Central Excise And Customs Directorates, Additional Assistant Director (Group B, Gazetted, Non-Ministerial Posts) Recruitment Rules, 2022

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Directorate of Revenue Intelligence (Class II, Gazetted posts) Recruitment Rules,1975, the Directorate of Inspection and Audit (Customs and Central Excise) (Inspecting Officers) Recruitment Rules, 1987 and the Directorate of Statistics and Intelligence (Central Excise and Customs) Group 'B' posts, Recruitment Rules, 1999, in so far as they relate to the posts of Superintendent of Central Excise Class II/ Appraiser/ Inspector of Customs, Inspecting Officer and Additional Assistant Director, except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Additional Assistant Director (Group 'B', Gazetted, Non-Ministerial Posts) in the Directorates under the control of Central Board of Indirect Taxes and Customs, Ministry of Finance, Department of Revenue, namely:-

Rule - 1. Short title and commencement.

(1)     These rules may be called the Central Excise and Customs Directorates, Additional Assistant Director (Group B, Gazetted, Non-Ministerial Posts) Recruitment Rules, 2022.

(2)     They shall come into force on the date of their publication in the Official Gazette.

Rule - 2. Application.


These rules shall apply to the post specified in Column (1) of the Schedule annexed to these rules.

Rule - 3. Special provision.

(1)     Directorate General of Performance Management, Central Board of Indirect Taxes and Customs, New Delhi will be the Cadre Controlling Authority for all Group B and C posts (Gazetted and Non Gazetted) for the following Directorates as approved by the Board, namely:-

(i)       Directorate General of Performance Management;

(ii)      Directorate General of Revenue Intelligence;

(iii)     Directorate General of Goods and Service Tax Intelligence;

(iv)    Directorate of Logistics;

(v)      Directorate General of Tax Payer Services;

(vi)    Directorate General of Systems and Data Management;

(vii)   Central Revenues Control Laboratory;

(viii)  Directorate General of Vigilance;

(ix)    Directorate General of Anti-Profiteering;

(x)      Directorate General of Export Promotion;

(xi)    Directorate General of Audit;

(xii)   Directorate of Legal Affairs;

(xiii)  Directorate General of Human Resource Development;

(xiv)  Chief Commissioner (Authorized Representative), Customs, Central Excise and Service Tax Appellate Tribunal (CESTAT);

(xv)   Directorate General of Analytics and Risk Management;

(xvi)  Directorate General of Valuation;

(xvii) Directorate of International Customs;

(xviii)   Directorate General of Goods and Service Tax.

(2)     Inter-se-seniority of all merged Directorates posts in the grade of Group B and C shall be integrated as per the instructions or guidelines issued by the Government of India from time to time in this regard.

Rule - 4. Number of post, classification and level in pay matrix.


The number of said posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

Rule - 5. Method of recruitment, age-limit, qualifications, etc.


The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

Rule - 6. Disqualification.


No person,-

(a)      who, has entered into or contracted a marriage with a person having a spouse living; or

(b)      who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

Rule - 7. Power to relax.


Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

Rule - 8. Saving.


Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Promotion:

Inspector (Central Excise) in level-7 (Rs.44900- 142400) in the pay matrix having two years of regular service in the grade and having successfully completed 2-4 weeks of training prescribed by the Department.

Note: Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their senior would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

Deputation:

Officers of Central Government or State Government or Union Territories,-

(a)(i) holding analogous post on regular basis in the parent cadre or Department; or

(ii) with two years regular service in a post in level-7 (Rs.44900-142400) in the pay matrix or equivalent in the parent cadre or Department; and

(b) possessing the following educational qualifications and experience:

(i) Bachelors degree from a recognized University or Institute; and

(ii) three years experience in the matters of levy, assessment and collection of Customs duty, Central Excise duties, Goods and Service Tax and Integrated Goods and Service Tax, Intelligence and Investigation, enforcement of border control on goods and conveyances, dispute resolution including drafting of Show Cause Notices, adjudication and appeals or Audit of assessments for ensuring tax compliance.

Note 1: The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or Department of the Central Government shall ordinarily not exceed three years. The maximum age limit for appointment by deputation shall be not exceeding fifty six years as on the last date of receipt of applications.

Note 2: The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, the deputationists shall not be eligible for consideration for appointment by promotion.

Group ‘B’ Departmental Promotion Committee for considering promotion :

1. Director General, Directorate General of Performance Management - Chairman;

2. Principal Additional Director General or Additional Director General, Directorate General of Human Resource Development (Human Resource Management-I) - Member;

3. Additional or Joint Director, Directorate General of Performance Management - Member.

Consultation with the Union Public Service Commission is not necessary for filling up the post by promotion. However, consultation with the Union Public Service Commission is necessary for filling up the post by deputation.
