that identifies the condition and explains the failure to
comply.
(2)
Where
the Committee is satisfied that failure continues for a long time beyond three
days or it was an intentional lapse on the part of the permit-holder or any
other person to whom the permit applies, then the Committee may suspend or
cancel the permit.
(3)
Where
the failure causes a significant damage to the Antarctic environment, the
Committee shall order for recovery for damages as per section 39 and section
49.
Rule - 12. Production of permit on demand
(1)
When
there is reason to believe that a person has carried out or is carrying out or
about to carry out any activity for which a permit is required under the
provisions of the Act or these rules, the Inspector or any member of the
inspection team or an observer designated under article VII of the Treaty may
demand the production of the permit.
(2)
Every
permit holder and every other person to whom the permit applies shall keep all
times in his possession the permit while in Antarctic and produce the same on
demand by the authorities referred to in subrule (1).
(3)
A
permit issued for a vessel or an aircraft shall be kept by the operator on
board the vessel or the aircraft, as the case may be, and produced for
inspection on demand by the authorities referred to in sub-rule (1).
(4)
The
authorities referred to in sub-rule (1) shall have the power to demand production,
inspect and take copy of the permit.
Rule - 13. Suspension or cancellation of permit
(1)
Where
it appears to the Committee that,-
(a)
the
permit was procured by fraud or misrepresentation;
(b)
the
application for the permit contained material error or omission;
(c)
the
holder of the permit, or a person mentioned in it, or the description provided
in it, are not fit and proper person to carry out any activity authorised by
the permit;
(d)
there
has been a material change in the circumstances under which an activity was
authorised by the permit;
(e)
the
Committee got information about such environmental impact due to activity which
was not available at the time of grant of permit;
(f)
continuation
of the activity would have an unacceptable impact on the Antarctic environment;
(g)
the
carrying out or continuation of an activity authorised by the permit would be
undesirable because of an emergency, which has arisen subsequent to the grant
of permit;
(h)
the
person to whom the permit was granted or any person mentioned in it shall not
be able to comply with any material condition of the permit;
(i)
there
has been a breach of condition of the permit;
(j)
the
holder of the permit has purported to transfer, or has given possession of, the
permit or a copy of it, to a person who is not entitled to hold it; or
(k)
the
permit or a copy of it has been defaced or altered;
it
may suspend, till pending the completion of an inquiry under sub-section (1) of
section 29, or cancel, wholly or in part, any permit granted under the
provisions of the Act and these rules.
(2)
While
exercising its powers under sub-rule (1), the Committee shall give thirty days
notice to the permitholder of its intention to do so and after due
consideration of any representation made in writing by or on behalf of the
permit-holder may suspend or cancel the permit.
(3)
If,
by reason of the urgency of the matter, it appears to the Committee to be
necessary for it to do so, it may provisionally suspend a permit without
serving a notice, but it shall in any such case comply with the requirement of
sub-rule (2) as soon thereafter as is reasonably practicable, and shall then
either,-
(a)
revoke
the provisional suspension of the permit; or
(b)
suspend
or cancel the permit.
(4)
The
permit-holder or any person having possession or custody of any permit which
has been suspended or canceled under this rule shall surrender it and any
copies of it to the Committee immediately.
Rule - 14. Renewal of permit
(1)
Where
the activities to be carried out in accordance with the conditions of a permit
are still to be accomplished and the period authorised by the permit is going
to expire, the permit-holder may make an application to the Committee at least
sixty days before the date of expiry of the authorised period,
(2)
The
Committee may renew such permit in the first instance for a maximum period of
one year on payment of a renewal fee as provided in the Schedule 1.
Rule - 15. Security refund
(1)
Where
the permit-holder has completed his activities for which the permit was granted
and he along with other persons to whom the permit applies, return to India,
may make an application to the Committee for refund of security.
(2)
If
the Committee is satisfied on the basis of post visit report of the activities
in Form R1, R2 or R3 and the report of the authorised person in this regard,
that there was no violation of the provisions of the Act and these rules and
the conditions of the permit, it may allow the refund of security amount.
CHAPTER
5 SPECIALLY PROTECTED AREA, MARINE PROTECTED AREA, HISTORIC SITES AND MONUMENTS
AND PROTECTED SPECIES
Rule - 16. Specially protected areas and species
(1)
For
the purposes of the Act and these rules the Antarctic Specially Protected Area,
Marine Protected Area, Antarctic Specially Managed Area and Historic Site and
Monument and Protected Species shall be such, as described in Schedule 2.
(2)
No
person shall enter any Protected Area, Historic sites and Monuments referred to
in Schedule 2, without obtaining a Permit or authorisation from the Committee.
Rule - 17. Permit for protected area
(1)
While
submitting application for granting a permit for entering into the protected
area, the applicant shall declare that he is having the knowledge about the
Management Plan of protected area and shall take into account the contents of
such Management Plan.
(2)
Any
permit granted for entry in to a protected area shall provide,-
(a)
the
extent and location of the activity proposed in specially protected area;
(b)
the
activities that are authorised in relation to the specially protected area;
(c)
when,
where and by whom the activities may be conducted;
(d)
any
other condition that may be imposed by the Management Plan;
(e)
details
relating to the project;
(f)
the
validity of the permit; and
(g)
the
name, designation and affiliation of authorised signatory who shall grant
permit:
Provided
that a permit for entry into Marine Protected Area for scientific research
shall be granted in accordance with the procedure indicated in the conservation
measures and rules of procedure of the Commission for Conservation of Antarctic
Marine Living Resources;
Provided
further that for Specially Protected Area, the permit may be granted only for
compelling scientific purposes which cannot be served elsewhere and which shall
not jeopardise the natural ecological system in that Area.
Explanation.-
For the purposes of this rule, the expression "Management Plan" means
the Management Plan of Antarctic Specially Protected Area or Marine Protected
Area or Historic Site and Monuments as referred to in Schedule 2.
Rule - 18. Grant of permit for specially protected species
For the purposes of sub-clause (d) of the proviso to clause (ii) of sub-section
(1) of section 14, the Committee may issue a permit for taking of a specially
protected species set out in Appendix-A of Annex II to the Protocol, if the taking,-
(a)
is
for a compelling scientific purpose;
(b)
shall
not jeopardize the survival or recovery of that species or the local population
of that species; and
(c)
is
done using non-lethal techniques, if applicable.
Rule - 19. Permit to take native species
The Committee may grant a permit for taking native species,-
(a)
to
provide specimens for scientific study or scientific information;
(b)
to
provide specimens for museums, herbaria, zoological or botanical gardens or
other educational or cultural institutions or uses; or
(c)
to
provide for unavoidable consequences of other scientific activities.
Rule - 20. Manner of tackling native species
(1)
The
Committee shall include in a permit for taking of native mammals or birds the
condition that the taking of those mammals or birds shall be done in the manner
that involves the least degree of pain and suffering practicable being
inflicted on them.
(2)
While
granting a permit under rule 20, the Committee shall take in to account the
permits granted by all other Parties to the Protocol to ensure that,-
(a)
only
small numbers of native mammals or native birds are killed so that the mammals
and birds could be replaced by normal natural reproduction during the following
season; and
(b)
the
diversity of species, as well as the habitats essential to their existence and
the balance of the ecological systems existing within the Antarctic are
maintained.
Rule - 21. Permit for non-native species
(1)
The
Committee may grant a permit to allow introduction into Antarctic of animals or
plants of a species enumerated in Article 4 of Annex II to the Protocol.
(2)
The
Committee shall not grant a permit to allow any dog to take in the Antarctica.
(3)
Where
any permit is granted by the Committee under sub-rule (1), it shall provide in
the said permit,-
(a)
the
species which may be introduced into the Antarctica;
(b)
the
number of members of that species which may be introduced;
(c)
the
age and sex of the members of which species may be introduced;
(d)
the
precautions to be taken to prevent,-
(i)
any
escape of the members of species,
(ii)
any
contact of the members of species with native fauna and flora, and
(iii)
any
interference with an ecosystem of the Antarctic.
Rule - 22. Removal of species
Before the expiry of the date of permit, the permit holder shall remove from
Antarctic,-
(a)
any
plant or animal in respect of which a permit is granted under sub-rule (1) of
rule 21, and any progeny of such plant or animal; and
(b)
any
other plant or animal that the permit holder has introduced and which is not
indigenous to the Antarctic, including the progeny of any such plant or animal,
unless the plant or animal poses no risk to native flora or fauna or to an
ecosystem of Antarctic.
Rule - 23. Disposal of species
The permit holder shall dispose of species before the expiry of the date of
permit, in the following manner, namely:-
(a)
in
a case referred to in clause (a) of sub-rule (3) of rule 21, by incineration or
an equally effective means that eliminates risk to fauna and flora and to the
ecosystems of the Antarctic; and
(b)
in
a case referred to in clause (b) of sub-rule (3) of 21, by incineration or an
equally effective means that renders the plants or animals sterile.
Rule - 24. Disposal of parts and products of plants and animals
A permit holder shall keep all parts and products of plants and animals which
are introduced into the Antarctica, under carefully controlled conditions and
before the expiry of the permit shall dispose them of in a manner that
eliminates any risk to native fauna and flora and to the ecosystem of the
Antarctica.
CHAPTER
6 REMOVAL AND DISPOSAL OF WASTE AND ENVIRONMENTAL EMERGENCY
Rule - 25. Waste management
The permit holder shall remove the waste from the Antarctic to the country from
which the activities generating waste were organised or to any other country in
which arrangements have been made for the disposal of the waste in accordance
with the terms of the relevant international agreements.
Rule - 26. Field camp waste removal
The permit holder shall take all reasonable steps to remove waste generated at
a field camp to,-
(a)
the
station or vessel from which the field camp is supported; or
(b)
another
station or vessel if the permit holder has arranged for the waste to be
disposed off.
Rule - 27. Waste management plan
(1)
The
head of the Stations operation or maintenance shall prepare the waste
management plan and emergency plan as required under sub-section (6) of section
27.
(2)
Any
person making an application for obtaining a permit under the provisions of the
Act and these rules made thereunder shall submit a waste management plan along
with his application to the Committee.
(3)
The
waste management plan referred to in sub-rule (1) shall apply to all waste
generated by the activities to which the permit is to relate, including the
waste generated by vessels, aircraft, stations and field camps.
(4)
The
said waste management plan shall,-
(a)
include
measures for the reduction, recycling, safe storage, removal and disposal of
waste from the activities to which the permit is to relate, as well as an
undertaking by the permit holder to comply with these conditions;
(b)
include
that the permit holder shall take reasonable steps to minimize the amount of
waste generated or disposed of in the Antarctica;
(c)
include
current and planned waste management measures, including measures for final
disposal;
(d)
include
current and planned measures for analysing the effects of waste and waste
management on the Antarctic environment;
(e)
include
other measures to minimize any negative effects of waste and waste management
on the Antarctic environment; and
(f)
include
the method used for recording waste.
Rule - 28. Annual review of waste
Where the permit is granted for a period of more than one year, than after the
completion of one years period of the grant of the permit, within thirty days,
the permit holder shall review and update his waste management plan and provide
a copy of the classified waste updated plan to the Committee.
Rule - 29. Classification of waste
After review and updating waste management plan under rule 28, the permit
holder shall classify the waste produced in the process of activities as,-
(a)
sewage
and domestic liquid waste - Group-1;
(b)
other
liquid waste and chemicals, including fuel and lubricants - Group-2;
(c)
solids
to be combusted - Group-3;
(d)
other
solid waste - Group- 4; and
(e)
radioactive
material- Group- 5.
Rule - 30. Kinds of wastes to be removed
Before the expiry of a permit, the permit holder shall remove from the
Antarctica the following waste if they are generated by him,-
(a)
radioactive
materials;
(b)
used
or spent electrical batteries;
(c)
solid
and liquid fuels;
(d)
waste
containing heavy metals or toxic persistent organic compounds;
(e)
polyvinyl
chloride, polyurethane foam, polystyrene foam, rubber electronics scrap,
lubricating oils, treated wood or wood products and other products which
contain additives that could produce harmful emissions if incinerated;
(f)
all
other plastic waste, except low density polyethylene containers including bags
for storing waste;
(g)
fuel
drums, except if their removal would result in a greater adverse environmental
impact than leaving them in their existing locations;
(h)
other
solid, non-combustible waste, except if their removal would result in a greater
adverse environmental impact than leaving them in their existing locations; and
(i)
the
solid residue of combustible waste burned in an incinerator.
Rule - 31. Removal of liquid waste
The permit holder shall treat and dispose liquid waste including sewage and
domestic liquid waste before the expiry of the permit in the manner referred to
in section 35.
Rule - 32. Removal of other waste
Before the expiry of a permit, the permit holder shall also remove the
following waste from the Antarctic, unless they are incinerated, autoclaved or
otherwise treated to be made sterile,-
(a)
residues
of carcasses of imported animals;
(b)
laboratory
cultures of micro-organisms and plant pathogens; and
(c)
introduced
avian products.
Rule - 33. Incineration of combustible waste
(1)
Before
the expiry of a permit, the permit holder shall burn all combustible waste,
other than those which can be removed from the Antarctica.
(2)
In
the process of incineration, the permit holder shall make use of such
incinerators which meet emission standards described in Schedule 3 and the
process described in manual recommended by the Committee for Environmental
Protection and Antarctica Treaty Consultative Meeting.
Rule - 34. Disposal of sewage and domestic liquid waste
The sewage or domestic liquid waste, other than sewage or domestic liquid waste
from a vessel, may be disposed off directly into the sea if,-
(a)
the
sewage or waste is generated at a station with an average weekly occupancy over
the austral summer of at least thirty individuals;
(b)
the
sewage or waste is macerated before it is disposed off;
(c)
all
reasonable steps are taken to discharge the sewage or waste into the sea at a
place where conditions exist for dilution and dispersal of the sewage or waste;
and
(d)
the
effluent parameters are in accordance with the standards described in the
Schedule 3.
Rule - 35. Treated sewage
The by-product of sewage, other than sewage from a vessel, treated by rotating
biological contactor or any similar sewage processing system and possibly with
a tertiary treatment unit may be disposed into the sea, if the disposal,-
(a)
does
not adversely affect the local environment; and
(b)
is
in accordance with Annex III to the Protocol.
Rule - 36. Emission Standards
Emission Standards described in Schedule 3 shall be applicable only to
machineries, equipment and vehicles manufactured in India, but for imported
machineries, equipment and vehicles all the emissions from vehicle, machineries
the standards of Country of origin shall be applicable and shall be less than
as low as practically possible.
Rule - 37. Emergency Plan
(1)
The
emergency plan for station, vessel and aircraft shall be prepared according to
guidelines of Council of Managers of the National Antarctic Programme
established in pursuant to the Treaty on the subject.
(2)
In
the event of an emergency during undertaking activities in Antarctica, the
permit holder shall, without any delay inform the Committee about all measures
undertaken in response to an environmental emergency in Antarctica.
(3)
The
Committee shall circulate the information received under sub-rule (1) to all
Parties and the Committee for Environmental Protection.
Rule - 38. Maintenance of record of each removal and disposal
(1)
The
permit holder shall record each removal and disposal of waste, including sewage
discharge from vessel and maintain the record of the same.
(2)
Where
the permit is granted for a period of more than one year, including the term of
any renewal of the permit, the permit holder shall submit to the Committee the
details of all removals and disposals and locations where waste have been
incinerated or otherwise disposed off in Antarctica within a period of thirty
days from the date of complication of one year of granting the permit and also
before thirty days from the date of expiry of the permit.
Rule - 39. Cost of response action for environmental emergencies
Where no response action is taken by the Operator or by any Party, the Operator
shall be liable to such cost and penalty which is described in Annex VI to the
Protocol on Environmental Protection to the Antarctica Treaty.
Rule - 40. Other International obligations
(1)
The
Operator shall undertake to ensure that vessel granted Permit for entry into
Antarctica or Convention area shall bear the national flag of the country of
Operator and national flag of chartered Party.
(2)
Every
vessel entering into Antarctica or Convention area shall be fitted with tanks
of sufficient capacity on board for the retention of,-
(a)
sludge;
(b)
dirty
ballast water;
(c)
tank
washing water;
(d)
oil
residue and mixture;
(e)
garbage;
(f)
noxious
liquid substances, and shall have arrangements to discharge or dispose of above
waste.
CHAPTER
7 TERM OF OFFICE AND ALLOWANCES TO NOMINATED MEMBERS AND PROCEDURE IN MEETINGS
OF COMMITTEE
Rule - 41. Term of office of Chairperson and Ex-officio members
(1)
The
term of office of the Chairperson and ex officio member shall continue so long
as he holds the office by virtue of which he is a Chairperson, or an ex-officio
member.
(2)
The
term of office of a nominated member shall be three years from the date of his
notification.
(3)
A
nominated member shall be eligible for re-nomination for next one term.
(4)
A
nominated member may resign from his office by writing under his hand addressed
to the Central Government and his resignation shall take effect from the date
it is accepted by the Central Government or on the expiry of thirty days from
the date of receipt of written communication by the Central Government,
whichever is earlier.
(5)
A
nominated member may be removed by the Central Government from his office if
he,-
(a)
is
of unsound mind and stands so declared by a competent court; or
(b)
becomes
bankrupt or insolvent; or
(c)
convicted
of an offence involving moral turpitude; or
(d)
absents
himself from three consecutive meetings of the Committee without obtaining
leave of absence from the Chairperson; or
(e)
in
the opinion of the Committee, has failed or is unable to carry out his duties
satisfactorily:
Provided
that before issuing an order for removal, the Committee shall, give such member
an opportunity of being heard in the matter.
(6)
One
of the members nominated under clauses (c) and (d) of sub-section (1) of
section 23 may be a women
Rule - 42. Allowance payable to nominated member
(1)
A
nominated member, if he is not in the service of the Government or a State
Government or any statutory body, shall be paid an allowance of six thousand
rupees per day for attending meetings of the Committee.
(2)
A
nominated member shall be entitled to such allowance for his to-and-fro journey
to the place of meeting as may be admissible to a Joint Secretary to the
Government.
Rule - 43. Procedure of Committee meetings
(1)
The
Committee shall meet at least twice in a calendar year.
(2)
A
meeting of the Committee shall be presided over by the Chairperson and in his
absence by a member chosen by members present in the meeting.
(3)
The
quorum for the meeting of the Committee shall be fifty per cent. of its total
strength.
Explanation.-For
the purposes of this sub-rule, total strength shall not include the Chairperson
or members whose places are vacant.
(4)
Where
a meeting of the Committee could not be held for want of quorum, then, meeting
shall automatically stand adjourned to the same day at the same time and place
in the next week or if that day is a national holiday, till the next succeeding
day, which is not a national holiday, at the same time and place.
(5)
Every
question brought before any meeting of the Committee shall be decided by a
majority of members present and voting at the meeting before which the matter
is brought.
(6)
In
the case of an equality of votes, the Chairperson or the member, as the case
may be, presiding over the meeting, shall have a second or casting vote.
(7)
The
Member Secretary, with the prior approval of the Chairperson, shall convene the
meeting of the Committee.
(8)
The
meeting notice along with the agenda shall be delivered at the address registered
with the Committee of the Chairperson and members at least seven days before
the date of the meeting.
(9)
The
meeting notice and the agenda shall be sent by hand delivery or by post or by
electronic means.
(10)
The
record of business transacted at every meeting of the Committee shall be
prepared by the Member Secretary and signed by the Chairperson or the member,
as the case may be, presiding at such meeting.
Rule - 44. Filling up of casual vacancy
(1)
Where
the office of a nominated member is vacated before his term of office expires
in the normal course, the resultant casual vacancy shall be filled by the
Government in the manner referred to in section 23.
(2)
Any
person so appointed under sub-rule (1) shall hold office only till date up to
which the member in whose place he is so nominated would have held office, if
it had not been vacated.
CHAPTER
8 MAINTENANCE AND ADMINISTRATION OF ANTARCTIC FUND
Rule - 45. Maintenance and administration of Fund
(1)
All
receipts of the Committee shall be credited to the Antarctic Fund and all
payments of the Committee shall be made there from.
(2)
The
Committee shall have power, subject to the provisions of the Act and these
rules, to spend such sums to cover all administrative expenses of the Committee
and on objects and for purposes authorised by the Act and such sums shall be
treated as expenditure out of the Fund of the Committee.
(3)
All
moneys standing at the credit of the Committee which cannot immediately be
applied as provided in subrule (2), shall be,-
(a)
deposited
in the State Bank of India or any other Scheduled bank; and
(b)
invested
in the securities of the Government.
Explanation.-
In this sub-rule the expression "Scheduled bank" has the same meaning
as assigned to it in clause (e) of section 2 of the Reserve Bank of India Act,
1934 (2 of 1934).
Rule - 46.
The Committee may set apart such amounts as a reserve fund for the purposes of
expanding existing facilities or services or creating new facilities or
services at Indian stations, historic sites, and monuments and specially protected
areas in the Antarctica.
Rule - 47. Preparation of annual financial estimates
(1)
The
Committee shall, before the commencement of each financial year, prepare a
statement of the program of its activities during the forthcoming financial
year as well as financial estimate in respect thereof.
(2)
The
statement prepared under sub-rule (1) shall not less than three months before
the commencement of each financial year be submitted for approval to the
Government.
(3)
The
statement and the financial estimates of the Committee, may with the approval
of the Government, be revised by the Committee.
Rule - 48. Maintenance of accounts and record
(1)
The
Committee shall maintain proper accounts and other relevant record and prepare
an annual statement of accounts including the profit and loss account and the
balance-sheet in Form 3 annexed to these rules.
(2)
In
accordance with the provisions of sub-section (2) of section 52, the accounts
of the Committee shall be audited annually by the Comptroller and
Auditor-General of India and any expenditure incurred by him in connection with
such audit shall be payable by the Committee to the Comptroller and
Auditor-General of India.
(3)
The
accounts of the Committee as certified by the Comptroller and Auditor-General
of India together with the audit report thereon shall be forwarded annually to
the Central Government and that Government shall cause the same to be laid
before both Houses of Parliament.
CHAPTER
9 INSPECTIONS
Rule - 49. Qualifications and experience of Inspector
A person having following qualifications and experience shall be designated as
an Inspector for the purposes of this Act, namely:-
(a)
Masters
degree from a recognised University in science or law; or
(b)
Bachelors
degree in engineering or technology from a recognised University,
(c)
having
seven years regular experience after obtaining the degree referred to in
clauses (a) and (b) in,-
(i)
teaching
at graduate or post-graduate level;
(ii)
research
and development;
(iii)
survey;
(iv)
administration;
or
(v)
supervision.
Rule - 50. Manner of inspection
(1)
The
Committee shall communicate in advance through the Ministry of External Affairs
to other Party or Parties the names and other particulars of the observers
consisting of the inspection team.
(2)
The
inspection team shall have freedom of access at any time to any or all areas of
Antarctica.
(3)
All
areas of Antarctica, including all stations, installations and equipment within
those areas, and all ships and aircraft at points of discharging or embarking
cargoes or personnel in Antarctica, shall be open at all times for inspection
by observer of inspection team.
(4)
The
observers of the inspection team shall have the authority to carry out aerial
observation at any time over any or all areas of Antarctica.
(5)
Observers
of inspection team undertaking an inspection of a vessel shall have the
authority to,-
(a)
inspect
only a vessel flying the flag of a Party;
(b)
undertake
inspection in terms of Article VI and Article VII (3) of the Antarctic Treaty;
(c)
inspect
vessels other than those chartered by Parties only with consent of the master
of the vessel.
(6)
The
inspection team shall submit report of inspection to the Parties whose
stations, installations, equipment, vessel or aircraft are have been inspected.
(7)
The
inspection shall be carried out in accordance with the requirements provided in
Schedule 4.
Rule - 51. Qualifications and experience of Analyst
The analyst designated for the purposes of the Act shall be having,-
(a)
Masters
degree from a recognised University in science with seven years experience in
research and analysis and handling instruments; or
(b)
Bachelors
degree in engineering or technology from a recognised University with seven
years regular experience in research and analysis and handling instruments.

limit for diesel generator sets (upto 1000 KVA) manufactured on or after the
1st January, 2005
The
maximum permissible sound pressure level for new diesel generator (DG) sets
with rated capacity upto 1000 KVA, manufactured on or after the 1st January,
2005 shall be 75 dB(A) at 1 metre from the enclosure surface.
Provided;
(a)
The
diesel generator sets should be provided with integral acoustic enclosure at
the manufacturing stage itself.
(b)
The
DG set shall be provided with proper exhaust muffler with insertion loss of
minimum 25 dB (A)

Indian Antarctic Act, 2022 and rules made thereunder, including the obligation
of Treaty, Convention and the Protocol.

Permit
holder to ensure the expedition members covered by this Permit shall be fully
informed of all their environmental responsibilities, including interference to
wildlife, introduction of non-native species, waste disposal, significance of
historic sites and monuments and protected areas.

(1)
Permit

Entry
to the Antarctica Specially Protected Area/ Marine Protected Area/Historic Site
and Monuments shall be minimum to avoid interference.
(3)
All
authorised person shall carry a copy of the Management Plan while entering into
Protected Area.
(4)
All
intended activity shall be conducted according to Management Plan of the
Protected Area.
(5)
To
avoid introduction of non-native species visitors shall clean all footwear,
cloth, sampling equipment, instrument, and markers, before entering in to
Protected Area.
(6)
Vessel,
boats shall be left at the shoreline during access to the area to avoid any
disturbance.
(7)
Verbal
communication and noise level generated from any means shall be kept minimum.
(8)
Vehicles
are prohibited within the Protected Area.
(9)
Permit
holder to ensure the expedition members covered by this Permit shall be fully
informed of all their environmental responsibilities, including interference to
wildlife, introduction of non-native species, waste disposal, significance of

This
Form is to be completed by any person, companies or organisation visiting
Antarctic continent or any island or territory within the Antarctic Treaty
region for the purposes of recreation or tourism. The form consists of two
parts:
an
Expedition Record (Part 1) and a Site Visit Record (Part 2) which be completed
by the Expedition leader or Captain and submitted to the Committee. The
Expedition Record (Part 1) be completed for every expedition to the Antarctic
region regardless of whether any landings or visits to sites were made. The
Site Visit Record (Part 2) only be completed if visits or landings were made to
sites in the Antarctic region. Site Visits conducted exclusively by cruise only
vessels can include waterways. This completed form will be processed
electronically by a computer, to reduce errors and manual interaction. It is
imperative that this document be completed thoroughly and accurately.
