BORDER SECURITY FORCE, GROUP 'A' (GENERAL DUTY OFFICERS) RECRUITMENT RULES, 2015

PREAMBLE

In exercise of the powers conferred by clauses (b) and (c) of sub-section (2) of section 141 of the Border Security Force Act, 1968 (47 of 1968) and in super session of the Border Security Force Group ?A? (General Duty Officers) Recruitment Rules, 2010, except as respects things done or omitted to be done before such super-session, the Central Government hereby makes the following rules regulating the method of recruitment to Group ?A? posts in the Border Security Force, namely:-

Rule 1 - RULE 1

(1) These rules may be called the Border Security Force, Group ?A? (General Duty Officers) Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

Rule 2 - Definition

In these rules, unless the context otherwise requires.-

(a) ?Government? means the Government of India;

(b) ?Grade? means the grade of the cadre;

(c) ?Schedule? means the Schedule annexed to these rules;

(d) ?Scheduled Castes? and ?Scheduled Tribes? shall have the same meanings as assigned to them respectively in clauses (24) and (25) of article 366 of the Constitution;

(e) words and expressions used herein and not defined but defined in the Border Security Force Act, 1968 and the Border Security Force Rules, 1969, shall have the same meanings as assigned to them in that Act or rules.

Rule 3 - Rule 3

These rules shall apply to the posts mentioned in column (1) of the Schedule.

Rule 4 - Number of posts, classification and pay band and grade pay or pay scale

The number of posts, their classification and the pay and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule.

Rule 5 - Method of recruitment, age limit, qualifications, etc

The method of recruitment, age limit, qualifications and other matter relating to the said posts shall be as specified in columns (5) to (13) of the Schedule.

Rule 6 - Maintenance

Every post remaining unfilled and every vacancy that may arise hereafter shall be filled in accordance with the provisions as contained in these rules.

Rule 7 - Seniority

(1) All officers holding a higher rank shall be senior to the officers holding a lower rank.

(2) In a particular rank, seniority of officers appointed to any post shall be determined in accordance with the order of selection for appointment to that post.

(3) Subject to the provisions of sub-rule (2), inter-se-seniority amongst officers holding the same rank shall be as follows:-

(a) seniority of officers promoted on the same day shall be determined in the order in which they are selected for promotion to that rank ;

(b) inter-se-seniority of direct recruits shall be arranged in the order of ?combined? merit which shall be determined after adding together the marks obtained by them in the competitive examination conducted by the Union Public Service Commission and the Basic Professional Course of the Border Security Force in the ratio of 50:50:

Provided that in the case of direct recruits, the date of appointment shall be the date of joining the venue as mentioned in the offer of appointment:

Provided further that if two or more officers have secured equal marks in the combined merit, then, their order of merit shall be considered as per the order of their dates of birth:

Provided also that seniority in cases of delay in reporting for training after selection shall be as under:

(A) an offer of appointment issued by the Ministry or Department shall be valid for a period of four weeks from the date for joining mentioned in the offer of appointment after which the offer would lapse automatically;

(B) if, however, within the specified period of four weeks, a request is received from the candidate for extension of time and after due consideration by the Ministry, he may be granted extension for a maximum period of two weeks in addition to the four weeks if facts and circumstances deem it necessary to do so and the candidates who join within a period of six weeks shall have their seniority fixed as per sub-clause (i) of clause (b);

(C) after the grant of extension of two weeks as stated in clause (B), if a candidate fails to report within the stipulated time, (which shall not exceed a period of six weeks), the offer of appointment shall lapse automatically;

(D) an order of appointment which has lapsed, shall not ordinarily be revived, except in exceptional circumstances and on grounds of public interest to be recorded in writing, and only after obtaining the approval of the Ministry;

(E) where the offer of appointment is revived under clause (D), the seniority of candidates concerned shall be fixed above the candidates of the next selection examination, but, in case, such candidate joins after any of the candidate of the next selection examination has joined, he shall be placed below the last of such candidate;

(F) inter-se-seniority amongst officers of the Indian Police Service, the Army and the Border Security Force shall be determined according to the date of continuous service in that rank;

Provided that where the seniority has already been determined and fixed shall not be affected;

(c) inter-se-seniority of persons appointed as Assistant Commandant on the basis of Limited Departmental Competitive Examination shall be arranged in the order of ?combined? merit which shall be determined after adding together the marks obtained by them in the Limited Departmental Competitive Examination and the Basic Professional Course of the Border Security Force in the ratio of 50:50:

Provided that the date of appointment of such officers shall be the date of joining the venue as mentioned in the offer of appointment:

Provided that if two or more Officers have secured equal number of marks in the combined merit, then, their order of merit shall be considered as per the order of their dates of birth:

(d) Provided further that seniority in case of delay in reporting for training shall be fixed in accordance with the provisions of items (A), (B) and (C) of third provisions of clause (b);

(e) Seniority of re-employed officers in a particular rank shall be determined from the date of their re-employment in that rank;

(f) A serving Army Officer shall maintain his seniority between himself and other Army Officers within a particular rank and a Serving Officer of the Indian Police Service shall maintain his seniority between himself and other officers of the Indian Police Service within a particular rank;

Rule 8 - Appointment

Officers who are eligible for appointment in accordance with the terms and conditions specified in these rules shall only be considered for appointment on promotion, deputation or re-employment.

Rule 9 - Liability of service

Any person appointed to any category of posts under these rules shall be liable to serve anywhere in India or abroad.

Rule 10 - Disqualifications

No person, -

(a) who has entered into, or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living has entered into, or contracted a marriage with any person shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule.

Rule 11 - Ineligibility of aliens

No person who is not a citizen of India shall, except with the consent of the Central Government signified in writing be appointed under these rules:

Provided that nothing contained in these rules shall debar the appointment, enrollment or employment of a citizen of Nepal or Bhutan under these rules.

Rule 12 - Superannuation

The officers holding posts higher than that of a rank of Commandant shall retire from service on the afternoon of the last day of the month in which they attain the age of sixty years; and officers of other ranks shall retire from service on the afternoon of the last day of the month in which they attain the age of fifty-seven years:

Provided that an officer whose date of birth is the first of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of sixty years or fifty-seven years, as the case may be.

Rule 13 - Power to relax

Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

Rule 14 - Saving

Nothing in these rules shall effect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Colour vision

Candidate should not have squint of any degree and should have high colour vision. The candidate will be tested for colour vision by Ishihara?s test as well as Edridge-Green lantern Test. Eyes should be bright, clear with no abnormality/disease. Movements of eyeballs should be full and free in all direction. In every case of Myopia, fundus examination should be carried out and the result should be recorded. Contact lenses or laser surgery is not allowed.

(ii) Desirable:

Possession of National Cadet Corps ?B? or ?C? certificate or outstanding achievements in sports or athletics will be an added qualification.

1. 50% by direct recruitment (including 10% Assistant Commandant (Direct Entry) from amongst the Ex-servicemen) failing which by direct recruitment to be conducted by the Union Public Service Commission.

2. 33% by Promotion.

3. 17% by Limited Departmental Competitive Examination to be conducted by Central Paramilitary Forces i.e. Border Security Force/Central Reserve Police Force/Central Industrial Security Force/Indo-Tibetan Border Police/Sashastra Seema Bal on rotation basis failing which by promotion.

Note: The vacancies for female candidates to be filled up in the rank of Assistant Commandant (Direct Entry) will be calculated on year to year basis by Director General, Border Security Force on functional requirement basis.)

I. Promotion:

(a) Subedars/Inspectors/Subedar Major (General Duty)/Communication/Cipher/Motor Transport Workshop with three years regular service in the grade in Pay Band-2 Rs. 9,300-34,800 with Grade pay Rs. 4,600/Rs. 4800/-; and

(b) must be Matriculate or Higher Secondary or an equivalent qualification of recognised Board of Education/University and must have qualified the following courses of Border Security Force namely:-

(i) Basic training course prescribed for the post/rank at the entry level.

(ii) Should have successfully completed pre-promotional course or courses as prescribed by the Director General, Border Security Force from time to time;

(iii) Two years service in service Coy for all Inspector/Subedar (General Duty) or two years service in a duty Battalion for Subedar/Inspector (Communication).

Provided that the provision of two years tenure in Service Coy/Duty Battalion will not apply to the following category of Subedars/Inspectors:-

(a) Inspector/Subedar (Cipher);

(b) Inspector/Subedar (General Duty) working in Water Wing;

(c) Inspector/Subedar (General Duty) working as Junior Engineer in Engineering branch, Ammunition Technician Inspector in Small Arms Workshop, Special Repair Organisation, Special Instrument Workshop, Central Workshop and Stores, Motor Transport Workshops, Small Arms Workshop, Tear Smoke Unit, Field ?G? Team, Field Vigilance Team, Unit ?G? Cell, Inspector/Subedar (General Duty) performing technical/specialised duties against the sanctioned and transferred posts of Printing Press, service rendered in Special Protection Group, National Security Guard and other Technical Workshops or those working in posts declared as technical by Director General, Border Security Force.

(d) Inspector/Subedars in Central Sports team of Border Security Force.

(e) Medical Category - SHAPE-I.

Note.-1 The service rendered on deputation posting/attachment basis in National Training Institutions including Border Security Force Academy Tekanpur will be treated as 50% of the required field service for the purpose of promotion and no relaxation in respect of the remaining 50% mandatory service will be granted in such case.

Note.-2 Where juniors who have completed their qualifying or eligibility service are considered for promotion their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service for more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next grade along with their Juniors who have already completed such qualifying or eligibility service.

II. By Limited Departmental Competitive Examination:-

(a) Sub-Inspector/Inspector having four years regular service including training will be eligible.

(b) The upper age limit for appearing in the Limited Departmental Competitive examination will be thirty-five (35) years. The required educational qualifications will be graduation as required for direct recruitment mentioned under column-8.

(c) Must have good record of service.

(d) Physical standards will be same as applicable to Assistant Commandant (Direct Recruitment) under column-8.

(e) Must possess Medical Category SHAPE-I.

Note.- The number of vacancies for induction of female Sub-Inspectors and Inspectors for selection to the rank of Assistant Commandant through Assistant Commandant (Limited Departmental Competitive Examination) out of 17% Limited Departmental Competitive Examination quota will be calculated on year to year basis by Director General Border Security Force on functional requirement basis.
