In exercise of powers
conferred by proviso to Article 309 of the Constitution read with the
Government of India, Ministry of Home Affairs, Notification G.S.R. No. 3267,
dated the 1st November, 1966, the Administrator, Union Territory, Chandigarh
makes the following rules, regulating the method of recruitment of GroupC Posts
in the Education Services (School Cadre), Chandigarh Administration, namely: (i) These rules may be called the
Chandigarh Education Service (School Cadre) (GroupC) Recruitment Rules, 2014. (ii) They shall come into force on the
date of their publication in the official gazette. These rules shall apply to the posts specified in
Column 1 of the Schedule annexed to these rules. The number of posts, their classification and the
scales of pay shall be as specified in Column (2) to (4) of the said Schedule. The method of recruitment to the said posts, age
limit, qualifications and other matters connected there with shall be as
specified in Column (5) to (13) of the said schedule. (1) No person shall be appointed to
the Service unless he/she is, (a) a Citizen of India; or (b) a Citizen of Nepal; or (c) a Subject of Bhutan; or (d) a Tibetan refugee who came over
to India before the 1st day of January, 1962 with the intention of permanently
settling in India; or (e) a person of India origin who has
migrated from Pakistan, Burma, Sri Lanka and East African Countries of Kenya,
Uganda and United Republic of Tanzania (formerly Tanganyika and Zanzibar),
Zambia, Malawi, Zaire, Ethiopia and Vietnam with the intention of permanently
settling in India: Provided that a person belonging to any of the
categories (b), (c), (d) and (e) shall be person in whose favour a certificate
of eligibility has been given by the Government of India in the Department of
Home Affairs. (2) A person in whose case a
certificate of eligibility is necessary may be admitted to an examination or
interview conducted by the Commission or the Board, as the case may be, on his
furnishing proof that he has applied for the certificate but he shall not be appointed
to the service unless necessary certificate is given to him by the Government
of India in the Department of Home Affairs. (3) No person shall be recruited to
the service by direct appointment, unless he produced, (a) a certificate of character from
the principal academic officer of the university, college, school or
institution last attended, if any, and similar certificate from two responsible
persons not being his relatives, who are well acquainted with him in his
private life and are unconnected with his university, college, school or
institution; and (b) an affidavit to the effect that
he was never convicted for any criminal offence involving moral turpitude and
that he was never dismissed or removed from service or any State Government or
of Government of India, or of any Public Sector Undertaking. No person, (a) who has entered into or
contracted a marriage with a person having a spouse living, OR (b) who, having a spouse living, has
entered into or contracted a marriage with any person, shall be eligible for
appointment to the said posts: Provided that the Administrator, Union Territory,
Chandigarh may, if satisfied, that such marriage is permissible under the
personal law applicable to such persons and the other party to the marriage and
there are other grounds for so doing, exempt any person from the operation of
this rule. Where the Administrator, Union Territory,
Chandigarh is of the opinion that it is necessary or expedient so to do, he
may, by order, for reasons to be recorded in writing, relax any of the
provisions of these rules in respect of any class or category of persons. Nothing in these rules shall affect reservations,
relaxation of age limit and other concessions required to be provided for
Scheduled Castes, Scheduled Tribes, Other Backward Classes, Ex-Servicemen and
other special categories of persons in accordance with the orders issued by the
