Punjab Prevention of Out-break of Malaria Regulations, 1995

[11th July 1995]

PREAMBLE

Whereas the Governor of Punjab is satisfied that the whole of the State of Punjab is threatened with an out-break of dangerous epidemic disease, namely, Malaria and that the ordinary provisions of law for the time being in force are insufficient to prevent spread of this disease:

Now, therefore, in exercise of the powers conferred by sub-section (1) of the section 2 of the Epidemic Diseases Act, 1897 (Central Act No. 11 of 1897), the Governor of Punjab is pleased to make the following temporary regulations, namely:-

Regulation - 1

(i)       These regulations may be called the Punjab Prevention of Out-break of Malaria Regulations, 1995.

 

(ii)      They shall come into force on the publication of this notification in the official Gazette and shall remain in force upto 31st of December, 1995.

 

Regulation -2

 

In these regulations, the inspecting officer shall be a person who is appointed by the Government as a Chief Medical Officer or District Health Officer.

Regulation - 3

Every Inspecting Officer, who is unavoidably prevented from discharging any functions under these regulations may by an order, in writing authorise any Epidemiologist, Medical Officer, District Malaria Officer, Assistant Unit Officer, Health Supervisor, Senior Malaria Inspector, Senior Sanitary Inspector, Malaria Inspector, Malaria Supervisor, or Basic Health Worker to discharge such functions of the Inspecting Officer, as may be specified in such order and every officer or official as the case may be, so authorised so far as such functions are concerned, shall be deemed to be an inspecting officer.

Regulation - 4

 

The Inspecting Officer may enter any premises for inspection of fever surveillance, treating or spray and may also authorise such other persons to enter such premises along with him as he considers necessary.

Regulation - 5

 

In order to ascertain whether there is any reasons to believe or suspect that any person is or may be suffering from Malaria, the Inspecting Officer, may put to him any question he thinks fit and such person shall be bound to answer truly any question put to him.

 

Regulation - 6

Where, a result of inspection or examination or otherwise, the Inspecting Officer considers that there is reasons to believe or suspect that any person is or may be infected with Malaria, the Inspecting Officer may direct such person to give his blood slide for examination and to take such treatment as the Inspecting Officer may consider necessary:

Provided that in case of a minor, such order shall be directed to the guardian or any other adult member of the family of the minor.

Regulation - 7

 

The Inspecting Officer may order any premises to be sprayed with insecticide.
