PANCHAYAT RAJ (REMOVAL OF MEMBER BY PRESCRIBED AUTHORITY) RULES, 1999
PREAMBLE
Whereas
the draft of the Goa Panchayat Raj (Removal of members by prescribed authority)
Rules, 1999 was published as required by sub-section (1) of section 240 of the
Goa Panchayat Raj Act, 1994 (Goa Act 14 of 1994), in the Official Gazette,
Series I No. 28 dated 7-10-1999 under Notification No. 44/DP/PAN/RM/1999 dated
30-9-1999 of the Department of Panchayat Raj and Community Development,
inviting objections and suggestions from all persons likely to be affected
thereby before the expiry of fifteen days from the date of publication of the
said Notification in the Official Gazette;
And
Whereas the said Gazette was made available to the public on 7-10-1999;
And
Whereas no objections and suggestions have been received from the public on the
said draft by the Government.
Now,
Therefore, in exercise of the powers conferred by section 131, read with
sub-section (1) of section 240 of the Goa Panchayat Raj Act, 1994 (Goa Act 14
of 1994), the Government of Goa hereby makes the following rules, namely:
Rule - 1. Short title and commencement.
(1) These rules may be
called the Goa Panchayat Raj (Removal of member by prescribed authority) Rules,
1999.
(2) They shall come into
force at once.
Rule - 2. Definitions.
In
these rules, unless the context otherwise requires,
(a) "Act" means
the Goa Panchayat Raj Act, 1994 (Goa Act 14 of 1994);
(b) "Member"
means a member of the Zilla Panchayat;
(c) "State Election
Commissioner" means the State Election Commissioner appointed under
section 237 of the Act;
(d) Words and expressions
used and not defined under these rules shall have the same meaning as assigned
to them under the Act;
Rule - 3. Removal of member by the prescribed authority.
The
State Election Commissioner shall be the prescribed authority for the removal
of a member under section 131 of the Act.
