Government Of National Capital Territory Of Delhi Subordinate Service (Second Amendment) Rules, 2024

In exercise of the powers conferred by the proviso to Article 309 of the Constitution read with the Government of India, Ministry of Home Affairs Notification No.F.27/59-Him (i) dated the 13th July, 1959 and all other powers enabling him in this behalf, the Lt. Governor of the National Capital Territory of Delhi, in consultation with Union Public Service Commission, is pleased to amend the Government of National Capital Territory of Delhi Subordinate Service Rules, 2022 (as amended from time to time), namely: -

Rule - 1. Short title and Amendment:

 

(i)       These rules may be called the "Government of National Capital Territory of Delhi Subordinate Service (Second Amendment) Rules, 2024.

(ii)      They shall come into force on the date of their publication inthe Official Gazette.

Rule - 2. Amendment of Rule 2 (Definitions):

 

In Rule 2 of "the said rules" for existing clause (b) & (e), the following shall be substituted:

"(b)"Appointing authority" in relation to Senior Scale (GNCTDSS) meansthe "Lt. Governor", Grade-I and Grade-II means the "Chief Secretary" and in relation to Grade-III and Grade-IV, the "Heads of Department" concerned for the purposes of these rules."

"(e) "Cadre" means the group of posts of the five grades of service specified in Schedule-I."

Rule - 3. Amendment of Rule 3 (Constitutionof Service and its Classification):

 

In Sub-rule (1) & (2) of Rule 3 of "the said rules", the following shall be substituted:

"(1) The Government of National Capital Territory of Delhi Subordinate Service, consists of following grades, namely:

Senior Scale (GNCTDSS)

Grade-I

Grade-II

Grade- III

Grade-IV"

"(2) The posts in Senior Scale (GNCTDSS) shall be Central Civil Post Group A, (Gazetted), Grade-I shall be Central Civil Service Group B, (Gazetted) and Grade-II shall be Central Civil Service Group B, (Non- Gazetted) and those in Grades- III and IV shall be Central Civil Service Group-C (Non-Gazetted)."

Rule - 4. Amendment of Rule 7 (Future Maintenance of Service):

 

In Sub-rule (2) of Rule 7 of "the said rules", the following shall be substituted:

"2    (a) All posts in Senior Scale (GNCTDSS) shall be filled by promotion of officers of Grade-I in the manner specified in Schedule-II in consultation with Union Public Service Commission.

(b) All posts in Grade-I shall be filled by promotion of officers of Grade- II in the manner specified in Schedule-II.

(c) (i) 33% of the posts in Grade-II shall be filled by direct recruitment through an examination on the basis of educational and other qualifications and age limit in the manner specified in Schedule-II.

(ii) 52% of the posts in Grade-II shall be filled by promotion fromofficers in Grade-III of the Service and Trained Kanungos of Revenue department of GNCT of Delhi in the manner specified in Schedule-II.

(iii) 15% of the posts in Grade-II shall be filled by Limited Departmental Competitive Exam from officers in Grade-III of the Service and Trained Kanungos of Revenue department of GNCT of Delhi in the manner specified in Schedule-II.

(d) (i) 85% of the posts in the Grade-III shall be filled by promotion from Grade-IV officials of the service in the manner specifiedin Schedule-II.

(ii) 15% of the posts in Grade-III shall be filled by Limited Departmental Competitive Exam from officers in GradeIV of the Service, in the manner specified in Schedule-II.

(e) (i) 85% of the posts in the Grade-IV shall be filled by direct recruitment through an examination on the basis of educational and other qualifications and age limit specified in Schedule-II.

(ii) 15% of the posts in the Grade-IV shall be filled by promotion from Group C employees in Level- 1 of the pay matrix in the mannerspecified in Schedule-II."

Rule - 5. Amendment of Rule 9 (Probation):

 

In Sub-rule (1) of Rule 9 of "the said rules", the following shall be substituted:

"(1) Every officer on appointment to the Service, either by promotion from Grade-I to Senior Scale (GNCTDSS) or direct recruitment in the Grade-II and Grade-IV or by promotion from Grade-III to Grade-II, shallbe on probation for a period of two years:

Provided that the Appointing Authority may extend the period of probation in accordance with the orders and instructions issued by the Government of India from time to time:

Provided further that any decision for any extension of period of probation shall be taken ordinarily within eight weeks after expiry of the previous period of probation and communicated in writing to the concerned member of service together with the reason for so doing within the said period."

Rule - 6. Amendment of Rule 10 (Appointment to the Service):

 

In Rule 10 of "the said rules", the following shall be substituted:

"10. Appointment to the Service:

All appointments to the Service shall be made to Senior Scale (GNCTDSS), Grade-I, Grade-II, Grade-III and GradeIV of the Service and not against any specific post included in the Service."

Rule - 7. Amendment of Schedule-I:

 

Schedule-I of "the said rules" shall be substituted as under:

Governor.

Schedule-II of "the said rules" shall be substituted as under:

(i) Direct Recruitment

 

Essential Qualification: Bachelor Degree from a recognized University/ Institute.

 

Note 1:- Qualifications are relaxable at the discretion of the Competent Authority/DSSSB, for reasons to be recorded in writing, in case of candidates otherwise well qualified.

 

B. Age limit: Between 21 - 30 years (relaxable for govt servants upto 5 years in accordance with instructions or orders issued by central govt.)

 

Note 2: The crucial date for determining the age limit shall be as advertised by the Delhi Subordinate Services Selection Board (DSSSB)/ CompetentAuthority.

 

(ii) Promotion

 

From officers in Grade-III of the Service and Trained Kanungos of Revenuedepartment of GNCT of Delhi in Level-4 in the pay matrix (Rs.25500-81100/-) with Eight years’ service in the grade rendered after appointment thereto on regular basis.

 

(iii) Limited Departmental Competitive Exam (LDCE): Officers in Grade-III of the Service and Trained Kanungos of Revenuedepartment of GNCT of Delhi in Level-4 (Rs.25500- 81100/-) of the Pay Matrix with five years’ service in the Grade rendered after appointment thereto on regular basis, shall be eligible to appear in the LDCE for appointment tothe post in Grade-II.

Grade-III

 

(i) 85% by Promotion on selection basis

 

(ii) 15% by Limited Departmental Competitive Exam (LDCE)

 

(i) Promotion:

 

From officers in Grade-IV of the Service in level 2 in the pay matrix (Rs.19900- 63200/-) with Six years’ service in the grade rendered after appointment thereto on regular basis; promotion on selection basis.

 

(ii) Limited Departmental Competitive Exam (LDCE):

 

Officers in Grade-IV of the Service in level 2 in the pay matrix (Rs.19900-63200/-) with three years’ service in the Grade rendered after appointment thereto on regular basis shall be eligible to appear in the LDCE for appointment to the post in Grade-III.

Grade-IV

 

(i) 85% by Direct Recruitment

 

(ii) 15% by promotion on selection basis

 

(i) Direct Recruitment:

 

A. Educational and OtherqualificationsEssential Qualification:

 

(i) 12th pass from arecognized Board/Institution.

 

(ii) A typing Speed of 35 w.p.m in English or 30 w.p.m in Hindi onComputer

 

Note 1: - Qualifications are relaxable at the discretion of the Competent Authority/DSSSB, for reasons to be recorded in writing, in case ofcandidates otherwise well qualified.

 

Age Limit: Between 18-27 years (relaxable for govt. servants up to 5 years in accordance with instructions or orders issued by central govt.)

 

Note 2: The crucial date fordetermining the age limit shall be as advertised by the Delhi Subordinate‘Services Selection Board (DSSSB)/ CompetentAuthority.

 

(ii) Promotion:

 

From Group C employees of Government of NCT of Delhi in Level-1 (Rs. 18000-56900/-) in the pay matrix with three years’ service in the grade rendered after appointment thereto on regular basis and possessing the qualification of Matric/12th pass or equivalent from a recognized Board or Institutions.

 

Note-1:The candidates selected by this method shall be required to pass a typing Speed of 35 w.p.m in English OR 30 w.p.m in Hindi on Computer (35 w.p.m and 30 w.p.m correspond to 10,500 K.D.P.H/9000 K.D.P.H on an average of 05 keydepressions for each word) unless exempted by the Lt. Governor of Delhi.

 

Note-2:The requirement of passing typewriting test is relaxable for physically handicapped persons who are otherwise qualified to hold the aforesaid post and who are certified ‘as being unable to type on account of physical disability by the prescribed Medical Board in accordance with the prevailing instructions of Government of India issued from time to time.





Note I: An open competitive examination for direct recruitment tothe post of Grade II and Grade IV Service shall beconducted by the DSSSB at such interval as the ChiefSecretary may determine from time to time. The dates onwhich and the places at which the examination is to beheld shall be fixed by DSSSB in this regard.

Note II: No candidate shall be appointed to the post of Grade II and Grade -IV of the Service unless he/she is declared fit,after such medical examination as the Government may prescribe and to be free from any mental or physical defect likely to interfere with the discharge of duties of the Service, unless he/she has already been examined by the Competent Medical Authority at the time of his/her initial appointment and declared fit.

Note III: The inclusion of a candidates name in the approved lists shall confer no right to appointment unless the AppointingAuthority is satisfied after such enquiry, as he may consider necessary that the candidate is suitable in allrespects for appointment to the respective grades and anactual offer of appointment is made to the candidate.

Note IV: The dates, place and the manner for the Limited Departmental Competitive Examination (LDCE) referred to in these rules shall be such as may be determined by the DSSSB or recruiting agency approved by the government

Note V: Subject to the provisions of these rules, the candidates included in the approved lists for Grade-II and Grade-IV shall be appointed to these grades in the order of merit.

Note VI: The Limited Departmental Competitive Examination (LDCE) shall be conducted by DSSSB or any other recruiting agency approved by the government in pursuance of the notification issued in this regard.

Note VII: The dates, place and the manner for the Limited Departmental Competitive Examination (LDCE) referred to in these rules shall be such as may be determined by the DSSSB or recruiting agency approved by the government.

Rule - 9. Amendment of Schedule-III:
