PREAMBLE

In exercise of the powers conferred by the proviso to article 309 of the Constitution and supersesion of the Directorate of--

(i) the Directorate of Plant Protection, Quarantine and Storage, Technical Officer (III), Recruitment Rules, 1989;

(ii) the Directorate of Plant Protection, Quarantine and Storage, Assistant Plant Protection Officer, Recruitment Rules, 1989;

(iii) the Directorate of Plant Protection, Quarantine and Storage, Plant Protection Officer (Weed Science) Recruitment Rules, 2008;

(iv) the Directorate of Plant Protection, Quarantine and Storage, Assistant Director (Weed Science) Recruitment Rules, 2008;

(v) the Directorate of Plant Protection, Quarantine and Storage, Deputy Director (Weed Science) Recruitment Rules, 2008;

(vi) the Directorate of Plant Protection,. Quarantine and Storage, Joint Director (Weed Science) Recruitment Rules, 2008, 

except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Assistant Plant Protection Officer (Weed Science), Plant Protection Officer (Weed Science), Assistant Director (Weed Science), Deputy Director (Weed Science), and Joint Director (Weed Science) in the Directorate of Plant Protection, Quarantine and Storage, Faridabad under the Department of Agriculture and Co-operation in the Ministry of Agriculture, namely:-


Rule 1 - Short title and commencement

(1) These rules may be called the Directorate of Plant Protection, Quarantine and Storage, Faridabad Weed Science Discipline Recruitment Rules, 2012.

(2) They shall come into force on the date of their publication in the Official Gazette.


Rule 2 - Application

These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.


Rule 3 - Number of posts, classification and pay band and grade pay or pay scale

The number of the said posts, their classification and the pay band, grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.


Rule 4 - Method of recruitment, age limit, other qualifications, etc

The method of recruitment to the said posts, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the aforesaid Schedule.


Rule 5 - Disqualification

No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living;

or

(b) who, having a spouse living, has entered into or contracted a marriage with any person, 

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.


Rule 6 - Power to relax

Where the Central Government is of opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.


Rule 7 - Saving

Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-servicemen, the Other Backward Classes, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note.-1. Qualifications are relaxable at the discretion of the Staff Selection Commission for reasons to be recorded in writing, in the case of candidates otherwise welt qualified.

Note: The existing incumbents holding the post of Scientific Assistant-I as on the date of this notification who are possessing B.Sc. degree with Zoology, will be exempted from the above requirement.

Two Years for" Direct Recruits and Promotees

33.33% by promotion failing which by deputation (including short-term contract), 66.67% by direct recruitment.

Promotion: Scientific Assistant (Pay Band-1, Rs. 5200-20200/- with Grade Pay of Rs. 2800/-) having six years' regular service in the grade.

Note.-1. For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to Ist January, 2006, the date from which revised pay structure based on the Sixth Central Pay Commission recommendations have been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale.

Note.- 2. Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided that they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service.

Deputation (including short term contract):

Officers under the Central or State Governments or Public Sector Undertakings or Union territory Administrations or Semi-Governments or Autonomous or Statutory Organisation or Agricultural Universities or Recognised Research Institutions or Councils:-

(a) (i) holding analogous post on regular basis in the parent cadre or Department; or

(ii) with six years' regular service in the post in the Pay Band-1 (Rs. 5200-20200/- with grade pay of Rs. 2800/-) or equivalent in the parent cadre or

Department; and

(b) Possessing the qualifications prescribed for direct recruits under column (7).

Note.-1. The Departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, the officers who are on deputation will not be eligible for promotion.

Note.-2. (The period of deputation (including short term contract) including (including short term contract) in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not exceed three years. The maximum age limit for appointment by deputation (including short term contract) shall be not exceeding 56 years as on the closing date of the receipt of applications).

Note.-3. For the purpose of appointment on deputation basis, the service rendered on a regular basis by an Officer prior to Ist January, 2006, the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations have been extended shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and there this benefit will be extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any upgradation

Note.-3.A common seniority list of all Assistant Plant Protection Officers as on the date of notification of these recruitment rules would be maintained till all such Assistant Plant Protection Officers are promoted as per eligibility, seniority and preference to different streams of Entomology, Plant Pathology and Weed Science depending on the vacancies as and when arise.

Note.- 4: The existing incumbents holding the post of Assistant Plant Protection Officer on the date of notification of these Recruitment Rules and possessing B.Sc. degree in Zoology will be exempted from the requirement of possessing of B.Sc. Degree in Agriculture or B.Sc. with Botany as and when they become eligible for promotion.

Deputation (including short-term contract):

Officers under the Central or State Governments or Public Sector Undertakings or Union territory Administrations or Semi-Governments or Autonomous or Statutory Organisations or Agricultural Universities or Recognised Research Institutions or Councils:-

(a) (i) holding analogous post on regular basis in the parent cadre or Department; or

(ii) with five years regular service in the post in the pay band 2, (Rs. 9300-34800) with grade pay of Rs. 4200/- in the parent cadre or Department; and

(b) possessing the educational qualification and experience as under :-

Essential:

(i) B.Sc. Agriculture or B.Sc. Degree with Botany as one of the subjects from a recognised University or Institution,

(ii) Three years' practical experience in Weed Control or Weed Science.

Desirable:

M.Sc., degree in Agriculture (Agronomy) with specialisation in Weed Science or M.Sc., degree in Botany with Weed Science as a subject from a recognised University or Institution.

Note.- 1. The Departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, Deputationists shall not be eligible for consideration for appointment by promotion.

Note 2: Qualification regarding experience is relaxable at the discretion of - the Union Public Service Commission in case of candidates belonging to Scheduled Castes or Scheduled Tribes, if at any stage of selection the Union Public Service. Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the posts reserved for them.

Note: The existing incumbents holding the post of Plant Protection Officer (Weed Science), Assistant Plant Protection Officer or Scientific Assistant-I (re-designated as Scientific Assistant) on the date of notification of these Recruitment Rules possessing B.Sc. Degree in Zoology as on the date of notification of these Recruitment Rules, shall be exempted from above requirement as and when they are eligible for promotion.

Doctorate degree in Agronomy with specialisation in Weed Science from a recognised University or Institution.

(ii) Ten years practical experience in the field of Weed Science or Weed Control.

Desirable:

Doctorate degree in Agronomy with specialisation in Weed Science from a recognised University or Institution under the Central or State Governments or Public Sector Undertakings or Union Territories Administration or Semi-Governments or Autonomous or Statutory Organisations or Agricultural Universities or Recognized Research Institutions or Councils.

Note.- 1. The Departmental officers in the feeder 

category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, Deputationists shall not be eligible for consideration for appointment by promotion.

Note.-2. Period of deputation (including short term contract) including (including short term contract) in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not to exceed three years. The maximum age limit for appointment by deputation (including short term contract) shall be not exceeding 56 years as on the closing date of the receipt of applications.

Note.- 3. For the purpose of appointment on deputation basis, the service rendered on a regular basis by an Officer prior to Ist January, 2006 (The date from which the revised pay structure based on the Sixth Central Pay Commission recommendations have been extended) shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and there this benefit will be extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any upgradation.
