PREAMBLE
In exercise of the powers
conferred by proviso to article 309 of the Constitution of India, the Governor,
Himachal Pradesh, in consultation with the Himachal Pradesh Public Service
Commission, is pleased to make the following Rules further to amend the
Himachal Pradesh Elementary Department Trained Graduate Teacher (Arts/NonMedical/Medical),
Group-C, (Non Gazetted) Recruitment and Promotion Rules, 2024 notified vide
this Department notification No. EDN-C-A(3)-2/2020, dated 06-06-2024; namely .
Rule 1. Short title and Commencement.
(1)
These rules may be called the "Himachal
Pradesh Elementary Education Department, Trained Graduate Teacher
(Arts/NonMedical/Medical), Group-C, Recruitment and Promotion (Amendment)
Rules, 2025".
(2)
These rules shall come into force from the
date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.
Rule 2. Amendment of Annexure-A.
In Annexure-A to the
Himachal Pradesh Elementary Education Department Trained Graduate Teacher
(Arts/NonMedical/Medical), Group-C, Recruitment and Promotion Rules, 2024.
(a)
For the existing provisions against Col. No.
7 the following shall be substituted, namely.
(1)
ESSENTIAL QUALIFICATION.
(1)
TRAINED GRADUATE TEACHER (ARTS).
(i)
BA/B.Com./Post Graduation [Master Degree in
any discipline provided that candidates should have passed their Graduation
Degree in B.A./B.Com] from a recognized University with at least 50% marks
either inGraduation or in Post Graduation and 1 years Bachelor of Education
(B.Ed.)/2 Years Bachelor of Education (B.Ed.)/Bachelor of Education(B.Ed.) from
National Council for Teacher Education (NCTE) recognized institution.
OR
Post Graduation [Master
Degree in any discipline provided that candidates should have passed their
Graduation Degree in B.A./B.Com] with a minimum 55% marks and three-year
integrated B.Ed.-M.Ed. from National Council for Teacher Education (NCTE)
recognized institution.
OR
Senior Secondary/10+2 with
at least 50% marks and 4 years Bachelor in Elementary Education (B.El.Ed.).
OR
Senior Secondary/10+2 with
at least 50% marks and 4 years B.A. Education (Ed.)/B.A.B.Ed.
OR
B.A./B.Com. with at least
50% marks and 1 years Bachelor in Education (B.Ed.) (Special Education).
AND
(ii)
Pass in Teacher Eligibility Test (TET) duly
conducted by H.P. Board of School Education Dharamshala, Distt. Kangra or any
other Agency authorized by the Government.
(2)
TRAINED GRADUATE TEACHER (NONMEDICAL).
(i)
B.Sc. (Non Medical)/Post Graduation [M.Sc. in
any science discipline provided that candidates should have passed their
Graduation Degree in B.Sc. (NM)] from a recognized University with at least 50%
marks either in B.Sc. (Non Medical) or in Post Graduation and 1 years Bachelor
of Education (B.Ed.)/2 Years Bachelor of Education (B.Ed.)/ Bachelor of
Education (B.Ed.) from National Council for Teacher Education (NCTE) recognized
institution.
OR
Post Graduation [M.Sc. in
any science discipline provided that candidates should have passed their
Graduation Degree in B.Sc. (NM)] with a minimum of 55% marks and three-year
integrated B.Ed.-M.Ed. from a National Council for Teacher Education (NCTE)
recognized institution.
OR
Senior Secondary/10+2 in
Science(Non-Medical) with at least 50% marks and 4 years Bachelor in Elementary
Education (B.El.Ed.)
OR
Senior Secondary/10+2 in
Science(Non-Medical) with at least 50% marks and 4 years B.Sc. (Non
Medical)Ed/B.Sc. (Non Medical) B.Ed.
OR
B.Sc. (Non Medical) with at
least 50% marks and 1 years Bachelor in Education (B.Ed.) (Special Education).
AND
(ii)
Pass in Teacher Eligibility Test (TET) duly
conducted by H.P. Board of School Education Dharamshala, Distt. Kangra or any other
Agency authorized by the Government.
(3)
TRAINED GRADUATE TEACHER (MEDICAL).
(i)
B.Sc. (Medical)/ Post Graduation [M.Sc. in
any science discipline provided that candidates should have passed their
Graduation Degree in B.Sc. (Medical)] from a recognized University with at
least 50% marks in B.Sc. (Medical) or Post Graduation and 1 years Bachelor of
Education (B.Ed.)/ 2 Years Bachelor of Education(B.Ed.)/Bachelor of Education
(B.Ed.) from NationalCouncil for Teacher Education (NCTE) recognized
institution.
OR
Post Graduation [M.Sc. in
any science discipline provided that candidates should have passed their
Graduation Degree in B.Sc. (Medical)] with a minimum of 55% marks and
three-year integrated B.Ed.-M.Ed. from a National Council for Teacher Education
(NCTE) recognized institution.
OR
Senior Secondary/10+2 in
Science (Medical) with at least 50% marks and 4 years Bachelor in Elementary
Education (B.El.Ed.).
OR
Senior Secondary/10+2 in
Science (Medical) with at least 50% marks and 4 years B.Sc. (Medical)
Ed./B.Sc.(Medical) B.Ed.
OR
B.Sc. (Medical) with at
least 50% marks and 1 years Bachelor in Education (B.Ed.) (Special Education)
AND
(ii)
Pass in Teacher Eligibility Test (TET) duly
conducted by H.P. Board of School Education Dharamshala, Distt. Kangra or any
other Agency authorized by the Government:
Provided that a candidate
must have passed Matriculation and 10+2 from any School/Institution situated
with in Himachal Pradesh:
Provided this condition
shall not apply to Bonafide Himachalis.
(b) DESIRABLE
QUALIFICATION(s):
Knowledge of customs, manner
and dialects of Himachal Pradesh and suitability for appointment in the
peculiar conditions prevailing in the Pradesh.
Note (1).-Provided that
minimum percentage of marks in graduation shall not be applicable to those
incumbents who had already taken admission to the Bachelor of Education or Bachelor
of Elementary Education prior to the 29th July, 2011.
Note (2).-Relaxation upto 5%
will be allowed in minimum educational qualifications and also in minimum
qualifying marks for TET to the candidates belonging to SC/ST/OBC/PWD
categories of H.P.
Note (3).-In case of
candidates who have taken admission in B.Ed. course on the basis of M.A./M.Sc.
with at least 50% marks shall only be considered for the post of TGT.
Note (4).-The minimum
qualification as prescribed by NCTE on the date of publication of the
Advertisement shall also be considered as part and parcel of these R&P
Rules and the Government (in the Department of Elementary Education, H.P.)
shall provide such changes in the minimum essential qualificationto the
recruiting agency till the date of publication of advertisement.
(b)
For the existing provision against Col. No.
10, the following shall be substituted, namely.
(i)
75% by direct recruitment on regular basis or
recruitment on contract basis as the case may be in the following manners.
(a)
37.5% through Himachal Pradesh Rajya Chayan
Aayog, Hamirpur/other recruiting agency/authority as the case may be.
(b)
32.5% on batch -wise basis.
(c)
5% through Limited Direct Recruitment (LDR)
through Himachal Pradesh Rajya Chayan Aayog/other agency/authority, as the case
may be, on regular basis or on contract basis, from amongst in service SMC
Teachers [with at least five (05) years of service] engaged under SMC Policy
dated 17-07-2012, amended from time to time, possessing the requisite
Educational qualification as prescribed in the Col No. 7:
Provided that the upper age
limit for direct recruits will not be applicable to the SMC Teachers already in
service of Government.
(ii)
25% by Promotion.
Note.-The 5% Limited Direct
Recruitment Quota will cease automatically after the absorption of all SMC
teachers engaged under SMC Policy dated 17-07-2012, amended from time to time,
in the Elementary Education Department and thereafter, the 5% quota meant for
LDR recruitment shall be considered as part andparcel of quota for direct
recruitment through batch-wise.
(c)
For the existing provision against Col. No.
11 , the followingshall be substituted, namely.
(i)
15% by Promotion from amongst the in-service
JBTs possessing the educational qualification as prescribedin Col. No. 7 above,
with at least five years regular service or regular combined with continuous
adhocservice rendered, if any, in the grade.
(ii)
10% by promotion from amongst the in-service
Classical & Vernacular Teachers (C&Vs) possessing the essential
educational qualification as prescribed in Col. No. 7 above, with at least five
years regular service or regular combined with continuous adhocservice
rendered, if any, in the grade.
For filling up the posts the
following roster shall be followed.

Note.1.-This roster will be
rotated after every 40th post till the representation to all the categories is
achieved by the given percentage and thereafter the vacancy is to be filled up
from thecategory which vacates the post.
Note-2.-The 5% Limited
Direct Recruitment quota will cease automatically after the absorption of all
in service SMC teachers engaged under SMC Policy dated 17-07-2012, amended from
timeto time, in the Elementary Education Department and thereafter, roster
point 35 & 38 allotted to LDR Recruitment shall beconsidered as roster
points for direct recruitment through batchwise.
(I)
Provided that for the purpose of promotion
every employee shall have to serve at least one term in the Tribal/Difficult/
Hard areas and remote/rural areas subject to adequate numbers of post(s)
available in such areas:
Provided further that the
proviso (I) supra shall not be applicable in the case of those employees who
have fiveyears or less service, left for superannuation. However, such
incumbents may posted/transferred to remote/ruralareas on their promotion:
Provided further that
Officers/Officials who have not served atleast one tenure in
Tribal/Difficult/Hard areas/remote/rural areas shall be transferred to such
area strictlyin accordance with his/her seniority in the respectivecadre.
Explanation I.-For the
purpose of proviso (I) supra the "term" in Tribal/Difficult/Hard
areas/remote/rural areas shall mean normally three years or less period of
posting in such areaskeeping in view the administrative exigencies/convenience.
Explanation II.-For the
purpose of proviso (1) supra the Tribal/Difficult Areas shall be as under.

(2)
Pangi and Bharmour Sub Division of Chamba
District.
(3)
Dodra Kawar Area of Rohru Sub Division
(4)
Pandrah Bis Pargana, Munish Darkali and GramPanchayat
Kashapat, Gram Panchayats ofRampur Tehsil of District Shimla.
(5)
Pandrah Bis Pargana of Kullu District
(6)
Bara Bhangal Areas of Baijnath Sub Division
of Kangra District.
(7)
District Kinnaur
(8)
Kathwar and Korga Patwar Circlse of Kamrau
Sub Division, Bhaladh Bhalona and SangnaPatwar Circles of Renukaji Tehsil and
Kota PabPatwar Circle of Shillai Tehsil in Sirmaur District.
(9)
Khanyol-Bagra Patwar Circle of Karsog Tehsil,
Gada Gussaini, Mathyani, Ghanyar, Thachi, Baggi, Somgad and Kholanal of
Bali-Chowki Sub Tehsil, Jharwar, Kutgarh, Graman, Devgarh, Trailla, Ropa,
Kathog, Silh-Badhwani, Hastpur, Ghamrehar and Bhatehar Patwar Circle of Padhar
Tehsil, Chiuni, Kalipar, Mangarh,Thach-Bagra, North Magru and South Magru
Patwar Circles of Thunag Tehsil and Bhatwara Patwar Circle of Sunder Nagar
Tehsil in Mandi District.
Explanation III.-For the
purpose of proviso (I) supra the Remote/Rural Areas shall be as under:
(i)
All stations beyond the radius of 20 Kms.
from sub Division/Tehsil headquarter.
(ii)
All stations beyond the radius of 15 Kms.
from State Headquarter and District headquarters where busservice is not
available and on foot journey is more than 3 (three) Kms.
(iii)
Home town or area adjoining to area of home
town within the radius of 20 Kms. of the employee regardless of its category.
(II)
In all cases of promotion, the continuous
adhoc service rendered in the feeder post, if any, prior to regular appointment
to the post shall be taken into account towards the length of service as
prescribed in these rules for promotion subject to the condition that the adhoc
appointment/promotion in the feeder category had been made after following
proper acceptable process of selection in accordance with the provisions of R
& P Rules:
(i)
Provided that in all cases where a junior
person becomes eligible for consideration by virtue of his total length of
service (including service rendered on adhoc basis, followed by regular
service/appointment) in the feeder post in view of the provisions referred to
above, all persons senior to him in the respective category/post/cadre shall be
deemed to be eligible for consideration and placed above the junior person in
the field of consideration:
Provided that all incumbents
to be considered for promotion shall possess the minimum qualifying service of
at least three years or that prescribed in the Recruitment & Promotion
Rules for the post, whichever is less:
Provided further that where
a person becomes ineligible to be considered for promotion on account of the
requirements of the preceding proviso, the person(s) junior to him shall also
be deemed to be ineligible for consideration for such promotion.
Explanation.-The last
proviso shall not render the junior incumbent(s) ineligible for consideration
for promotion if the senior ineligible person(s) happened to be Ex- Servicemen
who have joined Armed Forces during the period of emergency and recruited under
the provision of Rule-3 of Demobilized Armed Forces Personnel (Reservation of
vacancies in Himachal State Non-Technical Services) Rules, 1972 and having been
given the benefit of seniority thereunder or recruited under the provisions of
Rule-3 of Ex-Servicemen (Reservation of Vacancies in the H.P. Technical
Services) Rules, 1985(as amended from time to time) and having been given the
benefit of seniority thereunder.
(ii)
Similarly, in all cases of confirmation,
continuous adhoc service rendered on the feeder post, if any, prior to the
regular appointment/promotion against such post shall be taken into account
towards the length of service; if the adhoc appointment/promotion had been made
after proper selection and in accordance with the provisions of the Recruitment
and Promotion Rules:
Provided that
inter-se-seniority as a result of confirmation after taking into account, adhoc
service rendered as referred to above shall remain unchanged.
