HIMACHAL PRADESH LIVESTOCK IMPROVEMENT RULES, 1969

PREAMBLE

In exercise of the powers conferred by sub-section (1) of section 21 of the Himachal Pradesh Livestock Improvement Act, 1968, the Lieutenant Governor, Himachal Pradesh is pleased to make the following rules under the aforesaid Act after previous publication in Rajpatra Himachal Pradesh, dated 25-10-1969 and these shall come into force immediately:-

Rule - 1. Short title.

These rules may be called the Himachal Pradesh Livestock Improvement Rules, 1969.

Rule - 2. Definitions.

In these rules, unless there is anything repugnant in the subject or context:-

(i)       "the Act" means the Himachal Pradesh Livestock Improvement Act, 1968;

(ii)      "Castrate" means to perform an operation in accordance with these rules for the purpose of removing the reproductive power of a bull and the words "Castrated and Castration" shall be construed accordingly;

(iii)     "Form" means a form appended to these rules;

(iv)    "Section" means a section of the Act l

(v)      "Village" means an area declared as specified area under section 3;

(vi)    words and expressions not defined in these rules but defined in the Act, shall have the meaning assigned to them in the Act.

Rule - 3. Section 5.

Intimation with regard to the possession of any bull required to be given under section 5 to the Livestock Officer shall be given within 15 days from the date of the issue of the notification under section 3, or from the date of coming into possession of the bull, as the case may be.

Rule - 4. Section 6.

The order to be issued under section 6 by the Livestock Officer requiring any person keeping a bull to present the bull for inspection shall be Form No. 1.

Rule - 5. Section 7.

Where after inspection of the bull produced before him and in pursuance of the order, issued under section 6, the Livestock Officer is of the view that the bull is capable of being used for breeding purposes and should be certified as approved within the meaning of section 7, he shall certify the bull as approved and cause it to be branded with a mark given below:-

"HP" (On left Thigh).

Rule - 6. Section 8.

Where on inspection, the Livestock Officer is satisfied that the bull is effectively castrated, he shall cause it to be branded with the mark as given below:-

"R" (On Right Thigh).

Rule - 7. Section 9.

Where on inspection as aforementioned, the Livestock Officer is satisfied that the bull is not fit for being certified as an approved bull, and is also not effectively castrated, he shall order (which shall be in Form No. II) the person keeping the bull to have it castrated within a period of 15 days from the date of the service of the order.

Rule - 8. Section 10.

The mark with which the bull castrated under provisions of sub-section (2) and (3) of section 10 shall be branded will be as under:-

"R" (on Right Thigh).

Rule - 9. Castration.

(a)      Every bull directed to be castrated under section 6 of the Act shall be effectively desexed from the nearest Veterinary Hospital free of any charge.

(b)      If the Livestock Officer is not satisfied with the castration of the bull he may order the castration to be performed again in a manner approved by the Director of Animal Husbandry, Himachal Pradesh.

(c)      The bulls should be castrated before attaining the age of 1 1/2 year.

Rule - 10. Manner of inquiry under section 10 of the Act.

Before seizing a bull under sub-section (1) of section 10 of the Act, the Livestock Officer shall cause an enquiry to be made as to the ownership of the bull by the Panchayat of the village in collaboration with the village Level Worker.

Rule - 11. Determination of costs of maintenance and sale of a bull.

The amount of costs, stabling charges, or incidental expenses shall be fixed by the Livestock Officer:

Provided that if the owner or other person who keeps the bull, disputes the amount so fixed, such amount shall be determined by the Panchayat of the village.

Rule - 12. Duties of Livestock Officer.

It shall be the duty of the livestock Officer to exercise all or any of the powers conferred on him under the Act or the rules for the purpose of carrying into effect the purposes of the Act; and in particular to see that no bull shall remain in any specified area notified as such under section 3(1) of the Act, unless it has been inspected and branced with mark prescribed under these rules.

Rule - 13. Section 11-Power of Livestock Officer to enter premises.

The Livestock Officer or any other Officer or person authorised by him in this behalf shall have power to enter between sun-rise and sun-set, any premises or place where he has reason to believe that bulls are kept, for the purpose of performing any of the duties imposed on him by the Act or the rules:

Provided that before entering such premises or place a due notice thereof shall be given in the form prescribed in Form III.

Rule - 14. Section 13.

The service will be effected by the Village level worker or other employee of the Veterinary Department or through post of the notice or order on the person under section 13.

Rule - 15. Section 14.

The register to be maintained by the Livestock Officer under section 14 shall be in Form No. IV.

Rule - 16. Penalty.

Whoever commits any breach of any of these rules, shall be punishable with fine which may extend to Rs. 20 and in case of second or any subsequent offence with fine which may extend to Rs. 50.
