BUS RAPID TRANSIT SERVICE SCHEME, 2016

PREAMBLE

Whereas the Governor of Punjab is of the opinion that for the purpose of providing an efficient, adequate, economical and properly coordinated road transport service to the general public, it is necessary in public interest, to run a transport service, namely, the 'Bus Rapid Transit Service', on such track and route in an area as specified in the Schedule given below, to be operated by the State Transport Undertakings, whether to the exclusion (complete or partial, as the case may be), of other persons, from operating on such track and route in the said area;

Whereas, in exercise of the powers conferred by section 99 of the Motor Vehicles Act, 1988 (Central Act No. 59 of 1988), the proposal regarding a Scheme for the aforesaid purpose was formulated and objections thereto were invited are required under sub-section (1) of section 100 of the aforesaid Act, vide Government of Punjab, Department of Transport, Notification No. S.O. 6/C.A.59/1988/S. 99/2016, dated the 3rd February, 2016;

WHEREAS, no objection or suggestion has been received in response to the aforesaid proposal;

Now, therefore, in exercise of the powers conferred by sub-section (3) of section 100 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988) and all other powers enabling him in this behalf, the Governor of Punjab is pleased to notify the following Scheme namely:-

SCHEME 1.

This Scheme may be called the bus Rapid Transit Service Scheme, 2016.

SCHEME 2.

In this scheme, unless the context otherwise requires,-

(a)      "Bus Rapid Transit Service" means a motor vehicle, constructed or adapted to carry passengers including driver and conductor, as a public service vehicle, within such area on the track and route as specified in the Schedule from time to time;

(b)      "route" means a route to be operated by the 'Bus Rapid Transit Service' within such area, on such track and route as specified in the Schedule from time to time;

(c)      "Schedule" means the schedule appended to this Scheme;

(d)      "tranck" means a restricted path or closed corridor, on which only Bus 'Rapid Transit Service', shall run and operate; and

(e)      "up and down" means a journey of 'Bus Rapid Transit Service', from first station to the last station and back from last station to the first station, on the track and route specified in the Schedule, specified in the Schedule.

SCHEME 3.

The stage carriage permits, for operation of 'Bus Rapid Transit Service', shall be granted by the State Transport Commissioner, subject to the condition that such vehicle, shall operate only on the track and route as specified in the Schedule.

SCHEME 4.

No motor vehicle, other than the 'Bus Rapid Transit Service' motor vehicle, shall be permitted to carry out operation, on the tranck and route meant for 'Bus Rapid Transit Service'.
