BUSINESS OF THE HARYANA
GOVERNMENT (ALLOCATION) AMENDMENT RULES, 2016
In
exercise of the powers conferred by clauses (2) and (3) of article 166 of the
Constitution of India, I, Kaptan Singh Solanki, Governor of Haryana, hereby
make the following rules further to amend the Business of the Haryana
Government (Allocation) Rules, 1974, namely:-
Rule 1.
These
rules may be called the Business of the Haryana Government (Allocation)
Amendment Rules, 2016.
Rule 2.
In
the Business of the Haryana Government (Allocation) Rules, 1974 (hereinafter
called the said rules) in the Schedule, under heading "HEALTH DEPARTMENT
(Through the Secretary to Government, Haryana, Health Department)",-
(i)
in the entry against serial number 19,
the words "and Indian Council of Medical Research" shall be omitted;
(ii)
in the entry against serial number 22,
the words "and dental education" shall be omitted;
(iii)
in the entry against serial number 25,
the words "and medical education" shall be omitted;
(iv)
in the entry against serial number 26,
the words "and nursing education" shall be omitted;
(v)
in the entry against serial number 28,
the words "and Pharmaceutical education" shall be omitted.
Rule 3.
In the
said rules, in the Schedule, after heading "Law and Legislative
Department, (Through the Legal Remembrancer and Secretary to Government,
Haryana, Law and Legislative Department)" and entries thereunder, the
following heading and entries thereunder shall be inserted, namely:-
"MEDICAL EDUCATION AND RESEARCH DEPARTMENT"
(Through
the Additional Chief Secretary to Government, Haryana, Medical Education and
Research Department)
1.
Matters regarding medical education and
research institutions including health and medical universities in the State.
2.
Formulation and implementation of
policies, programmes and schemes for quality medical education and research in
the State.
3.
Superintendence, direction, control and
administration of government institutions imparting medical education and
undertaking medical research in the State.
4.
Mapping and planning of human resource
needs in health and medical education sector in the State.
5.
Formulation and implementation of
policies regarding scholarships, fellowships, awards, stipends, citations, roll
of honour etc. to the students, scholars, educators, researchers etc. in the
health and medical education sector in the State.
6.
Regulation of admissions, fixation of fee
and maintenance of educational standards in health sciences educational
institutions including private institutions in the State and for the matters
connected therewith or incidental thereto.
7.
Matters regarding compliance of rules, regulations,
by-laws and other statutory requirements of various regulatory authorities
vested with the powers of regulation of a degree, diploma or certificate in
modern System of Medicine, Indian System of Medicine, nursing or any of its
branches by Central Government, State Government, any University or by any
Statutory or other body which has powers of affiliation, recognition or
accreditation of certificate, diploma or degree, as the case may be.
8.
Regulating/formulating policies regarding
opening, running, closing and affiliation of medical educational institutions
including issuing/renewal/cancellation of Letter of Intent, No Objection
Certificate or Essentiality Certificate as the case may be regarding
establishment of medical education institution under Central Government/State
Government/Semi Government/autonomous organizations/private sector.
9.
Grant-in-aid to medical education and
research institutions including universities.
10.
Promotion of medical education supported
by online teaching, within learning management systems (LMSs) or virtual
learning environments (VLEs).
11.
Matters relating to formulation and
implementation of policy for development and propagation of:-
(a)
Medical Education (Education in Modern
System of Medicine) i.e. Education in a system of medicine which includes all
branches of modern medicine, hospital administration and dentistry dealing with
pre-clinical, para-clinical, clinical, para- medical and para-dental
disciplines at the diploma or degree level or above and such other disciplines;
(b)
Indian System of Medicine Education i.e.
Education in a system of medicine which includes Ayurveda, Unani, Siddha,
Homeopathy, Yoga and Naturopathy and such other disciplines;
(c)
Para Medical Education i.e. Education in
nursing, multipurpose health workers (MPHW), radiographer, ophthalmic
assistant, operation theatre assistant, lab technician, pharmacist and such
other courses;
(d)
Pharmacy Education.
12.
Matters relating to the administration of
the following Acts and rules made thereunder:-
(a)
Pandit Bhagwat Dayal Sharma University of
Health Sciences Rohtak Act, 2008 (Act 26 of 2008);
(b)
Haryana Private Health Sciences
Educational Institutions (Regulations of Admission, Fixation of fee and
Maintenance of Educational Standards) Act, 2012 ( Act 9 of 2012);
(c)
The Punjab Medical Registration Act, 1916
(Punjab Act 2 of 1916);
(d)
The Punjab Nurses Registration Act, 1932
(Punjab Act 1 of 1932);
(e)
The Dentists Act, 1948 (Central Act No.
16 of 1948);
(f)
The Pharmacy Act, 1948 (Central Act No. 8
of 1948);
(g)
The Punjab Homoeopathic Practitioners
Act, 1965 (Punjab Act No. 16 of 1965);
(h)
The Punjab Ayurvedic and Unani
Practitioners Act, 1963 (Punjab Act No. 42 of 1963);
(i)
The Punjab Anatomy Act, 1963; (Punjab Act
14 of 1963);
(j)
The Punjab Corneal Grafting Act, 1963
(Punjab Act 13 of 1963).
13.
13. General supervision, direction,
administration and control and all issues and matters requiring action at the
level of Government in regard to:-
(a)
The Haryana Medical Council;
(b)
The Haryana Nurses Registration Council;
(c)
The Haryana State Dental Council;
(d)
The Haryana State Pharmacy Council;
(e)
The Council of Homeopathy System of
Medicine, Haryana;
(f)
Board of Ayurvedic and Unani System of
Medicine, Haryana; and
(g)
Haryana Medical Education Society.
14.
Inter-State and intra State coordination
in the Medical Education and Research sector.
15.
Matters relating to Indian Council of
Medical Research.
16.
Matters regarding setting up/opening of
medical education, medical research and medical training institutions in the
State.
17.
Matters regarding setting up/opening of
health sciences and medical institutions to provide physical and intellectual
milieu for young scientists working in multiple disciplines of medicine, to
advance the frontiers of knowledge to render humane service to sick and
suffering people and to train medical and paramedical manpower in the State.
18.
Matters regarding research for the rural
and community related environment and health problem with the focus of research
on tackling diseases like diarrhoea, tuberculosis, malaria, amoebiasis systemic
vacuities, Relapsing Polychondritis, HIV, Leprosy, hepatitis, anaemia,
leukaemia, hypertension, atherosclerosis, thalassemia, dental caries, stone
disease, cancer and sexually transmitted diseases etc.
19.
Matter regarding setting up of facilities
for research and conducting studies in health and medical sciences by using
advanced techniques such as flow cytometry, chromatography (HPLC, FPLC),
molecular biology, positron emission tomography (PET) and genetic studies etc.
20.
Matters regarding setting up of research
centers by international agencies (such as World Health Organisation) and
national agencies, including matter regarding setting up of medical
institutions of national importance such as All India Institute of Medical
Sciences, National Cancer Institute etc.
21.
Establishment matters relating to
officers and staff under the administrative control of the Department except
matters allotted to the General Administration Department.
