GUJARAT PRIVATE UNIVERSITIES (AMENDMENT) ACT,
2011 THE GUJARAT PRIVATE
UNIVERSITIES (AMENDMENT) ACT, 2011 [Act No. 25 of 2011] [ 12th October, 2011] An Act further to
amend the Gujarat Private Universities Act, 2009. WHEREAS
the Auro International School of Hospitality Management, Surat, Bardoli Pradesh
KelavaniMandal, Tarsadi, Dist. Surat, ShriShamjibhaiHarjibhaiTalaviya
Charitable Trust, Rajkot and the Puri Foundation for Education in India,
Gandhinagar had applied to the State Government under the provisions of the
Gujarat Private Universities Act, 2009 (Guj. 8 of 2009) to establish Private
Universities in the State; AND
WHEREAS the said applications have been scrutinised by the Scrutiny Committee
and on the report of Scrutiny Committee the State Government has issued the
letter of intent to the respective sponsoring bodies for establishment of the
Private University; AND
WHEREAS the State Government is satisfied that the sponsoring bodies have
complied with the conditions of letter of intent as provided in section 10 of
the said Act and has also established the Endowment Fund as per the letter of
intent; NOW,
THEREFORE, the Government of Gujarat, in accordance with the provisions of
section 10 of the said Act, establishes the institutions specified in column 2
of the Schedule as Private University of the aforesaid sponsoring bodies, by
the name, location and jurisdiction as specified in column 4 of the Schedule. It
is hereby enacted in the Sixty-second Year of the Republic of India as
follows:- (1) This Act may be called the Gujarat Private
Universities (Amendment) Act, 2011. (2) It shall come into force on such date as the State
Government may, by notification in the Official Gazette, appoint. In
the Gujarat Private Universities Act, 2009 (Guj. 8 of 2009) (hereinafter
referred to as "the principal Act"), in section 3, in sub-section
(5),- (a) for the words "The constituent colleges and
institutions of the Sponsoring Body affiliated to and enjoying the privileges
of any University immediately before the commencement of this Act", substitute
the words" The constituent colleges and institutions of the Sponsoring
Body, except the grant-in-aid colleges and institutions, affiliated to and
enjoying the privileges of any University immediately before the establishment
of the University under sub-section (1)"; (b) for the words "the date of commencement of
this Act", the words "the date of establishment of such
University" shall be substituted. In
the principal Act, in section 45, for the words "before the commencement
of this Act", the words, brackets and figures "before the
establishment of the University under sub-section (1) of section 3" shall
be substituted. In
the principal Act, in the Schedule, after entry at serial No. 4, the following
entries shall be inserted, namely:- Sr.
