Pradesh Police Department (Recruitment Of Constables) Rules, 2024

In
exercise of the powers conferred by sub-section (1) of section 141 read with
section 23 of the Himachal Pradesh Police Act, 2007 (Act No. 17 of 2007), the
Governor, Himachal Pradesh, proposes to make the following rules for carrying
out the purposes of the Act ibid;
If any
person, likely to be affected by these draft rules has any objection(s) or
suggestion(s) with regard to the same, he/she may send the same to the
Secretary (Home) to the Government of Himachal Pradesh, Shimla-2 within a
period of 15 days from the date of publication of this notification in the
Rajpatra (e-Gazette), Himachal Pradesh.
Objection(s)
or suggestion(s), if any, received within the above stipulated period, shall be
taken into consideration by the Government before finalization of the said
rules, namely :-
PART 1
Rule - 1. Short title and commencement
(1)
These rules may
be called The Himachal Pradesh Police Department (Recruitment of Constables)
Rules, 2024.
(2)
These rules shall
come into force from the date of their publication in the Rajpatra (e-gazette),
Himachal Pradesh.
Rule - 2. Repeal and savings
(1)
The Himachal
Pradesh Police Department (Recruitment of Constables) Rules, 2021 notified vide
this Department Notification No. Home (A) A(3)-2/2020, dated 05-08-2021 and
published in Rajpatra, Himachal Pradesh dated 09th August, 2021 are, hereby,
repealed.
(2)
Notwithstanding
such repeal, any appointment made or anything done or any action taken under
the rules so repealed under sub-rule (1) supra, shall be deemed to have been
validly made or done or taken under these rules.
PART 2
Rule - 3. Recruitment of constables
Recruitment
shall be done 100 percent on regular basis once a year or at such frequency as
may be required based on vacancies as may be determined.
Rule - 4. Number and apportionment of posts
(1)
The number of
posts shall be determined/ created by the Government, from time to time.
(2)
Posts of
Constables will be filled on the basis of the ratio of population of the
district. Women shall be provided thirty percent (30%) horizontal reservation
and will be filled up in all the categories of vertical reservation separately along
with horizontal reservation being available to other categories.
(3)
Vacancies of
Constable (Driver) shall be filled from among male candidates only
Rule - 5. Appointing authority
Commandants
of Battalions shall be the appointing authority.
Rule - 6. Pay and allowances
The
official shall draw such pay and allowances as may be determined by the State
Government in this regard, from time to time.
Rule - 7. Reservation
(1)
Vertical
Reservation amongst SC/ST/ OBC shall be as per Government instructions on the
subject from time to time. Further, the persons belonging to Economically
Weaker Sections (EWSs) who are not covered under the scheme of reservation for
SCs, STs and OBCs shall be provided 10% vertical reservation in direct
recruitment. Special horizontal reservation for women, ex-servicemen, wards of
freedom fighters, Antyodaya/ BPL, distinguished sports persons and Home Guards
will be given as per Government instructions issued from time to time.
(2)
The requisition
for vacancies of Ex- servicemen shall be sent by the Director General of
Police, HP to the Secretary, Ex- servicemen Cell, Hamirpur to sponsor names.
The requisition shall specify the number of posts for each District and the
names will be sponsored accordingly.
(3)
In the event of
non-availability of suitable/eligible candidate against the vacancy reserved
for Ex-servicemen, the vacancy shall be carried forward for 2 calendar years
and in the 3rd year the said vacancy shall be filled up from the dependent
sons, daughters and wives of Ex-Servicemen. If in the 3rd year, the
eligible/suitable candidate for whom the vacancy is reserved is not available,
the same may be filled up from the respective residuary category to which the
point belongs in that year itself. When it is obvious that Ex-servicemen would
not at all be available for appointment to any category of posts, the posts so
reserved for ex-servicemen may be filled-up by dependent sons, daughters and
wives of ex-servicemen with the prior concurrence of the Exservicemen Cell,
Himachal Pradesh. In case, sons, daughters and wives of Ex- servicemen for
posts authorized to be filled are not available then reservation will be
carried forward for 2 calendar years where after the vacancy shall be filled up
from the respective residuary category to which the point belongs.
Rule - 8. Eligibility

(2)
In case of
Ex-serviceman minimum qualification shall be matriculation. However, whenever
the vacancies go to the wards of Ex-serviceman the education qualification will
be 10+2.
(3)
A candidate shall
be eligible for recruitment to the post of Constable, if he/she has passed
Matriculation and 10+2 from any Institution/School/Board situated within
Himachal Pradesh:
Provided
that this condition shall not apply to Bonafide Himachalis
Rule - 9. Physical standard test
(1)
All measurements
will be taken by a Medical Officer which shall be recorded in the Candidate
Sheet and signed by the Medical Officer and countersigned by a Member of the
Recruiting Agency. This process will be video graphed. The Committee shall
award marks only for height as per the following table:-

(2)
Candidates who do
not meet the standards specified in sub-rule (1) of rule 8 shall be summarily
declared unfit and informed accordingly.
Rule - 10. Physical efficiency of candidates
(1)
Physical

(2)
The Recruting
Agency shall cause to be entered the record of timing and distance of the
Physical Efficiency Test in the Candidates Sheet which will be duly signed by
each Member of the Recruiting Agency.
(3)
Candidates who
fail to qualify in any event will be disqualified forthwith and will not
participate in the remaining events.
(4)
Videography of
the outdoor Physical Efficiency Test and Written Examination will be done for
the sake of transparency.
(5)
The dope test
shall be carried out to detect narcotics opiates at the outset of Physical
Efficiency Test during the recruitment of Constables.
Rule - 11. Recruiting Agency
The
Recruiting Agency shall be H.P. Public Service Commission or any other agency
as decided by the State Govt. from time to time. The written examination in
online mode, shall be conducted by recruiting agency. The details of the
conduct and evaluation of the written examination will separately notified by
the recruiting agency. Written examination will be of 90 marks. The syllabus
for the above written examination shall be of 10+2 standard. The questions
papers will be provided in both languages i.e. English and the Hindi version.
Rule - 12. Evaluation
The
merit list to the post of Constables in the rank of Constables Class-III posts
shall be made on the basis of the merit of written examination and specified
educational qualification followed by evaluation, based on the following
parameters:-

Rule - 13. Publication of final result
(1)
The list of selected candidates so received from the
Recruiting Agency shall also be published in the notice Board.
(2)
Waiting List shall also be prepared at the same time in
similar manner which shall not be displayed and shall be kept in the office of
Recruiting Agency to take care of an eventuality when a suitable candidate
either fails to join or is not found fit for appointment subsequently.
Rule - 14. Medical examination
(1)
The selected candidates shall undergo a medical examination
as per instructions of the State Government issued from time to time.
(2)
Suitable candidates from the waiting list shall be
substituted in the place of the candidates who have been finally declared
medically unfit.
Rule - 15. Character and antecedents
(1)
The verification of character and antecedents of the
selected candidate who have been selected provisionally will be carried out
through concerned district police but the process for issuance of appointment
letters will not be withheld due to pendency of such verification. The
appointing authorities will issue provisional appointment letters after
obtaining the filled and duly signed attestation form and self declaration from
the candidate. In case, a candidate is found to have been convicted in a court
of law, the applicant/candidate shall not be offered appointment irrespective
of the nature of the offense and the period of sentence.
(2)
In case of a candidate against whom investigation trial is
pending the offer of appointment may be held in abeyance until
candidate/applicant get clearance during investigation or trial. Such a
candidate shall not be deemed to have become overage on this account alone.
(3)
The post may be filled up from the waiting list and the
candidate will be offered a subsequently occurring vacancy.
Rule - 16. Appointment and probation
The candidates appearing in the
final merit list after declaration of medical fitness and verification of
character and antecedents shall be issued a letter of appointment by the
concerned appointing authority. All Police Constables on initial recruitment
shall undergo induction training/Recruits Training Course in batches as
determined by the Director General of Police, HP. The period of training shall
be 9 months. After completion of basic Recruitment Training Course (RTC) the
newly recruited Constables will undergo Special Commando Course at PTC Daroh.
The Principal PTC Daroh will design a 04 weeks Commando Course for new recruits
to make them Special Commandos. The syllabus of training and the schedule
thereof shall be as may be notified by the Director General of Police, through
Standing Orders. On successful completion of the RTC and Special Commando
Course, the candidates will be called as Special Commando Constables. In case a
recruit is unable to pass the recruitment training course and the special
commando course, his/her service shall be liable to be terminated. Recruits
will be confirmed only after successful completion of RTC & Special
Commando Course and probation of 2 years including RTC & Special Commando
Course.
Rule - 17. Roster and seniority
(1)
A district wise 100 point roster to determine the number of
vertically and horizontally reserved vacancies in respect of Constable cadre
shall be followed in terms of provisions of the rules and instructions issued
by the State Government from time to time, if applicable.
(2)
The seniority of the selected Constables shall be maintained
by the respective Appointing Authority as per level of the cadre in accordance
with the rules/ instructions issued by the State Government on the subject from
time to time.
Rule - 18. Power to relax
Where the State Government is of the
opinion that it is necessary or expedient to do so, it may, by order for
reasons to be recorded in writing, relax any of the provision(s) of these
rules.
